    assistance you can to the three retired agents whose

    depositions they seek?

    MS. HARWOOD: Correct.

    THE COURT: All right. Are there any issues that need

    to be addressed, then, as far as the United States is concerned

    as it relates to those witnesses or the two documents that

    you've provided to the -- to the parties in this matter?

    MS. HARWOOD: No, there's no more issues.

    THE COURT: All right. Does either party wish to be

    heard with respect to that, to that issue?

    MR. CASEY: Yes, Your Honor. First of all, I'd like

    to thank Ms. Harwood and her office for their cooperation.

    It's been very helpful.

    I would just like it -- to make sure I understand the

    federal government's position, there are three other

    individuals who no longer work with ICE. One is Jim

    Pendergraph, and I understood that I was authorized to try to

    facilitate his deposition and I provided that information to

    Ann Harwood yesterday.

    There's a man out of Maryland named William Read, and

    I would like to make sure it's clear that I am authorized to

    speak with him solely for the purposes of lining up a

    deposition.

    Then I understand there's a third man, Troy Henley,

    who now may be in Afghanistan. We may or may not need to go

    THE COURT: All right. And then, Ms. Strange, I will

    enter your order.

    MS. STRANGE: Thank you, Your Honor.

    THE COURT: You want to be heard on anything else?

    MS. STRANGE: Just one other matter, Your Honor.

    May I -- should I approach the podium --

    THE COURT: You need to, yes. You need to approach

    the podium, please.

    MS. STRANGE: Thank you.

    The other matter is that the United States is going to

    move for a protective order, a very limited one, as to the

    depositions themselves that had originally been part of the

    protective order that was submitted to the parties, but --

    THE COURT: I thought those took place in April,

    didn't they?

    MS. STRANGE: The depositions have not taken place

    yet, Your Honor.

    THE COURT: All right. That's of the agents?

    MS. STRANGE: Yes.

    THE COURT: What was it, it was Jason Kidd, Jason

    Mull, something like that?

    MS. STRANGE: Jason Kidd.

    THE COURT: Yeah.

    MS. STRANGE: There are I believe four different ICE

    people that the defendants intend to take the deposition of

    now. And we have two of them scheduled in September, one on

    October 1st, and I think two other ones are going to be

    scheduled in October?

    MR. CASEY: Your Honor, right now we've noticed up

    Alonzo Pena, I believe, for September 30th, pursuant to the

    availability provided by the United States; Jason Kidd the

    following day, or vice versa.

    I'm in contact with a man from North or South Carolina

    named James Pendergraph where I think he may have proposed the

    4th, but I'll be circulating the 4th of October to everyone.

    And I will be contacting William Reid, who I

    understand is now a magistrate judge in Maryland outside of

    D.C. That is the other person.

    We have permission to depose one other, a man named

    Troy Henley, who we're all having difficulty reaching. He may

    be on a DOD contract in Afghanistan, and if in fact we just

    can't do him, we can't do him. If we do find him, it may not

    be necessary to interrupt his work.

    THE COURT: What's your protective order?

    MS. STRANGE: What we had proposed to the parties was

    that there be a very limited period of time, say, 21 days,

    following the deposition itself, in which ICE could review the

    deposition testimony and see if there was anything in there

    that was law enforcement sensitive, and then make a very

    particularized motion to the Court specifying the parts of the
