Authorisation Conditions

Community event organisers are responsible for all costs associated with the design, manufacture, installation, maintenance and removal of its signs. This work is done at the organisations own risk and must not contravene any applicable law, code of practice or Australian Standard.

1. Permitted Use

The Authorisation allows the Applicant/s named above (the ‘Authorisation Holder’), subject to these conditions, to undertake the activity described on page 4 (office use) of this document at the times and dates approved.

2. Authorisation Area

The approval authorises the Permitted Use to be carried out in the approved location/s only.

3. Nature of Authorisation

3.1. The Authorisation does not take effect until:

3.1.1. any fee applicable has been paid and the application has been approved and signed by the Council, with a copy returned to the Applicant; and

3.1.2. the Applicant has provided a copy of a current certificate of public liability insurance for the sum of $20,000,000 and any fee has been paid.

3.2. The Authorisation does not confer on the Authorisation Holder any exclusive right, entitlement or proprietary interest in the approved area and does not derogate from the Council’s powers under the Local Government Act 1999 or any other legislation.

3.3. The Authorisation is personal to the Authorisation Holder and is not transferrable.

3.4. The Council may vary the Authorisation Conditions at any time by notice in writing to the Authorisation Holder.

3.5. The Council does not accept any responsibility or liability for vandalism, damage or theft to the Authorisation Holder’s property which is erected at their own risk.

3.6. This Authorisation does not permit an event to be held on Council land (separate approval is required).

3.7. Priority will be given to promotion of Council events and services to the community.

4. Expiry

The Authorisation expires on the date specified on page 4 (office use section) of this document.

5. Revocation

This authorisation may be revoked immediately (without written notice) by the Council if the Authorisation Holder fails to comply with any condition in this authorisation and the Authorisation Holder has no right of recourse against the Council or any right for financial reimbursement. Or where Council considers it necessary to do so in the interest of public safety or for the purpose of undertaking Council works in the area.

6. Insurance

6.1. The Authorisation Holder must take out and maintain throughout the term of the Authorisation a public liability insurance policy that:

6.1.1. insures the Authorisation Holder for the minimum sum of twenty million dollars ($20,000,000) against all actions, costs, claims, damages, charges and expenses whatsoever which may be brought, made or claimed against the Authorisation Holder in relation to the Authorisation Holder carrying on the Permitted Use; and

6.1.2. bears the endorsement of the insurer indicating the insurer accepts the indemnity given by the Authorisation Holder under the Authorisation.

6.2. Failure to maintain insurance as required by this clause is a breach of this Authorisation.

7. Indemnity

The Authorisation Holder indemnifies and will keep indemnified the Council (including its employees, servants and agents) from and against all actions, costs, claims, damages, charges and expenses whatsoever that may be brought, made or claimed against the Council (or its employees, servants and agents) arising out of or in relation to the issuing of the Authorisation, the Permitted Use and/or the actions or omissions of the Authorisation Holder and/or any person acting on the Authorisation Holder’s behalf.

8. Authorisation Holder’s Obligations

The Authorisation Holder must:

8.1. At the Authorisation Holder’s cost and expense in all things, comply with all applicable laws and all Council directions in relation to the Authorisation Holder’s use of the Authorised Area.

8.2. Make the Authorisation document available for inspection upon request by a Council officer.

8.3. Not cause, suffer or permit any damage to Council land or property. The Authorisation Holder is liable to pay to the Council the costs of making good any damage caused to Council land or property in connection with the Permitted Use.

8.4. Ensure the signage is properly installed, secured and maintained during the period they are erected

8.5. Ensure the Authorised Area is left in a clean and tidy state that is free from rubbish.

8.6. The Authorisation Holder must include on the back of the sign the contact details of the party responsible for the sign and the authorisation number.

9. General

9.1 The signage must promote an upcoming community event or activity that is being held within the City of Victor Harbor. Community events or activities may be cultural, social, educational, recreational or of an environmental nature. Advertising by commercial organisers will be limited to tourism and community interest events and activities in these categories. It is not the intention of this Authorisation for a commercial business to advertise goods for sale or product promotion.

9.2 Signs advertising events or activities of a political, religious, marginal or controversial nature as their focus, should be discussed at an early stage and will only be permitted subject to approval. Material that is deemed inappropriate or offensive to the community at large, or to any particular community sector will not be permitted.

9.3 Construction of signs / banners must meet with Council design specifications of but not limited to:

9.3.1 Be of a commercial quality material and fit for purpose

9.3.2 Must be non-reflective and suitable for windy conditions, banners should contain wind pockets

9.3.3 Signs for the Hindmarsh Road sign board must be 1800mm wide x 900mm high

9.3.4 Star droppers must include capping.

9.4 Unless otherwise approved by Council, event signs / banners may only be placed at approved sites

and must be securely fixed by appropriate means with an approved booking.

9.5 Temporary signs may be appropriate where a tourist attraction or service has limited or seasonal

relevance. However, events that occur weekly, fortnightly or monthly may only display signage for up

to one (1) week prior to the event and only subject to availability of space.

9.6 Non-compliant signage may be removed by Council staff if in breach of Authorisation conditions.

Unauthorised signage may be removed under Section 234 of Local Government Act 1999.

10. Special Conditions

The Authorisation Holder must comply with all special conditions (if any) which special conditions prevail in the extent of any inconsistency with the Permit Conditions above.

Council encourages event organisers to employ safe work practices and to assess each site

before installing and removal of any signage to ensure potential risks are identified and

managed. Consideration should be given to the number of people and appropriate tools required

for the safe installation of each sign.
