CITY OF SIMI VALLEY MEMORANDUM September 13, 2021 TO: City Council FROM: Department of Public Works SUBJECT: ADOPTION OF A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE RECIPIENT CERTIFICATIONS AND ASSURANCES AND RELATED DOCUMENTS FOR SUBMISSION TO THE CALIFORNIA DEPARTMENT OF TRANSPORTATION FOR THE STATE OF GOOD REPAIR PROGRAM AND ANNUAL STATE TRANSIT ASSISTANCE FUNDS, AND APPROVAL OF A SUPPLEMENTAL BUDGET REQUEST STAFF RECOMMENDATION It is recommended that the City Council adopt Resolution No. 2021-35 (page 3), authorizing the City Manager to execute the Recipient Certifications and Assurances to receive State Transit Assistance funding from the State of Good Repair Program (SGR), and approve a Supplemental Budget Request in the amount of $13,879, in the Transit Fund (Fund 750). BACKGROUND AND OVERVIEW The Road Repair and Accountability Act of 2017, Senate Bill (SB) 1 (Chapter 5, Statutes of 2017), includes a program that will provide additional revenues for transit infrastructure repair and service improvements. This investment in public transit is referred to as the State of Good Repair (SGR) Program. This Program provides funding of approximately $105,000,000 annually to the State Transit Assistance (STA) account. These funds are available to recipients for eligible transit maintenance, rehabilitation, and capital projects. The City of Simi Valley is a recipient of STA funds and is eligible to receive SGR funds. Pursuant to Public Utilities Code 99312.1(d)(1), prior to receiving an apportionment of the SGR monies, a potential recipient must submit executed Recipient Certifications and Assurances with an attached authorizing resolution for this funding period. FINDINGS AND ALTERNATIVES The City’s estimated SGR and STA apportionments are $12,039 and $56,288 respectively, for a total of $68,327. Initially, the City anticipated receiving a total of $54,448 between the two apportionments. As a result of the increased apportionment, the approval of a Supplemental Budget Request in the amount of $13,879. In the Transit Fund (Fund 750), is necessary. The Recipient Certifications and Assurances with an attached authorizing resolution must be completed and submitted in order for Simi Valley to qualify for receipt of these funds. STAFF RECOMMENDATION

Transit system bus stop improvements. Staff has prepared a list of bus stop improvement projects, including all required details, and submitted it electronically to the California Department of Transportation. A condensed list of the proposed projects in priority order is attached to Resolution No. 2021-35 as Exhibit A, which includes bus stop modernization at various locations.

The following alternatives are available to the City Council:

1. Adopt Resolution No. 2021-35 authorizing the City Manager to execute and file theRecipient Certifications and Assurances and related documents to submit to theState Transit Assistance Fund State of Good Repair Program (SGR), and approvea Supplemental Budget Request in the amount of $13,879, in the Transit Fund(Fund 750);

2. Provide staff with other direction.

Staff recommends Alternative No. 1.

SUGGESTED CITY COUNCIL MOTION

I move to adopt Resolution No. 2021-35 authorizing the City Manager to execute the Recipient Certifications and Assurances and related documents to submit to the State of Good Repair Program to receive State Transit Assistance funding, and approve a Supplemental Budget Request in the amount of $13,879, in the Transit Fund (Fund 750).

SUMMARY

The City of Simi Valley estimated State of Good Repair (SGR) apportionment is $12,039. The attached Resolution No. 2021-35 must be adopted and submitted with a list of projects and supporting documents in order for Simi Valley to qualify for receipt of these funds. Along with the SGR funds, the City will receive State Transit Assistance (STA) funds in an estimated amount of $56,288. The current FY 2021-22 CIP budgeted amounts were based on previous years estimates, so a budget adjustment is needed.

It is recommended that the City Council adopt Resolution No. 2021-35 authorizing the City Manager to execute the Recipient Certifications and Assurances for the State of Good Repair Program, and approve a Supplemental Budget Request in the amount of $13,879.

RESOLUTION NO. 2021-35

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SIMI VALLEY AUTHORIZING THE EXECUTION OF THE RECIPIENT CERTIFICATIONS AND ASSURANCES FOR THE CALIFORNIA DEPARTMENT OF TRANSPORTATION STATE OF GOOD REPAIR PROGRAM FUNDED BY SENATE BILL 1 (SB 1) FOR FY 2021-22

WHEREAS, the City of Simi Valley is an eligible project sponsor and may receive State Transit Assistance funding from the State of Good Repair Account (SGR) now or sometime in the future for transit projects; and WHEREAS, the statutes related to State-funded transit projects require a local or regional implementing agency to abide by various regulations; and WHEREAS, Senate Bill 1 (2017) named the Department of Transportation (Department) as the administrative agency for the SGR; and WHEREAS, the Department has developed guidelines for the purpose of administering and distributing SGR funds to eligible project sponsors (local agencies); and

WHEREAS, the City has developed a SGR project list (Exhibit A) to ensure revenues are being used on the most high priority and cost-effective projects and meet the community priorities for transit investment; and WHEREAS, the City of Simi Valley wishes to delegate authorization to execute these documents and any amendments thereto to the City Manager.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SIMI VALLEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the fund recipient agrees to comply with all conditions and requirements set forth in the Recipient Certification and Assurances document and applicable statutes, regulations and guidelines for all SGR-funded transit projects.

SECTION 2. The City Manager shall be authorized to execute all required documents of the SGR Program and any Amendments thereto with the California Department of Transportation.

and shall cause a certified resolution to be filed in the Office of the City Clerk.
