This design criteria provides information and lists requirements to be used in the preparation of plans andspecifications for Tenant’s mechanical and electrical work. Tenant’s plans and specification shall beprepared by and bear the seal of Architects and Engineers licensed by the Commonwealth ofPennsylvania and shall comply with current code requirements and meet the requirements of allgoverning agencies exercising jurisdiction.

Tenant’s plans and specifications, with calculations and supporting data, shall be submitted for review bythe Landlord. Work will not be permitted to commence without plans and specifications having priorreview and written acceptance of the Landlord, as well as that of all governing bodies exercisingjurisdiction. Landlord’s review is solely for conformance to this criteria and Landlord’s review shall not beconstrued to be a guarantee of design or function adequacy.

Tenant shall field verify exact location and size of demising premises, all service characteristics andlocations as well as any interference to the installation of Tenant’s work. Tenant shall immediately notifyLandlord of any discrepancies or interference and shall not commence any work prior to the resolutionthereof.

Tenant’s work shall be performed by licensed contractors. Tenant shall require any person performingsuch work to guarantee the work to be free from any and all defects in materials and workmanship for one(1) year from date of beneficial use or acceptance. Tenant shall also require any such person to beresponsible for the replacement or repair, without additional charge, of any and all work done, orfurnished by or through such person, which shall become defective or inoperable within one (1) year afterbeneficial use or acceptance. The correction of such work shall include, without additional charge, allexpenses and damages in connection with the removal, repair or replacement of any part of the workwhich may be damaged or disturbed thereby. All warranties and guarantees as to materials orworkmanship, with respect to Tenant’s work, shall be contained in the contract or subcontract which shallbe so written that such warranties or guarantees shall insure to the benefit of both Landlord and tenant,as their respective interests appear, and can be directly enforced by either. Tenant covenants to giveLandlord any assignment or other assurances necessary to affect the same.

Tenant’s work shall be coordinated with the work being done by Landlord and other Tenants, to suchextent that the Tenant’s work will not interfere with or cause delay of any other associated constructionwork or business conduct.

Tenant shall engage the services of licensed Architects, Engineers, and contractors who will work inharmony with each other and those of the Landlord. To this end there shall be no labor dispute whichwould interfere with the construction, completion and operation of the Mall.

Tenant agrees to deliver to Landlord a complete release of all liens associated with the Tenant’sconstruction work. Tenant shall provide public liability and property damage insurance, in such amountsas stipulated by Landlord, for all work performed by the Tenant’s contractors, subcontractors and/orsuppliers.

Tenant is responsible to procure any and all necessary permits and obtain written approvals fromLandlord and all governing agencies exercising jurisdiction including, but not limited to, hot work permit orsprinkler permit.

At the Tenant’s expense, and with the Landlord’s written approval, any and all existing mechanical,electrical and/or plumbing services, equipment or portion thereof not scheduled for re-use as part of theTenant’s construction, shall be demolished or otherwise safely terminated. A Tenant electing to reuseexisting services, equipment or portion thereof is permitted to do so provided that the Tenant’s Engineerand/or contractor deems these components acceptable for reuse in the new design. Tenant accepts fullresponsibility for the operational integrity of any and all existing equipment. The reuse of existingservices, equipment or portion thereof does not relieve the Tenant of the responsibility to furnish plans asaforementioned.

HVAC

EQUIPMENT

Tenant shall furnish and install a split system: all electric heating and air conditioning unit, complete withoutdoor condensing unit, indoor fan, refrigerant coil and filter unit, automatic temperature controls and airdistribution ductwork.

Condensing unit (outdoor Section) shall be located on roof dunnage provided by the Landlord (seelocation detail in addendum). Supplemental supports between dunnage and equipment shall be providedby Tenant and installed per details furnished by the Landlord. Tenant shall provide vibration isolatorsbetween condensing unit and support structure. Isolators shall be of the open spring type bolted to theequipment and support structure. Unit shall be labeled with Tenant name in 2” letters.

The HVAC equipment (indoor Section) may be floor supported and be approved by Landlord in writing.Suspended units must be installed per provided structural details and be approved by Landlord in writing.All indoor units shall be installed with isolators of the combination rubber in shear/spring type forsuspended units (for food court Tenants only) and housed springs with neoprene pads top to bottom forfloor mount units. All isolators shall be bolted to equipment and support structure.

Tenants must provide engraved phenolic identification tags with store name and space numberpermanently affixed to all equipment located outside the demised premises. All piping outside demisedpremises shall be painted by stencil with type of service, store name and space number.

All equipment remaining from previous tenant and not to be reused shall be removed by this tenant aspart of its work. Paperwork verifying equipment was removed and disposed of in accordance withFederal Regulations shall be provided to Landlord.

CAPACITY

HVAC heating and cooling load calculations shall be prepared and sealed by the Tenant’s ProfessionalEngineer and must be submitted on forms provided within the Tenant Criteria for review and approval bythe Landlord and for record purposes. Calculations shall be in accordance with the latest ASHRAEHandbook.

Design conditions indicated herein shall be minimum criteria values. Tenant’s whose installed oranticipated loads require equipment sizing greater than predicted on the minimum criteria shall utilize theactual installed and/or anticipated loads in the calculations. In no case shall loading be less than hereinstated.

Minimum Outside Air Supply shall be the greater of (for load calculations):

1. As required by local codes or2. As require by ASHRAE or3. 7-1/2 cfm person or4. An amount equal to the makeup air requirements supplied within the demised premises.

VENTILATION CRITERIA

Minimum total ventilation (air circulation) shall be in accordance with all applicable codes, but no less than6 air changes per hour.

The demised premises shall be maintained at a minimum positive pressure except as herein specified.The outside air supply shall be equal to a minimum of the demised premises exhaust requirements.

Odor producing areas such as food preparation, dining rooms, kitchens, pet stores, beauty parlors, etc. orspaces deemed by the Landlord, shall be exhausted to the atmosphere directly through the use ofmechanical fans and hoods as required. These areas shall be maintained under negative pressurerelative to the Mall and adjacent areas. Space exhaust air quantities shall exceed area outside air supplyby 10%. Should odors be objectionable, Landlord shall have the right to require an increase in theexhaust air rates to stop the migration of odor beyond the demised premises.

Minimum exhaust air requirements shall meet or exceed all government or regulator agencies and codes.

DUCTWORK

Tenant shall provide at their sole expense all duct work and accessories except as otherwise noted for airdistribution. All ductwork shall be designed in accordance with the procedures described in the AmericanSociety of Heating Refrigeration and Air conditioning Engineers guide (ASHRAE) and fabricated andinstalled in accordance with the latest methods recommended in the Sheet metal and Air-conditioningContractors National Association (SMACNA) low velocity dust manual, latest edition.

All supply air ducts (heating and cooling) and return air ducts and outside air ducts shall be galvanizedsteel with minimum 1” thick external (no internal allowed) acoustical and thermal insulation. All exhaustand relief air ducts shall be galvanized.

All kitchen hood exhaust ductwork shall be stainless steel where exposed within building. Concealedducts may be black steel or stainless steel. All elbows shall be throat radius type without running vanes.All gauges, fabrication and installation shall be in strict compliance with NFPA, local, state and federalagencies having jurisdiction and the Landlord’s insurance underwriters.

Tenants shall provide U.L. listed fire dampers at all penetrations of fire partitions as required by applicablecodes.

OUTSIDE AIR AND RELIEF AIR SYSTEMS

Ducts will be provided for each tenant for standard outside air and relief air requirements (maximum) 1.5cfm per square foot) with capped outlets stubbed to locations selected by the Landlord for connection,extension and hook up by Tenant. Refer to Smoke Control for additional requirements.

Outside air and exhaust system requirements for special systems shall be the sole responsibility of theTenant with approval by the Landlord. Landlord’s outside air ducts shall not utilized for special systemrequirements.

AUTOMATIC TEMPERATURE CONTROLS

The Tenant shall furnish and install a complete Automatic Temperature Control system for maintainingenvironmental conditions. The system shall incorporate the following:

1. Automatic Occupied/Unoccupied control2. Continuous ventilation on occupied mode3. Motorized outside air damper to be open during occupied periods only4. Economizer control for units above 5000 cfm (refer to Mechanical Criteria Modifications)5. Interface with “Smoke Control System” (refer to Mechanical Criteria Modifications)

TOILET EXHAUST SYSTEM

Each Tenant shall provide their own toilet exhaust system in accordance with the requirements of allapplicable codes. In no case shall Tenant’s system exhaust be less than 2 cfm per square foot of toiletroom area or 50 cfm which ever is greater.

Tenant shall provide an appropriately sized fan and backdraft damper. Lower level tenant shall run itstoilet exhaust duct(s) to an exhaust main provided by Landlord. Tenants shall connect ducts to theexhaust main at Tenant’s expense. Upper level Tenant shall run discharge duct through roof to dischargecap mounted on roof curb. Refer to Mechanical Criteria Modifications, and Division of Responsibility.

SMOKE CONTROL

SPECIAL EXHAUST SYSTEMS

Minimum Exhaust Air shall be based on codes and special requirements. Food and other odors fromkitchen, food preparation area, dining room and/or cafeteria areas must be exhausted to the atmospherethrough a tenant-furnished and installed up-blast exhaust fan UL listed for grease extraction. Theexhaust fan shall be provided with a drainage area at the bottom of the unit complete with a residuetrough equipped to be cleaned periodically by Tenant. The location of the exhaust fan shall be no lessthan 20’-0” away from any air intakes so as to avoid contaminating air supplied to other tenants. Ifnecessary, an additional duct extension of the fan discharge may be required if odors become a problemwithin the mall. Exhaust duct and fan location shall be submitted to Landlord for review and approval.Approval of location shall not relieve the Tenant from relocation responsibility should odor become aproblem within the Mall.

Tenant shall clean all filter and duct systems on a regular basis so that grease is not deposited on theroof. Any grease damage shall be corrected at Tenant’s sole expense within ten (10) days notification byLandlord.

Tenant is required to run exhaust fans so that no odors are allowed to enter the public mall or anyadjacent tenant spaces.

Makeup for exhaust systems from kitchen, food preparation area, dining area, and cafeteria area must beaccomplished by Tenant-furnished and installed make-up accomplished by Tenant-furnished andinstalled make-up air systems or at Landlord’s discretion from secondary mall air. No more than tenpercent (10%) or 100 cfm, whichever is less, of the air furnished to Tenant from Landlord’s air supplysystem can be used as supply air for Tenant’s special Exhaust System. Make-up air not supplied directlyto the exhaust hood shall be provided through the Tenant HVAC.

FOOD PREPARATION EXHAUST SYSTEMS SPECIAL REQUIREMENTS

Automatic extinguishing equipment shall be installed in accordance with the National Fire ProtectionAssociation Standard 96, latest edition, and the local codes.

The extinguishing system shall be Underwriter’s Laboratories approved CO2 or dry chemical pre-engineered system with the following features:

1. Protection of the hood and duct.

2. Surface protection for deep fat fryer, griddle, broiler and range.

3. Automatic devices for shutting down fuel or power supply to the appliances receiving the surfaceprotection. It should be noted that these devices must be of the manual reset type and notautomatic reset.

4. A readily accessible means to manually actuate the fire extinguishing equipment shall beprovided in a path of ingress or egress and shall be clearly identified. This means shall bemechanical and shall not rely on electric power for actuation.

5. The installation of these systems is to be made only by persons properly trained and qualified bythe manufacturer of the system being installed. Tenant shall also have an inspection agreementwith the firm whose personnel are properly trained and qualified (by the manufacturer) to makesuch inspections.

6. Before the system is fabricated and installed, the system’s vendor shall submit plans and otherpertinent information on the proposed system to Landlord for review and approval.

7. All exhaust system ductwork and exhaust fans used for exhausting cooking odors and grease-contaminated air shall be cleaned on a regular schedule by an established contract engaged inthat type of service. This cleaning will occur at intervals often enough to insure against greaseaccumulation in exhaust system, thus eliminating the probability of fires. Copy of all such serviceschedules and reports shall be provided to Landlord.

8. Springfield Mall Tenants Code Requirements effective 10/26/2006.

In occupancies not required to be equipped with a fire alarm system, actuation of a smokedetector shall activate a visible and an audible alarm signal in an approved location. Duct smokedetector trouble conditions shall activate a visible or audible signal in approved location and shallbe identified as air duct detector trouble. This shall occur inside the tenant space and is notrequired to be part of the mall system.

Tenants Bathrooms – Included in tenant’s space shall have Annunciators and Audibles.

Tenants Public Area – Fire alarm system must tie into Mall System.

PLUMBING CRITERIA

GENERAL

All plumbing materials shall be in strict accordance with the applicable codes and Mall criteria. Should aconflict occur, applicable codes shall prevail.

All plumbing piping shall be at Tenant’s option in accordance with the applicable codes.

Tenants may cut lower level slab where required to satisfy approved tenant design at Tenant’s soleexpense. Tenant shall be responsible for replacement of all backfill, compaction and concrete inaccordance with Landlord’s specifications. Tenant shall be responsible for replacing any existingunderground utilities which may be disrupted during Tenant Construction, as required by Landlord, inaccordance with Landlord’s direction. Upper level floor penetrations may be made only with theLandlord’s written approval. This work must be schedule so that no other tenant is inconvenienced ordamaged by the work. Any floor penetrations must be properly sealed, and have a 4” minimum highcollar projecting through and above the penetration. Waterproof membranes will be required for upperlevel tenants consuming water as a normal function of their business, i.e., restaurants, beauty salons, petshops, etc. Refer to Mall Management Office for all requirements.

Tenant shall provide toilet rooms within demised premises sized for appropriate occupancy; except forFood Court and Kiosk Tenants shall be permitted to utilize Public Mall Toilet Rooms.

PLUMBING SYSTEMS

DOMESTIC Water: Domestic cold water will be provided for each Tenant’s space with a ¾” fittingcapped, plugged and valved, stubbed to a location selected by the Landlord for connection, extensionand hook up by the Tenant. The Tenant shall be required to tap into the water main for any service whichis required over the ¾” provided. All water piping shall be insulated with a minimum ½” fiberglass withvapor barrier for cold water or Armstrong Armaflex 2000.

Soil & Waste: Soil and Waste piping will be provided for each Tenant’s space with a fitting capped andstubbed to a location selected by the Landlord for connection extension and hook up by the Tenant.Refer to Mechanical Criteria Modifications at the end of this section.

EQUIPMENT

All plumbing fixtures shall meet all applicable codes.

Waste closets shall be flush tank elongated water-saving-type unless otherwise required by codes andapproved by Landlord.

Lavatory trim shall be metering type at 0.25 gallons or 0.5 gpm.

Water Meters: Tenants hall provide a water meter valved at the inlet and outlet of the meter. The metershall conform to American Water Works Association specifications for domestic service.

Meter shall be direct reading in gallons and located with the demised premises at an accessible location(floor level) approved by Landlord.

A back flow preventer shall be provided after the water meter (refer to Township Code).

GREASE INCEPTORS

Grease Interceptors: Above floor individual grease interceptors adequately sized and in compliance withState, Local and Health Departments having jurisdiction shall be installed on all scullery sinks, prewashedsinks, dishwashers and other kitchen equipment as determined by the authorities having jurisdiction.Grease interceptor shall bear the Plumbing Drainage Institute seal (PDI) and shall be equal to JR Smithfloor-mounted series 8000/8100 and approved by the local authorities.

ELECTRICAL AND GAS SERVICE

ELECTRICAL SERVICE

1. General Information

a) Tenant’s electrical work shall be performed in full compliance with the most recent edition of theNational Electrical Code (NEC); State and local codes or ordinances. A Certificate ofInspection, issued by the recognized inspection agency, must be furnished to Landlord uponcompletion of the work.

b) The Tenant will be responsible for installing conductors from the Landlord’s Main Service. TheTenant’s electrical distribution center, including main circuit breaker, shall be coordinated withTenant’s feeder size, panel board, transformer and all other components necessary to meet theelectrical requirements of the Premises.

c) Primary service to the Premise shall be 277/480 volts, 3-phase, 4-wire, plus full size ground, 60hertz for all Tenants.

d) Tenant’s total connected electrical load shall not exceed twelve (12) watts per square foot ofTenant’s leased area. Tenant’s Engineer shall complete the attached Electrical LoadTabulation Form ET-1 and submit to Landlord for review. In the event the electric servicerequirements of the Tenant exceeds the capacity, referenced above, provided by the Landlord,the Tenant shall reimburse the Landlord on demand for any additional expense incurred by theLandlord for providing increased electric service to the Premises.

e) The Landlord will not be obligated to provide the Tenant with temporary electric service duringthe Tenant’s construction period. At the determination of the Landlord’s Engineer, the Tenantwill be responsible to reimburse the Landlord on demand for electrical service, temporary orpermanent, supplied from the Landlord’s distribution system.

2. Electrical Equipment:

a) Transformers: Tenant shall furnish and install 277/480 volt, 3-phase, 4-wire to 120/208 volt, 3-phase, 4-wire transformer for secondary distribution loads. Transformers shall be generalpurpose dry type with Class H insulation, mounted below finished ceiling.

b) Metering: Tenant shall furnish and install meter base socket. Landlord shall provide electricalmeter at Landlord’s expense.

c) Panel boards: Panel boards shall be 277/480 volt and 120/208 volt, 3-phase with solid neutral.Circuit breakers in 277/480 and 120/208 volt panel boards shall be bolted type. All panelboards shall contain twenty percent (20%) spare circuit breaker capacity. Single pole circuitbreakers shall be quick-lag type and 2-pole and 3-pole circuit breakers shall be common trip.Handle ties are not acceptable. Panel board loads shall be balanced. Tenant’s contractor shallbe responsible for furnishing completed panel board schedule.

d) Conduit and Conductors: Tenant’s electrical materials shall be new and bear the Underwriterslaboratories (UL) label. All wiring shall be in metal raceway. Flexible Metal (FM) conduit withfull-sized ground may be used in concealed locations where permitted by code. Non-Metallicsheathed cable (Romex) will not be permitted. Wire and cable shall be insulated copperconductors and in accordance with the NEC. Minimum conductor size shall be #12 AmericanWire Gauge (AWG).

e) Motor Disconnect Switches: Motor disconnect switches shall be fused or non-fused, standardduty horsepower rated, NEMA type, in enclosure suitable for the application.

f) Nameplates: Tenant equipment such as, but not be limited to, main service disconnect, meter(if applicable), distribution panel boards, lighting panel boards, motor starters and roof-mountedequipment shall be identified with individual permanent nameplates.

g) Tenant’s electrical installation shall be readily accessible for service and maintenance. Allconduits shall be concealed wherever possible. Exposed conduits shall be installed parallelwith or at right angles to column lines or beams. Sleeves, cored holes or other method ofpenetration of Tenant’s Premises shall be sealed and fire safe as required.

h) Supports: Supporting systems for electrical installations such as, but not limited to, hangers,miscellaneous steel, channels and rods shall be fastened to building structural steel, concreteor masonry. Support from other piping systems will not be permitted.

3. Kiosk Electrical Service:

a) Electrical services to kiosk locations are typically one (1) 20-amp 120-volt circuit.

4. Telephone Service:

a) Tenant shall be responsible for contacting the local Telephone company and for all installationcosts including service, conduit, outlets, deposits and associated costs.

b) Tenant’s electrical contractor shall install conduit with pull cord at all concealed locations.Exposed conduits shall be installed parallel with or at right angles to column lines or beams.

GAS SERVICE

Tenants requiring gas shall be responsible for coordinating with and obtaining service from PECOEnergy.

Tenant shall provide piping between gas meter and Tenant space at Tenant’s expense. In common mallareas, piping shall be hung from racks provided by the Tenant. Tenant shall make all final connections togas meter and extend piping to all equipment.

All work and testing shall be the responsibility of the Tenant in accordance with applicable codes and theutility company.

FIRE PROTECTION SPRINKLER SYSTEM

A fire protection sprinkler service shall be provided at each Tenant’s space. Modification and completionof sprinkler system shall conform to the Tenant’s approved plans and in accordance with the code andstandards of the governing insurance rating boards and/or governing authorities. Modifications requiredof the sprinkler system will be installed by the Tenant’s sprinkler contractor at Tenant’s expense inaccordance with approved sprinkler system plans. Any construction installed or omitted by the Tenantwhich causes an increased rate for insurance will be corrected, and the increased premium paid by theTenant. There are established fees pertaining to sprinkler shut down published by mall management.

Tenant’s sprinkler installation shall conform to the requirements and regulations of all authoritiesexercising jurisdiction. Sprinkler contractors are required to submit working drawings to Landlord’sInsurance Underwriter and to the local agencies exercising jurisdiction for approval prior to workcommencement. Submissions shall consist of three (3) sets of blue line drawings.

Tenant shall obtain directly, or through Tenant’s contractor, the services of an approved sprinklercontractor for installation of Tenant’s sprinkler system.

Tenant’s sprinkler installation shall conform to the requirements and regulations of the Landlord’sinsurance Underwriters including, but not limited to, the following:

1. The sprinkler system installation, including all appurtenances, shall meet Americans with DisabilitiesAct (ADA) requirements.

2. Where applicable, Tenant shall provide sprinkler protection at rear service corridor door offset fromLandlord’s sprinkler system main.

3. Food Preparation Tenants using open cooking equipment must install self-contained fire suppressionsystem or other approved systems.

Tenant’s sprinkler contractor shall be responsible for payment of Landlord’s sprinkler system drain downfee.

Tenant’s sprinkler contractor shall connect to the capped or blank flange outlet of the Landlord’s sprinklersystem. Pressure test(s) must be accomplished in accordance with the criteria established by Landlord’sInsurance Underwriters and industry standards and witnessed by Landlord’s representative. Tenant’ssprinkler contractor must immediately make repairs of any defects in the sprinkler installation.

Tenant shall be responsible to forward on (1) set of approved sprinkler system drawings to the Landlord.

Prior to requesting a shutdown of the Landlord’s sprinkler system for connection of or modification to theTenant’s sprinkler system, the Tenant or the Tenant’s sprinkler contractor, must obtain written approvalfrom the Landlord’s Insurance Underwriter and present same to Landlord.

Hot Work Permit: Tenant’s contractor shall be responsible to obtain and secure a Hot Work Permit(s)from Landlord. A Hot Work Permit is required for any and all open flame welding or cutting such as butnot limited to welding, soldering and brazing.
