General Procedures for Meetings

Use of tape recorders or other means capable of producing verbatim transcriptions of any NFPA Committee Meeting is not permitted.

Attendance at all NFPA Committee Meetings is open. All guests must sign in and identify their affiliation.

Participation in NFPA Committee Meetings is generally limited to committee members and NFPA staff. Participation by guests is limited to individuals, who have received prior approval from the chair to address the committee on a particular item, or who wish to speak regarding public proposals or comments that they submitted.

The chairman reserves the right to limit the amount of time available for any presentation.

No interviews will be allowed in the meeting room at any time, including breaks.

All attendees are reminded that formal votes of committee members will be secured by letter ballot. Voting at this meeting is used to establish a sense of agreement, but only the results of the formal letter ballot will determine the official action of the committee.

Note to Special Experts: Particular attention is called to Section 3.3(e ) of the NFPA Guide for Conduct of Participants in the NFPA Codes and Standards Development Process in the NFPA Directory. This section requires committee members to declare any interest they may represent, other than their official designation as shown on the committee roster. This typically occurs when a special expert is trained by and represents another interest category on a particular subject. If such a situation exists on a specific issue or issues, the committee member shall declare those interest to the committee and refrain from voting on any action relating to those issues.

Smoking is not permitted at NFPA Committee Meetings.

Jacqueline Wilmot passed around the Committee List and asked attendees

to make any necessary corrections. Also passed around an attendance list and asked that attendees check off their names.

Staff Liaison, Jacqueline Wilmot also introduced Barry Chase of NFPA Staff who is attending this meeting and the following NFPA 17/17A meeting, for support and assistance.

Attendees introduced themselves. There were 18 voting Committee members of which 1 was an Alternate. There was 1 Non-

Voting member as well as other non-voting Alternates present. Also attending were 13 guests. Motion and second to accept Minutes of A-2014 ROC meeting (Baltimore, MD), succeeded. Jacqueline Wilmot reviewed the new NFPA “Standards Making” Process.

Jacqueline Wilmot indicated that the meeting of the 2017 NFPA Annual meeting is tentatively scheduled for June in a location yet to be determined.

Chairman Roth reminded all that voice and vote on all issues are reserved to only Principals and to Alternates where the TC

Principal is not in attendance. An Alternate may be permitted to speak to, and vote on a particular issue when the Principal is in attendance with approval of the Chair. In such case the Principal will defer to the Alternate and the Principal will not have voice or vote on that particular issue. Only one guest (J. R. Nerat) has requested, and has been granted, permission in advance to speak to a particular issue.

Technical Committee members began to review and act on 90 Proposals to NFPA 96. In the course of the review, Chairman

Roth recognized some guests to speak on particular issues to assist the Committee in fully addressing a proposal.

Additionally, Chairman Roth assigned the following Task Groups to meet informally regarding some specific proposals and meet back with the Committee with recommendations.

May 6, 2015 Meeting reconvened at 8:00 AM. Called to order by Chairman Roth. Technical Committee members continued to review and act on Public Input to NFPA 96. In the course of the review, the Chair

entertained reports from Task Groups previously appointed. Meeting recessed by Chair at 12:45 PM until 1:30 PM. Meeting reconvened at 1:35 pm and called back to order by Chairman Roth. Technical Committee members completed the

review and actions on the remaining public proposals to NFPA 96 Chairman Roth reminded the members of the Technical Committee that a 2/3 majority is required on the ballot to accept each

of the Technical Committee actions. Chairman Roth appointed the following Task Group Leader and Task Group members. The Chairman suggested that the

Group Leader plan to deliberate on the issues by e-mail as the most cost effective way. The Group Leader can call on other persons, TC members or not, to assist in pursuing the Group’s goals.

Cooking equipment used in fixed, mobile, or temporary concessions, such as trucks, buses, trailers,pavilions, tents, or any form of roofed enclosure, shall comply with this standard unless otherwiseexempted by the authority having jurisdiction in accordance with 1 . 3.2 of this standard .

Statement of Problem and Substantiation for Public Comment

This Public Comment requests returning the text of this section back to the existing language. There are many instances where temporary cooking situations do not warrant the extensive provisions of NFPA 96, such as a car dealership using a small, residential BBQ to cook hotdogs. Rather than having the AHJ inundated with requests for regulating these types of situations, the existing provision makes it clear that the AHJ can exempt them. For that reason, the provision should be deleted.

Listed grease filters and grease removal devices that are removable but not an integral component of aspecific listed exhaust hood shall be listed in accordance with ANSI/UL 1046 and shall be clearlydesignated on the filter so it is visible with the filter installed . In proximity to the filter location, a label shallbe permanently fixed on the hood that states “Use Listed Filters.” .

Statement of Problem and Substantiation for Public Comment

First Revision #9 does not address the visibility of the filter label when the filter is installed, which was the intent of Public Input 121. This Public Comment seeks to add the visibility issue back for consideration. This Public Comment also adds a provision to remind the person that installs the filter that listed filters are required to be utilized.

If the heat source is non-electric and open flames are used, a carbon monoxide detector shall be installedin both the kitchen and dining areas.

Statement of Problem and Substantiation for Public Comment

NFPA’s Building Code Development Committee (BCDC) is in agreement with the negative comment. The scope of this standard is not detection, but more so ventilation. If CO detection is desired, then it should be submitted to NFPA 1, 101 and 5000, because it falls within the scope of those documents. Note that the technical justification seems insufficient.

Fume incinerators, thermal recovery units, air pollution control devices, or other devices installed in theexhaust duct, shall be protected by an independent a fire-extinguishing system with its own automaticdetection for system actuation .

Statement of Problem and Substantiation for Public Comment

The minimum requirement should be for a fire protection system. An independent system is only one option for fulfilling this requirement. The substantiation provided with the change in the First Revision does not provide justification for an "independent system".

Statement of Problem and Substantiation for Public Comment

The intent of Public Input 103 was to eliminate the date since the effective date has passed. Since the effective date has passed, there is no need to identify the date. Now, all existing systems now need to comply. Consideration could be given to adding the Technical Committee statement to Public Input 103 as annex material because the information – that the provision became a requirement for all systems after January 1, 2014 giving 2 years to comply – may be useful.

Hoods installed end to end, back to back, or both, sharing a common ductwork, the ductwork beyond 75ftfrom the farthest hood, shall be protected by a fire-extinguishing system, either an independentfire-extinguishing system with its own detection system and shall not require or a system withsimultaneous activation with by the hoods’ fire-extinguishing systems.

Statement of Problem and Substantiation for Public Comment

Both arrangements will extinguish the fire. NFPA standards typically provide minimum requirements for a reasonable level of fire protection without establishing a preference of one arrangement over another.

Statement of Problem and Substantiation for Public Comment

As drafted, First Revision 26 adds requirements that exceed OSHA requirements in 29 CFR 1910.157(g) for portable fire extinguishers and 29 CFR 1910.160 (b) for fixed extinguishing systems. Both of these OSHA provisions require annual, not semiannual training.

Statement of Problem and Substantiation for Public Comment

Inspection and maintenance records should be allowed to forwarded to, or shared with, the AHJ by hard copy (mail) or electronically (email or allowing access). The wording in the first revision could be misinterpreted to allow access by others. Replacing 11.2.9 with the proposed text clarifies that inspection and maintenance records can be shared with the AHJ by either method.
