Judgment order dated:13.02.2018 in W.P.(MD) No.58 of 2018.ORDER:- In the Government Order first read above orders were issued to the effect that aGovernment Servant whose increment falls due on the day following superannuation, oncompletion of one full year of service which are countable for increment under FundamentalRule 26, be sanctioned with one notional increment at the rate as described under rule 6 of TamilNadu Revised Scales of Pay Rule, 2009, purely for the purpose of pensionary benefits and notfor any other purpose and that the above concession of sanction of notional increment isapplicable only to the employees retired on or after 31122014.
2. In the Government Order second read above, the following amendment was issued witheffect from 31.12.2014:
AMENDMENTIn the said Fundamental Rules, after rule 26 and the Rulings and the Implications there
under, the following rule shall be inserted, namely:“26AThe Government servant, who retires on or after the 31st December 2014 and
whose increment falls due on the next day following the date of superannuation, on completionof one full year of service which is countable for increment under Rule 26, shall be sanctionedwith one increment at the rate of 3% of Pay + Grade Pay, notionally on the afternoon of the dateof retirement, purely for pensionary benefits only”.3. The Writ Petition No.15107 of 2016 has been filed by Thiru S.Srinivasan to quash the
orders issued in G.O.Ms.No.311, Finance (CMPC) Department, dated:31.12.2014 in sofar as it restricts the grant of notional increment purely for the purpose of pensionary benefitand consequently direct the respondents to grant the notional increment to the petitioner, onthe date of his retirement.
4. The Hon’ble High Court in its order dated:16.08.2017 in Writ Petition No.15107 of 2016has observed that “the purport of the Government Order is to grant benefits in accordancewith the Fundamental Rules and the Government in G.O.Ms.No.311, further issued directionsto carry out necessary amendment to the Fundamental Rules in this regard. Such beingthe factum of the case, the claim with regard to the grant of annual increments for the retireesprior to and after G.O.Ms.No.311, Finance (CMPC) Department, dated:31.12.2014, is to

be affirmed by the State. Further, the eligibility of the writ petitioner in respect of the annualincrements cannot be denied. In view of the above the date of retirement is not prescribedas a cutoff date in the Government Order regarding eligibility. Since the claims set out inthis writ petition deserve consideration. Accordingly, if the writ petitioner falls in the categoryas stipulated in G.O.Ms.No.311, Finance (CMPC) Department, dated:31.12.2014, he iseligible to get his annual increments notionally with effect from the date of retirement andthe monetary benefits will be granted with effect from 31.12.2014 i.e., the date ofG.O.Ms.No.311, Finance (CMPC) Department, dated:31.12.2014. With this clarificationrespondent and competent authorities are directed to implement G.O.Ms.No.311 Finance(CMPC) Department, dated.31.12.2014, by granting the benefit of annual increments,by verifying the respective service records of the writ petitioners and pay the monetarybenefits prospectively with effect from 31.12.2014”.
5. In the orders of the Hon’ble High Court of Madras fourth to twenty first read above,orders were passed by the Hon’ble High Court to extend the benefit of G.O.Ms.No.311Finance (CMPC) Department, dated:31.12.2014 in favour of the petitioners.
6. After careful consideration of the various judgments passed by the Hon’ble High Court,the Government have decided to comply the orders of the Hon’ble High Court in favourof all eligible retired employees who have completed one full year of service and notsanctioned annual increment due to their superannuation prior to 31.12.2014. Accordingly,Government extend the benefit of sanction of annual increment to all the petitioners whohave filed various Writ Petitions and all other similarly placed persons who retired priorto 31.12.2014 and completed one full year of service prior to their retirement, notionallywith effect from the date of their retirement for the purpose of revision of pension withmonetary benefit prospectively with effect from 31.12.2014 i.e. from the date of issue ofG.O.Ms.No.311, Finance (CMPC) Department, dated:31.12.2014.
7. The Government also direct that the rate of notional increment granted above, shall notexceed the eligible rate based on the basic pay drawn by the employee on the dateof retirement.
8. Necessary amendment to Fundamental Rules will be issued by the Personnel &Administrative Reforms Department separately.

I am directed to refer to Government Letter first cited, wherein it has been requested tokeep in abeyance the following proceedings issued by the then Director of CollegiateEducation until further orders of the Government.
i. Proc. Rc. No. 1321/J1/2012, dated 01.02.2013 regarding rectification of anomaly ofjunior drawing more pay by comparing the anomaly between teachers belonging to anydiscipline instead of same discipline.
ii. Proc. Rc. No. 1321/J1/20122 dated 01.02.2013 regarding sanction of incentive incrementsfor Ph. D. and M. Phil. Degrees in inter disciplines instead of relevant discipline and
iii. Proc. Rc. No. 1321/J1/20122, dated 07.02.2013 regarding implementation of CareerAdvancement Scheme (CAS) w.e.f 01.01.1996 instead of 27.07.1998.I am also to state that the Chief Internal Auditor of Internal Audit and Board was also requestedto take up a special audit on the proceedings issued by the then Director of CollegiateEducation mentioned in para 1 above and to send a detailed report to Government.
3. In the references second cited, the Director of Treasuries and Accounts was also requestedto issue necessary instructions to the Pay and Accounts Officer / Treasury Officers not to passany claim bills pertaining to the proceedings issued by the then Director of Collegiate Education.
4. In the Government order fourth cited, the Government have already directed that allprivileges including advance increments shall be made applicable to the faculty memberswith interdisciplinary Ph.D., by ensuring that the interdisciplinary Ph.D., is in the relevantdiscipline. It was also reiterated in the said Government order that the relevance of interdisciplinary Ph.D., will be decided by the University concerned with the help of subjectexperts in the concerned / related field.
5. I am to state that the proceedings mentioned in para 1 above, issued by the then Directorof Collegiate Education was reviewed in detail in light of the report from the Chief Internal
TANRECTA SPEAKS JUNE - 2018 TANRECTA SPEAKS JUNE - 2018Auditor of Internal Audit and Statutory Board and the Director of Collegiate Education.Accordingly, the following clarifications are issued in respect of rectification of junior gettingmore pay than the Seniors and the other related issues of college teachers:
i) Career Advancement Scheme has to be implemented from 27.07.1998 only i.e the dateof issue of clarification by University Grants Commission as clarified in G.O.(Ms) No. 435,Higher Education (H1) Department, dated 25.10.2000. As benefit has been given tofaculty who have seved longer at the lower feeder levels, lecturer who have alreadybeen awarded senior scale prior to 27.07.1998 have to be awarded selection gradebased on the total number of years of service, as per the para (d) under CareerAdvancement Scheme of G.O.(Ms) No. 111, Higher Education (H1) department, dated24.03.1999).
ii) As the seniority list of lecturer is a combined seniority list, the anomaly of junior getting morepay has to be rectified by Comparison to a junior of any discipline and not just the samediscipline subject to the condition that qualification of senior and junior are comparable, eg.A senior with M.Phil., cannot compare with a junior who has Ph.D., Comparison withjunior has to be done only as clarified in Government Letter No. 45113/ Finance (PayCell) department/20091. Dated 17.08.2009.
iii) In respect of certain glaring violations pointed out by the Chief Internal Auditor of internalAudit and Statutory Board in awarding increments based on Ph.D., subject, all such caseshave to be reviewed completely and wherever it is seen that the subject of Ph.D., is notrelevant, the increments awarded have to be cancelled and benefits already drawn haveto be recovered.iv.) A special drive has to be undertaken to rectify other errors all the pointed out by theChief Internal Auditor of Internal Audit and Statutory Board and effect recoveries in all suchcases where benefits/higher pay has been wrongly drawn and to fix the pay of the retiredGrade1 Principals as per the above clarifications.
6. This Letter issues with the Concurrence of Finance department vide its 23816/EdnI/2018, dated 10.05.2018.

MAYILADUTHURAI UNITMonthly meeting of Tanrecta MAYILADUTHURAI unit was held on
13/5/2018 at Arivalayam Mat HR Sec School. Prof. A. Subbiah, our senior
member celebrated his 70th Wedding Day and gave a party to all the
members. We all got his blessings.
The following resolutions were passed.
1. Resolved to pay second class sleeper fare as TA and Rupees 250/per
day as DA for attending meetings in Chennai, Madurai and places be-
yond Trichy. For Trichy TA will be actual train/bus fare and Rupees 200/
will be paid as DA.
2. Resolved to consider financial support to members attending AIFRUCTO
programs outside the State by placing the issue in the unit general
body meeting beforehand. The next meeting of Tanrecta will be
held on 10/6/2018 in Arivalayam Mat School at 10AM.

– 05 – 1958], Prof. Dr.J.R.Rajan [12 – 05 – 1946]. We wish them all a
happy birthday. Er. A.Jenif Xavier Richard (son of our member Dr. A.John
Merina) wedded Ms. S.Asha B.E., on 06 – 05 – 2018. We congratulate
the couple to have long and happy life. We remind our members to complete

Report for May 2018
78 members attended the monthly meeting of the Chennai Unit. In the
absence of the Unit Chairman ,the Vice Chairman Dr.M.Chandrasekaran
presided and conducted the proceedings of the meeting.
In his address,the Vice Chairman mentioned in detail about the on
going Jacto Geo struggle for scrapping the NPS and for re-introducing the
Liberalised pension Scheme.He appealed to the members that they
participate in all the programs chalked out by Jacto Geo.
The secretary in his report briefed the house about the meeting that
took place between the PPO and tanrecta office bearers,on pending
issues.The following issues were discussed with the PPO and detailed
memoranda have been submitted to the PPO.
(1) Pension for the month of April 2018,not paid to a few tanrecta members
due to the scrapping of the Public Sector Banking Scheme(PSBS) and
transfer of all these accounts to the PILOT Scheme.
(2) Automatic payment of additional pension for pensioners completing 80
years,85 years etc as done for Central Government Employees.
(3) Automatic restoration of commuted pension after 15 years.
(4) Issues related to mustering.
(5) Issues relating to TDS and income tax for pensioners.The following 3
individual issues of Dr.P.Subhadra Baskaran and A.Muthusamy
(pension for April 2018 not paid) and Prof.R.Nandagopal,Retired prof
from S.I.V.E.T College,Chennai were also discussed and the PPO
gave immediate positive solutions to issues directly under her control.
An appeal was made to the members to pay the subscription to the
unit, life subscription for AIFRUCTO and building fund for tanrecta.The unit
accepted the suggestion of the Secretary to send self addressed stamped
envelops to members for payment of subscription as well as building fund
through crossed cheques or through NEFT transfer.
It was reported that our National Federation ‘AIFRUCTO’ was taking
all efforts to get a Central Government order on pension for all retired College
and University teachers through out the Country,clearly indicating the
equivalence of various pay stages for Associate Professors and
Professors.There should be a clear mention about pension on a par with
Associate Professors for all those who completed 19 years(16+3) of service
prior to retirement and parity in pension with Professors for all those who
retired after completion of 22 years(16+3+3) of service prior to retirement
as indicated by the draft regulations (2018) of UGC.
Informations about the AIFRUCTO seminar and NEC at Bangalure on
23rd and 24th June,2018 and the FISE Conference at Nepal in September
2018 were passed on to the members.
The unit approved the proposal of the Secretary to conduct a Zonal
conference of AIFRUCTO at Chennai.Letters will be sent to General Secretary
tanrecta & AIFRUCTO seeking permission to host the same at Chennai.
The resignation of the treasurer (who is settling down in Australia)was
accepted by the unit.A new treasurer will be elected in the next meeting in
June 2018.Members may send by SMS/Whatsapp/letter to the Secretary,the
names of the members willing to contest for the post of treasurer.
There was a brief report by the Secretary about the tanrecta dharna at
Trichy protesting for a just solution on the Cauvery issue and the Sterlite
factory issue.The Secretary appealed to the members that such social issues
should be supported in full by all members of tanrecta. Next monthly
meeting will be held on 09-06-2018 at 4pm at Quide E Millath College.
