WHEREAS by Article 16c of the Palestine Orders in Council, 1922 to 1939, the High Commissioner may if he thinks fit,.by order under his hand to be published in the Gazette, convert such land in Palestine of the category termed "Metrouke" as is foreshore, public highway or village threshing floor into land of another category; AND WHEREAS an area of land measuring 1065 square metres now forms part of a public highway and is registered under deed No. 1233/42, parcel 96, block 4320, Latrun; AND WHEREAS I am satisfied that any rights or benefits which may hitherto have been enjoyed in the said land will be replaced by rights and benefits reasonably equivalent in character; Now, THEREFORE, I, JOHN STUART MACPHERSON, C.M.G., Officer Administering the Government of Palestine, in virtue of the powers vested in the High Commis- sioner as aforesaid, do hereby order that the said area of land shall be converted into the category of land termed "Miri" and registered accordingly in the Land Registry at Jaffa. I N E X E R C I S E of the powers vested in h im by Article 3 of the Emergency Powers (Colonial Defence) Order in Council, 1 9 3 9 , and the Emergency Powers (Defence) Act , 1 9 3 9 , the H i g h Commissioner has made the following Defence Regulations :—

1. These Regulations may be cited as the Defence (Municipal Tribunals) .(Amendment) Regulations, 1 9 4 2 , and shall be read as one with the Defence (Municipal Tribunals) Regulations, 1 9 4 1 , hereinafter referred to as the principal Regulations.

21. Regulation 3 of the principal Regulations shall be amended by the substitution of the following paragraph for paragraph (a) thereof:—

"(a) any offence against the Food and Essential Commodities (Control) Ordinance, 1 9 3 9 , the Food Control Ordinance, 1 9 4 2 , or any rules or orders made under either of those Ordinances or the Defence (Prevention of Profiteering) Regulations, 1 9 4 2 . "

I N E X E R C I S E of the powers conferred upon me by Regulation 1 4 of the Defence Regulations, 1 9 3 9 , I , R E G I N A L D M A N D E V I L L E R O D W E L L , A . F . C . , Brigadier and Mil i ta ry Commander of the Hai fa District , being a Competent Authority for the purpose of the said Regulation, do hereby order as follows :—

1. This Order may be cited as the Control of Photography (Haifa District) Order, 1 9 4 2 .

2 . No person shall within the Haifa Distr ict , except under the authority of a written permit issued by me, make any photograph, sketch, plan, or other repre­sentation of any object of the descriptions following, that is to say —

(a) any fortification, battery, searchlight, listening post, or other work of de­fence ;

(b) any aerodrome or seaplane station ; (c) any assembly of any of H i s Majesty's or of any All ied forces;

(d) any barracks, encampment, or building occupied or in course of preparation for occupation by any of H i s Majesty's or of any All ied forces;

(c) any arsenal, magazine or store for munitions of war or arms, or any factory, magazine or store for equipment or supplies, for any of H i s Majesty's or for any All ied forces, whether completed or in course of construction;

(/) any wireless, telegraph, telephone, signal or cable station; (g) any dock, caisson, dockyard, harbour, shipbuilding works or loading pier;

( h ) any ship or any vessel of war or any vessel or vehicle engaged in the trans­port of supplies or personnel;

(i) any aircraft or the wreckage of any aircraft;

(]) any building structure, vessel or other object damaged by enemy action or as a result of steps taken to repel enemy action;

(k) any hospital, or station at which casualties, whether c ivi l or otherwise are treated; any ambulance or convoy of injured persons, or any injured person;

(0 any electricity or water works, or any gasometer or reservoir, or any oil store; (m) any assembly of persons for the purpose of transport or evacuation, or any

temporary camp or other accommodation or transport vehicles used for the purpose of evacuation;

(n) any riotous or disorderly assembly, or premises, or other objects damaged i n the course of such an assembly;

(o) any roads or railways exclusively connected with works of defence.

I N E X E R C I S E of the powers vested in him by subsection (2) of section 3 of the Urban Property Tax Ordinance, 1940, the H i g h Commissioner in Council is pleased to order and it is hereby ordered that the boundaries of the Urban Area of Ramallah (including E l Bira) , as set out in the Order dated 27th January, 1931, made by the H i g h Commissioner under subsection (1) of section 3 of the

Cap. 147. Urban Property Tax Ordinance, and published in the Gazette No. 276 of the 1st of February, 1931, shall be varied and the Urban Area of Ramallah (including E l Bira) , for the purpose of the Ordinance shall, as from the 1st of A p r i l , 1942, be the area com­

prised and outlined in red on the Survey Department map of Ramallah (including ]51 Bira) and environs on the 1/5,000 scale.

Copies of the map and of a schedule giving a description of the boundaries of the new area signed by the Director of L a n d Settle­

ment are exhibited at the District Offices, Ramallah, the L a n d Registry Office, Jerusalem, the Ramallah Municipal Office, the office of the Local Council of E l B i r a , and the office of the Director of Land Settlement in Jerusalem and are open for inspection by any member of the public at any of these places between the hours of 10 a.m. and noon.

I N E X E R C I S E of the powers vested in me by section 4 of the Food Control Ordin­

ance, 1942, I , G E O F F R E Y W A L S H , Food Controller, do hereby order as follows :—

1. This Order may be cited as the Defence (Control of Meat) Order, 1942. .

2. F o r the purpose of this Order— "Establishment" means any hotel, boarding house, pension, hostel, hospice,

restaurant, cafe, bar or any other place where food is prepared for sale or sold for human consumption.

" M e a t " means the flesh of cattle, sheep, goats, swine or camels or any other edible part derived from any such animals, and includes any chilled, frozen, cooked or otherwise preserved meat and any sausages and meat products of which the flesh or any other edible part of cattle, sheep, goats, swine or camels is an ingredient.

"Officer of Pol ice" means an officer of the Palestine Police Force of or above the rank of sub-inspector.

"Sa l e " or "Offering for sale" means sale by wholesale or retail and, in addition to its ordinary meaning, shall include, offer, advertise, expose, transmit, con­sign, import, convey or deliver for sale, or cause a sale; and further shall mean barter or exchange or supply or dispose for any consideration direct or indirect.

3. —(1) The slaughter in any public slaughter house, or in any other place, of any cattle, sheep, goats, swine or camels within the following period in each week shall be prohibited :—

F r o m G p .m. on Saturday to 12 noon on the following Wednesday.

Provided that nothing in this paragraph shall preclude the emergency slaughter of any animal which has sustained an accident justifying its immediate slaughter, but in such event the owner of the animal so slaughtered shall report the fact of slaughter :—

(a) i n the Municipal Areas of Jerusalem, Jaffa, Tel A v i v , Hai fa , Nablus, Nazareth and Gaza to the Assistant Food Controller of the District concerned, and

(b) i n the rest of Palestine to the Officer of Police in charge of the area in which slaughter took place.

The owner of the animal so slaughtered shall provide all such information as may be required regarding the nature and extent of the emergency.

(2) The slaughter of animals, as allowed in sub-paragraph (1) hereof, shall be limited as the Food Controller may from time to time decide by notice to be placarded on the slaughter house concerned.

4. The sale or offering of sale of any meat on any Monday, Tuesday or W e d ­

nesday shall be prohibited, with the exception of the sale by wholesale within the premises of a public slaughter house which wil l be permitted as from 12 noon on Wednesday only.

5. —(1) No person shall on any Monday, Tuesday or Wednesday supply for con­

sumption at, to or from any establishment any meat, or any sandwich containing meat, or any dish containing meat.

(2) N o person shall, on any Thursday, Friday, Saturday or Sunday supply to any one customer at any one meal more than one plate or dish containing meat, or more than one plate of sandwiches containing meat.

6. The Food Controller may, subject to such conditions as he may think fit to impose, grant licences exempting from all or any of the provisions of paragraph 3 or 4 of this Order in order to provide for—

(a) the consumption of meat by patients in hospitals, or (b) for the supply to any Department of Government.

7. —(1) Any police constable or any officer employed or authorised by the Food Controller may at any time enter and inspect—

(a) any public slaughter house or other place where animals are slaughtered;

(b) Any butcher's shop, establishment or other place where meat is sold or offered for sale;

(c) any cold store, sausage factory or other factory for producing meat; and

(d) any other premises where lie may have reasonable cause to suppose that animals may be slaughtered or meat sold or offered for sale,

with a view to securing compliance with the provisions of this Order.

8. — ( a ) Any person who either I)y himself or by his servant, employee or agent shall act in contravention of any of the provisions of this Order, and

(b) A n y person who aids, abets or conspires with any person to contravene the provisions of this Order, shall be guilty of an offence and on conviction shall be liable to the penalties provided by the Food Control Ordinance, 1942, namely to the confiscation of the meat sold and to a fine not exceeding five hundred pounds or to imprisonment for a period not exceeding one year or to both such fine and imprisonment.

9. Nothing in this Order shall apply to the slaughter of animals for supply to any of H i s Majesty's or Allied Forces or to any transactions connected with the slaughter of such animals for supply as aforesaid. ־

10. Any meat derived from animals lawfully slaughtered on days on which the sale of meat is prohibited may be transported, subject to the supervision of any local authority and/or subject to such conditions as the Food Controller or an Assistant Controller, may wish to impose, to—

(a) a butcher's shop or cold store where it shall be detained until a day on which sale of meat is permitted,

Citation. 1. These Regulations may be cited as the Defence (Village Committees) Regulations, 1942.

Interpretation. 2. In these Regulations —-"]District Commissioner" means the District Commissioner of

the District :in which the village is situated; "Administrative Officer" means the officer of the District A d ­

ministration appointed by the District Commissioner to be in charge of the sub-district or administrative sub-division in which the village is situated;

" M u k h t a r " means a person appointed by the District Com­missioner to carry out the functions of a Mukhtar or Sheikh of a tribe.

" V i l l a g e " means a place which has been or which may hereafter-be declared to be a village or tribal unit under Article 11 of the Palestine Order in Council, 1922, but shall not include any place within the jurisdiction of a Municipal or Local Council ;

"Vi l lage Committee" means a committee established in ac­cordance with Regulation 3 of these Regulations.

3. It shall be lawful for a District Commissioner to establish, within a village, or part thereof, a Vil lage Committee.

. —: Every. Village Committee •shall, consist of '(1־)— .4(a) the Mukhtar or Mukhtars of the village ex­offieio; (b) a number, determined by the District Commissioner., of

persons"chosen by the inhabitants of the village in such man­

ner as may be approved by the ]District Commissioner; Provided, that the District Commissioner may also deter­'

mine the number of persons to represent a particular quarter or community.

(2) •The District Commissioner may appoint; one of the members of the Village Committee to be chairman thereof : Provided that where the District Commissioner has not appointed a chairman then the Mukhtar . or it there is more than one Mukhtar , the Mukhtar who has been the longest in office, shall be the chairman.

, In the absence of the chairman, then— ( a ) where he is not a Mukhtar , the Mukhtar or if there is • more than one Mukhtar the Mukhtar who has been the lon­

gest in office, shall act as chairman; ( b ) where he is a Mukhtar and there is more than one

Mukhtar , the other Mukhtar if there are two Mukhtars shall act as chairman, or if there are more than two Mukhtars the Mukhtar who has been the longest in office shall preside;

(c) where no Mukhtar is available, the member of the Village Committee most senior in age shall act as chairman.

: (3) A Village Committee may, as to the chairmanship or mem­, bership thereof, be reconstituted by the District Commissioner as circumstances require in like manner as provided in paragraphs (1) and (2) of this Regulation.

(4) I f any member of the Village Committee shall die, become disqualified or resign or for any other reason cease to hold office, the District Commissioner may in his discretion take such steps' as he deems necessary to fill the vacancy.

5. The jurisdiction of a Village Committtee shall extend over the whole of the lands of the village other than such lands as are within the jurisdiction of a Municipal or Local Council and any area specifically excluded by the ]District Commissioner by order.

6. A Village Committee shall exercise such powers and per­

form such duties as may from time to time be assigned to it by law or by Order of the H i g h Commissioner made under these Regulations.

7. Every Village Committee shall with regard to any of the matters enumerated in the preceding Regulation comply with the requirements of the District Commissioner, and shall assist officers of the Government including Mukhtars in the execution of their duties.

8. —(1) Every Village Committee shall have power with the ap­proval of the District Commissioner to make by-laws necessary for the execution of any powers or performance of any duties assigned to the Committee under Regulation 6 of these Regulations.

(2) A l l by-laws made and approved under this Regulation shall be published by posting them in some conspicuous place i n the village and shall thereupon come into force. A certificate as to such publication by a District Commissioner or an Administrative Officer shall be conclusive proof of the enactment of the by-laws specified in such certificate :

Provided that such publication may, in addition to posting as aforesaid, be made by village crier.

(3) Every person who, by any act or omission, shall contravene any by-laws made under this Regulation shall be guilty of an offence and shall be liable for such offence to such maximum penalty, not exceeding a fine of live pounds or fifteen days imprisonment, as shall be specified in the by-laws.

9. —(1) A Village Committee established under Regulation 3 of these Regulations shall have power to settle by arbitration any dispute existing between parties resident or owning or cultivating land within the village :

Provided that arbitration shall be limited to such matters as have been customarily submitted to the arbitration of the elders of the village and are for such reason approved by the District Commis­sioner, and also such matters as are declared by law to be suitable for arbitration by a Village Committee.

(2) The award of a Village Committee upon such an arbitration shall require the confirmation of the District Commissioner or A d ­ministrative Officer and upon such confirmation shall become bind­ing upon all parties to the dispute and shall be enforceable in such manner as the District Commissioner or Administrative Officer shall by order direct.

10. A n y person acting lawfully under the authority of any order for the enforcement of an arbitration award made under the preced­ing Regulation shall not; be liable to any suit or prosecution in re­spect of such act.

11. The Interpretation Ordinance shall apply to these Regula­tions as it applies to an Ordinance save that it shall not; be neces­sary to publish in t h e Gazette any order, by-law, direction or notice made or issued under these Regulations.

1. This Order may be cited as the Food Control (Allocation and Purchase of Commodities) Order, 1942.

Citation.

. I n this Order —

"Controlled article" means wheat, barley, durra, maize and sesame:

" V i l l a g e " means a place which has been or which may here­after be declared to be a village or tribal unit under Article 11 of the Palestine Order in Council , 1922.

"Vi l lage Committee" means a Village Committee appointed under the provisions of the Defence (Village Committees) Regulations, 1942, or other properly constituted local author­ity ;

" M u k h t a r " includes a person appointed by a! District Commis­sioner to carrv out the functions of a Mukhtar .

Interpretation.

• 3. A District Commissioner may by notice require a village committee or any other person to furnish within such period as may be specified in the notice such information, or to produce such do­cuments, as may be specified in the notice regarding the number of inhabitants of and the owners and cultivators of land in the v i l ­lage and the number and categories of animals belonging thereto and such other information as the District Commissioner shall deem necessary to enable h im to ascertain the village requirements of any controlled article. And a District Commissioner may by notice re­quire such other incidental and supplementary information as ap­pears to h im to be necessary for the purpose of this Order.

:!. ' A '•District Commissioner may fix the quantity of any con­

trolled article which, he considers necessary for the needs of the inhabitants'or animals of the village and seed for the next sowing season. A District Commissioner may also require the village• com­

mittee or any person to produce at a specified place within a specified time any such quantities of a controlled article as the District Commissioner may decide to be surplus to the requirements of the inhabitants or animals of the village, and seed for the next sowing season. A village committee shall comply with any such requirement and may issue such directions to the inhabitants and owners and cultivators of the village as may be necessary to comply with such requirement of.the District Commissioner.

5. A District Commissioner, on behalf of the Government of Palestine, may purchase, at a price which shall be fixed from time to time the surplus specified in paragraph 4 hereof and pay such amount to the village committee or such other person as he may appoint, for distribution of such amount among the persons entitled thereto.

7. A District Commissioner may issue such directions and forms as he shall deem necessary for the purpose of carrying into effect the provisions of this Order.

Recovery of 8. A ".District Commissioner may direct, in addition to any pe­

oxpenses. nalty for the breach of the provisions of this Order or the Food Control (Estimation of Crops) Order, 1942, that any expenses i n ­

curred in consequence of the breach of such Orders or failure to carry out the directions of a District Commissioner shall be paid by the person or village committee committing such breach or failing to carry out such directions.

I N E X E R C I S E of the powers vested in him by Article 3 of the Emergency Powers" (Colonial Defence) Order in Council, 1939, and the Emergency Powers (Defence) Act , 1939, the H i g h Commissioner has made the following Defence Regulations:—

1. These Regulations may be cited as the Defence (Food Con­trol) (Amendment) Regulations, 1942, and shall be read as one with the Defence (Food Control) Regulations, 1942, hereinafter referred to as the principal Regulations.

2. The principal Regulations shall be amended by the addition of the following regulation at the end thereof:—

"Eecovery of expenses in­curred through non-compliance with orders under Food Control Ordin­ance, 1942.

4. A n order made by the Food Controller under the Food Control Ordinance, 1942, may make pro­vision for the recovery from any person or body of any expenses incurred in consequence of such person or body having contravened or failed to com­ply with any order so made or with any directions issued thereunder."
