We now know that the ‘live’ Essentials Seminars are still very much in demand, so with that in mind, the Seminar Programme now includes two dates for each of the essentials seminars, in different locations within the UK. The essentials packages for Air Quality, PPC and Contaminated Land will again each have all 5 modules available in the membership year to enable officers to obtain qualifications and competency within one year. We received a great response from our questionnaire on your training requirements, so thanks to everyone who took the time to reply. Contaminated Land Management: EMAQ+ and Land Quality Management Ltd (LQM) are working in partnership to offer the ‘Essentials of Contaminated Land Management (CLM)’ training course for local authority officers. This structured package of training is separated into 5 separate units. This training opportunity is intended as a foundation course for officers with land contamination related responsibilities to demonstrate that they have the knowledge necessary to operate under the Part 2A of the Environmental Protection Act 1990 and relevant requirements of the Town and Country Planning Acts. This year we will be focusing on the Essentials modules only after receiving feedback from our members from a recent survey we mailed out which asked for more Essentials courses. The advanced seminars in our 2015/16 were not very well attended so this was another factor to remove the advanced seminars from our program for 2016/17. Air Quality: The 5 core essentials modules will be updated to reflect the updated Local Air Quality Management Policy and Technical Guidance. However, to address immediate needs, we offer a dedicated one day seminar to highlight the changes and new requirements that the updated guidance brings. By popular demand we will update the Planning and Impact Assessment seminar, which will draw upon case study examples of air quality impact assessments. We also offer biomass training which focuses on how to appraise a planning application for a biomass plant. New to this year are several more practical sessions on how to use the LAQM Excel tools that requires use of laptops, to help in analysing monitoring data and quantifying the impact of measures. Pollution Prevention and Control: In addition to the PPC Essentials course, this year based on your feedback, you indicated that the largest number of Authorities would welcome an advanced course on dealing with Dust

monitoring and nuisance, Solvent-using activities and Emissions Monitoring. More details about each of the five seminars is available on the EMAQ+ website, download the full Essentials of PPC – An Introduction to Environmental Permitting Syllabus (PDF) The team is always looking to cover topics that are of particular relevance to delegates (and we welcome further feedback). This year we will continue to deliver the essentials seminars bolstered with advanced courses identified from the feedback. Specifically we plan to provide seminars on:

regulation of solvent activities,

emission monitoring (using crematoria as an illustration as these installations have a very wide range of monitoring needs) and,

regulation of dusty processes.

We also plan to include an update on EPR installation regulation to look at recent changes in guidance and regulations for industrial installations.

IAPSC: As in the past year, EMAQ+ subscribers are able to use EMAQ+ places for IAPSC bookings. IAPSC is a forum for the exchange of information and best practice in the field of air quality measurement and management in the UK – see http://www.iapsc.org.uk/ for programme details.

The next conference is booked for Monday 13 June 2016, at SOAS University of London. This venue is near to Russell Square Tube Station in Central London. The Brunei Gallery Lecture Theatre is tiered with an adjacent open area which we use for refreshments and exhibitors.

Webinar News

We acknowledge that some of the Webinars that were introduced into the 2015/16 Programme had quality issues, and some delegates had problems viewing some of the webinars because of IT problems within their LA.

Going forward, we are re-developing and upgrading the PPC & LAQM webinars for the new Subscription year, so that they will greatly improve the training experience for the user and make it more enjoyable. These webinars are detailed in the 2016/17 Seminar Programme. An example of the new webinars will be available on the EMAQ website shortly.

We have also reduced the cost of webinars by introducing 2 new webinar packages – for 3 and 5 places.

NEW VENUES We have added 2 new venues for 2016-17 Ricardo’s London office. The seminars will be held in the Conference Suite, the office is located very close to Paddington Station. Our Oxfordshire Office will host a number of the advanced seminars, the Oxfordshire office is based in Harwell which is located just off the M4/A34 and there is parking available. If you travel by public transport, Didcot Parkway train station is only a short bus ride & the bus stops outside the building, the buses run every 15 minutes. We will be providing a free return taxi from this office to the train station. We hope that this location will be more accessible to local authorities from the South West region.

PRICE INCREASE We recognise that Local Authority budgets are constantly being reduced, however, as prices were held in 2015/16, we will need to increase the subscription fees for 2016-2017 by 2%, details on page 10. However, we have reduced the cost of the Webinars and providing 2 new packages (also see page 10).

QUALIFICATION TOOL

We are hoping to develop a new Local Authority Qualification Tool that will enable you to look up how many credits and qualifications your local authority has gained through the EMAQ syllabuses. Each time an officer from a local authority completes a knowledge check exam, they earn one credit for that module within the syllabus and these will be displayed on the EMAQ-OPA website. Once 5 credits have been gained, one for each of the 5 modules in the syllabus, officers are eligible to take the OPA (Online Proficiency Assessment) exam.

Essentials of LAQM – Modules 1 – 5 Seminars & Webinars - see programme for dates & venues

Biomass & Air Quality Training – June & December 2016 – Oxford The training day will comprise of a combination of theory in the morning which will describe some of the scientific principles behind the issue of biomass combustion, which will lead into the afternoon session which will include practical sessions on the application of the biomass calculator, stack emission calculator and also example case studies. Each delegate will need to bring their own lap top with them as they will need to use this on the day.

New Air Quality Technical & Policy Guidance 2016 – April & May 2016 – Birmingham, London, Bradford and Oxford These training days will set out the changes to the LAQM policy and technical guidance including when reports are to be submitted to Defra or the Devolved Administration and what these should contain. We will discuss the change in emphasis to action planning and public health and what this means for your day to day air quality management work, including monitoring and attempts at quantifying the impacts of measures.

Environmental Data Analysis in Excel (Half day) Practical – June 2016 – Bradford This seminar is intended as a gentle refresher or first taste in using Excel for environmental data analysis. Using real data we will explore the use of formulas and cover how to generate plots for inclusion in reports. In the later part of the seminar we will introduce statistics and show how to make calculations of mean, median, error and percentiles in a data set. We’ll cover linear regression using real examples and explore the relationship between air pollutants in the atmosphere from hourly and annual average measurements. The most important LAQM Excel tools will be covered as well including the diffusion tube bias sheet and the NOx to NO2 calculator. Throughout the session we will be able to offer practical tips on data handling in Excel and delegates are encouraged to bring some data that can be used for a short practical session we will use to close out the seminar.

Planning & Impact Assessment – September 2016 – Oxford This seminar will provide an introduction to air quality management issues of relevance to the UK planning system and will focus on the development of local planning policy to encourage the inclusion of mitigation measures as standard design practice. Examples of Local Planning Policy and guidance will be examined. Methods to calculate the contribution to Section 106 or Community Infrastructure Levy will be shown. Examples of planning guidance will be presented.

Use of Excel Tools for AQ Management (half day) Practical – November 2016 - Oxford This seminar will cover the practical application of Microsoft Excel based tools provided by Defra and the Devolved Administrations for the purposes of air quality management. We will focus on tools provided for handling and adjusting NO2 diffusion tube data, converting modelled NOx to NO2 at roadsides, characterising background concentrations and calculating emissions for basic road traffic scenarios. The session will provide plenty of opportunity for practising the use of these tools to provide a solid grounding in their use by Local Authority officers. EMISSIONS MONITORING

Essentials of PPC – Modules 1 – 5 Seminars & Webinars - see programme for dates & venues

Noise Training & BS4142 Competency – May 2016, Feb & March 2017 – Bradford, London & Oxford This seminar will provide an update to those who carry out noise monitoring or noise evaluation work. It will provide a basic introduction to noise measurement and control. It will also provide a detailed review of the new BS4142:2014 standard focussing on the areas that have changed since the previous iteration in 1997. The seminar will highlight the intended uses of the new standard, and place those into the context of local authority regulation using examples of complaint investigation for statutory nuisance, and use as a planning evaluation tool. Finally the seminar will review a report, looking at the issues of uncertainty, and demonstrating competency in particular. This seminar is intended to be a pragmatic look at the revision of a much used standard.

Crematoria – November 2016 & January 2017 – Oxford The seminar will address the complex aspects of monitoring and controlling emissions from cremators and associated activities. The presenters will draw on available guidance and good practice identified by themselves and the delegates. Permit conditions will be developed and examined which will provide regulators with a basis for permitting cremators in their own areas. Delegates can bring example permits for discussion and will work with process guidance note (PG 5/2 (12)). The seminar is aimed at staff who are currently involved in LA-PPC and who have attended the Essentials of PPC Course or have equivalent knowledge and experience. Attendees should expect to make a technical input to discussion and group exercises.

Dust – Nuisance and Sampling – January 2017 – Oxford The purpose of this seminar is to examine the range of dust related issues that delegates may need to manage or regulate, via planning, permitting or nuisance legislation. We will review current guidance on dust, addressing the different approaches taken to managing dust. The seminar will draw on a series of case studies (construction, quarry, process emissions etc) to explore what is good practice. Topics covered will include: dust nuisance and how it is assessed, and the use of dust management plans.

Solvents – March 2017 - Oxford The seminar will examine the provisions for solvent-using activities in the EU Industrial Emissions Directive (IED - the successor to the Solvent Emissions Directive) and UK implementing regulations. We will define what volatile organic compounds (VOC) are according to EU and UK legislation, and look at compliance options for chapter V of IED. In particular we will look at what emissions there are and how they are controlled using contained and fugitive emission limits. The seminar will also examine the derivation of VOC target emissions (for use with solvent reduction schemes) and how compliance can be demonstrated. It will also examine the structure of solvent management plans and a range of possible solvent emission control strategies - including both solvent reduction schemes and end of pipe solutions. The seminar will also examine the various methods by which the inputs and outputs of solvent management plans can be obtained and refinements developed. In addition, the seminar will contain example exercises and break-out working, whereby delegates can gain useful experience and knowledge of the practical and administrative aspects of regulating VOC emissions from solvent using processes. We will also look at an example which falls outside the normal requirements for IED and look at the concept of derogation.

Update on Environmental Permitting Regulations (EPR) – March 2017 - Oxford In this half day (pm) seminar we will examine some of the changes which have been made to the Environmental Permitting Regulations and/or associated guidance regarding LA-PPC and LA-IPPC. The exact scope of the seminar is not yet determined but is likely to include an overview or summary of changes in treatment of waste oil burners, energy efficiency directive requirements implemented through EPR, relevant new BAT Conclusions and updates to process guidance notes. Also potential implications of the recent Medium Combustion Plant Directive (if implementation mechanism has been agreed).

Value for Money – subscribing is the most cost effective way of paying for training – this includes the

cost of each delegate’s seminar place, which is a full day’s training from our very experienced trainers, a CPD & delegate pack for reference and access to our online reference material. The online Knowledge Check follows each seminar to test your understanding of the seminar content. On successfully passing the Knowledge Check, a credit is gained towards that particular Essential syllabus, this year we would like to register everyone’s credits on-line with their permission to show their local council’s competency.

The EMAQ+ website is a resource that enables subscribers to access the training materials used for all the courses, view model permits, and follow hot links to key documents. It also provides the portal that enables users to register for the Essentials courses and undertake on-line assessments that can lead to certification.

When you log in to the Members section of the website you can see at a glance how many seminar places you have available to use and can e-mail us from the site if you have a query.

The on-line booking facility for subscribers is fully operational. If you or a colleague were unable to get to a seminar this year, then the presentations can be found by clicking on Technical Materials then Seminar Presentations.

Attendees will be provided with seminar booklets via email, in advance, and the delegate will then have a choice as to whether to download and print their copies or use laptops – whatever their preference. Consequently, it is imperative that you include your email address on all booking forms and other correspondence you send to us.

On completion of each of the 5 seminars within each course (Essentials of LAQM, Essentials of PPC and Essentials of Contaminated Land Management), you can register on the EMAQ+ OPA (Online Knowledge Checks and Proficiency Assessment) website to take the corresponding Knowledge Check. This Knowledge Check will test your knowledge of all aspects of the seminar you have attended. Once you have attended all 5 seminars, taken and passed the 5 corresponding Knowledge Checks, you will be eligible to take the online Proficiency Test for that course. The Proficiency Test covers all aspects of each syllabus and Candidates passing the Proficiency Test will be awarded a:

- Certificate in Local Air Quality Management - Certificate in Integrated Pollution Prevention and Control - Certificate in Contaminated Land Management There is an additional £150.00 fee to take the Proficiency Test and Candidates successfully passing the Proficiency Test will receive a Certificate, be fully accredited and have their name and local authority listed on the website “Wall of Fame”

To achieve the best possible value for both your money and time, it would greatly help us if participants tell us in advance if they are unable to attend a seminar and no-one else can take their place. It saves both money on catering and time if Trainers are not left waiting for all the participants on the list to arrive. We should like to draw your attention to the Cancellation policy which is stated in the Booking Terms and Conditions for all EMAQ+ seminars; “Cancellation without 48 hours prior notice will render the delegate liable for the full fee/loss of subscription place. Substitutions can be made but please let us know in advance.” EMAQ+ reserves the right to cancel or reschedule a seminar session should take up be less than the minimum number of participants per room booking – typically this is 10 but does depend on venue. Should a seminar session be over-subscribed then EMAQ+ reserve the right to limit the number of places booked per subscriber. If appropriate, alternative places will be offered at other venues in both instances.

EMAQ+ SUBSCRIPTION CONTRACT - TERMS AND CONDITIONS

1. Law. Acceptance of this offer constitutes a Contract, made in England and subject to the laws of England and the sole jurisdiction of the courts of England, between the Subscriber and Ricardo Energy & Environment a trading name of Ricardo-AEA Ltd (“Ricardo Energy & Environment”).

2. Payment Terms. All charges payable to Ricardo Energy & Environment are due within 30 days from the date of the invoice and must be paid in full. The Subscriber agrees to pay and bear any sales, value-added, withholding or other similar taxes imposed by applicable law that the Subscriber must pay based on the Services.

3. Rights Granted and Ownership. Upon payment of the subscription, the Subscriber will have non-exclusive, non-assignable, royalty free licence to use for Subscriber’s internal business operations, anything developed by Ricardo Energy & Environment and delivered to the Subscriber under this Contract. The Subscriber’s right to use any Ricardo Energy & Environment trademark and/or logo is limited to such purposes; any other use requires the prior written consent of Ricardo Energy & Environment. Ricardo Energy & Environment and its subcontractors retain ownership of and all intellectual property rights to anything developed and delivered under this Agreement.

4. Warranty, Disclaimer and Exclusive Remedy. Ricardo Energy & Environment warrants that the Services will be provided with reasonable care and skill consistent with industry standards. The Subscriber must notify Ricardo Energy & Environment of any warranty deficiencies within 30 days from performance of the Services. For any breach of the warranty, the Subscriber’s exclusive remedy, and Ricardo Energy & Environment’s entire liability, shall be the re-performance of the deficient Services, or if Ricardo Energy & Environment cannot substantially correct a breach in a commercially reasonable manner, the Subscriber may end the relevant Services and recover the fees paid to Ricardo Energy & Environment for the deficient Services. To the extent permitted by law, this warranty is exclusive and all other warranties, conditions or terms whether express or implied are expressly excluded, including warranties or conditions of merchantability, satisfactory quality and fitness for purpose.

5. Intellectual Property Rights Indemnity. If a third party makes a claim against either the Subscriber or Ricardo Energy & Environment (as the case may be “Recipient”) that any information, specification, data, or material (“Material”) furnished by either Ricardo Energy & Environment or the Subscriber (as the case may be “Provider”) and used by the Recipient infringes its intellectual property rights, the Provider will indemnify the Recipient against the claim if the Recipient (i) notifies the Provider promptly in writing, not later than 30 days after the Recipient receives notice of the claim (or sooner if required by law); (ii) gives the Provider sole control of the defence and any settlement negotiations; and (iii) gives the Provider the information, authority, and assistance the Provider needs to defend against or settle the claim. If the Provider believes or it is determined that any of the Material may have infringed a third party’s intellectual property rights, the Provider may choose to either (i) modify the Material to be non-infringing, (ii) obtain a license to allow for continued use, or (iii) if these alternatives are not commercially reasonable, the Provider may end the license for, and require return of the applicable Material and refund any fees the Recipient may have paid for it. If an infringement claim materially affects Ricardo Energy & Environment’s ability to meet its obligations under this Contract, then Ricardo Energy & Environment may, at its option, upon 30 days prior written notice, terminate the Contract. Ricardo Energy & Environment will not indemnify the Subscriber if (i) it alters the Material or uses it outside the scope of this Contract, if the infringement claim could have been avoided by using the unaltered version of the Material and/or (ii) to the extent that an infringement claim is based upon any information, specification, instruction, data, or material not furnished by Ricardo Energy & Environment or the combination of Materials with any products or services not provided by Ricardo Energy & Environment. This clause provides the parties’ exclusive remedy for any infringement claims or damages.

6. Limitation of Liability. Nothing in this Contract shall limit either party’s liability for personal injury or death caused by its negligence, or its liability in the tort of deceit. Neither party shall be liable for any indirect, incidental, special, punitive, or consequential damages, or any loss of profits, revenue, data, or data use. Ricardo Energy & Environment’s maximum liability for any damages arising out of or related to this Contract or Subscriber’s order, whether in contract, tort, or otherwise, shall be limited to the greater of fifty thousand pounds (£50,000) or the fees paid and payable under Contract. The parties each confirm that all the exclusions and limitations of liability set out in this clause are fair and reasonable having regard to all the relevant circumstances.

7. Termination. If either party breaches a material term of this Contract and fails to correct the breach within 30 days of written specification of such breach, the other party may terminate the affected services with five days written notice. Either party may terminate the contract upon written notice to the other party in the event that: (i) a proposal is made for a voluntary arrangement of the other party or any other composition scheme or arrangement is made with its creditors or a shareholders’ meeting is convened a petition is presented for the purpose of considering a resolution that it be wound up or a resolution for its winding-up is passed (other than as part of, and exclusively for the purpose of, a bona fide reconstruction or amalgamation) or a receiver, administrative receiver or similar officer is appointed over the whole or any part of its business or assets, or a moratorium comes into force or it is or becomes insolvent; (ii) the other party undergoes a change in control within the meaning of section 416 of the Income and Corporation Taxes Act 1988. Upon termination, the Subscriber must pay, within 30 days, all charges and expenses which may have accrued as well as all sums remaining unpaid for any Services received under this Contract, plus related taxes and expenses. Provisions that survive termination or expiration include those relating to limitation of liability, infringement indemnity, payment, and others which by their nature are intended to survive.

8. Cancellation. If we are unable to secure the necessary subscription renewals then Ricardo Energy & Environment reserve the right to cancel and refund any payments to members for the new subscription year, on a pro-rata basis.

9. Force Majeure. Ricardo Energy & Environment shall not be responsible for failure or delay of performance if caused by: an act of war, hostility, or sabotage; epidemic or pandemic; act of God; electrical, internet, or telecommunication outage that is not caused by the obligated party; government restrictions (including the denial or cancellation of any export or other license); or other event outside the reasonable control of Ricardo Energy & Environment. Both parties will use reasonable efforts to mitigate the effect of a force majeure event. If such event continues for more than 90 days, either party may cancel unperformed services upon written notice. This clause does not excuse either party’s obligation to take reasonable steps to follow its normal disaster recovery procedures or the Subscriber’s obligation to pay for services provided.

10. Third Party Rights. Ricardo Energy & Environment is an independent contractor and each party agrees that no partnership, joint venture, or agency relationship exists between the parties. Each party will be responsible for paying its own employees, including employment related taxes and insurance. A person who is not a party to this Contract has no rights under the Contract (Rights of Third Parties) Act of 1999 to enforce any term of this Contract but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

11 Assignment. The Subscriber may not assign this Contract or give or transfer any Services, deliverables or an interest in them to another individual or entity.

12. Entire Agreement. The Subscriber agrees that this Contract and the information which is incorporated into this Contract by written reference is the complete agreement for the Services ordered by the Subscriber and that this Contract supersedes all prior or contemporaneous agreements or representations, written or oral, regarding such Services. Nothing in this Contract excludes or limits either party’s liability for deceit or fraudulent misrepresentation. If any term of this Contract is found to be invalid or unenforceable, the remaining provisions will remain effective. It is expressly agreed that the terms of this Contract shall supersede the terms in any purchase order or other non-Ricardo Energy & Environment document and no terms included in any such purchase order or other non-Ricardo Energy & Environment document shall apply to the Services. This Contract may not be modified and the rights and restrictions may not be altered or waived except in writing signed by authorised representatives of the Subscriber and Ricardo Energy & Environment.
