representative, from retrieving, obtaining or using data recorded, stored or transmitted from recording device, unless:

1) owner or owner's representative consents in writing at time data is retrieved, obtained or used; 2) recorded data is

retrieved or obtained by law enforcement officer pursuant to search warrant or court order, as specified; 3) recorded

data is used for purpose of improving motor vehicle safety, security or traffic management, including for medical

research on physical reaction to motor vehicle accidents, provided that identity of owner, operator or other vehicle

occupant is not disclosed with respect to data; 4) recorded data is retrieved or obtained by licensed new motor

vehicle dealer, motor vehicle repair or servicing facility & technician or mechanic at such facility, or vehicle mfr. &

used for sole purpose of diagnosing, servicing or repairing vehicle; 5) recorded data is accessed by emergency

response provider & used for sole purpose of determining need for or facilitating emergency medical response in

event of vehicle crash & assisting emergency response provider in performing its duties; or 6) recorded data is

retrieved or obtained pursuant to legally proper discovery request or order in civil action. Provides that any person

who retrieves or obtains recorded data, except law enforcement officer, as specified above, shall not further disclose

such data, except that person may further disclose data, as specified, if identity of owner, operator or other vehicle

occupant is not disclosed. Allows recorded data to be retrieved, obtained & used by subscription service provider

pursuant to subscription service agreement if agreement discloses that data may be recorded, stored & transmitted.

Provides that no person shall knowingly alter or delete data on recording device, or knowingly destroy recording

device within 2 yrs. after crash event that resulted in bodily injury or death. Provides that alteration or deletion of

data by recording device with overwriting or rewriting program or function, which is activated during vehicle’s

normal operation, shall not be considered knowing alteration or deletion, as specified.

Prohibits OHM operators under age 16 unless operator: 1) is supervised; 2) is operating on parent/guardian’s land;

or 3) received OHM safety certificate as prescribed by this bill or holds recognized safety certificate from another

instructor prior to publication of OHM safety training & certification standards. Specifies that nothing shall be
