Sir,

Sub: Proposed Const ruction of New Dam at Mullai Periyar by Kerala – unsubstantiated – DPR to be reject ed – no permission to be granted – reasons furnished.

Ref: Kerala ’s move on New Dam at M ullai Periyar – submission of DPR by the Kerala Chief M inister on 21-04-2012 at New Delhi for clearance

1. Kerala has no claim for the new Dam on the following grounds

i) No data / document / evidence to support their stand that Mullai Periyar Dam is weak and it will endanger the safety of Kerala people.

a) Floods earlier in 1886 caused no damage

b) Floods after 1886 and upto 1976 – also caused no damage

c) Floods / heavy rains after 1976 – no damage was reported

ii) Our Dam Break Analysis (upto 4.50 & 6.25 Lakh cusecs) establishes that no part of Kerala d/s of Mullai Periyar is getting flooded / submerged & no damage occurred as c laimed by Kerala.

a) Initially 86000 cusecs discharging capacity

b) After strengthening it has been increased to 1,22,000 cusecs at no point of time such floods so far occurred

c) Seismic forces pertaining to Zone III (3.5 to 4.2) do not cause any distress in the Dam

iii) GOTN stability analysis and our independent Dam stability analysis ensures that the Dam is safe even when water is stored upto 152’0” FRL – CWC & Expert committees also endorse the safety of the dam

iv) Supreme Court of India – inits verdict on WP (C ivil) No. 386 of 2001 dt. 27-02-2006 also declared that the dam is safe

v) The AG of Kerala State submitted an affidavit in the Kerala High Court that 450 families living nearby the dam (D/s) (encroachers) are only subjected to evacuation and further Idukki & Cheruthoni dam are capable o f taking any amount of flood waters from M ullai Periyar Dam and they are also safe against earthquake forces.

vi) Earlier expert committees under Brar and Mittal constituted by CWC at the instance of Supreme held that the Mullai Periyar dam is safe a fter strengthening and there is no cause for any one to be panic as falsely alleged by the Kerala.

vii) Dr. K.C .Thomas, Former Chairman, CWC has categorically stated in Jan 2012 that after strengthening measures, the dam is very safe and there is no reason / logic for Kerala’s Political propaganda.

2. Why Kerala is advocating t he Construction of new dam at cost of Rs. 663 crores at Mullai Periyar?

i) In order to c ircumvent and illegally nullify the order of Supreme Court dt. 27-02-2006

ii) Kerala has no respect to the rule of law and to the Supreme Court by open declaration of their Chief Ministers and other politic ians not to obey the judgement from time to time.

iii) Their Amendment Bill dt. 18-03-2006 relating to Kerala Irrigation & Water Conservation Act – 2006 in another tactical – but unconstitutional approach against the verdict of Supreme Court.

iv) Their indirect and hidden agenda is to nullify 1886 lease deed and subsequently amended 1970 lease deed so that entire water o f M ullai Periyar is available / to be utilized by Kerala alone for power production at Idukki.

3. Their recent DPR submitted to Empowered committee headed by Justice Dr.AS.Anand during Sept 2011 & now (April 2012) to you clearly proclaims that

i) The State of Tamilnadu has absolutely no riparian rights on the Mullai Periyar River waters s ince it is not a Interstate River & it is purely an intra Kerala river (Page 37 – Vol I).

A Copy of expert legal opinion by Dr.Justice A .K.Rajan “Mullai Periyar Dam is the property of Tamilnadu” is attached with this letter for your reference.

ii) Under “sharing water wit h other states” , (page 23. Vol I) it is stated as - “subject to availability”. (ie means there is no guarantee to supply water to TN). Hence Kerala has no intention to supply water to Tamilnadu

iii) The new dam is also proposed to legalise an illegal encroachments by Kerala in the Mullai Periyar Dam water spread area between the levels 136ft and 155ft with vested interests.

iv) The M inistry of Environment & Forest clearly stated that Kerala did not / does not apply for the detailed i nvestigation to prepare DPR for environmental clearance and it will also endanger the same as it is covered under Periyar T iger Reserve and wild life sanctuary.

From the above it is crystal clear that Kerala State has locus standi to construct the new dam at Mullai Periyar against the constitution and against supreme court verdict and also CWC norms and guidelines by the GOI – M inistry of Water Resources.

Under the above circumstances and reasons adduced in this letter, you as the Honb’le M inister of Water Resources and GOI are duty bound to reject t he proposal of Kerala (DPR) to construct the new Dam at M ullai Periyar in order to protect the supremacy o f the constitution and supremacy of the rule o f law in the interest of union of India.

Dr. V.Senthilvelkumar in his speech explained about the World Trauma cases – It means that while we are driving Two wheeler or Four wheeler we should not use Cell Phone. A lmost all accidents occurred due to this.

He also explained the P lastic surgery is to replace the skin and obtain the orginal position. It is mainly for the Fire accidental patients.

If any leg, leg fingers hand or hand fi ngers have cut with an accident. The broken portion taken to the hospital safely with ice plastic bag with in one hour. It will be operated and necessary plastic surgery will be carried out and it is possible to get the original position.

Every year senior person should have master check up in the hospital for the happy living.

CHAPTER NO. 14 INTERSTATE WATER DISPUTES

The major int er-st ate rivers are Araniyar, Kosast halayar, Palar, Cauvery Ponniar and Periyar and Parambikulam Aliyar. The various stages are indicated f or each river-basin.

A. Mullaiperiyar Dispute on restoring F.R.L.

Central Water Commission suggested R.C.C coping and widening of dam-top, to provide 3 additional spillway vents, cable anchoring, conc rete backing on rear face, strengthening of leading drain and parapet wall and energy dissipating arrangements. All costing Rs.13 crores.

1979 F.R.L lowered to 136f t

1976-77 Strengthening scheme sent for approval for Rs.49.56 Lakhs

1982-83 Strengt hening works costing Rs.720.5 Lakhs taken up and to be completed by 1984-85.

1990 3 Additional vents to surplus escape approved in June 1983 f or Rs.320 lakhs and started in 84-85 and t o be completed by 86-87. Kerala objects to conveyance of materials f or pitching of apron and work stopped.

1991 capping on top of dam completed f or Rs.131 lakhs.

1998-99 All strengthening works complet ed except dissipation works f or additional vents of spillway which are in progress Tamilnadu wrote to Kerala f or discussion.

1999-2000 Meeting held in 1998 at Trivandrum and constit uted Technical committee to discuss technical issues and submit reports. Tamilnadu ready but Kerala not ready and not conveyed date f or discussion.

2000-01 Kerala does not permit energy dissipation works and raising parapet walls was started in 1987 and t hese have to be done later. Meetings held on 28-11-96 and 13-08-98 to constit ute Technical committee. Reports placed on 28-01-2000 at Trivandrum. Many meetings held bet ween chief ministers but no agreement reached.

2001-02 As per direction of supreme court, meeting convened on 28-04-2000. Water resources committee of eminent engineers constituted f or raising F.R.L. on a

phased manner in June 2000. Final report of March 2001 sent to st ates f or their views.

2005-2006 Meeting held on 06-11-04 and minister level meeting on 27-11-04 at Trivandrum.

27.02.2006 Supreme Court issued f inal orders.

(i) The agreement f or 999 years is legally valid

(ii) The env ironment is not at all af f ected.

(iii) The dam is strong and saf e and hence water can be stored upto 142 f eet (f rom 136 f t).

(iv ) Af ter strengthening the Babydam, water can be stored upto 152 f eet.

(v ) The Kerala Gov t should assist GOTN in strengthening the Baby Dam.

15.03.2006 To nul lif y the Supreme Court order, Govt. of Kerala on 15. 03.2006 enacted an Act Kerala Irrigation and Water Protection Act, stating Kerala Gov t alone has authority to f ix the water levels in all 22 dams including Mullai Periyar Dam, restr icting the maximum water level at 136 f eet.

11/2006 to Discussion at Gov ts level under the guidance of central Gov t but failed as

March 2007 the Kerala did not agree.

21.02.2008 Kerala proposed construction of new dam and reiterated.

11.01.2007 GOTN pref erred petitions in the supreme court to quark the Kerala Act 3/2006 and permit GOTN to raise water upto 142.

2006-2007 Aff idav it f iled on 31-03-06 t o declare the Kerala i rrigation and water Consolidation Committee Act of 2006 as unconstit utional and SC addressed to advise rest oration of 142 f eet.

2009-10 S.C ordered on 13-12-07 SC appoints Arul Singh Retired CJ of Rajast han to record ev idence. Final hearing on 31-03-09 and adjourned to July 2009.

19.12.2010 Supreme Court once again appointed another committee under f ormer Chief Justice Dr.A.S.Anand t o f ind out the present strength of Mul lai Periyar Dam and the samd is now investigated.

06.06.2011 Meanwhile, Kerala Gov t. prepared DPR and planned to construct a new dam below the Mullai Periyar, once again stating the old Dam is not saf e. However GOTN continued t o contest t he contention of Kerala Govt and opposed the construction of new dam by Kerala.

08.04.2011 Geological investigation by Geological survey of India carried out soil investigation by CSMRS was completed.

2003-2004 River Basin Management Development Board (RB MDB) f or Palar and Tamiraparani met at secret ariat in August 2002-2 meetings were held and second meeting was held on 24-11-02.

2006-2007 Mysore not to proceed with check-dam as per 1892 agreement. Andhra Pradesh assured that it will proceed with scheme only af ter consulting with Tamilnadu.

2007-2008 Tamilnadu filed a suit in Supreme Court. But Andhra Pradesh proposed to give details of scheme before 05-02-07 and not to proceed without consulting Tamilnadu.

2009-2010 Andhra Pradesh f urnished inf ormation and central water commission will conduct studies to f ind water availability .

CAUVERY WATER DISPUTE :

The 1924 agreement was signed subject to rev iew af ter 50 years. Karnataka stat e ref used t o honour t he agreement from 1974. Theref ore disput e had arisen. The Kerala and Pondichery Governments also joined by putting up t heir claims. Organized groups of f armers had also stepped in to make their demands. Under these circumstances c reation of new platf orm for negotiations became inevitable. This led to bilateral and multilateral meetings. Bet ween 1968 and 1990; 22 st ate multilateral-level meetings, 21 meetings under the Chairmanship of Union Minister of Irrigation, 5 bilateral session bet ween Tamilnadu and Karnat aka took place. These meetings took place in 70’s and became scarce in 80’s.

1991 Tamilnadu demanded constit ution of a tribunal under Interstate waters. Disput es Act 1956 and urged f or tribunal enquiry which took place in 1975, 79 and 1986 25-06-1991. The tribunal gave an intern award that 205 TMC shall be given by Karnataka and that Tamilnadu shall make 6 TMC available t o Pondicherry wit h eff ect f rom 01-07-1991 and also stipulated that Karnataka should not extend their ayacut beyond 11. 2 lakhs. This order was also published in gazette by Government

of India on 10-12-91. Pursuant to this award, this quantity was realized on yearly basis bet ween 1991 and 2001 (except 1995-96) but 182.73 TMC only was realized in 1995-96. Karnataka had also applied for clarif ication and amendments.

1995-96 Supreme-Court suggested that C. M.’s shall meet and come t o an amicable interim measure.

1998-99 As no amicable settlement could be reached, disput e has gone bef ore t he Tribunal where c ross-examination of 9 witnesses and 1 of union were complet ed. Furt her cross-examination are being continued (as in 2009).

1999-2000 Cross-examination of 5 witnesses of Karnataka upto 08-05-97 4 more of Tamilnadu to be heard Kerala to provide 3 witnesses. Final award only af ter conclusion of cross examination.

2000 -2001 Final adjudication in progress and cross examination are being continued.

2002-2003 Interim award of 25-06-91 only meetings held 3rd meeting proposed on 10-10-01 not prov ided for making good def icits. Arguments started on 29-01-02 and final award only af ter conclusion.

2003-2004 Meeting on 08-09-02 Cauvery Rev iew Authority directed 9 TMC to be made available on weekly basis (0.8 TMC per day ) during September and October. But Kuruvai has been lost in 8 lakhs out of 11 lakhs hectares only could be planted. Mettur storage cannot last beyond Jan 2003. The North East Monsoon had f ailed. Samba crops planted in 8 lakhs hect ares could not be saved due to adamant attitude of Karnataka.

2004-2005 Final arguments on issues f ramed by CWC are at an advanced stage.

5th Feb 2007 Final award passed by the Tribunal however not yet notif ied in t he central Govt. gazette due to appeals pending in the Tribunal & Supreme Court.

All About Hypertension - High Blood Pressure What is High Blood Pressure?

When you have your blood pressure taken, your health care provider is measuring the pressure, or tension, that blood exerts on the walls of the blood vessels as it travels around the body . In a healthy person, this pressure is just enough for the blood to reach all the cells of the body , but not so much that it strains blood vessel walls.

Blood pressure is measured in millimeters of mercury (mm Hg).

A typical normal blood pressure is 120/80 mm Hg, or "120 over 80."

The first number represents the pressure when the heart contracts.

The second number represents the pressure when the heart relaxes.

Blood pressure greater than 140/90 mm Hg is considered high.

Generally, blood pressure will go up at certain times - for instance, if you smoke a cigarette, win the lottery , or witness a car crash - and will return to normal when the stressful or exciting event has passed.

But when blood pressure is high all the time, the continuous increased force on blood vessel walls can damage blood vessels and organs, including the heart, kidneys, eyes, and brain.

The medical term for high blood pressure is hypertension.

Need to Know:

Systolic and Diastolic Blood Pressure.

Blood travels through blood vessels much like water through a garden hose. The blood in the vessels is under pressure just like the water in a hose when the tap is turned on.

With each heartbeat more blood is pumped into the vessels - like turning up the tap - so the pressure rises. This is the systolic blood pressure, the first number in the blood pressure measurement, which is normally around 120.

Between heartbeats, while the heart is resting, the pressure in the arte ries is lower. This is the diastolic pressure, second number in the blood pressure measurement, which is normally around 80.

Indication of high blood pressure

You can increase the pressure in a hose either by turning up the tap or by putting a crimp in the hose (that is, by narrowing the hose). In this same way, the blood

pressure in blood vessels will rise if fluid flows more forcefully or i f the arteries are narrowed.

Pressure in a hose can be regulated either by controlling the rate at which fluid passes through it or by widening it Likewise, the pressure in the blood vessels can be controlled, with medications that act on the heart or blood vessels and with certain lifestyle modifications.

Need to Know:

Although high blood pressure can be extremely dangerous, it usually causes no symptoms - so many people don't even realize they have it. High blood pressure can only be detected with accurate and repeated measurements of a person's blood pressure. That's one reason why its so important to have regular medical checkups.

Even though high blood pressure can be treated safely and effectively, only about one-quarter o f people who have high blood pressure take the necessary steps to keep their blood pressure within a normal range.

There are three types of hypertensio :

Primary hypertension (essential hypertension). This is high blood pressure for which no cause can be found. Most people with high blood pressure '90 to 95 percent) have this type of hypertension. Doctors suspect that a combination of lifestyle, diet, heredity, age , gender, race/ethnicity, hormone levels, and other factors all contribute to high blood pressure.

Secondary hypertension (non-essential hypertension). This is high blood pressure for which a defi nite cause can be found. This type of high blood pressure accounts for only 5 to 10 percent of all cases of hypertension. Some of these causes are temporary or controllable - for instance, pregnancy or the use of certain medications - while others are chronic conditions like hormonal diseases, kidney disease, or head injuries.

Isolated systolic hypertension (ISH). O lder people are sometimes susceptible to another form of high blood pressure, called isolated systolic hypertension. In people with this condition, blood pressure is higher than normal when the heart beats, but returns to normal in between beats of the heart. The large difference in pressure can place additional strain on artery walls.

Blood keeps moving around the body because there are di fferences in pressure in the blood vessels. Blood flows from higher-pressure areas to lower-pressure areas until it eventually returns to the heart.

VALLALAR - THE REBEL SAINT Gul ;rpj;Jwtp (Part -XIX) DEATHLESSNESS Of all the theories propagated by Vallalar most deff icult & least

understood is t he t heory of Deathlessness. He says that all of us can live a deat hless lif e. In reality no body seems to have reached this end. Vallalar did not die in the ordinary sense. He disappeared in a room at his Ashram in rpj;jptshfk; which is 3 km f rom Vadalur.

He locked himself in that room and direct ed his disc iples not to open that room. He is considered to have sublimat ed his body into the f ive elements. When the room was opened af ter a couple of mont hs under directions from an European District Collect or, not hing was f ound inside. Is this what he means by deathlessness.

His disciples who were closely watching him in the last f ew weeks of his lif e, report the process through which he processed his body to reach deat hlessness. He reduced his f ood intake gradual ly to morsel of f ood per day . That was f urther reduced to a few spoons of sugar wat er or Honey and practically nothing towards the end. In this process he made his body transparent (xsp cly;). When somebody tried to phot ograph him at that stage no impression was f ound on the photographic plat e used in those days f or taking photos. In that stage only he locked himself in the room at rpj;jp tshfk;.

By going thro the process thro which he went f or attaining deathlessness it is f ound to be very diff icult and practically imposs ible f or being followed by ordinary people. But he inv ites everyone to the stat e of deat hlessness tk;kpd; cyfpatPh;> kuzkpyhg; ngUtho;tpy ; tho;e;jplyhk; fz;BH; which means he expected everyone to f ollow his pat h to reach the state of deathlessness.

Many scholars try to explain this process of deathlessness. A great scholar in Aurobindo Ashram Pondicherry has written two bulky volumes under the heading mUl;ngUQ;Nrhjp or deathlessness in the council of which he has referred to jpU%yh; (jpUke;jpuk;) and khzpf;fthrfh; (jpUthrfk;).

Ref erences in these looks to long lif e and deathlessness; this aut hor is a sowrashtra f rom Madurai. He was a chartered accountant who lived in Sri Aurobindo Ashram f or his whole lif e. He was an ardent devotee of Shri Aurobindo and also Ramalinga Swamigal. Even going through the two bulky volumes written by him and published by University of Madras we do by not get even a gazy idea of deathlessness he narrates in his book how Sri Aurabindo also attempted to reach the state of deathlessness but did not succeed in doing so. He died an ordinary death and his body is buried in Sri Aurobindo Ashram.

ngUtho;T) and disappeared by sublimating his body in his room at rpj;jptshfk;. This is also a unique aspect of Saint Vallalar for which we call him a rebel saint. No one af ter Val lalar has reached the state of deathlessness except f or the attempts of Sri Aurabindo to reach the state.

GUAVE A DAY KEEPS A DOCTOR AWAY Guavas are rich in dietary fiber, vitamins A and C, folic acid, and the dietary minerals, potassium, copper and manganese. Having a generally broad, low-calorie profile of essential nutrients, a s ingle common guava fruit contains about four times the amount of vitamin C as an orange. A series of tests conducted on fruits found in India, including Himalayan apples and pomegranates, bananas and grapes, found that the guava, the poor man’s fruit in India, has the highest concentration of antioxidants as compared to all the other fruits. According to scientists from India’s National Institute in Hyderabad, the Indian plum, the custard apple and India ’s beloved mangoes, come after guavas in antioxidant richness. The study found that while there is a presence of antioxidant concentrations of just under 500 milligrams per 100 grams in guavas, 330mg in plums and 135mg in pomegranates, apples have a quarter of the antioxidants in guavas and bananas merely have a tiny fraction with 30 mg per 100 grams. Foliage diseases, such as anthracnose, can be a problem in humid c limates where guava is grown. They are regularly controlled with fungic ide applications so it is important for the consumer to access organic varieties that use natural methods to control pests. Watermelons and pineapples were found to o ffer the least protection for the body’s fight against free radicals, which can cause cell damage, whereas mangoes, despite a high fructose contenct, have 170 mg of antioxidants, which is more thatn three times that of papaya, and grapes were found to be three times more beneficial to the body than oranges. Guava is a rich source of antioxidants, a rich source of fibre. It’s a poor mans fruit because they’re quite cheap. A guava a day keeps a doctor away.
