NOTICE INVITING TENDER

On behalf of the Executive Officer, T.T. Devasthanams, Tirupati sealed tenders are invited by the Office of The Assistant Executive Officer, New Jewellery, Old Huzur Office, Tirupati for “WOODEN STRUCTURE OF OLD SILVER CHARIOT FOR SRI TIRUMALA TEMPLE”. The intending tenderers should satisfy the following criteria.

A The Tenderer must be registered as Jewellery Contractor in Jewellery Section.

B The tenderer should have completed Gold Malam work with at least 50.0 Kg of Gold in any financial year either in TTD / other endowments , proof to be attached.

C The Tenderer should have a labour turnover of at least Rs. 5,00,000/- (Rupees Five lakhs only) in any one year during the last 5 financial years, proof to be furnished.

D Should produce the Solvency certificate issued by a nationalized/ scheduled bank for Rupees not less than Rs. 5,00,000/- (Rupees One lakh only).

E Earnest Money Deposit (EMD) of Rs. 3,00,000.00 (Rupees Three lakhs only) shall be paid by DD.

The intending participants may obtain the tender documents in person from the O/o The Assistant Executive Officer, Jewellery Section, Old Huzur Office, Tirupati during the working hours from 10:30 AM to 5.00 PM on the dates give below by duly paying an amount of Rs. 500 /- (Rupees Five hundred only) which is non-refundable, towards the cost of tender documents by way of Demand Draft drawn on any scheduled bank favoring the Executive Officer, TTDs, Tirupati. 2. We will not make any claim or demand upon TTD, based upon or arising out of any alleged misunderstanding, misconception or mistake.

4. In the unlikely event of the tender being withdrawn by us, the EMD (Earnest Money Deposit) amount may be forfeited by TTD.

6. If our tender is accepted the EMD will be retained by TTD for further fulfillment of the contract.

8. We understand and agree that TTD is not bound to accept the lowest bid that it receives under this tender.

9. We also understand and agree that TTD reserves the right to cancel all or any applications under this tender without assigning any reasons or explanations and if necessary call or re-tendering.

10. If our tender is accepted, we agree to enter into a formal agreement with TTD to affect the delivery of products or services under this tender.

TENDER RULES1. Eligible Tenders :

1.1 THE QUALITATIVE REQUIREMENTS FOR PRE-QUALIFICATION ARE AS FOLLOWS AND ONLY THOSE PARTICIPANTS, WHICH FULFILL THE FOLLOWING CRITERIA, ARE ELIGIBLE TO BE EVALUATED. FURTHER, IT IS TO BE NOTED THAT THOSE AGENCIES NOT FULFILLING THE FOLLOWING CRITERIA WILL BE SUMMARILY REJECTED AND IN THIS REGARD, THE DECISION OF T.T.D. IS FINAL AND BINDING ON THE TENDERERS WITHOUT ANY RECOURSE.

A The Tenderer must be registered as Jewellery Contractor in Jewellery Section.

B The Tenderer should have a labour turnover of at least Rs. 5,00,000/- (Rupees Five lakhs only) in any one year during the last 5 financial years, proof to be furnished.

2. Cost of Tendering2.1 The tenderer shall bear all costs associated with the preparation

and submission of the tender. The TTD, will in no case, be responsible or liable for these costs, regardless of the conduct or outcome of the tendering process.

3. Bid documents:3.1 The tender Documents include :

3.2.1

The tenderer is expected to examine all instructions, forms, terms and specifications in the tender Documents. Failure to furnish all information required as per the tender Documents or submission of tender not substantially responsive to the tender Documents in every respect will be at the tenderer’s risk and may result in

rejection of the tender.

4. Clarification of Tender Documents:4.1 A prospective tenderer, requiring any clarification of the tender

Documents shall notify TTD in writing or by FAX at the TTD’s mailing address indicated in the Notice inviting tender. The TTD shall respond in writing to any request for clarification of the tender Documents, which it receives not later than 14 days prior to the date for the submission of tenders. Copies of the query (without identifying the source) and clarifications by TTD shall be sent to all the prospective tenderers who have received the bid documents.

4.2 Tenders must be received by TTD at the address specified in Notice inviting tender not later than the prescribed time on due date. Tender schedules shall not be received by post/courier. Tender schedules are not transferable. Tenderers shall drop the tender covers in the tender box kept in the following address. Office of the The Assistant Executive Officer, Jewellery, Old Huzur Office, T.T.Devasthanams, Tirupati. The due date and time are a specified in “Notice inviting tender”.

5. Amendment of Tender Documents:5.1 At any time, prior to the date of submission of tenders, the TTD

may for any reason, whether at its own initiative or in response to a clarification requested by a prospective tenderer, modify the tender documents by amendments.

5.2 The amendments shall be notified in writing by FAX to all prospective tenderers on the address intimated at the time of purchase of tender document from TTD and these amendments will be binding on them.

5.3 In order to afford prospective tenderers reasonable time to take the amendments into account in preparing their tenders, the TTD may, at its discretion, extend the deadline for the submission of bids suitably.

6. Tender Form:6.1 The tenderer shall complete the tender form and the appropriate

price schedule furnished in the tender Documents.

7. Bid Prices:7.1 The tenders shall give the total composite price inclusive of

Service Tax payable at applicable rates from time to time. The Income Tax, surcharge & Cess on Income Tax at applicable rates shall be deducted from the Gross Bill of the contractor. The offer shall be firm in Indian Rupees.

7.2 Prices indicated on the Price Schedule shall be entered in the following manner:I The price quoted shall be total price inclusive of all taxes and levies payable to the bidder.

II The bidder shall quote only one price for each item and if more than one price is quoted under different options the rate quoted by him in

the first option only will be valid and will be taken for evaluation as per price schedule given for all the items given in the schedule of requirement.

7.3 The prices quoted by the tenderer shall generally remain fixed during the period of contract, subject to revision of rates if any by the Government. A tender submitted with an adjustable price quotation is likely to be treated as non-responsive and rejected.

7.4 The unit price quoted by the tenderer shall be in sufficient details to enable to TTD to arrive at prices of proposed manpower offered.

7.5 “Discount”, if any, offered by the tenderers shall not be considered unless they are specifically indicated in the price schedule. Tenderers desiring to offer discount shall therefore modify their offers, suitably while quoting and shall quote clearly net price taking all such factors like Discount, free supply, etc. into account.

7.6 The price approved by TTD for procurement of the service will be inclusive of levies and taxes, as mentioned in para 7.1 above.

8. Documents establishing tenderer’s eligibility and qualification:

8.1 The tenderer shall furnish, as part of his tender documents establishing the tenderer’s eligibility all the following documents or whichever is required as per terms and conditions of tender documents.

I Certificate of incorporation in case of companies participated.II Articles of Memorandum of Association or partnership deed as the case may be.

III The bidder shall furnish PAN number, along with IT returns of last 3 years duly audited & certified by a chartered accountant.

8.2 The bidder shall furnish Annual report and/or a certificate from its bankers as evidence that he has financial capability to perform the contract.

9. Submission of tenders9.1 The offer shall be submitted in sealed cover for the service to be

provided. The covers should be super scribed with the headings ‘TENDER FOR Gold Malam on Copper parts to cover WOODEN STRUCTURE OF OLD SILVER CHARIOT FOR SRI TIRUMALA TEMPLE.

9.2 The envelope containing Technical Bid should include the EMD. The whole of this Tender documents other than the price schedule duly signed by the Tenderer along with the Agency Profile and standard printed technical literature/brochure about the agency with connected certificates of testimonials, registrations etc., which are all required for evaluating the bid as mentioned in S.No. 1 should be enclosed along with the Technical Bid.

9.3 The envelope containing Price Schedule should include only the price quote for the services offered (as per the format enclosed). Please note that no other information other than the price (rate) should be furnished along with this offer.

9.4 The two envelopes of technical and price bids for the services rendered as above shall in turn be put in a sealed outer envelope to be superscripted “Technical and Price Schdule for the Gold Malam on Copper parts to WOODEN STRUCTURE OF OLD SILVER CHARIOT FOR SRI TIRUMALA TEMPLE.

9.5 If additional allied services are offered, it may be furnished as optional feature explaining whether those are with/without extra cost, mentioning both in technical and price bid documents. However the basic quote should be confined only to the requirement asked for.

9.6 Negotiations will not be made with all the tenderers. In case of necessity negotiations will be made only with the lowest selected tenderers and in this regard the decision of the Committee or the decision of the Executive Officer, T.T.D, shall be final and binding on the tenderers without any recourse.

9.7 The tenders with over-writing, alternations etc., will not be admitted unless they are attested by the tenderer. Tenders should be neatly typewritten and every correction should be invariably attested by full signature with date before submission of Tenders to the authority concerned, failing which the tenders will not be eligible for further consideration. Errors, if any, will be corrected/ accepted by the tender accepting authority at its discretion. Telegraphic and Pencil Quotes will not be accepted. Unsigned tender forms will be rejected.

i) Where there is a discrepancy between the rates in figures and in words, rate in words will govern and

ii) Where there is a discrepancy between the unit rate and the line item, the total resulting from multiplying the unit rate by the quantity, the unit rate as quoted will govern.

9.8 The TTD may, at its discretion extend the deadline for the submission of the bids by amending the bid documents in accordance with Clause 7 in which case all rights and obligations of TTD and bidders previously subject to the deadline will thereafter be subject to the new deadline as extended.

10. Late Tenders:10.1 Any tender received by TTD after the deadline for submission of

tenders prescribed by TTD pursuant to Clause 9, Shall be rejected and returned unopened to the bidder.

11. Opening of tenders by TTD11.1 The TTD shall open tenders in the presence of tenderers or their

authorized representatives who chose to attend, at 15:30 hrs on due date. The tenderer’s representatives, who are present, shall sign in an attendance register. The tenderers shall submit

authority letter to this effect before they are allowed to participate in bid opening.

11.2 A maximum of two representatives for any tenderer shall be authorized and permitted to attend the tender opening.

11.3 The tenderer’s names, and any other details as the TTD, at its discretion, may consider appropriate; will be announced at the opening.

11.4 The date fixed for opening of tenders, if subsequently declared the holiday

by the TTD, the revised date of schedule will be notified. However, in the

absence of such notification, the bids will be opened in the next working

day, time and venue.

12. Clarification of Bids:12.1 To assist in the examination, evaluation and comparison of

tenders the TTD may, at its direction ask the tenderer for the clarification of its tender. The request for clarifications on the response shall be in writing. However, no post tender clarification at the initiative of the tenderer shall be entertained.

13. Preliminary Evaluation:13.1 TTD shall evaluate the bids to determine whether they are

complete, whether any computational errors have been made, whether required sureties have been furnished, whether the documents have been properly signed and whether the bids are generally in order. All certificates pertaining to the manpower agency shall be enclosed with the tender schedules. No further opportunity will be given to the tenderer for providing technical and any other details.

13.2 If there is a discrepancy between words and figures, the amount in words

shall prevail. If the supplier does not accept the correction of the errors, his

bid shall be rejected.

14. Contacting TTD.14.1 Subject to Clause 12, no tenderer shall try to influence TTD on any

matter relating to its tender, from the time of the tender opening till the time the contract awarded.

14.2 Any effort by a tenderer to influence TTD in the TTD’s tender evaluation, tender comparison or contract award decision shall result in the rejection of the tender.

15. Placement of Order.15.1 The TTD shall consider placement of orders on those tenderers

whose offers have been found technically, commercially and financially acceptable.

16. TTD’s Right to vary quantities at time of Award.16.1 TTD will have the right to increase or decrease up to 25% of the

quantity of goods and services specified in the tender without any change in the unit price or other terms and conditions at the time of award of contract.

17. TTD’s Right to accept any tenderer and to reject any or all tenders.

17.1 The TTD reserves the right to accept or reject any tender, and to annul the tendering process and rejection of tenders including cancellation of Tenders, at any time prior to award of contract without assigning any reason whatsoever and without thereby incurring any liability to the affected tenderer or tenderers on the grounds for the TTD’s action.

18. Annulment of Award.18.1 Failure of the successful tenderer to comply with the requirements

of service shall constitute sufficient ground for the annulment of the award and forfeiture of the bid security in which event the TTD may make the award to any other bidder at the discretion of TTD or call for new bids.

GENERAL TERMS AND CONDITIONS OF THE CONTRACT

THE PREPARATION OF THE Gold Malam on Copper parts to cover WOODEN STRUCTURE OF OLD SILVER CHARIOT FOR SRI TIRUMALA TEMPLE CONSISTING 9 LAYERS , CONVERSION OF GOLD INTOGOLD FOILS, CUTTING MELTING, SHEETING, BUFFING AND FINISHING ETC. AND FIXING THE COPPER SHEET AFTER GOLD MALAM

1 Tirumala Tirupati Devasthanams being a religious Institution and a place of public religious worship also having sub shrines, utsavams, mantapams, tanks and other necessary appurtenant structures is desirous to have personnel only from Hindu Community.

2 The labour rates should be quoted including cost of all consumable materials and all other charges and taxes if any for complete work including final fitting charges. Each tenderer should quote the total labour charges for preparation of conversion of gold into gold foils, cutting melting, sheeting buffing and replacing of defected of copper parts etc., and fixing the existingcopper sheet after gold malam on the WOODEN STRUCTURE OF OLD SILVER CHARIOT FOR SRI TIRUMALA TEMPLE

3 The Copper sheet (19 guage ) and gold will be supplied by TTD. The Tenderer should make his own arrangements for conversion of gold into gold foils, cutting melting, sheeting buffing and finishing etc., and fixing the copper sheet after gold malam on WOODEN STRUCTURE OF OLD SILVER CHARIOT FOR SRI TIRUMALA TEMPLE. All materials should be accounted for by weight in the entire process.

6 The entire work should be completed within the 5 (Five) months from the date of issue of material to the utmost satisfaction of TTD and should confirm to the specifications including final fitting.

7 TTD at its discretion may form a committee to select the agencies from those applied before TTD as per the guidelines mentioned and in this regard the decision of the Committee and TTD shall be final and binding on the Applicant without any recourse

8 The successful tenderer should make his own arrangements for weight of the sheets before and after the Gold Malam . The Tenderer will be held responsible for any losses and such losses will be made good from him.

9 The process details may be given condition as follows :(a) The “Gold Malam work sheet” should be fixed on the copper

sheets covered on WOODEN STRUCTURE OF OLD SILVER CHARIOT FOR SRI TIRUMALA TEMPLE.

(b) The copper or brass screws used for fixing the sheets should not be visible

10 The payment will be made on the weight of finished product after completion of the work. No advance payment will be made.

11 The rates for labour charges mentioned above shall remain in force till the completion of the work and no enhancement of rates shall be considered under any circumstances. The agency shall be liable to be

cancelled in case of improper work as per the Schedule.

13 The Tenderer should be prepared to arrange to take up the work to be done in the workshop where TTD provides under the supervision of a committee comprising of officials and non-officials. The tenderer should undertake to provide workmanship of the highest order and he should be prepared to indemnify T.T.D. against any loss or damage due to defective work.

14 The accommodation for the workshop will be provided by T.T.D. The technical materials required for Gold Malam on Copper parts to cover WOODEN STRUCTURE OF OLD SILVER CHARIOT FOR SRI TIRUMALA TEMPLE should be arranged by the Tenderer with the skilled labourers.

15 The Tenderer should complete the work within the schedule of time fixed in the work-order. Failure to fulfill the time-schedule will lead for rejection of supplies, impose of cut or forfeiting of EMD or all or any other action as decided by the T.T.Ds.

16 The Designs prepared and other balance materials for this purpose should not be used elsewhere and should be returned to T.T.Ds. after completion of work without which the payments will not be made. Any violation/reproduction for other purposes will be viewed seriously which may even lead for taking appropriate action on the Tenderer in the Court or Courts.

17 The entrusted work will be completed in 5 (Five) months from the date of issue of the Material. There will be a penalty clause of Rs.5000/- (Rupees five thousand only) on everyday of default as the time of completion in the work.

23 The Tenderer is informed that TTD may find if necessary to postpone or cancel the assignment and/or reduce the quantities. However, every effort will be made to give as early as possible notice of any changes. In the event of termination the amount shall be paid to the extent of carrying out the assignment to the date of termination and report or parts thereof, or any other information and documentation gathered under this contract prior to the date of termination shall be handover to TTD.

24 The Tender will be responsible for compensation, insurance of the goods in transit during this assignment. The Tenderer has general liability insurance of goods while forwarding to T.T.Ds. against all damages, cost and charges and expenses for any untoward incidents or damage to any property arising out of, or in connection with, the services which result from the fault of Transportation or any other reasons.

25 The Tenderer shall indemnify and hold harness TTD against any/and all claims, demands and/or judgments of any nature brought against TTD arising out of the contract. The obligation under this paragraph shall survive even after the termination of this contract.

26 It is specifically accepted by the Tenderer/contractor that no employee of the Tenderer/ contractor shall under no circumstances be treated or deemed to be an “Employee” of TTD and TTD shall not have or be

asked to or expected to accept or accepted any responsibility or liabilities as an “Employer” to any of the employees of the Tenderer/Contractor for the reason of making any payment continuously or extending any facility under this contract.

27 Prohibited Sub Contracting: The agency shall not assign this contract to a sub contractor or any portion of it. Further the contract or any part, shares or interest of the contract is not to be transferred or assigned by the contractor directly to any person whomsoever.

28 Disclosure of information: The agency also agree that, all knowledge and information not with in the public domain which may be acquired during the carrying out of this contract, and after termination shall be for all time and for all purpose, regarded as strictly confidential and held in confidence, and shall not be directly or indirectly disclosed to any person whatsoever, except with the written permission of TTD.

29 Earnest Money Deposit (EMD): The tenderer shall deposit Rs. 2,03,000.00 (Rupees Two lakhs three thousand only) along with the tender in shape of Demand Draft drawn on any scheduled Bank in favour of Executive Officer, TTD, Tirupati and payable at Tirupati. The tenders with out EMD will be summarily rejected. The EMD of the unsuccessful tenderers will be refunded after the expiry of SIX months period from the date of the tender or after finalization of tenders which ever is earlier.

30 Security Deposit: The Security Deposit (2.5%) where in collected from the payment of labour charges. The EMD / Security Deposit will be refunded to the party of the second part after completion Defect Liability Period of 2 (two) years. No interest will be paid by TTD on the EMD/Security Deposit.

31 The tenderer should quote the rates both in words and in figures other wise their offer will not be considered. In case of any discrepancy between the rates quoted in words and figures, the rates quoted in words will prevail.

32 Payment: The standard payment terms of TTD are applicable and all statutory deductions applicable at the time shall be made from the payment. No advance will be paid against the order and agreed rates will be valid during the currency of the contract subject to revision of rates by the Government if any. The renewal of contract if required will be based on evaluation by TTD and the agreed rates shall continue till replaced by another contract. The payments are made by TTD through cheque only and it is to specifically ensure that all payments to personal shall be made by the agency only through Bank Accounts.

33 Documents required:a) Labour charges bill specifying the quantum of work

undertaken. The above document required is not exhaustive and it is to be specifically noted that without the above documents, the bills of the agency shall not be processed by TTD.

34 The Agency shall be responsible for the payment of wages, salary

allowances and any statutory contributions on behalf of the personnel employed and for others in pursuance of the contract with TTD and the TTD will not be liable on this count. The agency shall also hold and renew such of the licenses, registration, permit etc., and maintain/furnish such of the records as may be required under any Law or relevant rules from time to time.

35 The Executive Officer, TTD, Tirupati reserves the right to give preference to any Agency in the interest of the Organization at any time before the acceptance of the tender and the decision of the Executive Officer is final and binding on tenderers without any recourse.

36 TTD reserves the right to charge penalty as decided by the Asst. Exe. Officer, Jewellery, TTD, Tirupati or withhold payment for any unsatisfactory service rendered by the agency without prejudice to its other rights. In this regard, the decision of the Assistant Executive Officer (Jewellery) is final. The agency is further liable to reimburse/compensate the TTD or third party for any loss, damage, injury, harm etc., caused or arisen out of the negligence, rashness or any other act of its personnel employed or breach of contract.

37 All prohibitory activities applicable to TTD as a whole and in sacred Tirumala Hills in particular have to be followed strictly by all. Further, it is to inform to the tenderers that under Section 114 of Act 30 of 1987 any person contravening any prohibitory orders passed in this regard shall be punishable with imprisonment, which may extend to 3 months or with fine which may extend to Rs. 500 /- or with both.

38 TTD shall not be making any over time payment to the staff supplied by the contractor for this purpose to TTD.

39 The TTD reserves the right to terminate/amend/modify the contract without assigning any reason or advance notice to the tenderer. Similarly, the terms of the tender may be amended/modified by TTD, if necessary, to ensure competitiveness and quality of service. The terms and conditions of the contract includes Tender Rules specified in the Tender document.

40 The TTD reserves the right to add/delete/change/modify any or all the conditions mentioned in the tender schedule and the said addition / deletion / changes / modifications can also be incorporated in the agreement to be entered into with the tenderer at a latter date irrespective of tender conditions mentioned in the notice inviting tender or in the tender schedule and further if required the same can be incorporated in a form of codicil as the case may be and the same will be binding on the contract without any recourse.

41 If the tenderer, in the opinion of TTD, fails or neglects to be complied with any of the terms and conditions of the contract or with any orders issued, then in such a case, the TTD shall without prejudice to any other right or remedies under this contract as a right and be entitled to cancel the contract by giving a notice in writing to the contractor without being liable to pay any compensation for such cancellation.

42 The Agencies/ Firms who apply for pre-qualification documents have to furnish the declaration that “ They have not been black listed in any organizations”. Any wrong declaration in this regard which comes to the notice at a later date will disqualify them from tendering

in future in TTD and the tenders so received shall be automatically rejected.

43 Force Majeure:If, at any time, during the continuance of this contract, the performance in whole or in part by either party of any obligation under this contract is prevented or delayed by reasons of any war or hostility, acts of the public enemy, civil commotion, sabotage, fires, floods, explosions, epidemics, quarantine restrictions, strikes, lockouts or act of God (hereinafter referred to as events) provided notice of happenings of any such eventuality is given by either party to the other within 21 days from the date of occurrence thereof, neither Party shall by reason of such event be entitled to terminate this contract nor shall either party have any claim for damages against other in respect of such non-performance or delay in performance, and deliveries under the contract shall be resumed as soon as practicable after such an event come to an end or cease to exist, and the decision of the TTD as to whether the deliveries have been so resumed or not shall be final and conclusive. Further that if the performance in whole or part of any obligation under this contract is prevented or delayed by reasons of any such event for a period exceeding 60 days, either party may, as its option, terminate the contract.

44 Action where no specification:-In the case of any class of specifications or class of work of which there is no mention in the specifications or in the terms and conditions, such specifications shall be carried out in accordance with the instructions and requirement of TTD.

45 The intending tenderers should submit the tender duly signed in each and every page and should also mention that the conditions of the tender are thoroughly studied by the tenderer and tenderer is agreeing to the conditions. Otherwise the tender will not be accepted.

46 The successful tenderer has to enter into an agreement with in (7) seven days of intimation, on Non-judicial stamp paper of Rs. 100 /- duly paying the security deposit as specified in the tender schedule.

47 In the event of any breach of agreement at any time by the contractor, the Contract will be terminated by the concerned officer TTD, Tirupati without any compensation payable to the contractor. The contract may also be put to an end at any time by the officer concerned, TTD, Tirupati on giving (7) Seven days notice to the contractor. Further any dispute arising will besubject to the jurisdiction of Tirupati only.

48 The tenderer for the sake of uniform comparison should not add any condition and such of those tenders, which stipulate any condition, are liable for rejection.

49 During the period of the contract, the prevailing Income Tax (inclusive of surcharge on IT), Education Cess on IT and taxes as applicable from time to time will be deducted from the gross payment of each bill of the contract.

50 The TTD reserves the right to accept or reject any tender and to cancel the process and to reject all tenders at any time prior to the award of the contract without assigning any reasons and also under no

obligation to inform the affected tenderer the ground of acceptance or rejection of the same. In this regard, the decision of the Executive Officer, T.T. Devasthanams is final and binding on the tenderers without any recourse.

51 Further, it is to specifically be accepted by the tenderer when the Tenderer files the tender before T.T. Devasthanams that the acceptance or rejection of the tender by T.T. Devasthanams or methodology adopted by T.T. Devasthanams in short-listing the Agencies/Firms for the supply of tender requirements shall not become a cause of Action or Ground for the tenderer to initiate any legal action before any Court or Courts of Law for obtaining any order, Injection, direction etc., from the Hon’ble Court or Courts to stall the proceedings in T.T.Devasthanams.
