1. 1. POSITION IN CURRICULUMScience of the State has significant position in Law Faculty
as basic science in first semester. It has been considered aspure science which provides theoretical basis for appliedscience, such as Constitutional Law, Administrative Law, andother science which has state as its object.
In the book entitled Statslehre, Prof. Herman Heller wrotethat Science of the State is sociology, implied in realisticscience. Having a similar perception, Elders Mr also wrote it inStaatsbegripen Institutionalisme.
Law College (Rechtshogeschool) in the Netherland Indiesera, delivered Historische Ont wikkeling der hedendaagschestaatsinstellingen (historical development of state institution)which considered as introductory subject to Positive State Law.1

Kedudukan Ilmu Negara dalamKurikulum FH
Ilmu Negara diberikan pada tingkat pertama(persiapan), sebagai mata kuliah pengantar untuk matakuliah Hukum Tata Negara (Hukum Negara Positif).Ilmu negara dianggap sebagai Ilmu murni (pure science)yang menyediakan dasar-dasar teoritis bagi ilmu hukumnegara yang dipandang sebagai ilmu yang praktis(applied science).

4.1. FROM POLIS TO STATEa. Historical Approach (Hisorische Hoofd Typen Van De
Staats). Types of state is classified based on historicalgrowth :
i) Ancient East Type of state : tyranny Characteristic : theocratic (king as God) & absolute (king
has absolute power)
ii) Ancient Greek Polis (city state) The state as wide as a city, rounded by fortress, only a few
population. Implementing direct democracy, the people getencyclopaedie (science) in a place called acclesia. Solvingproblems together with philosopher as a leader.
iii) Roman Empire Imperium, Greek as Roman’s shadow-land Caesar as absolute leader hold authority to govern all people
(this authority called caesarismus) based on lex regia(regulation).
iv) Middle AgeDualism conflict : government >< citizen land owner >< tenant farmer = feudalism statesman >< religionist = secularismThose conflicts created monarchomachen (group of antiabsolute king) which had eager desire to limit the rights andduties of the king and the people. 4.1. MULAI DARI POLIS SAMPAI NEGARAa. Tipe Negara Menurut Sejarah (hisorische hoofd typen van
de staats) meninjau penggolongan negara berdasar sejarahpertumbuhannya :
i) Tipe Negara Timur Purba Tipe negara : tirani Ciri-ciri : teokratis (raja adalah dewa) & absolut (raja
berkuasa mutlak)
ii) Tipe Negara Yunani Kuno Polis (negara kota) Negara seluas kota, dikelilingi benteng pertahanan, sedikit

republic to monarchy based on the way of forming state’swillingness. If the willingness is determined by one personmeans monarchy, whereas republic by council / board (morethan 1 person)

d. Aristoteles observed the form of state by measuring quantityas ideal form and quality for the degeneration :
If many of people led by one person for the sake of all, so itcalled MONARCHY. When he governs based on his selfinterest, the monarchy changed into DICTATOR /TYRANNY.
If many of people led by numbers of people for the publicinterest, it called ARISTOCRACY. It became OLIGARCHY, ifthey govern only for their interest. It became PLUTOCRACY,if they govern only for the haves (plutocrat).

4. 3. FORM OF GOVERNMENTConfusing with governmental system, it discussed about juridicalform of the state, means relations among state institutions indefining its policy as mentioned in constitution.a. Parliamentary System : Close relation between executive
and parliament, which dependent to one another. Executiveled by Prime Minister whose elected by Parliament from themajority parties. People didn’t elect the Prime Minister andthe cabinet directly, but only the members of parliament. Thecabinet responsible and submit to parliament. The cabinetcould fail without supported by the majority in the parliament.In the other hand, the Head of the State could dismiss theparliament by the request of Prime Minister followed bygeneral election to elect the new members of parliament.
b. Presidential System / fixed executive : strict separationamong legislative (parliament), executive and judicative.President as the Head of the state and government /executive at once. President unelected by the parliament,but together with parliament was elected by the peopletrough general election, so that the President and cabinetcould not terminated by parliament. In the other hand,President could not terminate the parliament. Both bodiesperform their duties based on constitution until the end theirtenure, unless resigned by impeachment.
c. Swiss System : legislative body had the immediate controlby the people trough :
Referendum : people’s political activity to declare against /for parliament policy or certain policy that need people’sapproval :
Obligator referendum : the regulation (bill, act) drafted byparliament which is valid after agreed-on by the peopletrough major vote, specifically for regulation related topeople’s right
Facultative referendum : groups of people requestreferendum to declare parliament’s ordinary regulation
Consultative referendum : referendum for certain caseswhich people technically unknown
People’s initiative : people has rights to draft bill to theparliament or government.
4. 3. BENTUK PEMERINTAHANRancu dengan system pemerintahan, akan dibahas bentukyuridis Negara, artinya hubungan antara lembaga Negara dalammenetapkan kebijakannya berdasarkan konstitusi.a. Sistem Parlementer : Hubungan ketergantungan antara
eksekutif dan parlemen. Eksekutif dipimpim oleh PerdanaMenteri (PM) yang dipilih oleh Parlemen dengan mayoritaspartai. Rakyat tidak memilih PM dan kabinetnya secaralangsung, hanya anggota parlemen saja. Kabinetbertanggungjawab dan tuntuk pada Parlemen. Kabinet dapatdijatuhkan tanpa dukungan mayoritas suara dari parlemen.Sebaliknya, Kepala Negara dapat menjatuhkan parlemenberdasar permintaan dari PM yang diikuti dengan Pemiluuntuk memilih anggota Parlemen yang baru.
b. Sistem Presidensiil / fixed executive : pemisahan tegasantara legislative, eksekutif dan yudikatif. Presiden sekaligusmenjadi Kepala Negara dan Kepala Pemerintahan. Presidentidak dipilih oleh Parlemen, tapi bersama dengan Parlemendipilih oleh rakyat lewat Pemilu, sehingga Presiden dancabinet tidak dapat dijatuhkan oleh Parlemen. Sebaliknya,Presiden tidak dapat menjatuhkan parlemen. Kedualembaga itu menjalankan tugas berdasar konstitusi sampaiakhir masa jabatan, kecuali diberhentikan karenaimpeachment.
c. Sistem Swiss : legislative diawasi langsung oleh rakyatmelalui :
Referendum : tindakan politis rakyat untuk menyatakansetuju / tidak terhadap kebijakan parlemen atau kebijakantertentu yang memerlukan persetujuan rakyat :
Obligator referendum : UU yang dirancang parlemen sah jikadisetujui rakyat melalui suara terbanyak, khususnya regulasiyang berhubungan dengan hak rakyat
Facultative referendum : kelompok tertentu memintadiadakan referendum untuk mengumumkan regulasiparlemen
Consultative referendum : kasus tertentu yang teknisnyarakyat tidak tahu
