Kindergarten through Community College Public Education Facilities Bond Act of 2016

UPDATE 2016 State School Bond Initiative On August 3, all petitions were submitted to each county registrar of voters to begin the validation process. Signatures were gathered in 57 of the 58 counties; Alpine County was the only one without signatures. We expect the initiative to be qualified by the end of September or the beginning of October. At that point, we will shift our focus to funding a successful campaign, which is expected to cost approximately $10 million, of which C.A.S.H. will need to raise $1.5 million to $2.5 million. Fresno USD On August 26, the California Supreme Court indicated that it had denied hearing the petitions for review (i.e. appeals) in the Davis v. Fresno USD case. The Court also denied numerous requests to de-publish the findings of the Superior Court. This means that the ruling of the Appellate Court dated June 1, 2015 can be cited as precedent and relied upon, becoming binding law. The lawsuit in question may continue to proceed, and issues raised by the Appellate Court will now be tried in Superior Court. C.A.S.H. had joined a number of other organizations in submitting an amicus curiae letter to the California Supreme Court in support of Fresno USD’s appeal. Schools and community college districts will continue to face a period of uncertainty regarding the questions of what constitutes a true lease and parameters for a financing component under lease-leaseback. Additionally, the Appellate Court determined that the consultant providing preconstruction services in the Fresno USD case could have been considered an employee for the purposes of Government Code Section 1090. This means that the trial court may now consider whether or not a conflict of interest existed in this particular case. Check with your legal counsel on possible next steps if you have a lease-leaseback project that may be affected by the Appellate Court ruling or the Supreme Court’s decision. On August 18, 2015, legislation was introduced by the Associated General Contractors attempting to address issues related to contractor risk, but ultimately the attempt was unsuccessful. They used the gut and amend process to modify AB 975, a bill that was previously authored by Assembly Member Frazier and pertained to disqualification of prospective bidders participating in a prequalification process. The new bill was authored by Assembly Member Mullin and would have protected contractors from being sued for disgorgement of all funds if a lease-leaseback contract is ultimately invalidated. The proponents faced challenges in tackling political and administrative hurdles on the issue, trying unsuccessfully to urge Senator Carol Liu, Chair of Senate Education Committee, to calendar the bill for a special hearing. The bill included an urgency clause that would have

made it effective immediately but also require a two-thirds vote for passage. C.A.S.H. did not have an official position on the bill. Legislative Update The final push of the 2015 regular legislative session commenced when members of the Legislature returned to Sacramento on Monday, August 17. This is the time of year where anything can happen: bills are gutted and amended with new policy proposals, rules are waived, and everyone must remain vigilant. The Legislature has until September 11 to pass bills in the regular session; the Governor then has until October 11 to sign or veto bills. The Legislature adjourns for interim recess on September 11 and will reconvene on January 4. Below is an update on a selection of C.A.S.H. priority bills and issues of interest: SB 114 (Liu) – K-12 School Bond SB 114 (Liu) is the only one of the three main bond bill vehicles that is still alive in the legislative process for 2015, after being amended to insert an urgency clause to bypass legislative deadlines. Senator Liu still needs at least one Republican vote to pass the bill, which requires a two-thirds vote, off the Senate floor. While this is within the realm of possibility for 2015, legislators have time when they reconvene in 2016 to pass a school bond proposal for the June or November 2016 ballots. Skilled Workforce Legislation The Governor signed AB 566 (O’Donnell) on August 17, enacting significant changes to the lease-leaseback delivery method. AB 566 creates more stringent requirements for projects using lease-leaseback by requiring the use of a skilled and trained workforce, defined as a workforce where all workers are either skilled journeypersons or apprentices registered in an apprentice program approved by the Chief of the Division of Apprenticeship Standards of the Department of Industrial Relations. Additionally, the bill expands prequalification requirements for lease-leaseback, requiring prequalification regardless of contract size or funding source. C.A.S.H. submitted a request to the Governor to veto the bill. Two additional bills still moving through the legislative process would implement similar workforce provisions. AB 1358 (Dababneh) recasts existing design-build authorization, extending the sunset on this authority until 2025 and lowering the threshold for use from $2.5 million to $1 million. The bill also requires the use of a skilled and trained workforce (apprentices and journeypersons) for all workers on a design-build project. AB 1185 (Ridley-Thomas) establishes similar skilled workforce requirements as a component of a pilot program authorizing Los Angeles Unified School District to use a best value procurement method for public projects that exceed $1 million. C.A.S.H. does not have a formal position on either bill. This approach to ensuring a skilled workforce has been described by key legislators, staffers, and the building trades as the wave of the future. C.A.S.H. has raised concerns

about the availability of appropriate apprentices and journeypersons to complete school construction jobs across the state. AB 219 (Daly) – Concrete Delivery This bill became controversial between groups representing union and non-union contractors and trades. AB 219 (Daly) would expand the definition of “public works” for purposes of prevailing wage law to include the hauling and delivery of ready-mixed concrete. Opponents are concerned about the potential slippery slope that this policy would enact regarding the differentiation between drivers and construction workers. C.A.S.H. is actively watching the bill to ensure that it does not expand to cover delivery of other materials. The bill passed out of Senate Appropriations Committee, meeting a key legislative deadline. AB 1126 (Rendon) – HVAC Inspections AB 1126 (Rendon) would require that the most recent date of a HVAC system inspection report be posted on a school district’s website. C.A.S.H. is a signatory to a joint opposition letter with other education stakeholders, making the primary argument that the bill is unnecessary because the Facility Inspection Tool (FIT) already includes this information. The bill failed to pass off the suspense file in Senate Appropriations Committee and is no longer moving forward this year. SB 334 (Leyva) – Clean Drinking Water SB 334 (Leyva) specifies that a school district must provide access to free, fresh, and cleaning drinking water during meal times through the use of drinking “water access points”. C.A.S.H. did not take a position on the bill, but is working with other school advocacy organizations with an eye toward potential facilities and maintenance implications of the bill. The bill was amended in the Assembly Appropriations Committee, but the substance and effect of the amendments are unclear at this time. It was passed off the suspense file by the Assembly Appropriations Committee. State Allocation Board – Emergency Repair Program The 2015 Budget Act provided $273.4 million to retire the State’s $800 million Emergency Repair Program (ERP) obligation established by the Williams settlement. At its meeting on August 26, 2015, the State Allocation Board apportioned $266.1 million for projects on the ERP Unfunded List. This action provided $2,236,003 to fully fund five previously prorated applications that had already received 43 percent of their approved amount, as well as provided full apportionments for 607 applications, worth a total of $263,884,252. The action included one grant adjustment to cover additional expenditures of $18,024 for a previously-apportioned project. C.A.S.H. OverviewCalifornia’s current investment in public school facilities represents an acknowledgement of the key role buildings play in education, as well as an enormous ongoing challenge in management and maintenance.

In light of the broad changes to California’s educational finance system with the Local Control Funding Formula (LCFF), School Facility Program (SFP), and significant reduction in funding to support school maintenance as a result of budget flexibility, we are pleased to offer the C.A.S.H. Maintenance Management Certification Program (CMMCP).

PurposeThe CMMCP is an educational program designed to develop current and potential maintenance staff into leading experts in the maintenance arena. The CMMCP will provide an educational resource for those who would like to increase their expertise in the management of school maintenance and operations programs. CMMCP graduates are a vital asset to school districts throughout California.

What Makes the CMMCP Unique?The CMMCP is a rigorous program with course study both in and outside of the classroom, led by experts in all areas of school facility maintenance. Students benefit from scenario-based learning, completing an intensive three-day boot camp, and group projects during the year-long program that will develop graduates as leaders in M&O and facilities management.

ObjectiveThe CMMCP will provide participants with the knowledge necessary to institute a Planned Maintenance System (PMS) for K-12 facilities. At the culmination of the program, students will present a project that will advance their district’s maintenance efforts to develop a PMS.

Format To reduce time away from the office and travel costs, the program is technology-based and supplemented by three in-person meetings: an intensive three-day boot camp, mid-year meeting and graduation. Curriculum isdeliveredonline,withweeklyassignments/quizzes.Duringthebootcampparticipantswillengageinteam-building and become familiar with the technology utilizedduringtheprogram.

Fall Conference, the Pre-Conference Workshop will focus on the fundamentals of how to finance your future school facility program in the light of uncertain state funding, new state requirements, and industry trends such as energy efficiency and water conservation.

The workshop will give you the tools to successfully navigate the financing and state approvals processes necessary to build and modernize schools. Specifically, the workshop will include presentations on contracting, delivery method options, local bonds and community relations, navigating state agencies, and the use of consultants.

If you are new to school facilities, or if you are looking to brush up on the most recent developments, this is a workshop that you cannot afford to miss.

The school facilities and maintenance community has experienced another year of significant change. At the Conference, industry experts will inform attendees about these changes and how they will affect their school facilities and maintenance departments.

ThenumberonepriorityforC.A.S.H.isthe2016StateSchool Bond Initiative, a $9 billion school facilities bond thatwebelievewillqualifyfortheNovember2016General Election Statewide Ballot and be approved by voters. This conference will update attendees of the latest status of the State School Bond campaign and will also give an insider’s perspective on CQS, the organization sponsoring the bond.

Attend the Conference to learn about how you can position your district, county office, and clients to leverage funding.

The program also includes presentations on hot topics such as new state water use restrictions for schools and what you need to do to comply; what the implementationofAB566andtheDavis v. Fresno USD case will mean for the lease-leaseback delivery method; and an overview and discussion of significant school facilities legislation, regulation, and State Budget issues.
