The Aprenda 3 reading subtests reflect current thinking about the ways in which good readers construct meaning with text and the ways in which students are taught to read. The reading subtests are designed to mirror the developmental, process-oriented nature of good reading instruction and thekinds of instructional materials used in exemplary programs.The Sounds and Letters subtest centers on auditory perception and visual discrimination/symbol perception, the building blocks for using sound-symbol correspondence to decode and encode words. Word Reading emphasizes relationships between word meaning and decoding skills at the target gradelevel, and Sentence Reading assesses students’ ability to comprehend single,simple sentences and two related sentences. The Reading Comprehension subtest uses three types of material to assessstudents’ reading abilities: literary, informational, and functional. Within eachtype of text, test items are constructed to measure the students’ skills in fourmodes of comprehension: initial understanding, interpretation, critical analysis,and reading strategies.

All passages in the ReadingComprehension subtest were written expressly for Aprenda 3by published authors and illustrators of Spanish children’s literature in the United States,Puerto Rico, Mexico, Spain, andCentral and South America. Theseauthentic selections create a levelplaying field for all students andreflect a variety of topics anddiverse cultural themes that appealto students of varying Hispanicbackgrounds, experiential levels,and interests.

Educators are formally recognizing the role of listening in literacy development, in learning in general, and in everyday life. In acknowledgment of the importance of listening, Aprenda 3 assesses both listening vocabulary and comprehension from kindergarten through grade 9. The vocabulary portion of the Listening subtest measures knowledge of wordmeanings. Tested vocabulary represents a carefully chosen sample of the typesof words that students at each grade are likely to encounter. Aprenda 3 assesses listening comprehension with dictated selections and questions. Listening Comprehension also parallels the ReadingComprehension subtest. Using literary, informational, and functional materials, this section of the Listening subtest measures the same modes of comprehension: initial understanding, interpretation, and critical analysis and strategies.

WritingThe direct writing assessment provides authentic information about students’productive skills in English (or Spanish). It requires a written response to a picture prompt. This subtest measures objectives that cannot be assessed with multiple-choice questions, such as appropriate and precise word choice,varied sentence structure, organization of sentences, and degree of fluency.

The Speaking subtest elicits a variety of discourse samples with efficient individually administered teacher-scored tasks. This subtest evaluates phonemic and linguistic accuracy, informational appropriateness, and overallintelligibility in the language. We make every attempt to maintainsufficient inventory to handle all routine orders without backorders. If a backorder occurs and you desirepartial shipment or would prefer thatwe hold your order until it can be filledin its entirety, please let us know.

4. Confirming Orders

Harcourt Assessment guarantees satisfaction with the physical qualityof its test materials. If materials are

damaged or defective, they may bereturned for exchange or credit at anytime. If not defective in manufacturing,resalable test booklets, answer documents, and accessory materialsmay be returned for credit within 90 days of the invoice date. Onlyunbroken, resalable packages will be accepted, and packages must show complete name, address, invoicenumber, and reason for return on allpaperwork.

All returns (except those resulting from shipment error or manufacturingdefects) will be assessed a 10%restocking fee.

Please observe these procedures toensure prompt handling:

Check your shipment upon receipt. Do not open packages; broken testpackages cannot be accepted for credit unless defective.

1. Acceptance of Terms and Conditions

Sales of test instruments, relatedmaterials, and services are based upon acceptance of the various termsand conditions and adherence to allpolicies described in this catalog.Purchasers agree to be bound to allterms and conditions by placing anorder for materials, signing HarcourtAssessment‘s Qualifications Form, aPurchase Order, a Test Order Form, anOrder for Scoring Services, or by partor total payment of HarcourtAssessment‘s invoice for any tests,materials, or services ordered. Nomodification or additions to these

terms and conditions are binding uponHarcourt Assessment unless previouslyagreed to in writing by an authorizedrepresentative of Harcourt Assessment.

2. Prices

All prices and terms are subject to change without notice and areexclusive of taxes and shipping andhandling charges. Terms are Net 30Days. No discount is offered for cash payments or prompt payment.

3. Taxes

If your account is not currently listedas “tax-exempt,” applicable state andlocal taxes will be added to yourinvoice. If you wish to be listed as“tax-exempt” for future purchases,send a copy of your tax-exempt certifi-cate to our Customer Service Center,Attn: Account Maintenance, P.O. Box708912, San Antonio, TX 78270-8912.

4. Shipping and Handling

Test materials are shipped by traceablemeans via ground delivery unless first class, air, or special delivery isrequested. Orders that include a specific delivery date will be treatedas authorizing air or special deliverycharges if accelerated shipping (or delivery) is needed to meet therequired date. A handling charge of 5% will be added to orders formaterials or scoring services to coverpicking, packing, and assembly costs.In addition, shipping charges will beadded. Together, these charges will belisted on your invoice as “Shipping andHandling.” Please allow 10 days fordelivery of test materials after wereceive your order.

5. Limited Warranty. HarcourtAssessment warrants that its products meet applicable professionalstandards and will be manufactured in usable quality. HARCOURTASSESSMENT MAKES NO OTHERWARRANTIES, EXPRESSED ORIMPLIED, INCLUDING WARRANTIESOF MERCHANTABILITY OR FITNESSFOR A PARTICULAR PURPOSE.REPLACEMENT OF MATERIALS, OR REFUND OF ALL OR A PORTIONOF THE PURCHASE PRICE (BASEDUPON THE SALABLE CONDITION OF THE MATERIALS), AT HARCOURTASSESSMENT’S SOLE OPTION AND IN ACCORDANCE WITH THEPRODUCT RETURNS POLICY CONSTITUTES THE PURCHASER’SSOLE AND EXCLUSIVE REMEDY, IN LIEU OF ALL REMEDIES ANDACTUAL, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR OTHERDAMAGES IN CONNECTION WITHTHE PRODUCT AND ANY USE ORMISUSE THEREOF. HARCOURTASSESSMENT WILL NOT, UNDER

ANY CIRCUMSTANCES, BE LIABLEFOR PURCHASER’S EXPENSES FOR DELAYS, FOR COSTS OF SUBSTITUTE MATERIALS, OR FORPOSSIBLE LOST INCOME, GRANTS,PROFITS, OR ANY OTHER SPECIALOR CONSEQUENTIAL DAMAGESTHAT MAY RESULT FROM USING A PRODUCT.

Some jurisdictions restrict certain limita-tion of warranties, so some or all of theabove limitations may not apply to you.

6. Confidentiality. Purchaseracknowledges and agrees the contentsof Harcourt Assessment’s tests mayconstitute trade secrets, which includeconfidential and proprietary material,information, and procedures. Purchaserwill not resell or otherwise distributematerials, or authorize or allow disclosure of the contents of a testinstrument protocol, including testquestions and answers, or normativedata, except under the limited circum-stances described in the section titled“Maintenance of Test Security,” or asotherwise contemplated in the manualassociated with the test. Purchaseracknowledges and agrees that the use or disclosure of trade secrets in a manner inconsistent with the provisions of this Agreement maycause Harcourt Assessment irrepara-ble damage for which remedies otherthan injunctive relief may be inade-quate. Accordingly, you agree that inany request by Harcourt Assessment toa court of competent jurisdiction forinjunctive or other equitable reliefseeking to restrain such use or disclo-sure, you will not maintain that suchremedy is not appropriate under the circumstances.

7. Maintenance of Test Security.Each person or institution purchasing atest must agree to comply with basicprinciples of minimum test security,including the standards described onpage 80: “Maintenance of TestSecurity and Test Use.”

8. Copyright Notice. Tests, test proto-cols, test items, norms, score reports,and other related materials of HarcourtAssessment are copyrighted. They arenot to be reproduced or transmitted inany form or by any means, electronic ormechanical, including photocopying,recording, or any information storageand retrieval system without permissionin writing from Harcourt Assessment.The reproduction of any part of HarcourtAssessment’s copyrighted tests andrelated materials in any way, whetherthe reproductions are sold or furnishedfree for use, is a violation of federalcopyright law. No adaptations, transla-tions, modifications, or special versionsmay be made without permission in

writing from Harcourt Assessment;users are advised that such adaptations,translations, modifications, or specialversions may affect the validity of the tests.

9. Protective Orders. Purchaseragrees to seek a protective order safe-guarding the confidentiality of testmaterials classified by HarcourtAssessment as C-level assessments ifPurchaser is required to produce suchmaterials in court or administrativeproceedings.

10. Limitation of Liability. IN NOEVENT WILL HARCOURT ASSESS-MENT BE LIABLE FOR DAMAGESARISING UNDER THIS AGREEMENT,OR OTHERWISE ARISING FROM THEORDER(S) CONTEMPLATED UNDERTHIS AGREEMENT, IN EXCESS OF THE AMOUNTS PAID FOR THE PROD-UCT(S) WHICH DIRECTLY CAUSED THE DAMAGE.

11. Force Majeure. Except for pay-ment obligations, nonperformance ofeither party shall be excused to theextent that performance is renderedimpossible by strike, fire, flood, act ofGod, war, governmental acts or ordersor restrictions, failure of suppliers, orany other reason where failure to per-form is beyond the reasonable controlof the non-performing party and notdue to its fault or negligence.

12. Notices. Any required noticesshall be given in writing to thePurchaser at the most recent contactinformation provided by Purchaser toHarcourt Assessment. We may sendyou notice by electronic mail as analternative to conventional mail.

13. Governing Law and Venue. ThisAgreement, each transaction enteredinto in connection with thisAgreement, and all matters arisingfrom or related to this Agreement(including validity and interpretation)are governed by, construed, andenforced in accordance with the lawsof the State of Texas, without refer-ence to any conflict of law principles.Purchaser submits to the exclusivejurisdiction of the federal and statecourts located in Bexar County, in theState of Texas.

14. Limitation of Claims. Purchasermust bring any action on any claimagainst Harcourt Assessment withinone (1) year following the date theclaim first accrued, or it shall bedeemed waived.

15. Export Law Assurance. If theproduct(s) ordered from HarcourtAssessment have been rightfullyobtained within the United States,Purchaser agrees and certifies thatneither the products nor any technical




data received by the Purchaser fromHarcourt Assessment will be exportedoutside of the United States, except asauthorized by the laws and regulationsof the United States.

16. Maintenance of Test Securityand Test Use. Each person or institu-tion purchasing a test must agree tocomply with these basic principles ofminimum test security:

1. Test takers must not receive testanswers before beginning the test.

2. Test questions are not to be repro-duced or paraphrased in any way.

3. Access to test materials must belimited to qualified persons with aresponsible, professional interest whoagree to safeguard their use.

4. Test materials and scores may bereleased only to persons qualified tointerpret and use them properly.

5. If a test taker or the parent of a childwho has taken a test wishes to exam-ine test responses or results, the par-ent or test taker may be permitted toreview the test and the test answers inthe presence of a representative of theschool, college, or institution thatadministered the test.

Such review should not be permitted inthose jurisdictions where applicablelaws require the institution to providea photocopy of the test subsequent toreview. If you are not certain of theeffect of the laws in your state, pleasecontact your state’s professionalorganization.

6. No reproduction of test materials isallowed in any form or by any means,electronic or mechanical.

7. Requests to copy any test materialsmust be in writing and directed to the:

8. Test materials may not be resold ordistributed for any purpose.

In addition to the above Terms andConditions of Purchase and Use,the following special Terms andConditions of Purchase and Useapply to the referenced products:

ELL PD PLUSThe following Terms of Purchase and Use apply to the use of: (i)Harcourt Assessment, Inc.’s (Harcourt)proprietary Stanford English LanguageProficiency Test (Stanford ELP); (ii)

an online professional developmentsolution subscription service (ELL PDPlus™), including any optional functionsand features, jointly owned byHarcourt and Co-nect Inc. and (iii) aproprietary online educational sub-scription service titled Co-nect ELLeXchange™ (ELL eXchange™) owned byCo-nect Inc. (Co-nect) and licensed toHarcourt.

LICENSE GRANT

Subject to these Terms of Purchase andUse, the Subscriber is hereby granted a non-exclusive, non-transferable, revocable, subscription-based license to access and use the ELL PD Plus andthe underlying ELL eXchange platformsolely for internal, educational, non-commercial purposes, for a one-yearperiod beginning with the date on whichthe Subscriber is provided access by Co-nect (Service Period). Subscribershall ensure that any of its faculty andstaff (End Users) given access to use the ELL PD Plus do not exceed the scopeof this license grant.

At the time of order, Subscriber shallidentify a district administrator as wellas administrators at each school towhom Co-nect will issue passwordsfor access to the ELL PD Plus.Individual school administrators will beresponsible for assigning passwords tothat school’s End Users. The licensegranted in this section, shall extend tothe district and school administratorsidentified by the Subscriber and EndUsers receiving access to the ELL PDPlus from the school administrators. In addition, each district administrator,school administrator and End Usershall be bound by these Terms ofPurchase and Use. For purposes ofthese Terms of Purchase and Use, theterm “Subscriber” shall be interpretedto include each district administrator,school administrator and End User.

Each End User may access the ELL PDPlus from any computer under suchEnd User's control that has access tothe Internet; provided, however, thatsuch End User is and shall remain fullyresponsible for the cost and expenseof any hardware, software, or commu-nications charges related to such computer usage and Internet access.

RESTRICTIONS AND COMPLIANCE

Subscriber is prohibited from (i) sublicensing, renting or leasing all orpart of ELL PD Plus or the ELLeXchange; (ii) charging others to usethe Subscriber’s access to ELL PD Plus or ELL Exchange; (iii) distributing passwords to anyone other thanSubscriber’s End Users; iv) using ELLPD Plus or ELL eXchange in any manner that violates any of these

Terms or any other Harcourt or Co-nectpolicies or procedures; or (v) copying,modifying (including, without limitation, creating derivative works),reverse-engineering, decompiling, or disassembling ELL PD Plus or ELLeXchange or any content therein, orpermitting others to do so.

FEES AND PAYMENT

Subscriber’s access to the ELL PD Plusis subject to the payment of any feesdue to Harcourt for such access or use.Subscriber will pay invoices for theproducts and services hereunder within thirty (30) days of receipt.Volume discounts do not apply to ELL PD Plus orders.

REPRESENTATIONS AND WARRANTIES

THE ELL PD PLUS and ELL EXCHANGEARE PROVIDED “AS IS” WITHOUTWARRANTY OF ANY KIND, EITHEREXPRESS OR IMPLIED, INCLUDINGWITHOUT LIMITATION ANY WARRAN-TY FOR INFORMATION SERVICES,UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH ORIN CONNECTION WITH THE SERVICE.SPECIFICALLY, HARCOURT AND CO-NECT DISCLAIM ANY AND ALLWARRANTIES, INCLUDING WITHOUTLIMITATION: 1) ANY WARRANTIESCONCERNING THE AVAILABILITY,ACCURACY OR CONTENT OF INFORMATION, PROGRAMS OR SERVICES; AND 2) ANY WARRANTIESOF TITLE OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Harcourt’s and Co-nect’s entire liabilityand the Subscriber’s exclusive remedies are set forth in this section.For any breach of Harcourt’s or Co-nect’s obligations hereunder, theSubscriber’s exclusive remedy andHarcourt’s and Co-nect’s entire liabilityshall be the re-performance of thedeficient services. Notwithstandingthe foregoing, in the event damagesare assessed against Harcourt or Co-nect, Harcourt’s or Co-nect’s entireliability to the Subscriber for damages(regardless of the form of action,whether in contract, tort, warranty or otherwise) shall not exceed the feespaid by the Subscriber for the currentELL PD Plus subscription period.

IN NO EVENT SHALL HARCOURT OR CO-NECT BE LIABLE TO THE SUBSCRIBER OR ANY THIRD PARTYFOR INCIDENTAL, CONSEQUENTIAL,SPECIAL, PUNITIVE, OR EXEMPLARYDAMAGES OF ANY KIND, INCLUDINGLOST PROFITS, LOSS OF BUSINESS, OR OTHER ECONOMIC DAMAGE, AS A RESULT OF BREACH OF ANYWARRANTY OR OTHER TERM OF

THIS AGREEMENT, REGARDLESS OFWHETHER HARCOURT AND/OR CO-NECT WAS ADVISED, HAD OTHERREASON TO KNOW, OR IN FACT KNEWOF THE POSSIBILITY THEREOF.

ELL PD Plus results are intended forinformational purposes only, and neither Harcourt nor Co-nect shall haveany liability whatsoever arising from orrelating to any use of such results bythe Subscriber or its End Users. Since ELL PD Plus is delivered via the Internet, an End User’s access isdependent on End User's access to theInternet, and End User's firewall/proxyserver performance and configuration.

TERMINATION

Subscriber shall have the right to terminate the subscription andSubscriber’s access to ELL PD Plusimmediately upon written notice toHarcourt in the event of a materialbreach of any of Harcourt’s obligationsherein, which material breach has notbeen cured or corrected in all materialrespects within thirty (30) days following written notice of the same.No refund of fees paid will be made in the event of such termination.

Harcourt and/or Co-nect shall have the right to terminate the subscriptionand Subscriber’s access to ELL PD Plusimmediately in the event that Subscriberor any End User has breached theseTerms.

Upon termination of Subscriber’saccess for any reason the Subscriberagrees to immediately return all originals and copies of Harcourt’s workproducts in its possession, and not toretain any copies thereof. Upon termi-nation, all amounts previously paid orpayable at the time of terminationshall be deemed fully earned byHarcourt and Harcourt shall have theright to retain all such amounts.

The election of either party to terminatepursuant to this section hereof shall notserve to waive, limit, bar or otherwiseextinguish any rights that party mayhave to pursue and recover any dam-ages that party may have suffered orincurred arising from these Terms ofPurchase and Use.

“Proprietary Materials” shall mean theELL PD Plus, ELL eXchange, StanfordELP, and any plans, procedures, poli-cies, methods of operation, businesssystems, training materials, technicaldata and any other information or data,or portions thereof that Harcourt andCo-nect, either jointly or separately,owns or may develop and use in connection with these Terms which by

identification or by its nature or typeshould reasonably be considered proprietary or confidential. TheProprietary Materials are and shallremain the sole property of Harcourtand/or Co-nect and these Terms do notcreate in the Subscriber any interest inor rights to the Proprietary Materials.Subscriber shall not disclose anyProprietary Materials to any third party or use any Proprietary Materialsdelivered to Subscriber other than inconnection with these Terms.Subscriber shall have no right toreceive any updates to any ProprietaryMaterials following the termination of the Subscriber’s access.

Subscriber acknowledges that theProprietary Materials constitute confidential and competition-sensitiveinformation of Harcourt and Co-nect andthat Subscriber’s obligations and dutiesunder these Terms are necessary andreasonable to protect the ProprietaryMaterials. Subscriber further acknowledges that any inadvertent orunauthorized disclosure of theProprietary Materials or any otherbreach of these Terms would causeirreparable damage and harm toHarcourt and Co-nect and that monetarydamages and Harcourt’s and Co-nect’sremedies at law would be inadequate tocompensate Harcourt and Co-nect forsuch breach. Therefore, in the event ofSubscriber’s breach of these Terms,Subscriber hereby agrees that Harcourtand Co-nect shall be entitled to obtaininjunctive relief, specific performanceand/or other equitable relief, in additionto such further remedies at law as maybe granted by a court of competent jurisdiction, without requirement (i) toshow or prove actual damages, or (ii) to post bond.

INDEMNITY

As a condition of Subscriber’s use ofthe ELL PD Plus, Subscriber agrees todefend and hold Harcourt and Co-nectharmless from and against any and all liabilities, expenses (includingattorneys’ fees) and damages arisingout of any third party claim resultingfrom or in connection with Subscriber’suse of the ELL PD Plus in violation of (i)these Terms or any other Terms of Useor Sale, including without limitationany claims alleging facts that if truewould constitute a breach bySubscriber of these Terms; (ii) anyapplicable federal, state or local laws; and (iii) the breach of any representation, warranty or covenantof Subscriber in these Terms.

GENERAL

This Agreement shall be construed inaccordance with, and its performance

governed by, the laws of the State ofTexas without regards to conflict oflaw principles thereof.

Neither party shall be liable for any lossor damage suffered by the other party,directly or indirectly, as a result of thefirst party’s failure to perform, or delay inperforming, any of its obligations con-tained in this Agreement (other than thepayment of money), where such failureor delay is caused by circumstancesbeyond the first party’s control or whichmake performance commercially imprac-ticable, including but not limited to fire,flood, storm or other natural disaster,explosion, accident, war, riot, civil disorder, governmental regulations orrestrictions of any kind or any acts ofany government, judicial action, powerfailure, acts of God or other natural circumstances.

These Terms of Purchase and Use and any interest herein may not beassigned or transferred, in whole or in part, by a party without the priorwritten consent of the other parties,which shall not be unreasonably withheld.

The provisions set forth underRepresentations and Warranties andProprietary Rights and Confidentialityherein shall survive termination of thisAgreement.

ADDITIONAL TERMS AND CONDITIONS

The purchase of a subscription to use ELL PD Plus is also subject to theTerms and Conditions of Purchase and Use stated in Harcourt’s productcatalog and referenced on the Harcourt Assessment websiteHarcourtAssessment.com, and to theTerms of Service set forth on Co-nect’swebsite, currently located athttp://Exchange.Co-Nect.net. In theevent that Co-nect’s web addresschanges, Subscriber shall be promptlynotified. In the event of any conflicts,these Terms of Purchase and Use takeprecedence over those Terms andConditions of Purchase and Use.

COMPLETE AGREEMENT, MODIFICATION, SEVERABILITY

These Terms of Purchase and Use contain the entire agreement betweenSubscriber and Harcourt with respectto the products and services orderedby Subscriber provided hereunder andsupersedes any other communicationsor advertising, whether written or oral,with respect thereto or any other oradditional terms stated on an purchaseorder or other document submitted toHarcourt by Subscriber. These Termsmay not be modified or expandedexcept by a writing signed by anauthorized representative of Harcourt.

If any provision of these Terms is heldinvalid or unenforceable, the remain-der shall continue in full force andeffect, provided that, if any limitationon the grant to Subscriber of any rightherein is held invalid or unenforceable,such right shall immediately terminate.

Policies1. Permissions and Licensing

Reproduction of any purchased materials requires the prior writtenconsent of Harcourt Assessment.Questions and answers, includingpractice questions and answers, maynot be reproduced without written permission, regardless of the numberof lines or items involved. Test copiesmay not be bound in theses or reports placed in libraries, generallycirculated, or accessible to the public,or in any article or text of any kind.Harcourt Assessment will considerrequests for permission to reproduce,modify, or translate part or all of anycopyrighted publication and will alsoconsider the granting of licenses foruse of our copyrighted materials.Requests to reproduce, translate,adapt, modify, or make special versions of these publications shouldbe addressed to the

2. Permission to Use

Copyrighted Test Norms

Harcourt Assessment has the sole rightto authorize reproductions of any portionof its published tests, including testnorms. Copying of test norms withoutauthorization is a violation of copyright.The term “copying” includes, but is notlimited to, entry of test norms into acomputer memory for purposes of testprocessing, scoring, or reporting. Anyperson or organization wanting to useHarcourt Assessment’s test norms mustsubmit a formal written request to theLegal Department. If permission isgranted, a fee may be charged.Permission from Harcourt Assessmentfor use of test norms does not implyendorsement of, or responsibility for, the accuracy or adequacy of any testprocessing, scoring, or reporting service.

3. Permission for Research

Permission is not needed for researchby individuals who are qualified to purchase and administer the tests;however, no reproduction of test materials is allowed for any purpose,including articles and reports based on

research, without the prior writtenconsent of Harcourt Assessment.Students wanting to use test materialsfor thesis, dissertation, or researchshould complete and submit a StudentQualifications Form located atHarcourtAssessment.com.

This form must be accompanied by aprepaid order for the materials request-ed. The form and order can be faxed to Customer Service at 800-200-4880, or mailed to us at P.O. Box 708912, San Antonio, Texas, 78270-8912.

A 50% discount is offered to studentsusing published assessments inresearch; a 40% discount is offered tostudents using published interventioninstruments in research. Because oftest security, permission is not grantedfor appending tests to theses, dissertations, or reports of any kind.

4. Software

All of Harcourt Assessment's softwarelicenses are sold on a per user basisand each license may be installed and used by one user only (unless otherwise noted).

Software may be returned within 30 days of invoice date. Software must be returned with all media,accompanying materials, and originalpackaging along with a written statement verifying that the softwarehas been removed from all computers.

5. Qualifications for Purchase

Note: Please read this section. Noteveryone who wishes to buy a test isqualified to do so. In order to avoiddelay in your order, please make sureyour qualifications are known to us.

The tests listed in this catalog are carefully developed assessment instruments that require specializedtraining to ensure their appropriate professional use. Eligibility to purchasethese tests, therefore, is restricted to individuals with specific training and experience in a relevant area ofassessment. These standards are consistent with the Standards forEducational and Psychological Testingand with the professional and ethicalstandards of a variety of professionalorganizations. These organizationswhose members use tests are diverse,but include such organizations as theAmerican Counseling Association (ACA),the American Educational ResearchAssociation (AERA), the AmericanPsychological Association (APA), theCouncil for Exceptional Children (CEC),the National Association of SchoolPsychologists (NASP), and the National Council on Measurement inEducation (NCME).




Harcourt Assessment is committed toupholding these standards, and wereserve the right to require additionalevidence of each Purchaser’s qualifications. Harcourt Assessmenthas the sole right to determinewhether a Purchaser is qualified andunder what classification. In addition,Harcourt Assessment retains the rightto withhold or withdraw approval fortest purchase where there is evidenceof violation of commonly acceptedtesting practices or any of the Termsand Conditions of Purchase.

Note: No tests are sold for self-guidance, nor to any individual ororganization engaged in testing andcounseling by mail. Test users mustagree to guard against the improperuse of our tests in order to retain theright to purchase those tests. To protect their security and value,tests and scoring keys must be kept in locked files or storage cabinets accessible only to authorized personnel. 6. Trademarks

Harcourt Assessment has the soleright to license use of its trademarks.Any unauthorized use of HarcourtAssessment or Harcourt, Inc. trademarks is strictly prohibited.Requests to use any trademark should

7. Rules Governing Sale ofMaterials to Various Categories of Purchasers

Universities, schools, organizations,businesses, clinics, and hospitals aresubject to the guidelines set forthabove and must have appropriatelyqualified individuals on staff in orderto purchase test materials. These indi-viduals must complete a QualificationsForm or provide information as to theirqualifications. Orders not accompaniedby this documentation may not beprocessed.

Qualified customers should complywith the requirements of their respective institutions concerning the use of purchase orders. HarcourtAssessment may not be able toprocess orders without the appropriatepurchase order(s) or other documenta-tion required by the institution.

No educational materials will beshipped to a home address. If you are a homeschooler, please contactCustomer Service for advice. There arehomeschool agencies that providetesting services in programs approvedby Harcourt Assessment.

University libraries and bookstores may purchase materials subject to

8. Compliance with HIPAA

Harcourt Assessment would like toadvise its customers that they are notobligated to disseminate copies of testrecord forms or protocols to personswho erroneously claim that they areentitled to copies under HIPAA’sPrivacy Rule. This position is consis-tent with a guidance letter Harcourtreceived from the Department ofHealth and Human Services whichstates that so long as test items(which may be disclosed in recordforms) are trade secrets, such information is not required to be disclosed under HIPAA. HarcourtAssessment has claimed trade secretstatus for its test record forms and protocols for many years in order topreserve the validity of these toolsused by the professional communityfor the benefit of the general public.Please go to HarcourtAssessment.comfor a more detailed explanation of ourposition regarding HIPAA.
