2. The Existing Environment

Existing Structures:

There are no land use related restrictions which are likely to affect health and safety. Areas closely adjacent to the site have been developed as residential housing.

Underground services providing domestic drainage, water, gas, electricity and telephone services are located within the curtilage of the site.

Overhead services are designated British Telecom.

Cable TV etc lines maybe slung between adjacent blocks at eaves level.

Protection measures will be required while working adjacent to overhead powerlines. Early notice of such requirements should be raised with site staff to request sheathing from the Electrical Supply Company.

Note: The accuracy of service information has not been verified.

Vehicular access to the sites is provided by a tan:n~"c surfaced road and paved walkways.

There are no existing traffic restrictions and it is envisaged that all access road ways will remain open throughout the duration of the contract.

There are not known to be any special health and safety problems associated with the existing structures requiring increased precautions excepting height mentioned elsewhere and the possibility of overhead power cables.

Ground Conditions:

Access Arrangements:

Particular care will be required while preparing most existing soffits for painting due to their asbestos content.

PPE may be required during this operation.

Work must stop immediately, should any material be found to contain asbestos and remains unpainted and MUST be reported to the COM Co-ordinator for his recommendation.

Care will also be required while working around boiler outlets at ground and intermediate floors.

Appropriate measures should be undertaken to provide suitable footing for access systems.

The use of ladders will not be permitted as a place of works above two storeys unless precluded by other design restrictions or where the duration of the work is less than 30 minutes. The term Short Duration must be given proper consideration taking account of the working operation involved, the level of fatigue encountered while carrying out a specific operation and including climbing and descending the ladder as a repeated operation.

For works specifically involving builder work etc operations at high level, an appropriate tower scaffold system will require to be considered with guard rail/toe boarding and firqt~ction over doorways/access or other access detailed in a risk assessment.

Scaffold design certification where appropriate will be required.

A full method statement will be required in accordance with The Construction (Health Safety & Welfare) Regulations 1996 and will require to be approved by the COM Co­ordinator prior to works commencing.

3. Existing Drawings

NB A hierarchy of control measures will be required to be provided to show that all methods of working at heights have been explored before selecting the most appropriate system adopted.

There are no drawings. (All available information is provided herewith)

4. The Design

Prior to commencement of the works the Contractor is required to submit the respective Construction Phase Plan for approval by the COM Co-ordinator in accordance with Construction (Design and Management) Regulations 2007. The Contractor is required to submit proposals for managing the following specific site problems:

Access to overhaul I decorate rainwater goods to single, two, three and four storey properties and

Access for applying full decorative finish if specified to eaves, fascias, barges, etc up to and including four storey properties and

Access for applying full decorative finish if specified (including burning off) to windows/doors to single, two, three and four storey properties and

The control of manual handling and safety of all stock.

5. Construction Materials

The use of materials of an extraordinarily hazardous nature requiring precautions has not been included:VJlthin this design. However, the Contractor will be required to observe manufacturers recommendation against eye/skin contact and the appropriate measures for removal. Flammable materials where stored will be required to be separated from any risk of fire. Appropriate fire fighting measure will be required.

Oil based paints will only be permitted on existing fascias/soffits and doors where an existing oil finish has been used.

By common pathways and via staircases and from front and rear gardens and common places.

The Contractor will be required to provide a secured container, where practical, for material and Welfare facilities for operatives in accordance with the Construction Health Safety Welfare Regulations 1996.

Temporary site huts and compound wilt be located within a suitable area within practicable operating distances from the sites to allow reasonable use and access for operatives or other arrangements made by agreement.

Storage containers will be located as above.

Note the storage of contractors materials including waste will not be permitted on or in Council owned properties.

Traffic/pedestrian routes will remain open throughout the duration of the works.

The contractor is required to submit proposals for protecting public users of both pedestrian and vehicular routes from any for~seeable hazards i.e. erection of scaffold systems footpath permits etc.

Tenants will remain in occupation throughout the duration of the contract.

All external works are to be completed in each house, street and area within the prescribed period in the contractors programme.

The Contractor will give the Contract Administrator at least 7 days notice before commencing the works on site. The Contractor will give the Tenant/Private Owner 7 days written notice before starting works on their home.

From Barn to 5pm Monday to Friday or by specific agreement.

The Contractor must ensure removal of all waste from site on a daily basis or if required to designated skip (covered) provided by the contractor.

All site personnel will be required to carry photographic identification at all times.

Ten ants power will not be used to operate power tools etc.

All services will be restored at the end of each working day to occupied properties.

Each property must be left in a secure state at the end of each working day.

Access arrangements will be required to be agreed with each respective tenant/owner.

All plant/tools and debris will be removed from each house at the end of each working day. Skips where used will be required to be secured during working hours and after by means of a proprietary lid.

In addition to the requirements of the Reporting of Injuries, Diseases and Dangerous Occurrences Regulation 1995 (RIDDOR) any fatality, specific major injury or condition, dangerous occurrence, flammable Gas incident or dangerous gas fitting will be reported

9. Continuing Liaison

immediately to Perth & Kinross Council by the quickest available means. An accident or injury of any nature whatsoever involving tenants or members of the public will also be reported immediately to Perth & Kinross Council by the quickest available means. In all cases of accident or injury etc. a written report will be submitted to Perth & Kinross Council within 7 days.

Liaison will be continued throughout the duration of the contract by holding regular site progress meetings, project meetings and site visits by PMP staff.

Visits to the site by this Council's Safety Officer(s) (Corporate Services) may also be undertaken.

INSTRUCTIONS TO TENDERERS AND PROCEDURE ON RECEIPT OF TENDERS

1. Tender Documents

This Bill of Quantities comprises (Sections and) pages in numerical sequence and the Contractor shall check the number of each page and if any are missing or duplicated, or if any work, letter or figure is indistinct, he shall at once notify the Team Leader, Planned Maintenance.

The Form of Tender is to be filled up with the lump sum for the whole works as described and subscribed by a duly authorised signatory and dated.

The authorised signatory must be:

(a) In the case of a Company incorporated under the Companies Acts, a Director or the Secretary of the Company.

(b) In the case of a partnership, a partner in the firm.

( c) In the case of an individual trading under his own or a firm's name, the principal.

( d) In the case of a tender not complying with the foregoing notes it must be accompanied with a document duly executed by the Company, partnership or principal conferring authority to sign on the signatory.

When documents are provided for pricing these should be filled up in detail and it should be noted that any amendments or alterations made to these documents or drawings or the exclusion of any item or items therein (except on the written instructions of the Contract Administrator) or any qualification imposed by the tenderer may invalidate the tender.

Tenders shall remain open for consideration for a period of 3 months from the date for receipt of same after which they shall be subject to confirmation.

The tender documents must be fully completed in indelible ink in all respects, i.e. rates, extensions and totals, together with additional information and signatures where required. Tenderers are requested to fill up and complete all documents in BLACK ink in order to facilitate future photocopying of the successful documents.

Income Tax and VAT information sheets must be completed for this project and are enclosed herewith.

Inability to Tender: If the Contractor is u!.lable to tender he should return the blank Bills of Quantities immediately.

Completion of Tender Documents: At various sections of the documents there is a requirement for the Contractor to provide information and/or to fully price the works detailed and/or to append a signature. All relevant parts of the tender documents must be completed in full prior to submission of the Form of Tender and the priced Bill of Quantities. Failure to complete all the relevant parts will invalidate the tender.

The attention of the Contractor is particularly drawn to the page for listing sub-contractors.

Should the Contractor fail to complete the details listing the names of any sub-contractor and append his signature thereto then the tender documents will be deemed to be incomplete and the tender will be rendered invalid.

2. Delivery of Tender Documents

One copy of the tender, conditions, preambles and bills, etc. priced and extended together with all information requested and all pages signed where required, shall be returned in a single sealed plain unmarked package.

(Where all the documents are returned in one package the label supplied for the return of the documents containing the Instructions to Tenderers and Form of Tender should be used).

Tenders lodged by facsimile will not be acceptable or considered.

3. Receipt of Tender Documents

Any tender documents received after the time and date for lodgement or submitted otherwise than in accordance with the requirements of paragraph 2 above shall not be considered.

4. Drawings Issued with Tender Documents

All drawings issued to tenderers are to be returned by the date and time stated for lodgement of tenders.

Failure to return the drawings may result in a charge being levied to cover the cost of printing.

5. Opening Tenders

As soon as possible after the time for receipt of tenders the envelopes containing the Instructions to Tenderers and Form of Tender will be opened and recorded. The priced documents of the three lowest tenders will be checked in accordance with paragraph 6 of these Instructions. At the discretion of the Director of Housing & Community Care, the priced documents for all or any of the other tenderers may be opened and checked.

The tendering Contractors are required to indicate on the Form of Tender if in the event of being unsuccessful and their priced documents unchecked, they wish them to be returned. Where no such request is indicated all such unopened Tender Documents will be confidentially destroyed.

6. Examination of the Priced Tender Documents

Between the last date and time for the lodgement of tenders and the date on which a decision is taken as to · which, if any, tender is to be accepted, the Forms of Tender and priced Documents will be examined by the

Contract Administrator, who,

(a) shall rectify errors in extensions or summations discovered in the checking of the tenders and correct the total sum quoted in each tender;

(b) may contact a tenderer if, on examination of the tenders, it is discovered that a tenderer has not complied with the requirements of the contract documentation. Such contact shall be limited to ascertaining if the tenderer is prepared to conform to the requirements of the contract documentation without amendment to the total sum quoted in his tender (subject to arithmetical correction); and

(c) ma/also contact a tenderer if, it is considered that a tenderer has made a mafor error in his tender. Such col}tact under this sub-heading shall be limited to ascertaining if the tende1'1l;:r wishes to confirm his tender as it stands (subject to arithmetical correction) or wishes to seek permission to withdraw his tender.

Where the tenderer fails to insert a rate for any item or items he will be deemed to have priced same and carry out the work at no additional cost to the contract. This procedure shall apply even when the tenderer has written "excluded" or similar words to that effect, against any item or items.

In this regard it should be noted that the tenderer is responsible for the accuracy of his submission and any errors not discovered in the examination whether arithmetic or not in the computation of the Contract Sum shall be deemed to have been accepted by the parties to the contract.

Evaluation of Tenders/Contractors

Tenders will be evaluated on the basis not only of price, but on the Contractor's ability to demonstrate to officials of the Council that he has clearly understood the terms and conditions of the contract and has given due consideration to programming, site management, supervision and management of sub-contractors, tenant liaison, attendance to instructions, call outs, march-ins and the like, and will have in place for the duration of the contract, including the defects liability period such personnel, infrastructure and organisational commitment to fully meet all the requirements of the Contract.

Where it is appropriate, immediately following the submission of the tender documents and assessment thereof, a short list of candidates may be drawn up for interview, at which the aforesaid matters would be discussed and evaluated.

7. Acceptance of Tender

The Employer (Perth and Kinross Council) is not bound to accept the lowest or any offer and no expense by any person submitting a tender will be reimbursed.

8. Notifying Results

Immediately the Contract has been placed, the unsuccessful tenderers will be so advised and where the contract value is in excess of £5,000 all tenderers will be notified of the firms who tendered (in alphabetical order) and the tender prices (in ascending order of value) provided that more than two valid tenders have been received.

Works: Planned Cyclical Maintenance Programme HP/09/03 29/01/2009

1. The Contractor is invited to submit a fixed price tender/quotation for the works in accordance with details provided in the enclosed documents specifications* /schedule*.

2. The Employer is not bound to accept the lowest or any of the offers and is not responsible for any loss or expense incurred by the Contractor in preparing and submitting a quotation.

3. The tender shall be a fixed price, exclusive of any VAT which may be liable to be charged and shall remain open for acceptance for a period of 3 calendar months from date for receipt stated herein.

4. The Pricing shall include for all means of access, scaffold, plant, tools, vehicles, temporary water, power and light, administration, protection, safety health and welfare of work people, disbursement arising from the employment of workpeople, removing rubbish, skips, temperature and humidity control, cleaning and drying the works on completion.

The Pricing shall also include for all temporary weather protection, barricades, temporary coverings and protection of new and existing finishes etc.

5. All materials, goods and workmanship shall conform to relevant Codes of Practice and British Standards and/or equivalents and from an approved manufacturer

All materials and goods shall be new and best quality available.

All ,labour and workmanship shall be carried out by qualified tradespeople fully conversant and capable in the nature of work to be undertaken.

6. The Contractor shall allow in his price for all notifications, fees and attendances on all Statutory Bodies and Service Authorities as required for the proper execution of the works ie. Roads Authority, Water Services etc.

7. The Contractor, in submitting his fixed price, shall be deemed to have visited the site and to have ascertained all local conditions and restrictions affecting the site and access thereto.

8. A Contract shall have been concluded and agreed between the Parties to the Contract on submission of a formal Tender by the Contractor and the issue of a formal Letter of Acceptance from the Employer.

GENERAL DESCRIPTION AND SUMMARY OF THE WORK

Extent of the Work

The work is largely to the external facades of council houses in single and double storey housing and in tenement buildings in flats all as described in the enclosed documents. Where required timber windows and doors are to be painted they are so described and many houses will now have plastics windows and door sets which do not require painting. External works like fences and gates in timber and metal will be so described and be painted along with clothes poles and other handrails as described.

Details will be given of common staircases to be painted but where there are brackets around house numbers like (55) this indicates that the block shown in brackets like [ 53, (55) 57, 59] has a private owner who will be required to agree to the extra work being carried out and no work should commence without written instruction from the Clerk of Works. Similarly the painting of external wet dash roughcast (which has been previously painted) will be agreed to on the same basis as the Council must seek the agreement of the private owner to such costs.

The work must be carried out in agreed discrete areas and the contractor must allow in the pricing of the Works for the full completion of all works in one area before agreement will be given for work to commence elsewhere.

A programme of all works will be agreed before the project commences to ensure that the above is both feasible and understood. Squad sizes should be ascertained to ensure that each area is properly staffed and that adequate resources are deployed throughout the work period to complete the contract by the agreed dates.

DEFINITIONS

CONTRACT ADMINISTRATOR: the person nominated by the Employer to administer the Contract.

EMPLOYER: Executive Director, Housing & Community Care, Perth and Kinross Council.

CONTRACTOR: the person accepted by the Employer to carry out and complete the works.

DEFECTS LIABILITY PERIOD: the period stated in these documents where any defects, shrinkages or other faults which shall appear within the Defects Liability Period and which are due to materials or workmanship not in accordance with this Contract shall be made good by the Contractor at no cost to the Employer. Such defects shall be specified by the Contract Administrator not later than 14 days after the expiration of the said Defects Liability Period and within a reasonable time after receipt of such schedule shall be made good.

DATE FOR COMPLETION: the date fixed for completion of all works under this Contract by reference to a date or period for work to be carried out and stated herein.

CERTIFICATE OF COMPLETION OF MAKING GOOD DEFECTS: when in the opinion of the Contract Administrator any defects, shrinkages or other faults shall have been made good he shall issue a Certificate to that effect, and completion of making good defects shall be deemed for all the purposes of this Contract to have taken place on the day named in such Certificate.

JCT 98 CONDITIONS OF CONTRACT: the Standard Form of Building Contract 1998 Edition as issued by the Joint Contracts Tribunal incorporating the Scottish Supplement and any relevant amendments issued up to the date of this Contract. The version applicable, ie. With Quantities, Without Quantities or With Approximate Quantities shall be that appropriate to the manner in which the Contact document is set out and the work is described and detailed herein.

JOINT NAMES POLICY: A policy of insurance which includes the Contractor and the Employer as the insured.

SERVICE AUTHORITIES: such public or private authorities and companies, including statutory undertakers, as are responsible for the various services in connection with and which may be affected by the works and including inter alia, those responsible for electricity, gas, water, telecommunications, roads, satellite communication, cable TV networks and radio communication.

STATUTORY BODIES: any statutory undertaker which has any jurisdiction with regard to the works in terms of any Act of Parliament, any instrument, rule or order under any Act of Parliament, or any regulation or byelaw of any local authority.

Defects Liability Period

The Contractor shall maintain a public liability insurance for the duration of the works in terms of Clause 20and Clause 21.1 of the JCT 98 Conditions of contract (Local Authority Edition) which insurance shall have a minimum cover of £5,000,000 for any one event.

*Existing Buildings. The Employer shall take out and maintain a Joint Names Policy in respect of the existing structures together with the contents thereof in terms of Clause 22C of the JCT 98 Conditions of Contract (Local Authority Edition).

*New Works (outwith existing buildings) The Contractor shall take out and maintain a Joint Names Policy in respect of the works in terms of Clause 22A of the JCT 98 Conditions of Contract (Local Authority Edition)

The Contractor shall take out and maintain a Joint Names Policy Other than the Works having a minimum indemnity cover of £5,000,000.00 in respect of any expense, liability, loss, claim or proceedings which the Employer may incur or sustain by reason of injury or damage to any property other than the Works and Site Materials caused by collapse, subsidence, heave, vibration, weakening or removal of support or lowering of ground water arising out of or in the course of or by reason of carrying out the works all in accordance with Clause 21.2 of the JCT 98 Conditions of Contract (Local Authorities Edition).

The Contractor shall be paid by instalments in each full calendar month from commencement. Retention of 5% reduced to 2.5% to be retained until the expiry of the Defects Liability Period stated herein and will be deemed to have taken place on the issue of the Certificate of Practical Completion and issue of Certificate of Completion of Making Good Defects.

*The Contract Administrator may, subject to the Contractor's right of reasonable objection, instruct variations to the Contract scope of work, sequence of activities or period in which they are to be carried out and all such variations will be valued by the Contract Administrator on a pro-rata basis if the work is of similar character to work set out in the document or on a time and material basis, if agreed, in terms of any additional works of a jobbing character.

All such instructions will be confirmed in writing by the Contract Admini.strator; if within 7 days after receipt of a written instruction from the Contract Administrator the Contractor.does not comply therewith the Employer may employ and pay other persons to carry out the work and all costs incurred thereby may be deducted by him from any monies due or to become due to the Contractor under this Contract or shall be recoverable from the Contractor by the Employer as a debt.

The Contractor shall at all times comply with the requirements of the Health and Safety at Work Act 197 4, and any other Acts, Regulations or Orders pertaining to the Health and Safety of employees or the general public.

The Contractor shall comply with, and carry out his obligations in compliance with, the Construction (Design and Management) Regulations, 2007.

The Contractor, unless exempted, shall provide his statement of safety policy, if requested to do so, (having regard to the Authority's .general statement of safety policy provided to the Contractor upon request), which shall be supplied to the Contract Administrator within fourteen days of the Acceptance Date.

The Contractor shall forthwith nominate a person to be responsible for health and safety matters. Whilst on premises controlled by the Authority the Contractor shall ensure that his employees comply with the Authority's general statement of safety policy and with the lawful requirements of the Authority's Safety Officer.

The Contractor shall provide and maintain sufficient storage, mess room and sanitary accommodation for the use of all site operatives during the currency of the Contract in compliance with the Construction (Health, Safety and Welfare) Regulations 1996

All the CDM Regulations shall apply and the Contractor will be required to provide a plan for the works base<;l on the CDM Co-ordinator's Pre-Contract Information File and no work can commence until written acceptance of the Contractors Construction Phase Plan is issued.

Value Added Tax:

Settlement of Disputes:

The Law of Scotland shall apply.

Clause IA of the VAT agreement applies as referred to in Clause 15.1 of the Conditions of Contract 1998 Edition (The VAT Agreement).

The Contractor shall complete the enclosed VAT Assessment form and return it as part of his tender.

Should any dispute arise as to the terms, nature and extent of the contract then such disputes shall be referred to Adjudication in terms of Clause 4 lA of the JCT 98 Conditions of Contract Local Authority Edition as amended by the Scottish Supplement thereto. Any dispute or difference arising out of or continuing from the adjudication shall be referred to Arbitration in terms of Clause 4 lB of the JCT 98 Conditions of Contract Local Authority Edition as amended by the Scottish Supplement thereto.

Damages for Non-Completion (This paragraph is optional)

If the Contractor fails to complete the Works by the Date for Completion then the Contract Administrator shall issue a certificate to that effect.

Subject to the issue of said certificate the Contractor shall, as the Employer may require in writing not later than the last day of Defects Liability Period, pay or allow to the Employer at a rate of £568.00 per week as liquidated and ascertained damages for the period between the Date for Completion and the date the works were actually completed. The Employer may deduct the same from any monies due or to become due to the Contractor under this Contract (including any balance stated as due to the Contractor on any outstanding Certificate) or the Employer may recover the same from the Contractor as a debt.

If, in terms as set out in Clause 25.3.3 of the JCT 98 Conditions of Contract (Local Authorities Edition) the Contract Administrator fixes a later completion date the Employer shall pay or repay to the Contractor any amounts recovered, allowed or paid under the foregoing clause for the period up to such later completion date.

Special Conditions:

Tenderers are expressly directed to note that the property will/will not* be occupied and the Contractor will be deemed to have allowed for all costs arising from the following:

1. The provision of adequate site security both during and outwith working hours.

2. Special care required in protecting any persons working within or visiting the premises during the period of works, including the erection and removal of temporary fencing, guard rails, signs, etc or other satisfactory means as required.

3. Protecting the site, existing structure finishes, fittings, items of equipment, etc. of the building from any damage caused by the carrying out of the works and for making good any damage caused by lack of such special care and attention.

4. No burning of rubbish on site will be permitted and the Contractor will be responsible for removing his rubbish from the site on a daily basis. No undue accumulation of rubbish will be permitted.

5. Smoking will not be permitted on site.

6. Storage of materials, plant and equipment within the premises will not be permitted and areas for storage and temporary buildings, etc. must be agreed with the Contract Administrator before commencement of the works, and the Contractor must include for reinstatement on completion of these areas, and all other damage caused by the execution of the works.

7. The site of the works is often outwith the site boundary and the work must proceed with the minimum possible disturbance to the public and adequate notices and measures for their protection is expected. The use of radios, etc will not be allowed.

8. The Contractor will be deemed to have allowed in his rates for all costs incurred to comply with the completion dates including any continuous working over Trades and other holiday period, any overtime working which the Contractor considers necessary to ensure completion in accordance with the programme and therefore no payments for overtime working will be considered unless authorised in writing by the Contract Administrator.

9. The Contractor must agree a detailed programme of the works prior to commencement on site.

10. Site storage shall be agreed on site with the Contract Administrator prior to commencement and must take the form of a safe and secure lockfast enclosure with suitable signage, warnings, lighting as required. During working hours the store must be made lockfast at all times when not in use and without the presence of a Contractors employee.

11. The Contractor must provide/arrange for toilet and sanitary facilities for his employees as the use of amenities within the property will not be allowed.

12. All Contractors employees must check in and out on arriving and leaving site at the appropriate check point.

13. The provision of tenant liaison, civility and adequate notice is required of the successful contractor.. A post-card or similar notice must be delivered to each address giving seven days warning of work at or near each home listed in the documents.

14. Working Hours:

The normal working day is 8.00am to 5.00pm, Monday to Friday, although the Contractor may work outwith these hours to complete the installation should the Contract Administrator and the Clerk of Works and/or a particular occupier so agree.

No additional costs due to overtime working will be paid for by the Employer unless that overtime has been instructed in writing by the Contract Administrator and he has clearly stated in writing that the additional cost will be borne by the Employer. Any overtime thus authorised will be based on the standard time rates and paid net.

15. No drawings are issued with the Tender and the Contractor is deemed to have visited all sites.

The Contractbr shall carry out and complete the works described by or referred to in this specification with due diligence and a good workmanlike manner and in every respect to the satisfaction of the Contract Administrator and Clerk of Works.

The Contractor shall at all reasonable times keep engaged on the works a competent person in charge and any instructions given to him only by either the Contract Administrator or Clerk of Works shall be deemed to have been issued to the Contractor.

The Employer is concerned to ensure that staff employed by the Contractor are suitable to be employed on sites where they are likely to come into contact with persons under the age of 18 or other persons who may for any reason be considered vulnerable by the Employer. The Contractor shall be responsible for informing the Contract Administrator if any of the staff employed on the site have been convicted of a criminal offence prior to the employee or employees in question being allowed access to the site or in the event of an existing employee being convicted of a criminal offence. The Contractor must disclose to the Contract Administrator full details of all convictions of staff to be employed on the site, including sentences imposed, which are not spent convictions for the purposes of the Rehabilitation of Offenders Act 1974. The Contractor shall keep the Contract Administrator fully informed about industrial relations and give the maximum possible advance warning of prospective industrial action by his staff or by his suppliers of goods and services.

The Contractor shall ensure that his staff whilst on site:

a. Do not attend work under the influence of alcohol and/or illegal substances.

b. Do not consume alcohol and/or illegal substances.

c. Do not have in their possession alcohol and/or illegal substances.

d. Are strictly forbidden to bring onto site any unauthorised persons or animals during such times as their attendance is in connection with their duties under this contract.

e. Shall not authorise removal of or receive any material, furniture, equipment and/or product or stationery belonging to or consigned to the Employer.

f. Shall not remove, borrow or lend any property or equipment belonging to or consigned to the Employer.

g. Shall not read, copy or remove for any reason any file, correspondence, photographs, literature or any other document of the Employer.

h. Observe a normal standard of discipline and any such staff causing distress to site users, visitors or other Contractor's staff or colleagues by aggressive behaviour, actions or choice or language will be required to leave the site.

Any breaches of the foregoing will lead to that particular employee( s) of the Contractor being removed from the site. The future role of any such employee(s) in connection with the contract will be determined by agreement between the Contract Administrator and the Contractor.

The Contractor shall not employ on the works any person who shows active signs of, or who is under treatment for any infectious or communicable disease, or who is a known carrier of any such disease.

Securitv

The Employer will not accept any liability in respect of the theft, loss or damage to personal property of the Contractor or the Contractor's staff however caused. The Contractor shall draw this fact to the attention of his staff engaged in or about the provision of the works.

The Contractor shall at all times ensure that his vehicles and those of his suppliers are supervised or locked while on Council property.

Identity Cards, etc.

The Contractor shall provide and ensure that his-staff wear at all times photo identification cards dated and signed by the bearer in a form approved prior to the commencement of the contract by the Contract Administrator. It is an essential condition of the contract that all the Contractor's staff must be in possession of an appropriate photo identification card prior to the commencement date. Any person who is not in possession of a valid identity card shall be refused admittance to and/or be required to leave the site by the Contract Administrator/Clerk of Works. After the commencement date new starts will be permitted admittance for a period of three days only on production of a valid temporary identity card.

The provision of identification cards required in terms of this clause shall be at the sole expense of the Contractor.

Requirements to Avoid an Outbreak of Fire

The Contractor shall comply in all respects with the Health & Safety at Work Act 1974. In addition the Contractor must allow for any special requirements necessary to avoid an outbreak of fire.

Approval must be obtained from the Contract Administrator prior to commencing any works or using any equipment involving naked flames or sparking. Where approval of the Contract Administrator been gained for the use of any such equipment the Contractor must ensure it is only operated for the minimum time possible.

Description of the Site

The site comprises each individual house within the Contract and any adjacent areas externally where work will be detailed within the documents and such areas designated for site compounds etc. Access to the site is by the main public roads and access to the working areas shall be limited to those paths, garden areas, etc necessary to carry out operations in a workmanlike manner

Programming the Works

The project is described by population centres and the Contractor MUST finish all work in one area before moving to the next. These are seen as Perth City, Scone and the Carse of Gowrie.

PREAMBLE

GENERAL

Proprietary goods and materials: Where goods or materials of a particular manufacture are stated the rates shall be held to include for the specific goods or materials. Similar goods or materials of a different manufacture may be used in the works, if approved in writing by the Architect/Contract Administrator. The term "or other approved" shall therefore be implied wherever proprietary goods or materials are specified. Where a Contractor proposes to base his tender on similar goods or materials to those specified he shall obtain approval prior to submitting his tender.

The term "as described": Although the term "as described" is not used in the headings and item descriptions governed by these preambles this shall be implied and the rates shall include for materials and workmanship as described in these preambles.

The terms 'Approved' and 'Approval': Where the term 'approved' or 'approval' is used in the context of the use of materials being so approved by, or requiring the approval of, the Architect/Contract Administrator such terms shall be held to mean that permission has been granted by or permission must be sought from the Architect/Contract Administrator for their use in the Contract Works. The granting of permission by the Architect/Contract Administrator shall not relieve the Contractor from his duty to ensure that materials comply with the terms of the Contract.

Reference to British Standards and Codes of Practice: Where products and/or workmanship are required to comply with a relevant British Standard or Code of Practice the products and/or workmanship standards of other European Community (EC) Member States shall be deemed to satisfy such requirements if they meet national standards of another Member State (or an international standard recognised in another Member State) which offer equivalent guarantees of safety, suitability and fitness for purposes.

Amendments to British Standards and Codes of Practice: British Standards and Codes of Practice quoted in these preambles include all revisions and amendments made on or before Base Date.

MATERIAL

Generally

a) The contractor shall use only the brands and types of paint which are detailed below. The paints shall be brought to the site in the manufacturer's sealed container and shall be used strictly in accordance with the manufacturer instructions. No adulteration of materials will be permitted.

b) Primers, sealers and undercoats are to be obtained from the same makers as the finishing coats, and the special primers and undercoats advised by the makers are to be used in connection with e.ach different brand or material upon which it is applied.

c) The final choice of paint and colour is to be made by the Contract Administrator

COLOURS

The colours to be used in the execution of internal works are those as listed in the Schedule of Colours. Colours to be used in the execution of external works shall be notified by the Contract Administrator at

TURPENTINE

a) All turpentine shall be genuine gum spirit or American turpentine.

b) White spirit may be used in lieu and comply with BS245. <

WATER

The Contractor is to make provision for and pay all charges for water required on the premises, which shall be clean water.

SAMPLING AND TESTING

Sample for testing may be taken from the sealed containers or from the workman's kettles on the works. In addition, the Contract Administrator may require that unopened sealed containers be set aside for subsequent use.

Where such tests shows that, through the material taken from the unopened containers is in accordance with the specification, the material in workmen's kettles is unsatisfactory, any work coated with such unsatisfactory materials all be re-executed. Likewise any work on which the paint is found to be unduly thin shall be prepared again and repainted, all to the satisfaction of the Contract Administrator.

In the event of it being found that the work complies with the specification, then the cost of such testing will be allowed as an extra to the contract, if work is found not to comply with the specification then this work will be re-executed at the Contractor's expense.

WORKMANSHIP The work to be executed should be carried out by first class tradesmen only.

All brushes, paint rollers, kettles etc., used in the carrying out of the work shall be clean and shall be thoroughly re-cleaned before being re-used for a different type of material.

All old and irregular site lines on glass are to be removed before painting and all work is to be neatly cut in coming over glass to form new lines.

All liquid paints shall be thoroughly stirred to a uniform consistency when containers are opened and before being transferred to paint kettles.

No thinners, dri;~rs ur other paint additives shall be added to the paint unless permitted by the Comract Administrator. Emulsion paint shall be thinned as per the manufacturer's printed instructions:c Any paint showing bittiness in application shall be strained through fine gauze.

The mixing of different paints together shall not be permitted.

PREPARING All surfaces shall be thoroughly prepared and shall be clean, free from loose and powdery materials and sufficiently dry for subsequent decoration and shall comply to BS6150: 1982

a) If the surface to be stripped cannot be primed within the same working day then the work shall not be commenced.

b) All materials burned off, paint removed, or scraped should be removed from the site and surrounding areas left clean and tidy.

c) All ironmongery and door furniture is to be kept free from paint splashes at all times and on completion of work cleaned to the satisfaction of the Contract Administrator.

PROTECTION Data sheets must be provided to catch paint splashes. Every effort must be made to avoid soiling or damaging the tenant's furnishings.

The Contractor shall be responsible for the protection of fittings, floors, paving, glass, ironmongery, road signs, contents of gardens, work not included in the Contract, adjoining buildings and property. "Wet Paint" notices shall be clearly displayed on all surfaces liable to contact by the general public. Any damage caused to the above shall be remedied by the Contractor at his own expense.

CLEARING AWAY

a) Surplus material, broken glass, empty containers etc, are to be cleared away as the work proceeds and the premises and sites are to be left clean and in proper order on completion. Paint spots to be removed.

b) Protection ofladder ends must be provided when working on vinyl or emulsion surfaces.

GLAZING Any panes of glass cracked or compound broken down are to be reported to the Contract Administrator prior to the commencement or work.

DEFECTIVE GLAZING COMPOUND Defective glazing compound shall be hacked out, the rebates re primed and the glazing made good with an approved glazing compound.

METAL GLAZING MASTIC Metal glazing mastic is to be used for re glazing in metal casements.

IRONMONGERY All door furniture shall be removed from existing door prior to painting and replaced afterwards, having been cleaned and lightly oiled.

STORAGE All materials on site are to be safeguarded from extremes of temperature, adverse weather conditions, damage or theft. All volatile materials with a low flash point must be stored at a safe distance from any existing buildings.

The Contractors is to provide his own store for the material used in the works and is to arrange for the protection thereof. Under no circumstances will the contractor be permitted to store materials, plant, scaffolding, tools or appliances within the property without the prior written consent of the Contract Administrator.

APPLICATION No paint is to be applied during foggy, frosty or inclement weather not upon any surface where there is moisture content exceeding that as specified by the paint manufacturer or when the ambient temperature falls below below 5oC or when the relevant humidity exceeds 80%.

All paint is to be applied by brush; rollers may be used for ceilings and walls only. All work should be priced for this method only.

WOODWORK PREPARATION AND FINISHING GENERALLY AU surfaces specified are to be washed with an approved solution, rubbed down with waterproof abrasive paper to expose a clean smooth and level surface and rinsed off with clean water, allowed to dry and prime any areas where the paint is defective with Aluminium wood primer, being followed with tinted undercoat and apply one coat undercoat and one coat gloss finish in approved material.

WOODWORK- EDGES OF DOORS Particular attention is to be paid to the preparation and treatment to all edges of outward opening doors including "up and over" garage doors.

VARNISHED WORK All varnished woodwork to be washed off as previously specified, filled with "Sikkens GUPA" stopper or equal and approved, rubbed down, dust off and apply two coats polyurethane varnish.

JOINER PREVIOUSY TREATED WITH PRESERVATIVE STAIN All woodwork to be washed down, cracks filled with tinted filler, prepared and given two coats of semi­transparent/opaque preservative.

METALWORKPREPARATION AND FINISHING a) All metal casements, frames, balcony railing etc, are to be washed with approved solution, rubbed down to a smooth surface with waterproof abrasive paper, rinsed with clean water and allowed to dry, touch in bare metal with metal primer, being followed with tinted undercoat and apply one coat undercoat and one coat gloss finish.

b) Note: Where it is found the existing paint surface is loose and flaking, the whole of that section shall be removed, in an approved manner, to the return of that section.

c) All loose scale, rust and surfaces where rust has formed beneath the existing paint fill are to be thoroughly stripped and the metal work cleaned by the use of a wire brush and coarse abrasive paper, apply one coat metal primer to all bare surfaces, two coats undercoat (first coat to be tinted) and one coat gloss finish.

d) Metalwork not previously painted is to be cleaned down, prepared and painted with one coat primer as specified, two coats undercoat (first coat to be tinted) and one coat gloss finish.

e) Particular attention is to be paid to the stripping, scraping and rubbing down of old paint where there is a build up on the meeting faces of casement, fanlights etc.

METALWORK-GUTTERS INSIDE All metal gutters are to be cleaned out and dried and then painted inside with one full coat of bituminous paint.

METALWORK- SOIL, VENT & WASTE PIPES, RAINWATER PIPES & GUTTERS Note: Care is to be taken to paint behind all soil, rainwater and other downpipes.

The cleaning of gutters and downpipes is to be carried out prior to commencement of paintwork to external walls.

GALVANISED METAL SURFACES To be prepared and primed with Calcium Plumate where overcoated with oil base decoration and applied all in accordance with the manufacturer's specification.

WALLS AND CEILINGS (EMULSIONED) a) All previously painted emulsioned walls and ceilings to be washed down and all holes and cracks in plaster made good using an approved filler. Surfaces to be rubbed down to achieve a true and level finish.

b) Apply two coats of matt vinyl allowing four hours between coats or as recommended by the manufacturer.

PLASTIC GUTTERS, RAINWATER PIPES, SOIL AND VENT PIPES, WASTE PIPES ETC All gutters, rainwater pipes, soil pipes and waste pipes in plastic material should be washed clean in a detergent solution and wiped dry (including internal surfaces or gutters).

PRIMERS Priming coats shall be applied by brush to give a coat if adequate thickness with no misses and to satisfy the porosity of the surface. The priming shall be well worked into the surface, joints, angles and other places where moisture is likely to collect.

Priming coats applied off-site shall be touched up or re-primed as necessary before undercoating.

Where there is doubt as to the adequacy of the primer to fully satisfy the porosity of the surface, the Contract Administrator should be informed.

UNDERCOATS Undercoats shall be applied evenly over the whole surface to give a solid film, care being taken to avoid uneven thickness of paint at edges and angles.

FINISHING COATS Finishing coats shall be applied evenly over the whole surface to give a solid film free from brush marks, sags, runs, orange peeling or other defects.

DRYING OUT The Contractor is to provide everything necessary for drying and controlling the humidity of the works and pay all costs in connection therewith for the internal of buildings during the execution of the works, and any work that blisters, blooms, crazes, cracks, lifts or flakes shall be removed and repainted at the Contractor's expense.

POWERWASHING WALLS To clean walls only: -

After application ofbiocide, wash off with a pressure not more than 500PSI and the head of lance to be at least 500mm away from the surface at all times.

To remove loose and flaking coatings: -

Powerwash using necessary pressure to remove all loose and flaking coating back to a sound surface.

FINISH All windows, doors etc, are to be checked on completion of works to make sure that they move and open freely after painting. Remove all temporary markings, coverings and protective wrappings unless otherwise instructed.

Clean all glass both sides and remove all splashes, deposits, rubbish and surplus materials on completion of works.

STOPPING Stop and fill all cracks, crevices etc, after priming coat has been applied with propriety oil based filler (excluding linseed oil putty). Tub down and paint as previously specified.

NOTICES AND INSPECTIONS a) The Contract Administrator shall give notice to the Contractor or his representative to leave open for inspection such items of work as may be requested at his discretion.

b) Any defects must be put right and approved before the Contractor may proceed to the next stage.

c) The number of dwellings in which work may be commenced shall be as directed and agreed by the Contract Administrator or his representative. The practice if moving from house to house in different parts of the site or on different sites with work at varying stages on houses scattered about the site will not be permitted.
