F.S. 125 Background Discussion The Parks and Natural Resources
Department requires an easement over Florida sovereignty submerged
lands located in Palma Sola Bay in order to complete Phase IIB of
the Robinson Expansion project. The easement area will provide for
the ability to create a tidal flushing channel which will feed
internal waters created within Robinson Preserve and Expansion.

Pursuant to the above Request for Legal Services you have asked this office to review an easement
for sovereignty submerged lands (“Easement”) from the Board of Trustees of the Internal
Improvement Trust Fund, processed through the Florida Department of Environmental Protection
(“FDEP”). The Easement is required in order to establish a flushing channel for Robinson Preserve
pursuant to a permit from FDEP. I provide the following comments in response to the RLS:
1.
The Easement follows a standard FDEP form that this office has found acceptable in past
transactions. Because FDEP is reticent to make changes to its standard form, I have limited
my comments to changes necessary from a legal standpoint.
2.
Attached are marked pages reflecting my comments.
3.
Also attached is a Word version of the County’s standard signature block, proscribed by
Florida Statute 125.411.
4.
A review of the legal description and the property records available on the County’s GIS
system indicates that the Easement area will touch the shoreline of the County’s Robinson
Preserve property, such that the County has the requisite riparian rights required pursuant
to Section 17 of the Easement and the regulations referenced therein.
5.
I note that, pursuant to FDEP’s standard practice, the Easement incorporates by reference
the FDEP permit conditions which have not been submitted to this office for review. I
express no opinion as to the business judgment of submitting to those conditions or the
business terms of the Easement.
Subject to the incorporation of my suggested changes, I have no objection from a legal standpoint to
the Easement being scheduled for approval by the Board. This concludes my response to the RLS.
