NOTICE INVITING TENDER

RENOVATION OF HOSTEL BLOCK at JNIBF CAMPUS Gachibowli, Hyderanbad

M/S........................... ................................. ............................. Sealed tenders are invited on behalf of IDBI Bank Ltd. for "Renovation of hostel block at JNIBF campus at Gachibowli,Hyderabad". The time of completion of the work shall be 8 Months. IDBI Bank Ltd. wants to renovate premises in a time bound schedule and hence timely completion shall be the main essence of the contract. The work shall be taken up in phases as decided by the Bank and only after completion of the particular phase of work in all respects the next phase of work will be taken up. The whole work shall be completed within 8 months from the date of issue of work order. If the work is not completed within the aforesaid period the contractor shall pay the Employer, or the Employer shall be entitled to deduct from the money due to the said contractor, the sum of 0.5% of contract value per week of delay or part thereof, subject to a maximum limit of 5% of the total contract value. The soft copy of the tender documents will be made available to pre-qualified contractors through their mail addresses indicated in the prequalification applications. The hard copy of the Tender documents shall also be made available to the prequalified contractors on payment of Rs.1,000/- (Rupees one Thousand only) towards the cost of documents in cash. Each tender document will have Volume-I & Volume-II, comprising Conditions of Contract, Form of Tender, Form of Agreement, Special Conditions of Contract; General & Detailed Specification; as well as Bill of Quantities and Tender Drawings (as listed in document). The Earnest Money Deposit amounting to Rs.1,50,000/ (Rupees one Lakh Fifty thousand only) must accompany each tender in the form of Demand Draft/Pay Order/Banker‟s cheque drawn in favour of IDBI Bank Ltd, payable at Hyderabad. Tender not accompanied by the Earnest Money Deposit shall be rejected.

Sealed tenders in the prescribed format (The Envelope No.1 & Envelope No.2 shall both together be enclosed in a separate Envelope), superscribed with the name of work shall be dropped only in the tender box kept in the office at JNIBF campus upto 3:00 pm, May 14, 2014 in a sealed cover addressed to The General Manager (FIMD), IDBI Bank Limited, JNIBF, Gachibowli, Hyderabad - 500032. The Part 1 of the tender will be opened on the same day at 3:30 pm in the presence of the bidders who wish to be present.

The contents of the envelope should be as follows:

Envelope No.1:To contain (i) Earnest Money (ii) Volume-I of the tender documents.

Envelope No. 2:To contain only the Price Bid & Declaration complete in all respects i.e.

Volume - II of the tender documents. Envelope No. 1: It will be opened at 3:30 pm on the same day i.e., May 14, 2014

in the presence of Tenderers or their authorized representatives who may be present at the time of opening of tender.

The tenderer may refrain from submitting conditional tenders. In case any tenderer puts any condition, he should be available himself or his authorised representative at the time of opening

of the envelope No.1 of the tender. After assessing the condition(s), the Employer shall notify to the tenderer / their authorised representative at the time of opening of Envelope No.1, its decision on the condition(s). Employer‟s decision shall be final and binding on the contractors. However, the contractor shall have the choice to revise their price bid(s). The original price bid in Envelope No.2 along with the revised price bids, if any, shall be opened on the same day at 4:00 pm or on any subsequent day with intimation to the participating tenderers. Envelope No.2 of only those tenderers complying with the above conditions shall be opened. The envelope No. 2 of the Tenderers who do not agree to comply with the above requirement will be returned unopened in due course On behalf of Date: IDBI Bank Ltd.

Instructions for Tendering 1. Before tendering, the Tenderer shall visit the site, mock-up room and also carefully

examine the Tender Documents, General Conditions of Contract, Special Conditions of Contract, General Specification, Detailed Specification, Drawings and other Specifications referred to therein, the Schedule and the Bill of Quantities, and if there should be or appear to be any ambiguity in or discrepancy between any of these documents or between figured and measured dimensions upon the Drawings, he should immediately refer the matter to the Bank / Architect for clarification.

2. Time is the essence of the contract and work must be completed within the time schedule

as indicated in the Appendix to the form of Tender. 3. The tenderer shall ascertain the location, size and condition of the areas available for his

use as working areas and all other information affecting this Tender. 4A (i) The Tenderer shall complete the annexed Form of Tender, Schedules and Bill of

Quantities with the whole of the prices and information called for therein, and shall sign and date each of the documents in the space provided for the purpose. The Tenderer shall initial each page of the Tender Documents. (ii)The Tender shall be signed by person or persons so authorized by the Tenderer with signature duly witnessed. In the case of a corporation, the Tender shall be signed by the officers so authorized by the corporation with its seal duly affixed. In case of a consortium, the Tender shall be signed by the officers so authorized by each corporate member of the consortium and the Tender shall be fixed with the corporation seals of each member of the consortium. (iii)The Tenderer shall furnish Address, Tel. No., Cell Phone No., E-mail I.D. & Fax No. for serving notices required to be served to the Tenderer in connection with the Tender.

4B The rates shall be filled both in figures and in words. In case there is any discrepancy in

the rate indicated in figures or words, the rate indicated in words shall be taken into consideration.

5. The Tender Form and the documents attached to it shall not be detached one from the

other, and no alteration or mutilation (other than filling in all the blank spaces) shall be made in any of the documents attached hereto. Any alterations or erasures to the entries in the attached documents shall be made by a separate covering letter, otherwise it shall not be entertained.

6. Each Tenderer will be issued with one copy of Conditions of Contract, Form of Tender, Form of Agreement, Special Conditions of Contract, General and Detailed Specifications, drawings and one copy of the Bill of Quantities.

7. Interested Tenderers who have purchased the Tender Documents but not submitted the

Tender, should return back all documents. 8. No Tender will be considered which is not accompanied by a sum of Rs.1,50,000/-

(Rupees one Lakh Fifty thousand only) as Earnest Money which is to be lodged on the understanding that, in the event of the Tenderer withdrawing his Tender before the

expiration of ninety days from the date fixed for receiving Tenders or such other dates as the Tenderer may be required to extend the date, the Tender would be cancelled and the Earnest Money will be forfeited to the Employer, and on the understanding also that if the Tender is accepted, the Bond or Guarantee referred to in Conditions of Contract would be furnished when required. The Earnest Money shall be paid by Bank draft/Pay Order/Banker's Cheque drawn in favour of IDBI Bank Ltd, payable at Hyderabad and shall be furnished in Envelope No.1; otherwise the Tender (Envelope No.2) will be returned unopened marked as "Refused". The Earnest Money will be returned to unsuccessful bonafide Tenderers within three months after the date fixed for receiving tenders or at such earlier time as a tender may have been accepted by the Employer. In the case of the successful Tenderer, the Earnest Money will be adjusted towards security money. The Earnest Money will not bear any interest.

9. The Tenderers should note that the tender is strictly on item rate contract and the rate

quoted for each item should be self supportive.

10. The Employer will not be responsible or pay for expenses which may be incurred, or

losses to person or property suffered by any Tenderer in connection with visits to site and examination of the site and in the preparation of his tender for submission.

11. The Tenderer (whether or not he submits a tender) shall treat the details of the

documents as secret and confidential. 12. The Employer reserves the right to adjust arithmetical or other errors in any Tender in the

way, which he considers suitable. Any adjustments so made by the Employer shall be stated to the Tenderer if the Employer shall make an offer to accept the Tender.

13. The Employer does not bind himself to accept the lowest or any Tender and has the right

to refuse any Tender without assigning any reason. The Employer also has the right to re-issue the Tender without Tenderers having right to object against such re-issue.

14. The contractor shall quote his rate to include the cost of material as per specification,

necessary wastage, labour, other materials, adhesives, VAT, sales tax, excise duty, Service Tax, Octroi, way bills/road permit, transportation to work site, lifting of all required material from ground floor to work site, removal of debris from the site to outside premises at a place as permitted by local municipality, cleaning of site on daily basis, Insurance, all other taxes as applicable etc. all inclusive.

1. Having visited the site and examined the Drawings, Conditions of Contract, Special Conditions

of Contract, General Specifications and Detailed Specifications, Schedules and Bill of Quantities of the above named work, we offer to furnish, complete and maintain the whole of the said work in conformity with the said Drawings, Conditions of Contract, Specifications, Schedules and Bill of Quantities of this Tender Documents or such other sum as may be ascertained in accordance with the said conditions of contract.

2. We undertake to complete and deliver the whole of the Work comprised in the Contract within

the time stated in the Appendix hereto. 3. We have independently considered the amount of Liquidated Damages shown in the Appendix

hereto and agree that it represents a fair estimate of the loss likely to be suffered by you in the event of the work not being completed in time.

4. If our Tender is accepted, we will obtain third Party Insurance policy from an Insurance

Company approved by you. 5. We agree to abide by this Tender for the period of three months from the date fixed for

receiving the same and it shall remain binding upon us and may be accepted at any time before the expiry of the period.

6. Unless and until a formal Agreement is prepared and executed this tender together with your

Appendix to form of tender

Form of Agreement

1. Articles of Agreement made at ................ this __________________ day of _____________ 2014 IDBI Bank Limited, a Bank registered under the Companies Act, 1956 (1 of 1956) and a ”Banking Company” within the meaning of Section 5 (c) of the Banking Regulation Act, 1949 (10 of 1949) and having its registered office at IDBI Tower, WTC Complex, Cuffe Parade, Colaba, Mumbai – 400 005, in the State of Maharashtra (hereinafter referred to as “the Bank”), having branch office at ,.............................. hereinafter called the Employer (which expression shall include its successors and assigns wherever the context or meaning shall so required permit) of the one part and M/s _________________________________ hereinafter called ‘The Contractor’ of the other part. Whereas the Employer is desirous of taking up furnishing work in hostel block at JNIBF campus, Gachibowli, Hyderabad has got drawings, Specifications and the Schedule of Quantities prepared which have been signed by or one behalf of the parties hereto. CONDITIONS OF CONTRACT

1. Definitions & Interpretations In the Contract (as hereinafter defined) Definition of the following words and expressions shall have the meanings, unless the context otherwise requires herein respectively assigned to them:

„Approved‟ means approved in writing; „Approval‟ means approval in writing.

„Bill of Quantities‟, „Schedule of Quantities‟ means items specification, the Quantities of items, materials, rates, conditions etc.

„Completion of the Work‟ means the completion of the whole of the work in all respect as evidenced by issuance of a Certificate of Completion by the Bank / Bank / Architects in pursuance of Clause 52 of the General Conditions of Contract.

"IDBI" means IDBI Bank Ltd.

„Contractor‟ means ____________________________________________________ and include the Contractor‟s personal representatives successors and permitted assigns.

„Conditions‟ means the Conditions of Contract.

„Contract‟ means this agreement and all documents which form part thereof and/or annexed thereto and all amendments thereto made in accordance with the provisions hereof.

„Contract Price‟ means the sum setout herein and shall be subject to additons and/or deductions and relates in accordance with the provision herein contained, materials, apparatus, equipment, plant, fittings and things.

„Construction‟ means all appliances or things of what-so-ever nature required in or about the execution, completion of maintenance of the work of Temporary Work (as herein after defined) but does not include Materials or other things intended to form or forming part of the Work.

„Drawings‟ means the drawings referred to in the specification and any modification of such drawings approved in writing by the Bank / Bank / Architects and such other drawings as may from time to time be furnished or approved in writing by the Bank / Bank / Architects. The Work is to be carried out in accordance with drawings, specifications, the Bill of Quantities. A set of drawings is provided with the tender to give the general idea about the total renovation. Successful contractors shall be issued with renovated drawings. In case any detailed Drawings are necessary contractor shall prepare such detailed drawings and/or dimensional sketches therefor and have it confirmed by the Employer/Bank / Bank / Architects prior to taking up such work. The Contractor shall ask in writing for all classifications on matters occurring anywhere in drawings, specifications on matters occurring anywhere in drawings, specification and bill of quantities or to additional instructions at least 10 days ahead from the time when it is required for implementation so that the Employer/Bank / Bank / Architects may be able to give decision thereon.

„Employer‟ „Owner‟ means IDBI Bank Ltd and includes the Employer‟s representatives, successors and assigns.

„Bank / Bank‟s Architect‟ means ---------------------------------------------------or any other agency appointed by the Employer to perform the required duties.

„Bank / Bank's Architects / Bank‟s Representative / Architects - in - Charge‟ means any engineer/Bank‟s officer/clerk of work appointed from time to time by the Bank / Bank‟s Architects to perform the duties set forth in Clause 2 hereof whose authority shall be notified in writing to the Contractor by the Bank / Bank‟s Architects on such appointment.

„Period of Maintenance‟ shall mean the period of 12 calendar months calculated from the date of virtual completion of the work certified by the Bank / Bank‟s Architects or at the discretion of the Bank / Bank‟s Architects from the date of virtual completion of the work certified by the Bank / Bank‟s Architects.

„Materials‟ means the materials, apparatus, equipment, fittings and other things for incorporation in the work.

„Month‟ means calendar month.

„Permanent Work‟ shall mean the work, which are of a permanent nature and are not Temporary Work.

„Special Conditions‟ means the Special Conditions of Contract.

„Specification‟ means specifications including Indian or British or other approved standard specification where so required.

„Site‟ means places on under in or through which the work are to be executed or carried out any place provided by the Employer for the purposes of the work together with such other places as may be specifically designated in the Contract as forming part of the Site.

„Work‟ means the work described in the „Scope of Work‟ and/or to be executed in accordance with the Contract and includes materials apparatus, equipments, fittings and things of all kinds to be provided.

„Temporary Work‟ means all temporary work of every kind required in or about the execution, completion or maintenance of the work.

Words inputting the singular only also include the plural and vice versa where the context required.

The marginal headings or notes shall not be deemed to be a part of the clauses and shall not be taken into consideration in the interpretation on construction thereof on the Contract.

All other work shall have the meaning assigned to them elsewhere in the Contract. 2. Duties of Bank / Bank's / Architect's representative

The duties of the Bank / Bank's / Architect's representative are to watch and supervise the work and to test and examine any materials to be used and the workmanship employed in connection with the work. He shall have no authority to relieve the Contractor of any of his duties or obligations under the contract nor except as expressly provided hereunder or elsewhere in the Contract to order variation in quantity, extension of time limit, extra items, arbitration and extra final payment.

The Bank / Bank / Architects may from time to time in writing delegate to the Bank / Bank's / Architect's representative any of the powers and authorities vested in the Bank / Bank's / Architect's powers/authorities delegated to the Bank / Bank's / Architect's representative by the Bank / Bank / Architects will be made known to the contractor in writing by the Bank /

Bank / Architects. Any written instruction or approval given by the Bank / Bank's / Architect's Representative to the Contractor within the terms of such delegation (but not otherwise) shall bind the Contractor and Employer as though it had been given by the Bank / Bank / Architects. Provided always as follows:

Incorrect approval or failure of the Bank / Bank's / Architect's representative to disapprove

any work or materials shall not prejudice the power of the Bank / Bank / Architects thereafter to disapprove such work or materials and to order the pulling down removal or breaking up thereof. If the Contractor shall be dissatisfied by reasons of any decision of the Bank / Bank's / Architect's Representative he shall be entitled to refer the matter to the Bank / Bank / Architects who shall thereupon confirm reverse or vary such a decision.

3. ASSIGNMENT

The whole of the work included in the Contract shall be executed by the Contractor and the Contractor shall not directly or indirectly transfer, assign or underlet the contract or any part, share of interest therein nor shall be taken a new partner without the written consent of the Bank / Bank / Architects and no subletting shall relieve the Contractor from the full and entire responsibility of the Contract of from active superintendence of the work during its progress.

4. Scope of work

The scope of work includes the renovation of hostel rooms in JNIBF campus, Gachibowli, Hyderabad. The Contractor shall carry out and complete the work in every respect in accordance with the directions and to the satisfaction of the Bank / Bank / Bank / Architects, who shall be the final authority. The Bank / Bank / Architects may in their absolute discretion issue further drawings and / or written instructions, details, directions and explanations, which are hereafter collectively referred to as “The Bank / Bank's / Architect's Instructions”. The variation or modification of the design, quality or quantity of work or the addition or omission or substitution of any work. Any discrepancy in the drawings or between the Schedule of quantities and/or drawing and/or Specification. The removal from the site of any materials brought thereon by the Contractor and the substitution of any other material therefor. The removal and/or re-execution of any work executed by the Contractor. The Dismissal from the work of any persons employed thereupon. The opening up for inspection of any work covered up. The amending and making good of any defects under clause 42 (Execution of repair work etc. during period of maintenance.

The Contractor shall forthwith comply with and duly execute all work comprises in such Bank / Bank's / Architect's Instructions provided always that verbal instructions, directions, and explanations given to the Contractor of his foreman upon the work by the Bank / Bank / Architects shall if involving an variation be confirmed in writing by the contractors within seven days. Rates of items not mentioned in the Priced Schedule of Quantities shall be fixed by the Bank / Bank / Architects. If compliance with the Bank / Bank / Architects Instructions as aforesaid involves extra work and/or was beyond that was contemplated by the Contract then unless the same were issued owing to some breach of this Contract by the Contractor, the Employer shall pay to the Contractor the price of the said work as extra to be valued as hereinafter provided and/or expense and/or loss.

Bank / Bank / Architects whose decision shall be final and binding on the contractor, Figured dimensions shall be followed in preference to scale. The Contractor shall provide himself for ground and fresh water for carrying out of the work at his own cost. The Employer shall not charge the Contractor for his own un-rented ground or for water out of his own well. The Employer shall on no account be responsible for he expense incurred by the Contractor for hired ground or water obtained from elsewhere. The Employer‟s tube wells, if any, shall not be available for Contractor‟s use. The Contractor shall make his own arrangements for water required for work and installation of power pump and pipe line.

5. Languages The language in which the contract documents shall be drawn up shall be English. 6. Documents mutually explanatory

Except if and to the extent otherwise provided by the Contract the provisions of the Conditions of Contract shall prevail over those of any other document forming part of the Contract. Subject to the foregoing the several documents forming the contract are to be taken as mutually explanatory of one another but in case of ambiguities or discrepancies the same shall be explained and adjusted by the Bank / Bank / Architects who shall thereupon issue to the Contractor instructions directing in what manner the work is to be carried out.

7. Custody of Drawings

i) The drawings shall remain in the sole custody of the Bank / Bank / Architects but two copies thereof shall be furnished to the Contractor free of cost. The Contractor shall provide and make at his own expense any further copies required by him. At the completion of the Contract the Contractor shall return to the Bank / Bank / Architects all drawings provided under the contract and copies if any made by the Contractor

ii) The Contractor shall give adequate notice in writing to the Bank / Bank / Architects or the

Bank / Bank's / Architect's representative of any further drawing or specification that may be required for the execution of the work or otherwise under the Contract.

iii) Drawing to be kept at site One copy of the Drawings furnished to the Contractor as aforesaid shall be kept by the Contractor on the Site and the same shall at all reasonable time be available for inspection and use by the Bank / Bank / Architects and the Bank / Bank's / Architect's representative and by any other person authorized by the Bank / Bank / Architects in writing in this behalf.

8. Disruption of Progress

The Contractor shall give adequate written notice to the Bank / Bank / Architects whenever planning or progress of the work is likely to be delayed or disrupted unless any further drawing or order, including a direction, instruction or approval, is required to be issued by the Bank / Bank / Architects. The notice shall include details of the drawing or order required and of why and by when it is required and of any delay or disruption likely to be suffered if it is late.

9. Further drawings and instructions

The Bank / Bank / Architects shall have full power and authority to supply to the Contractor from time to time during the progress of the Work such further drawings and instructions as shall be necessary for the purpose of the proper and adequate execution and maintenance of the Work and the Contractor shall carry out and be bound by the same.

10. Contractor‟s General responsibilities

i) The Contractor shall, subject to the provisions of the contract and with due care and diligence, execute and maintain the Work and provided all labor, including the supervision thereof, materials, constructional plant and all other things, whether of temporary or permanent nature, required in and for such execution and maintenance, unless the same according to this Contract is to be provided by the Employer or the Bank / Bank / Architects.

The Contractor shall carry out and complete the Work in accordance with good Bank / Architecture practices and using materials and workmanship of the quality and standards therein specified provided that where and to the extent that approval of the quality of materials or of the standards of workmanship is a matter of opinion, such quality and standards shall be to the satisfaction of the Bank / Bank / Architects/ Bank / Bank's / Architect's Representative.

11. Materials and workmanship to be best

All materials and workmanship shall so far as procurable be of the respective kinds described in the Priced Schedule of Quantities and/or Specifications and in accordance with the instructions of the Bank / Bank / Architects and the Contractor shall upon the request of the Bank / Bank / Architects furnish them with all invoice, accounts, receipts and other vouchers to prove that the materials comply therewith. The contractor shall at his own cost arrange for and/or carry out any test of materials which the Bank / Bank / Architects may require.

12. i) Letter of Intent

Before the signing of the Contract, the Employer may issue to the Contractor Letter of Intent to enter into a Contract with the Contractor for the execution of the work in accordance with the Contract. Upon issue of such Letter of Intent by the Employer the Employer shall be deemed to have signified his intention to award the Contract, however the process shall be deemed to be complete only when the Contract has been entered into by the Employer and the Contractor by duly acknowledge of the “Letter of acceptance” issued by the Bank / Bank / Architects, unconditionally.

ii) Contract Agreement

The Contractor shall when called upon so to enter into the execute a Contract agreement enter into the same with the Employer.

13. Execution of agreement

After acceptance of the Tender , the Tenderer shall sign the necessary agreement within 7 days of intimation.

14. Inspection of site

The Contractor shall be entitled if he so desires to inspect and examine the site and its surroundings and shall satisfy himself before submitting his tender as to the form and nature of the site, the quantities and nature of the work, materials, necessary for the completion of the work, the means of access to the site, the accommodation he may require and in general, the rules regulations and statutory obligations he has to fulfill and shall himself obtain all necessary information (subject as above mentioned) as to risks contingencies and other circumstances which may influence or effect his Tender or the obligations assumed by him under the Contract.

15. Sufficiency of Tender

The Contractor shall be deemed to have satisfied himself before entering into of the Contract as to the Correctness and sufficiency of the rates and prices stated in the priced Bill of quantities and the Schedule of Rates and prices (if any) set out in the Contract and rates and prices shall except in so far as it is otherwise provided in the contract cover all his obligations under the Contract and all matters and things necessary for the proper completion and maintenance of the work.

16. work to be to done to the satisfaction of Bank / Bank / Architects and employer

The Contractor shall execute complete and maintain the Work in strict accordance with the Contract to the satisfaction of the Bank / Bank / Architects and Employer and shall comply with and adhere strictly to the Bank / Bank's / Architect's Instructions and directions on any matter (whether mentioned in the Contract or not) touching or concerning the work. The Contractor shall take instruction sand directions only from the Bank / Bank / Architects or (subject to the limitations referred to in Clause 2 and mentioned in the agreement hereof) from the Bank / Bank's / Architect's Representative.

17. i) Programme to be furnished

Within 3 days of receiving letter of intent the Contractor shall prepare and submit detailed Programme of work showing the order in which he proposes to carry out the work including design, manufacture, delivery to site, erection and commissioning. While preparing the detailed program of work, The contractor shall keep in view the completion period as specified in the tender. The submission and approval by the Bank / Bank / Architects of such program shall not relieve the Contractor of any of his duties or responsibilities under the Contract or from adhering to the time schedule. Thereafter the Contractor shall furnish detailed monthly programmes. The programmes shall provide for the orderly performance of the work within the time specified in time schedule and in accordance with the requirements of the Contract.

ii) Progress Report

Fortnightly progress reports shall be provided by the Contractor indicating the actual state of progress during the course of the contract.

18. Contractor‟s Superintendence

The Contractor shall give and/or provide all necessary superintendence during the execution of the work and as long thereafter as the Bank / Bank / Architects may consider necessary for the proper fulfilling of the Contractor‟s obligations under the Contract. The Contractor or its competent and authorized agent or representative approved of in writing by the Bank / Bank / Architects (which approval may at any time be withdrawn) is to be constantly on the work and shall give his whole time to the superintendence of the same. Such representatives shall be adequately qualified and have the required experience in similar work. If such approval shall be withdrawn by the Bank / Bank / Architects the contractor shall as soon as is practicable (having regard to the requirement of replacing him as hereinafter mentioned) after receiving written notice of such withdrawal remove the agent from the Site and shall not thereafter employ him again on the site in any capacity and shall replace him by another agent approved by the Bank / Bank / Architects. Such authorized agent or representative shall receive on behalf of the contractor directions and instructions from the Bank / Bank / Architects of (subject to the limitations contained in the Contract) the Bank / Bank's / Architect's representative.

19. Contractor‟s Senior representative

i) The Contractor shall have on site at all times during working hours throughout the course of the Contract at least one competent representative who shall be empowered to make decisions binding on the Contractor in respect of all materials likely to arise in connection with the execution of the work at site and shall keep the Bank / Bank / Architects and the Employer informed at all times about the name and designation of such representative only Contractor‟s Representative shall have the power to take joint measurement and sign the measurement books/bills.

ii) Removal of Employees

The Bank / Bank / Architects shall be at liberty to object to and require the Contractor to remove forthwith from the work any person employed by the Contractor in or about the execution or maintenance of the work who in the opinion of the Bank / Bank / Architects

misconducts himself or is incompetent or negligent in the proper performance of his duties or whose employment is otherwise considered by the Bank / Bank / Architects to be undesirable and such person shall not be against employed upon the work without the written permission of the Bank / Bank / Architects. Any person so removed from the work shall be replaced as soon as possible by a competent substitute approved by the Bank / Bank / Architects.

20. Setting out

The Contractor shall be responsible for the true and proper setting-out of the Work in relation to original points lines and levels of reference given by the Bank / Bank / Architects in writing and for the correctness (subject as above mentioned) of the position levels provision of all necessary instruments appliances and labour in connection therewith. If at any time during the Progress of the Work any error shall appear or arise in the position levels dimensions or alignment of any part the of the Work the Contractor on being required so to do by the Bank / Bank / Architects or Bank / Bank's / Architect's representative shall at his own expense rectify such error to the satisfaction of the Bank / Bank / Architects or the Bank / Bank's / Architect's representative. The checking of any setting out or of the line or level by the Bank / Bank / Architects or the Bank / Bank's / Architect's representative shall not in any way relieve the Contractor of his responsibility for the correctness thereof and the Contractor shall carefully protect and preserve and bench-marks sight-fulls pegs and other things used in setting out the work.

21. Watching & lighting

The Contractor shall in connection with the work provide and maintain at his own cost all lights, guards, fencing and watch & ward staff when and where necessary or required by the Bank / Bank / Architects or Bank / Bank's / Architect's representative or by duly constituted authority for the protection of the work or for the safety and convenience of the public or others.

22. i) Care of Work Indemnification of Employer

From the commencement to the completion of the work the Contractor shall take full responsibility for the care thereof and of all Temporary Work and in case any damage loss or injury shall happen to the work or to any part thereof or to any Temporary Work from any cause whatsoever (save and except the excepted risks as defined in sub-clause (ii) of this Clause) shall at his own cost repair and make good the same so that at completion the work shall be in good order and condition and in conformity in every respect with the requirements of the Contract and the Bank / Bank's / Architect's instructions. In the event of any such damage, loss or injury happening from any of the excepted risks the Contractor shall if and to the extent required by the Bank / Architect and subject always to the provisions of Clause 55 hereof repair and make good the same as aforesaid at the cost of the Employer. The Contractor shall also be liable for any damage to the Work occasioned by him in the course of any operations carried out by him for the purpose of complying with his obligations under Clause 25 hereof. The Contractor shall indemnify the Employer from all risks on this account.

ii) Excepted Risks The “expected risks” are war (whether declared or not) hostilities, invasion, act of foreign enemies, rebellion, revolutions, insurrection, civil commotion (other than among the Contractor‟s own employees) riot use or occupation by the Employer of any portion of the Work in respect of which a Certificate of Completion has been issued or accuse solely due to the Bank / Bank's / Architect's design of the Work or any such operation of the forces of nature as reasonable foresight and ability on the part of the Contractor could not foresee or reasonably provide against (all of which are herein collectively referred to as “the excepted risks”).

23. i) Insurance of Work The Contractor before commencement of work shall in the joint names of the Employer and Contractor insure the work for a value not less than contract value of the work against loss and damage from whatever cause including but not limited to fire, lighting, explosion, storm, tempest, flood, bursting or overflowing of water tanks, apparatus or pipes, earthquake ,aircraft and other aerial devices or articles dropped therefrom riot and civil commotion for all work executed and all unfixed materials and goods, delivered to placed on or adjacent to the Work and intended therefor but excluding temporary buildings, plants, tools and equipment owned or hired by the Contractor or nay Sub-Contractor, and shall keep such work, material and goods so insured until Practical Completion of the Work. Such insurance shall be with insurers approved by the Employer and the Contractor shall deposit with the Employer the policy or policies and the receipts in respect of premiums paid; and should the contractor make default in insuring or continuing to insure as aforesaid the Employer may himself insure against any risk in respect of which the default shall have occurred and deduct a sum equivalent to the amount paid by him in respect of premiums from any monies due or to become due to the Contractor.

ii) Making good damaged work Upon acceptance of any claim the insurances aforesaid the Contractor with due diligence shall restore the work damaged replace or repaid any unfixed materials or goods which have been destroyed or injured remove and dispose of any debris Work. All monies received from such insurances (less only the aforesaid percentage (if any shall be paid to the Contractor by installments under certificates of the Bank / Architect issued at the Period of Interim Certificates named in the Appendix to form of Tender. The contractor shall not be entitled to any payment in respect of the restoration of work damaged, the replacement and repair of any unfixed materials of goods and the removal and disposal of debris other than the monies received under the said insurances.

24. i) Insurance against Injury to persons & property

Without prejudice to his liability to indemnify the Employer under these Condition the Contractor shall maintain and shall cause any Sub-Contractor to maintain such insurances as are necessary to cover the liability of the Contractor or, as the case my be, of such Sub-Contractor in respect of Personal injury or death arising out of or in the course of or caused by the carrying out of the work not due to any act or neglect of the Employer or of any person for whom the Employer is responsible and in respect of injury or damage to property, real or personal, arising out of or in the course of any negligence, omission or default of the Contractor, his servants or agents or, as the case may be, of such Sub-Contractor, his servants or agents. The insurance in respect of claims for personal injury to, or the death of any person under a contract of service of apprenticeship with the Contractor or Sub-Contractor or as the case my be, and arising out of and in the course of such person‟s employment, shall comply with the applicable laws, regulation and any statutory orders made thereunder or any amendment or reenactment thereof. For all other claims to which this sub-clause applies the insurance cover shall be the sum stated in the Appendix to Form of Tender (Or such greater sum as the Contractor may choose) for any one occurrence or series of occurrences arising out of one event.

ii) As and when he is reasonably required so to do by the Employer the Contractor shall produce and shall cause any Sub-Contractor to produce for inspection by the Employer documentary evidence that the insurances required by this sub-clause are properly maintained, but on any occasion the Employer may (but not unreasonably or vexatiously) require to have produced for his inspection the policy or policies and receipts in question.

25. i) Injury to Persons and Property & Employer‟s Indemnity

The Contractor shall be liable for and shall indemnify the Employer against any liability, loss, claim, or proceedings whatsoever arising under any statute or at common law in respect of personal injury to or the death of any person whomsoever arising out of or in the course of or caused by the carrying out of the Work, unless due to any act or neglect of the Employer or of any person for whom the Employer is responsible.

ii) Except of such loss or damage as is at the risk of the Employer under the contract the

Contractor shall be liable for and shall indemnity the Employer against, any expense, liability, loss, claim or proceedings in respect of any injury or damage whatsoever to any property real or personal in so far as such injury or damage arises out of or in the course of or by reason of the carrying out of the Work, and provided always that the same is due to any negligence, omission or default of the Contractor, his servants or agents or of any sub-Contractor his servants or agents.

26. i) Giving of Notice & payment of fees

The Contractor shall give all notices and pay all fees required to be given or paid by any Central or state Statute Ordinance or other Law or any Regulation or Bye-law of any local or other duly constituted authority in relation to the execution of the Work or of any Temporary Work and by the rules and regulations of all public bodies and companies affected in any way by the Work or any Temporary Work.

ii) Compliance with statues, regulations, etc.

The Contractor shall conform in all respects with the provisions of any such statute ordinance or Law as aforesaid and the regulation or Bye-Laws of any local or other duly constituted authority which may be applicable to the work or to any Temporary work and with such rules and regulations of public bodies and companies as a aforesaid and shall keep the Employer indemnified against all penalties and liability of every kind for breach of any such statute ordinance or law regulation or bye-law.

27. Authorities Notices and patents

The Contractor shall conform to the provisions of any Acts of the Legislature relating to the work, and to the Regulations and Bye-Laws of any Authority, and/or any water, lighting and other Companies, and/or Authorities with whose system the structure is proposed to be connected, and shall, before making any variations from the drawings or Specifications that may be necessitated by so conforming give to the Bank / Bank / Architects written notice specifying the variations proposed to be made and the reasons for making them and apply for instructions thereon. In case the Contractor shall not within seven days receive such instructions he shall proceed with the work conforming with the Provisions Regulations or Bye Law in question.

27.1 In particular, the Contractor shall be responsible to register themselves under the

Contract Labour (Regulation and Abolition) Act 1970 and Rules thereunder and they must comply with and carry out all the provisions and obligations under the said Act and Rules and furnish all information to Employer as may be required by it and shall also indemnify the Employer against any penalties/claims arising from any default, on their part.

27.2 The Contractor shall arrange to give all notices required by the said Acts, Regulations

or Bye Laws to be given to any Authority, and to pay to such Authority or to any Public Office all fees that may be properly chargeable in respect of the work and lodge the receipts with the Bank / Bank / Architects.

27.3 The Contractor shall indemnify the Employer against all claims in respect of patent

rights and shall defend all actions arising from such claims unless he has informed the Bank / Bank / Architects before any such infringement and received his permission to proceed and shall himself pay all royalties, licence fees, damages costs and charges of all and every sort that may be legally incurred in respect thereof.

27.4 The Contractor should observe that his work shall not cause any nuisance to the

Public in general and to the neighboring occupants in particular.

27.5 Should the Contractor desire to work on Sundays, Holidays and during night, permission in writing from the Bank / Bank / Architects must be obtained in time. It shall be the responsibility of the Contractor to obtain permission from Civil Authorities if necessary.

27.6 The Contractor shall indemnify the Employer from and against all claims and

proceedings for or on account of infringement of any patent rights design trade mark or name or other protected rights in respect of any Constructional Plant machine work or material used for or in connection with the Work or Temporary Work or any of them and from against all claims demand proceedings damages costs charges and expenses whatsoever in respect thereof or in relation thereto. Except where otherwise specified the Contractor shall pay all tonnage and other royalties rent and other payments or compensation (if any) for getting stone and gravel clay or other materials required for the Work or Temporary Work or any of them.

28. Opportunities for other contractor/Agencies

The Contractor shall in accordance with the requirements of the Bank / Architect afford all reasonable opportunities for carrying out their work to any other Contractor or agencies employed by the Employer and their workmen and to the workmen of the Employer and of any other duly constituted authority who may be employed in the execution on or near the site of any work not included in the contract or of any contract which the Employer may enter into in connection with or ancillary to the work. For any dispute in the matter, the same should be referred to Employer/Bank / Architect and decision given by them will be binding.

29. i) Contractor to keep site clear

During the progress of the work the Contractor shall keep the site reasonable free from all unnecessary obstruction and shall store or dispose of any constructional plant and surplus materials and clear away and remove from the site any wreckage, rubbish or temporary work no longer required.

ii) Clearance of Site on completion

On the completion of the Work the Contractor shall Clear away and remove from the site all constructional plant surplus materials rubbish and temporary work of every kind and leave the whole of the site and work clean and in a workmanlike condition to the satisfaction of the Bank / Architect not later than one month from the completion of the work.

30. i) Engagement & Conditions of Labour

The Contractor shall make his own arrangements for the engagement of all labour. In respect of the engagement, employment, wages, transport, paying, feeding, housing and working conditions of labour and of all matters connected therewith the Contractor shall be responsible and liable and shall at all times during the continuance of the Contract obligations imposed on him any the provisions and requirements of any Central or State Statute ordinance or other Law or any Regulation or Bye-law of any local or other duly constituted authority which may be applicable including any such law regulation or order passed or made of coming into force during the period of the Contract.

ii) Supply of Water

The Contractor shall having regard to local conditions provide on the Site to the satisfaction of the Bank / Architect an adequate supply of drinking and other water for the use of the Contractor‟s staff and workmen.

iii) Alcoholic Liquor or Drugs The Contractor shall not any time give sell or barter any alcoholic liquors or permit or suffer any such sale, gift or barter to be made by any Sub-Contractor, nor importation of any alcoholic liquors into India.

iv) Arms and Ammunition The Contractor shall not any time import or sell, give, barter or otherwise dispose of any arms or ammunition or explosive of any description to any person or persons whatsoever nor permit or suffer any of his Sub-Contractors agents or employees to make any such sale, gift, barter or other disposition.

v) Festivals & Religious Customs The Contractor and Sub-Contractors agents and employees shall in all their dealings with their workmen and laborers for the time being employed on or in connection with the work have due regard to all recognized festivals and religious and other customs.

vi) Epidemics In the event of any outbreak of illness of an epidemic nature the Contractor shall comply with and carry out such regulations orders and requirements as may be made by the Government or Governments concerned or the local medical or sanitary authorities for the purpose of dealings with the overcoming the same.

vii) Disorderly Conduct The Contractor shall at all times take all reasonable precautions to prevent any unlawful, riotous or disorderly conduct by or amongst his employees and for the preservation of peace and protection of persons and property in the neighborhood of the work against the same but the Contractor shall not interfere with member of any authorized Police Force who shall have free and undisputed access at all times to any part of the work in the execution of their duties.

viii) Accidents The Contractor shall within 24 hours of the occurrence of any accident at or about the site or in connection with the execution of the work report such accident to the Bank / Bank's / Architect's representative. The Contractor shall also report such accident to the competent authority whenever such report is required by law.

ix) Fair Wages The Contractor shall in respect of all persons employed by him in every factory, workhop or other place occupied or used by him for the execution of the Contract including the work pay rates or wages emoluments and expenses and observe hours and conditions of labour not less favourable than those established for the trade or industry in the district where the work is carried out by agreement machinery of negotiation to which the parties are organisations of employers and trade unions representatives respectively of Substantial proportions of the employers and workers engaged in the trade or industry in the district. In the absence of such established rates and conditions the contractor shall pay rates or wages, hours and conditions observed in the trades or industries similar to those in which the Contractor is engaged. The Contractor shall comply with the provisions of all labour legislation including the requirements of:

The payment of Wages Act Employer‟s Liability Act Workmen‟s Compensation Act Contractor Labour (Regulation & Abolition) Act, 1970 and Central rules 1971. Apprentices Act 1961. Any other Act of enactment relating thereto and rules framed thereunder from time to time.

x) Observance by Sub-Contractor

The Contractor shall be responsible for the observance by Sub-contractors employed by him in the execution of this Contract of the provisions hereof and applicable laws, rules and regulations.

xi) Returns of Labour, etc. The Contractor shall if required by the Bank / Architect deliver to the Bank / Bank's / Architect's representative or at his office a return in detail in such form and at such intervals as the Bank / Architect may prescribe showing the supervisory staff and the numbers of the several classes of labour from time to time employed by the Contractor on the Site and such information respecting Constructional Plant as the Bank / Bank's / Architect's representative may require.

31. (a) i) Quality of Materials & Workmanship & Test

All materials and workmanship shall be the best of the respective kinds described in the Contract and in accordance with the Bank / Bank's / Architect's instructions and shall be subjected from time to time to such tests as the Bank / Architect may direct at the place of manufacture of fabrication or on the Site or at all or any of such places or at any approved laboratory. The Contractor shall provide such assistance instruments machines labour and materials as are normally required for examining measuring and testing any work and the quality weight or quantity of any materials before incorporation in the Work for testing as may be selected and required by the Bank / Architect.

ii) Cost of Samples All samples as required by the Bank / Architect shall be supplied by the Contractor without any extra charge.

iii) Cost of Tests The cost of making any test shall be borne by the Contractor if such test is intended by or provided for in the Tender Conditions, Specification or Bill of Quantities and in the cases only of a test under load or of a test to ascertain whether the design of any finished or partially finished work is appropriate for the purposes which it was intended to fulfil is particularized in the specification or Bill of Quantities in sufficient detail to enable the contractor to price or allow for the same in his Tender.

(b) Cost of tests not provided for in the Tender Conditions: If any test is ordered by the Bank / Architect which is either.

a) not so intended by or b) (in the cases above mentioned) is not so particularized or c) though so intended or provided for is ordered by the Bank / Architect to be

carried out in addition to the tests arranged by the Contractor as usual practices by an independent person at any place other than the Site or the place of manufacture of fabrication of the materials tested. Then the cost of such test shall be borne by the Contractor if the test shows the workmanship or materials not to be in accordance to the provision of the Contract or the Bank / Bank's / Architect's Instructions and otherwise by the Employer.

32. ACCESS FOR INSPECTION The Bank / Architect and any person authorized by them shall at all times have access to the work and the site and to all workhops and places where work is being prepared or where materials manufactured articles or machinery are being obtained for the work and the Contractor shall afford every facility for and every assistance in or in obtaining the right to such access.

33. i) Examination of work before covering up No work shall be covered up or put out of view without the approval of the Bank / Architect or the Bank / Bank's / Architect's representative and the Contractor shall afford full opportunity for the Employer/Bank / Architect or the Bank / Bank's / Architect's representative to examine and measure any work which is about to be covered up or put out of view and to examine foundations before permanent work is placed thereon. The Contractor shall give due notice to the Bank / Bank's / Architect's representative whenever any such work or foundations is or are ready or about to be ready for examination and the Bank / Bank's / Architect's representative shall without unreasonable

delay, unless he considers it unnecessary and advises the Contractor accordingly, attend for the purpose of examining and measuring such work or of examining such foundations.

ii) Uncovering and making opening The Contractor shall uncover any part of parts of the Work or make openings in or through the same as the Bank / Architect may from time to time direct and shall reinstall and make good such part or parts to the satisfaction of the Bank / Architect. If any such part or parts have been covered up put out of view after compliance with the requirements of sub-clause (i) of this Clause and are found to be expenses of uncovering making openings in or through reinstating and making good the same shall be borne by the Employer but in any other case all such expenses shall be borne by the Contractor and shall be recoverable from him by the Employer or may be deducted by the Employer from any monies due or which may become due to the Contractor.

34. i) Removal of Improper Work & Materials The Bank / Architect shall during the progress of the work have power to order in writing from time to time :

a) The removal from the Site within such time or times as may be specified in the

order of any materials which in the opinion of the Bank / Architect are not in accordance with the Contract.

b) The substitution of power and suitable materials and The removal and proper re-execution (notwithstanding any previous test thereof or interim payment therefor) of any work which in respect of materials or workmanship is not in the opinion of the Bank / Architect in accordance with the Contract.

ii) Default of Contractor in Compliance

In case of default on the part of the Contractor in carrying out such order the Employer shall be entitled to employ and pay other persons to carry out the same and all expenses consequent thereon or incidental thereto shall be borne by the Contractor and shall be recoverable from him by the Employer or may be deducted by the Employer from any monies due or which may become due to the Contractor.

iii) Inspection & Testing during manufacture

Unless otherwise agreed in the Contract the Bank / Architect shall be empowered during manufacture to inspect, examine and test on the Contractor‟s premises during working hours the materials and workmanship and check the progress of manufacture of all fabrication materials to be supplied under the Contract and if part of the said materials is being manufactured on other premises the Contract shall obtain for the Bank / Architect permission to inspect, examine and test as if the said Plant were being manufactured on the Contractor premises. Such inspection, examination or testing if made shall not release the Contractor from any obligation under the Contract.

iv) Dates for Inspection & Testing

The Contractor shall agree with the Bank / Architect the date on and the place at which any plant/work will be ready for testing as provided in the Contract and unless the Bank / Architect shall attend at the place so named on the date agreed the Contractor may proceed with the tests, which shall be deemed to have been made in the Bank / Bank's / Architect's presence, and shall forthwith forward to the Bank / Architect duly certified copies of the test readings. The Bank / Architect shall give the Contractor 24 hours notice in writing of his Intention to attend the tests.

v) Facilities for Testing of Manufacture‟s work

Where the Contract provides for tests on the premises of the Contractor or of any Sub-contractor the Contractor shall provide such assistance, labour, materials,

electricity, fuel, stores, apparatus and instruments as may be requisite and as may be reasonably demanded to carry out such tests efficiently.

vi) Certificate of Testing

As and when fabrication materials shall pass the tests referred in this Clause the Bank / Architect shall furnish to the contractor a certificate in writing to that effect.

vii) Rejection

If as a result of such inspection, examination or test of the work (other than a Test on Completion under Clause 31 the Bank / Architect shall decide that such material is defective or not in accordance with the Contract he shall notify the Contractor accordingly stating in writing his objection and reasons therefor. The Contractor shall with all speed make good the defect or ensure that the material complies with the Contract. Thereafter, if required by the Bank / Architect, the tests shall be repeated under the same terms and conditions save that all reasonable expenses to which the employer may be put by the repetition of the tests shall be deducted from the Contract Sum.

viii) Inspection & Testing

All deficiencies revealed by testing and inspection shall be rectified by the Contractor at his own expense and to the satisfaction and approval of the Bank / Architect. Rectified components shall be subject to retesting and reinspection.

ix) The Contractor shall provide the Bank / Architect with five copies of reports of all inspection and tests.

35. i) Suspension of Work

The Contractor shall on the written order of the Bank / Architect suspend the progress of the Work or any part thereof for such time or times and in such manner as the Bank / Architect may consider necessary and shall during such suspension property protect and secure the work so far as is necessary in the opinion of the Bank / Architect. The extra cost including all running wages to be paid on the Site salaries depreciation and maintenance of plant Site on-costs and overhead costs of the Contract relatable to the work done, incurred by the Contractor and in giving effect to the Bank / Bank's / Architect's instructions under this Clause shall, to the extent outstanding, be borne and paid by the Employer unless such suspension is

a) Otherwise provided for in the Contract or b) Necessary for the proper execution of the work or by reason of weather

conditions affecting the safety or quality of the work or by some default on the part of the Contractor or

c) Necessary for the safety of the work or any part thereof.

Provided that the Contractor shall not be entitled to recover any such extra cost unless he gives notice in writing of his intention to claim to the Bank / Architect within 28 days of the Bank / Bank's / Architect's order. The Bank / Architect shall settle and determine such extra payment to be made to the Contractor in respect of such claim as shall in the opinion of the Bank / Architect be fair and reasonable.

ii) Suspension lasting more than 90 days

If on the written order of the Bank / Architect (in this Sub-clause referred to as “Suspension Order”) the progress of the Work or any part thereof shall be suspended for a consecutive period of 90 days or if the Bank / Architect having previously issued a Suspension Order for a period which has tasted less than 90 days shall within less than 90 days from the expiration of that period of suspension issue a further suspension order which together with the previous

suspension period amounts in aggregate to 90 days or more either in respect of the whole of the work or (where the previous suspension order has affected only a part) affecting or including that part, then and in any such case the Contractor may serve a written notice on the Bank / Architect requiring permission within 28 days from the receipt thereof to proceed with the work or that part thereof in regard to which progress is to suspended and if such permission is not granted within that time the Contractor by a further written notice so served may (but is not bound to \) elect to treat the suspension where it affects part only of the work as an omission of such part under clause 44 hereof or where if affects the whole work as an abandonment of the Contract by the Employer.

iii) Suspension by Contractor If the Contractor except on account of any legal restraint upon the Employer preventing the continuance of the work, shall suspend the work or in the opinion of the Bank / Bank / Architects shall neglect or fail to proceed with due diligence in the performance of his part of the Contract or if he shall make default in respect of Clause No. 2 the Employer shall have the power to give notice in writing to the Contractor requiring that the work be proceeded within a reasonable manner and with reasonable despatch of such notice shall purport to be a notice under this clause after such notice shall have been given, the Contractor shall not be at liberty to remove from the site of the work or from any ground continuous thereto any plant or material belonging to him, which shall have been placed thereon for the work and the Employer shall have a lien upon all such plant and materials to subsist from the date of such notice being given until the notice shall have been compiled with. If the Contractor shall fail for 7 days after such notice has been given to proceed with the work as therein prescribed the Employer may proceed as provided herein.

36. COMMENCEMENT OF WORK

The Contractor shall commence the work on Site within a period of 3 days after the receipt by him of an order in writing to this effect from the Employer/date of handing over of site whichever is later and shall proceed with the same with due expedition and without delay except as may be expressly sanctioned or ordered by the Bank / Architect or be wholly beyond the Contractor‟s control.

37. TIME FOR COMPLETION

Subject to any requirement in the specification as to completion of any portion of the Work before completion of the whole of the work shall be completed within the time stated in Appendix calculated from the date of Bank / Bank's / Architect's written order to commence the work or such extended time as may be allowed under Clause 38 hereof.

38. DELAY AND EXTENSION OF TIME

In the opinion of the Bank / Architect whose decision shall be final, conclusive and binding, the work be delayed (a) by Fore Majeure or (b) by reason of any exceptionally inclement weather or (c) by reason of proceedings taken or threatened by, or disputes with adjoining or neighboring owners or Public Authorities, or (d) by the work or delays of other Contractors or Tradesmen engaged by the Employer and not referred to in the Schedule of Quantities and/or Specifications, or (e) by reason of Bank / Bank's / Architect's Instructions as per Clause No. 5 or (f) by reason of Civil Commotion, local combination of workman or strike or lockout affecting any of the building trades of (g) in consequence of the Contractor not having received in due time necessary instructions from the Bank / Architect for which he shall have specifically applied in writing, or (h) from other causes which the Bank / Architect may certify as beyond the control of the Contractor, or (i) by reason of non-payment of interim certificate at specified time, the Bank / Architect shall make a fair and reasonable extension of time, the Bank / Architect shall make a fair and reasonable extension of time for completion of the Contract. In case of strike or lock out the Contractor shall give written notice thereof to the Bank / Bank /

Architects within 7 days, but he shall nevertheless and shall do all that may reasonably be required to the satisfaction of the Bank / Architect to proceed with the work. Should the amount of extra or additional work of any kind or other special circumstances of any kind whatsoever which may occur be such as fairly to entitle the Contractor to an extension of time for the completion of the work the Employer & Bank / Architect shall determine the period of such extension. Provided that the Bank / Architect is not bound to take into account any extra or additional work or other special circumstances unless the contractor has within 7 days after such work has been commenced or such circumstances have arisen delivered to the Employer/Bank / Bank's / Architect's representative full and detail particular of any claim to extension of time to which he may consider himself entitled in order that such claim may be investigated at the time.

39. RATE OF PROGRESS

The whole of the materials, plant an labour to be provided by the contractor and the mode manner and speed of execution and maintenance of the Work are to be of a kind an conducted in a manner to the satisfaction of the Bank / Architect. Should the rate of progress of work or any part thereof be at any time in the opinion of the Bank / Architect too slow to ensure the completion of the work by the prescribed time or extended time for completion the Bank / Architect shall so notify the Contractor in writing and the Contractor shall thereupon take such steps be considered necessary and the Bank / Architect may approve to expedite progress so as to complete the work by the prescribed time or extended time for completion. If the work is not being carried on by day and by night and the Contractor shall request permission to work by night as well as day then the Bank / Architect may grant such permission, however, the Contractor shall not be entitled to any additional payment for such work permitted all work at night shall be carried out without unreasonable noise and disturbance. The Contractor shall indemnity the Employer from and against any liability for damages on account of noise or other disturbance created while or in carrying out the work and from an against all claims demands proceedings costs charges and expenses whatsoever in regard or in relation to such liability.

40. i) Liquidated Damages for Delay

If the Contractor fails to complete the work within the time prescribed by clause 37 hereof or extended time then the Contractor shall pay to the Employer the sum stated in the Special Conditions as liquidated damages for such default and not as penalty for every day or part of a day which shall elapse between the time prescribed by Clause 37 hereof or extended time as the case may be and the date of completion of the work. The employer may without prejudice to any other method of recovery deduct the amount of such damages from any monies in his hands due or which may become due to the Contractor. The payment or deduction of such damage shall not relieve the Contractor from his obligation to complete the work or from any other of his obligations and liabilities under the contract.

41. VIRTUAL COMPLETION CERTIFICATE

As soon as in the opinion of the Bank / Architect the Work shall have been substantially completed and shall have satisfactorily passed any final test that may be prescribed in the Contract the Bank / Architect shall on receiving a written undertaking by the Contractor to finish any outstanding work during the period of maintenance issue a Certificate of virtual completion in respect of the Work an the Period of Maintenance of the Work shall commence from the date of such certificate. Provided that the Bank / Architect may give such a certificate with respect to any part of the Work before the completion of the whole of the work and shall upon the written application of the Contractor give such certificate with respect to any substantial part of the work which has been both completed to the satisfaction of the Bank / Architect and occupied or used by the Employer and when any such certificate is given in respect of a part the period of maintenance shall commence from the date of such certificate. Provided also that a

Certificate of completion given in accordance with the foregoing provisions of any part of the work occupied and used as aforesaid shall not be deemed to certify completion of any ground or surfaces requiring reinstatement unless such certificates shall expressly so state.

42. i) Execution work of Repair etc during period of maintenance

To the intent that the Work shall at or as soon as practicable after the expiration of the Period of Maintenance be delivered upto the Employer in as good and perfect a condition (fair wear an tear excepted) to the satisfaction of the Bank / Architect as that in which they are at the commencement of the Period of Maintenance the contractor shall execute all such work of repair amendment reconstruction rectification and making good of defects imperfections shrinkages or other faults as may be required of the Contractor in writing by the Employer/Bank / Architect during the period of maintenance or within fourteen days after its expiration as a result of an inspection made by or on behalf of the Employer/Bank / Architect prior to its expiration.

ii) Cost of Execution of Work of Repair etc. All such work shall be carried out by the Contractor at his own expense if the necessity thereof shall in the opinion of the Bank / Architect be due to the use of materials or workmanship not in the accordance with the contract or to neglect or failure on the part of the Contractor to comply with any obligation expressed or implied on the Contractor‟s part under the Contract.

iii) Remedy on Contractor‟s Failure to carry out work required

If the Contractor shall fail to do any work as aforesaid required by the Employer/Bank / Architect the Employer shall be entitled to carry out such work by his own workmen or by other Contractors and if such work is work which the Contractor should have carried out at the Contractor‟s cost shall be entitled to recover from the Contractor the cost thereof or may deduct the same from any monies due or that become due to the Contractor.

43. i) Variation

The Employer/Bank / Architect may make any variation in quality or quantity of the Work or any part thereof that may in their opinion be necessary and for that purpose or if for any other reason it shall in their opinion be desirable shall have power to order the Contractor to do and the Contractor shall abide by the orders and shall arrange for all or any of the following as advised.

a) Increases or decrease the quantity of any work included in the Contract. b) Omit any such work. c) Change the character or quality or kind of any such work.

d) Change the levels lines position and dimensions of any part of the work and

e) Execute additional work of any kind necessary for the completion of the work.

An no such variation shall in any way vitiate or invalidate the contract but the value (if any) of all such variations shall be taken into account in ascertaining the amount of the contract price.

ii) Orders for Variations to be in writing No such variation shall be made by the Contractor without an order in writing of the Bank / Architect. Provided that no order in writing shall be required for increase or decrease in the quantity of any work where such increase or decrease is not the result of an order given under this clause but is the result of the quantities exceeding or being less than those stated in the Bill of Quantities. Provided also that if for any reason the Bank / Architect shall consider it desirable to give any such order verbally the Contractor shall comply with such order and any confirmation in writing of such

verbal order given by the Bank / Architect whether before or after the carrying out of the order shall be deemed to be an order in writing within the meaning of this clause.

44. i) Valuation of Variations

The Bank / Architect shall determine the amount (if any) which in his opinion should be added to or deducted from the Contract Price, in respect of any extra or additional work done or work omitted by his Order. All such work shall be valued at the rates set out in the contract be derived from a relevant item of the contract if in the opinion of the Bank / Architect the same shall be applicable. If the contract shall not contain any rates applicable to the extra or additional work then suitable prices shall be agreed upon between the Employer & Bank / Architect and the Contractor. In the event of disagreement the Employer shall fix such prices as shall in his opinion be reasonable and proper.

ii) Power of Employer/Bank / Architect to fix rates

Provided that if the nature or amount of any omission or addition relative to the nature or amount of the whole of the contract to work or to any part thereof shall be such that in the opinion of the Employer/Bank / Architect the rate or price contained in the contract for any item of the work is by reason of such omission or addition rendered unreasonable or inapplicable then a suitable rate or price shall be agreed upon between the Employer & Bank / Architect and the Contractor. In the event of disagreement the Employer shall fix such other rate or price as shall in his opinion be reasonable and proper having regard to the circumstances. Provided also that no increase of the Contract Price under sub-clause (a) of his sub-clause (ii) of this clause shall be made unless as soon after the date of the order as is practicable and in the case of extra or additional work before the commencement of the work or as soon thereafter as is practicable notice shall have been given in writing.

a) by the Contractor to the Employer & Bank / Architect of his intention to claim extra payment or a varied rate or

b) by the Employer & Bank / Architect to the Contractor of his intention to vary a rate or price as the case may be.

iii) Day work

The Employer & Bank / Architect may if in his opinion it is necessary or desirable order in writing that any additional or substituted work shall be executed on a day work basis. The Contractor shall then be paid for such work under the conditions set out in the Day work Schedule included in the Bill of Quantities and at the rates and prices affixed thereto by him in his Tender. The Contractor shall furnish to the Bank / Architect such receipts or other vouchers as may be necessary to prove the amounts paid and before ordering materials shall submit to the Employer & Bank / Architect quotations for the same for his approval.

In respect of all work executed on a daywork basis the contractor shall during the continuance of such work deliver each day to the Bank / Bank's / Architect's representative an exact list in duplicate of the names occupation and time of all workmen employed on such work and a statement also in duplicate showing the description and quantity of all materials and plant used thereon or therefore (other than plant which is included in the percentage addition in accordance with the Schedule hereinbefore referred to). One copy of each list and statement will if correct or when agreed be signed by the Bank / Bank's / Architect's representative and returned to the Contractor. At the end of each month the Contractor shall deliver to the Bank / Bank's / Architect's representative a priced statement of the labour material and plant (except as aforesaid) used and the Contractor shall not be entitled to any payment unless such lists and statements have been fully and punctually rendered. Provided always that if the Bank / Architect shall consider that for any reason the sending of such list or statement by the Contractor in accordance with the

forgoing provision was impracticable he shall nevertheless be entitled to authorise payment for such work either as daywork (on being satisfied as to the time employed and plant and materials used on such work) or at such value therefor as shall in his opinion be fair and reasonable.

iv) Fixation of Rates

The price of all such additional items/non-tendered items will be worked out on the basis of rates quoted for similar items in the contract wherever existing otherwise on Bank / Bank / Architects rate analysis based on prevalent fair price of labour, material and other components as required as per the details hereinafter. No claim for an extra shall be allowed unless it shall have been executed by the authorization of the Employer as herein mentioned. Any such extra is herein referred to as an authorized extra. No variations, i.e. additions, omissions or substitutions shall vitiate the contract. he rates of items not included in the Schedule of Quantities shall be settled by the Employer in accordance with the following rules : a) If the rates for the additional, altered or substituted work are specified in the

contract for the work, the contractor is bound to carry out the additional, altered and substituted work at the same rates as are specified in the contract for the work.

b) If the rates for the additional, altered or substituted work are not specifically

provided in the contract for the work, the rates will be derived from the rates for a similar class of work as are specified in the contract for the work.

c) If the rates for the additional, altered or substituted work can not be specified

in the sub-clause (a) (b) above, the rates shall be derived on the basis of cost of materials and labour (rates for materials and labour will be as per the prevalent market rates for the same) plus 15% to cover overhead, supervision and profit etc plus prevalent sales tax on work contract.

45. CLAIMS

The Contractor shall send to the Bank / Bank's / Architect's representative once in 15 days an account giving particulars (as full and detailed as possible) of all claims for any additional expense to which the Contractor may consider himself entitled and of all extra or additional work ordered by the Bank / Architect which he has executed during the preceding month and no claim for payment for any such work will be considered which has not been included in such particulars.

46. APPROVAL OF MATERIALS ETC NOT IMPLIED

The operation of the preceding Clause 31 hereof shall not be deemed to imply any approval by the Bank / Architect of the materials or other matters referred to therein nor shall it prevent the rejection of any such materials at any time by the Bank / Architect.

47. QUANTITIES

The quantities set out in the Bill of Quantities are the estimated quantities of the work and they are not to be taken as the actual and correct quantities of the Work to be executed by the Contractor in fulfillment of his obligations under the Contract. The quantities in Schedule of Quantities can vary to any extent & this shall not affect the accepted unit rates.

48. WORK TO BE MEASURED

The Bank / Bank's / Architect's authorized representative(s) alongwith the contractor or his authorized representative(s) during the progress of work, as and when required will record measurements in Measurement Book(s) in duplicate to be supplied by Employer.

All measurements will be as per IS 1200. The contractor shall forthwith attend or send a qualified person to assist the Bank / Architect or the Bank / Bank's / Architect's representative/Employer‟s representatives in taking such measurements and calculations and to furnish all particulars or to give all assistance required by either of them. Should the contractor not attend or neglect or omit to send such person then the measurement taken by the Bank / Architect or a representative approved by him shall be taken to be the correct measurement of the work, such measurement shall be net quantities for the work produced and will be final and binding on the contractor. The contractor or his representative(s) may at the time of measurement take such notes and measurements as may require. All authorized extra work, omissions and all variations made without the Bank / Bank's / Architect's permission, if subsequently sanctioned by him in writing with the approval of the Employer shall be included in such measurements. The final measurement should be done within one month from the date of the completion of work jointly by the Bank / Bank / Architects and contractor, if the contractor fails to comply, the measurements taken by the Bank / Bank / Architects will be final.

49. i) Provisional Sum Every provisional sum (other than P.C. prices under sub-clause (ii) of this clause) set out in the Bill of Quantities (whether for work to be executed by the Contractor which has not been specified in detail when the Contract is entered into or for work to be executed by a nominated Sub-Contractor as hereinafter defined) together with the charges and profits (if any) which the Contractor shall have added to such sums shall be deducted from the Contract Price and in lieu thereof there shall be added to the Contract Price. a) Where work to which the provisional sum relates has been ordered by the Bank /

Architect and executed by a nominated sub-contractor (as hereinafter defined the sum or sums actually paid (subject however to the provisions of sub-clause (v) hereof) by the Contractor to such sub-contractor on the direction of the Bank / Architect and (if the Contractor shall have added to the provisional sum to which the work relates any sums in respect of charges and profits) a sum in the same proportion to the sum so actually paid as the said charges and profits bear to the said provisional sum.

ii) Prime Cost Items

Every sum in the Bill of Quantities which contains (either as the whole or part of the sum) a prime cost (P.C.) price for goods or materials to be supplied for or for incorporation into the Work shall be varied by the substitution for the prime cost price of the actual price (subject however to the provisions of sub-clause (v) hereof) paid by the Contractor for the goods or materials on the direction of the Bank / Architect and the Contract Price shall be increased or decreased (as the case may be) by the amount by which the sum in the Bill of Quantities is increased or decreased by such substitution. No variation shall be made to or in respect of any sum added for labours to the prime cost price on account of the said actual price being greater or less than the prime cost price but in respect of all other charges and profit there shall be added or deducted as the case may be a sum representing such percentage as is provided in the Bill of Quantities in relation to the particular item of prime cost concerned or (if none) as is inserted by the Contractor in the form of Tender as the percentage for the adjustment of prime cost sums.

iii) Use of Provisional & Contingency Items All sums set out in the Bill of Quantities which shall be stated to be provision or for contingencies shall be used only at the direction and discretion of the Bank / Architect and if not used either wholly or in part shall as to the amount not be deducted from the Contract Price.

iv) Production of Vouchers, etc

The Contractor shall when required by the Bank / Architect produce all quotations invoices vouchers and accounts or receipts in connection with expenditure in respect of provision or prime cost items.

v) Cash Discount In so far as any sum is paid by the Contractor to a nominated sub-contractor (as hereinafter defined) by direction of the Bank / Architect under sub-clause (i) (b) (ii) of this Clause before the Contractor shall have received payment of that sum from the Employer there shall for the purpose of adjusting the Contract Price under sub-clause (i) or (ii) hereof (as the case may be) be added to the actual sum paid by the Contractor as aforesaid 2.5 percent of the amount of such actual payment and the benefit of any cash discount allowed in respect thereof shall be passed to the Employer.

vi) Assignment of Sub-Contractors In the event of a nominated Sub-Contractor (as hereinafter defined) having undertaken towards the Contractor in respect of the work executed or the goods or materials supplied by such nominated Sub-Contractor any continuing obligation extending for a period exceeding that of the Period of Maintenance under this Contract the Contractor shall at any time after the expiration of the period of Maintenance assign to the Employer at the Employer‟s request and cost the benefit of such obligation for the unexpired duration thereof.

50. i) Payments

Running Account Bill shall be prepared and submitted by Archtects to the Employer duly signed by contractor‟s representative in the Measurement Book(s) for payment subject to minimum value for Running Account Bill as stated in the Appendix to Form of Tender. The bills must be duly accompanied by detailed measurements in support of the quantities of work done and must show deductions for all previous payments, retention money, Income Tax, Sales Tax etc. The Employer will have the discretion to amend the certificate of Bank / Bank / Architects if considered necessary and the contractor shall be entitled for payment thereof, within the period specified as under.

All the interim payments against Running Account Bills shall be regarded payments by way of advance against the final payment only and not as payments for work actually done and completed and shall not preclude the requiring of bad, unsound, and imperfect or unskilled work to be removed and taken away and reconstructed, or re-erected or be considered as an admission of the due performance of the contract, or any part thereof in any respect or the accruing of any claim, nor shall, it conclude determine or affect in anyway the power of the Owner under these conditions or any of them as to the final settlement and adjustment of the accounts or otherwise or in any other way vary or affect the contract. The Employer shall make payment within 10 days from the date of receipt of the request from the contractor for payment of the Running Account Bills and within one month from virtual completion of the work for the Final bill.The contractor will give a request to Bank / Bank / Architects under advise to the Employer for payment.

Final Payment Payments of final bill shall be made after deduction of Retention Money as specified which sum shall be refunded on expiry of the Defects Liability Period after rectifying all defects to the satisfaction of the Employer/Bank / Bank /

Architects. The acceptance of payment of the final bill by the contractor would indicate that he will have no further claim in respect of the work executed.

ii) Release of Retention Money

One half of the retention money shall become due and shall be paid to the Contractor when the Bank / Architect shall certify in writing that the work hase been virtually completed. The other half shall be paid to the Contractor on satisfactory completion of the period of maintenance and on furnishing a certificate to extent from the Employer notwithstanding that by such time there may be outstanding claims by the Contractor against the Employer. Provided always that if at such time there shall remain to be executed by the Contractor any work ordered during such period pursuant to Clause 42 hereof the Employer shall be entitled to withhold payment until the completion of such work of so much of the second half of the retention money as shall in the opinion of the Bank / Bank / Architects represent the cost of the work so remaining to be executed. Provided further in the event of different maintenance periods having become applicable to different parts of the work the expression “expiration of the period of maintenance” shall for the purposes of this sub-clause be deemed to mean the expiration of the latest of such periods.

iii) Terms of Payment

The Employer shall pay to the Contractor as per the terms of payment mentioned in Special Conditions of Contract.

51. APPROVAL ONLY BY MAINTENANCE CERTIFICATE

No certificate other than the Maintenance Certificate referred to in Clause 52 hereof shall be deemed to constitute approval of any work or other matter in respect of which it is issued or shall be taken as an admission of the due performance of the Contract or of additional or varied work have been ordered by the Bank / Architect nor shall any other certificate conclude or prejudice any of the powers of the Bank / Architect.

52. i) Maintenance Certificate

The Contract shall not be considered as completed until a Maintenance Certificate shall have been signed by the Employer/Employer‟s representative/Bank / Architect stating that the work have been completed and maintained to his satisfaction. The Maintenance Certificate shall be given by the Bank / Architect after the expiration of the Period of Maintenance (or if different Periods of Maintenance shall become applicable to different parts of the work the expiration of the latest such period) or as soon thereafter as any work ordered during such period pursuant to clause 42 hereof shall have been completed to the satisfaction of the Bank / Architect and full effect shall be given to this Clause notwithstanding any previous entry on the Work or the taking possession working or using thereof or any part thereof by the Employer.

ii) Cessation of Employer‟s Liability

The Employer shall not be liable to Contractor for any matter or thing arising out of or in connection with the contract or the execution of the work unless the Contractor shall have made a claim in writing in respect thereof before the giving of the Maintenance certificate under this clause.

iii) Unfulfilled Obligations Notwithstanding the issue of the Maintenance Certificate the Contractor and (subject to sub-clause (ii) of this clause) the Employer shall remain liable for the fulfillments of any obligation incurred under the provisions of the contract prior to the issue of the Maintenance Certificate which remain unperformed at the time such certificate is issued and for the purposes of determining the nature and extent of any such

obligation the Contract shall be deemed to remain in force between the parties hereto.

53. i) Determination of Contract by Employer

If the Contractor (Being an individual or a firm) commit any “Act of Insolvency” or shall be adjudged an insolvent or shall make an assignment or composition of the greater part in number of amount of his creditors or shall enter into a deed of assignment with his creditors, or (being an incorporated Company) shall have an order made against him or pass an effective Resolution for winding up either compulsorily or subject to the supervision of the Court or Voluntarily, or if the Official Assignee of the Contractor shall repudiate the contract, or if the Official Assignee or the Liquidator in any such winding up shall be unable within 7 days after notice to him requiring him to do so, to show to the reasonable satisfaction of the Bank / Bank / Architects that he is able to carry out and fulfil the contract and if required by the Bank / Bank / Architects to give the security therefore, or/if the Contractor (whether an individual firm or incorporated company) shall suffer execution to be issued or if the Contractor shall suffer any payment under this Contract to be attached by or on behalf of any of the creditors of the Contractor, or if the Contractor shall assign or sublet the contract without the consent in writing or the Bank / Bank / Architects first obtained, or if the Bank / Bank / Architects shall certify in writing of that in his opinion the Contractor : a) Has abandoned the Contract, or

b) Has failed to commence the work, or has without any lawful excuse under these

conditions suspended the progress of the work for 14 days after receiving from the Bank / Bank / Architects written notice to proceed, or

c) Has failed to proceed with the work with such due diligence and failed to make

such due progress as would enable the work to be completed with the time agreed upon, or

d) Has failed to remove the materials from the site or to pull down and replace work

within 7 days after receiving from the Bank / Bank / Architects a written notice that the said materials or work were condemned or rejected by the Bank / Bank / Architects under those conditions, or

e) Has neglected or failed persistently to observe and perform all or any of the acts,

matters, or things, by this Contract to be observed and performed by the Contractor for 7 days after written notice shall have been given to the Contractors requiring the Contractor to observe or perform the same, or

f) Has to the determine of good workmanship or in defiance of the Bank / Bank /

Architects instructions to the contrary sublet any part of the Contract. 54. i) Then and in any of the said causes the Employer notwithstanding any previous

waiver after giving 7 days notice in writing to the Contractors, determine the Contract, but without thereby affecting the powers of the Bank / Bank / Architects or the obligations and liabilities of the Contractor, the whole of which shall continue to be in force as fully as if the Contractor has not been so determined and as if the work subsequently executed had been executed by or on behalf of the Contractor. And further the Employer with the consent of the Bank / Bank / Architects, his Agents or Servants may enter upon and take possession of the work.

ii) Valuation of Date of Expulsion / Termination of Contract

The Bank / Architect shall as soon as may be practicable after any such entry and expulsion by the Employer fix and determine ex-partie or by or after reference to the parties or after such investigation or enquiries as he may think fit to make or institute

an shall certify what amount (if any) had at the time of such entry and expulsion has reasonably earned by or would reasonably accrue to the Contractor in respect of work then actually done by them under the contract an what was the value of any of the said unused or partially used materials any constructional plant and any Temporary work.

iii) Payment after Expulsion / Termination of Contractor If the Employer shall enter and expel the Contractor under this clause he shall not be liable in any manner whatsoever to the Contractor. The Employer further shall not be liable to pay to the Contractor any money on account of the contract until the expiration of the period of Maintenance and thereafter until the costs of completion and maintenance, damages for delay in completion (if any) and all other expenses incurred by the Employer have been ascertained and the amount thereof certified by the Bank / Architect. The Contractor shall then be entitled to receive only such sum or sums (if any) as the Bank / Architect may certify would have been due to him upon due completion by him after deducting the said amount. But if such amount shall exceed the sum which would have been payable to the Contractor on due completion by him then the Contractor shall upon demand pay to the Employer the amount of such excess and it shall be deemed a debt due by the Contractor to the Employer and shall be recoverable accordingly.

iv) Assignment of benefit of Agreement If so required by the Employer or the Bank / Architect the Contractor shall before the expiration of the notice referred to in sub-clause (i) of this clause assign to the Employer without payment the benefit of any agreement which the Contractor has entered into for the supply of materials and or for the execution of any work for the purpose of the Contract but on the terms that supplier or Sub-Contractor shall be entitled to make any reasonable objection to any further assignment thereof by the Employer and the Employer may pay the supplier or Sub-Contractor for any such materials supplied and delivered to the Site or Work executed under sign agreement (where the same be assigned as aforesaid or not) before or after the giving of the notice the amount due by such agreement in so far as the supplier or Sub-Contractor or by the Employer to the Contractor. The Employer‟s right under this sub-clause are in addition to his rights to pay nominated Sub-Contractor/supplier may be made out of any retention money in the hands of the Employer.

55. DETERMINATION OF CONTRACT DUE TO ABANDONMENT OR REDUCTION ON

SCOPE OF WORK If at any time after the acceptance of the tender, the Employer, shall for any reasons whatsoever not require the whole or any part of the work to be carried out, the Bank / Bank / Architects shall give notice in writing to the Contractor who shall have no claim to any payment of compensation or otherwise whatsoever on account of any profit or advantage which he might have derived from the execution of the whole of the work. a) The Contractor shall be paid at contract rates for the full amount of work executed

and in addition to the cost at site of all surplus approved materials collected for incorporation in the work, which the Contractor does not wish to retain and which shall thereafter become the property of the Employer.

b) Where the Contractor desires to retain the surplus of approved materials (excepting materials) supplied by the Employer‟s name which shall be in any case be returned to the Employer) the cost of handling and cartage charges for removal from the site.

c) If upon the determination of the contract under this condition the contractor is of

opinion that he has suffered hardship by reason of the operation of this condition, he may refer the circumstances to the Bank / Bank / Architects, who, on being satisfied make such allowance, if any as in his opinion is reasonable, and his decision shall be

final an conclusive. Only such of the above claims as are deemed reasonable and are supported by vouchers shall be admitted by the Bank / Bank / Architects.

56. SPECIAL RISKS Notwithstanding anything in the contract contained.

i) If the work or Temporary Work or any materials (whether for the former or the latter) on or near or in transit to the Site shall sustain destruction or damage by reason of any of the said special risks the Contractor shall nevertheless be entitled to payment for any permanent work and for any materials so destroyed or damaged and the Contractor shall be entitled to be paid by the Employer the cost of making good any such destruction or damage to the work and of replacing or making good such materials so far as may be required by the Bank / Architect or as may be necessary for the completion of the Work on a prime costs basis plus such profit as the Bank / Architect may certify to be reasonable.

ii) Projectile Missile, etc. Destruction damage injury or loss of life caused by the explosion or impact whenever and wherever occurring of any mine, bomb, shell, grenade or other projectile missile ammunition or explosive of was shall be deemed to be consequence of the said special risks and the Employer shall indemnify and save harmless the Contractor against and from the same an against and from all claims demands proceedings damages costs charges and expenses whatsoever arising there out or in connection therewith and shall compensate the Contractor for any loss of or damage to property of the Contractor used or intended to be used for the purposes of the work (including property in transit to the Site) and occasioned either directly or indirectly by said special risks.

iii) Increased Costs arising from Special Risks The Employer shall repay to the Contractor any increased cost of or incidental to the execution of the work (other than such as may be attributable to the cost of reconstructing work condemned under the provisions of special risk) which is howsoever attributable to or consequent on or the result of or in any way whatsoever connected with the said special risks (subject however to the provisions in this clause hereinafter contained in regard to outbreak of war) but the Contractor shall as soon as any such increase of cost shall come to his knowledge forthwith notify the Bank / Architect thereof in writing.

iv) Outbreak of War If during the currency of the Contract there shall be an outbreak of war (whether war is declared or not) which shall unless and until the contract is terminated under the provisions contained in this clause use his best endeavors to complete the execution of the work provided always that the Employer shall be entitled at any time after such outbreak of war to terminate this contract by giving notice in writing to the Contractor an upon such notice being given this contract shall (save as to the rights of the parties under this clause and to the operation of Clause 59 hereof) terminate but without prejudice to the rights of either party in respect of any antedecent breach thereof.

v) Removal of Plant on Termination If the contract shall be terminated under the provisions of the last preceeding sub-clause the Contractor shall with all reasonable despatch remove from the site all constructional Plant and shall give similar facilities to his Sub-Contractors to do so.

vi) Payment if Contract Terminated If the Contract shall be terminated as aforesaid the Contractor shall be paid by the Employer (in so far as such amounts or items shall not have already been covered by payments on account made to the Contractor) for all work executed prior to the date of termination of the rates and prices provided in the contract and in addition :

a) The amounts payable in respect of any preliminary items so far as the work or

service comprised therein has been carried out or performed and a proper proportion as certified by the Bank / Architect of any such items the work or service comprised out or performed.

b) The cost of materials or goods reasonably ordered or the work or Temporary work which shall have been delivered to the Contractor or of which the Contractor is legally liable to accept delivery (such materials or goods becoming the property of the Employer upon such payment being made by him).

c) A sum to be certified by the Bank / Architect being the amount of any expenditure

reasonably incurred by the Contractor in the expectation of completing the whole of the work in so far as such expenditure shall not have been covered by the payments in this sub-clause before mentioned.

d) Any additional sum payable under the provisions of sub-clause (i), (ii) and (iv) of

this clause.

e) The reasonable cost of removal under sub-clause (vi) of this clause and (if required by the Contractor) return thereof to the Contractor‟s main plant yard or to any other destination at no greater cost.

f) The reasonable cost of repatriation of all the Contractor‟s staff and workmen

employed on or in connection with the work at the time of such termination. Provided always that against any payments due from the Employer shall be entitled to be credited with any outstanding balances due from the Contractor for advances in respect of plant and materials and any sum previously paid by the Employer to the Contractor in respect of the execution of the work and any other sum due and payable hereunder on any account by the Contractor to the Employer.

57. PAYMENT IN EVENT OF FRUSTRATION

In the event of the contract being frustrated whether by war or otherwise however the sum payable by the Employer to the Contractor in respect of the work executed shall be the same as that which would have been payable under clause 47 hereof if the Contract had been terminated under the provisions of clause 53 hereof.

58. DISPUTES BE FINALLY DETERMINED BY BANK / ARCHITECT The instructions, decision, opinion, direction certificate, or valuation, with respect of or any of the matters under Clause 3, 4, 9,10,14 & 47 hereof (which matters are herein referred to as excepted matters) of the Bank / Architect shall be final and conclusive and binding on the parties hereto and shall be without appeal. Any other decision, opinion, direction, certificate or valuation of the Bank / Architect or any refusal of the Bank / Architect to give any of the same shall, be referred to the Employer

59. Supervision and Co-ordination The Contractor must engage supervisors of adequate experience and qualifications, the conversant with the language of the Contract and capable of receiving instructions from the Bank / Bank / Architects full time at the site and other places of work.

60. i) Serving of Notices on Contractor

Any notice to be given to the Contractor under the terms of the Contract shall be served by sending the same by registered post to or leaving the same at the Contractor‟s principal place of business (or in the event of the Contractor being a Company to or at its registered office).

ii) Serving of Notice on Employer

Any notice to be given to the Employer under the terms of the Contract shall be served by sending the same by registered post to or leaving the same at the Employer‟s last known address (or in the event of the Employer being a company to or at its registered office).

61. CONTRACT PRICE NOT SUBJECT TO VARIATION

Save as specifically provide elsewhere in the Condition of Contract the Contract rates shall not be adjusted in respect of any increase or decrease of cost to the Contractor in carrying out the work by reason of alteration in the rates of wages and allowances payable to labour or change in the conditions of employment thereof or change in the cost of materials (whether for the permanent or temporary work) consumable stores, fuel and power or variations in the rates of freight and insurance or in the incidence of or rates of landing charges or the operation of any law or statute or variation in the cost of any other matter or thing of whatsoever nature subsequent to the date of Tender.

62. i) Excise, Sales Taxes , Work Contract Tax, VAT, etc.

The Contractor shall pay and be responsible for payment of all taxes, duties, levies, fees or charges in respect of the work including but not or the Contract. All of the aforesaid taxes, duties, levies fees and charges shall be to the Contractor‟s account and Employer shall not be required to pay any addition or extra amount on this account. Variation of taxes, duties, levies, fees etc if any till completion of work and no extra claim on this account will in any case be entertained.

63. i) Taxes

The Contractor will be required to pay all taxes levied by the Central and/or State Governments on such part of his profit in respect of the Contract as is chargeable therewith under the laws for the time being in force and no claim on this account will in any case be entertained.

ii) Income Tax Payable by Staff

The Contractor‟s staff will be liable to pay all taxes levied by the Central and/or State Governments on such of their salaries as are chargeable therewith under the laws of the time being in force and the Contractor shall perform such duties in regard to the deduction thereof as may be lawfully imposed on him.

64. CONTRACT SUPERSEDES PREVIOUS DOCUMENTS

The Contractor shall have no right to any increase in the rates in the Bill of Quantities nor any other right whatsoever by reason of any representative‟s explanation or statement given or to be given or by reason of any information promise or guarantee given or alleged to have been given to him by any person (whether in the employ of the Employer or not) before the date of the Contract it being understood that the Contract embodies the whole arrangements between the parties with reference to the Contract hereby constituted and all previous correspondence, negotiations representations, explanations, statements promises or guarantees whether oral or written shall be excluded.

65. INDIAN CONTRACT

The Contract shall be deemed to be governed by the laws of India including any such law passed or made or coming into force during the Contract.

66. LABOUR LAWS

The Contractor shall observe and strictly adhere to all prevailing labour laws inclusive of Contract labour (Abolition and Regulation act of 1970 and other safety regulations).

67. CVC CLAUSE

If it shall appear to the Employer or to the Chief Technical Examiner, Central Vigilance Commission, Govt or India at any time during the construction or prior to the expiration of the maintenance period that any work has been executed with unsound, imperfect or unskillful workmanship or with materials of any inferior description or that any materials or articles provided by him for the execution of the work are unsound or of a quality inferior

to that contracted for, or not otherwise in accordance with the contract, the contractor shall, on demand in writing from the Employer specifying the work, fault, materials or articles complained of, notwithstanding that the same may have been passed certified and paid for, forthwith rectify or remove and reconstruct the work so specified in whole or in part, as the case may require or as the case may be, remove the materials or articles so specified and provide other proper and suitable materials or articles so specified and provide other proper articles at his own expense, charges and cost; and in the event of his failing to do so within a period to be specified by the Employer in his demand aforesaid, the Employer may carry out the work by other means at the risk and expenses in all respects of the contract. The contractor shall be liable to pay compensation at the rate of one per cent of the estimated amount put to tender for every day not exceeding ten days, apart from the expenses incurred by the Employer in rectifying or removing and re-executing the work or removing and replacing with the materials or articles complained of as the case may be. All work under or in course of execution or executed in pursuance of the contract shall at all times be open to the inspection and supervision of the Employer as well as the Bank / Bank / Architects and that authorized subordinates and the contractor shall at all times during the usual working hours and at all other times at which reasonable notice of the intension of the Employer or Bank / Bank / Architects or their authorized subordinates to visit the work shall have been given to the contractor, either himself be present or receive order or instructions or have a responsible agent duly accredited in writing present for that purpose. Orders given to the contractor‟s agent shall be considered to have the same force as if they had been given to the contractor himself. The work during its progress can also be inspected by the Chief Technical Examiner on behalf of the Employer. Employer shall have right to cause an audit an technical examination of the work and the final bills of the contractor including all supporting vouchers, abstract, etc to be made after payment of the final bill and if as a result of such audit and technical examination any sum is found to have been overpaid in respect of any work by the contractor under the contract or any work claimed by him to have been done by him under the contract and found not have been executed, the contractor shall be liable to refund the amount of over-payment and it shall be lawful for the Employer to recover the same from him in the manner as prescribed or in any other manner legally permissible; and if it is found that the contractor was paid less than what was due to him under the contract in respect of any work executed by him under it, the amount of such underpayment shall be duly paid by the Employer to the contractor. Provided that the Employer shall not be entitled to recover any sum overpaid nor the contractor shall be entitled to payment of any sum paid short where such payment has been agreed upon between the Employer on one hand the contractor on the other, under any term of the contract permitting payment for work after assessment by the Employer.

68. URGENT REPAIRS If by reason of any accident or failure or other even occurring to in or in connection with the work or any part thereof either during the execution of the work or during the Period of Maintenance any remedial or other work or repair shall in the opinion of the Bank / Architect or Bank / Bank's / Architect's representative be urgently necessary for security and the Contractor is unable or unwilling at once to do such work or repair the Employer may use his own or other workmen do such work or repair as the Bank / Architect or the Bank / Bank's / Architect's representative may consider necessary. If the work or repair so done by the Employer is work which in the opinion of the Bank / Architect the Contractor was liable to do at his own expense under the contract, all costs and charges property incurred by the Employer in so doing shall on demand be paid by the Contractor to the Employer or may be deducted by the Employer from any monies due or which may become due to the Contractor. Provided always that the Bank / Architect or the Bank / Bank's / Architect's representative (as the case may be) shall as soon after the

occurrence of any such emergency as may be reasonably practicable notify the Contractor thereof in writing.

SPECIAL CONDITIONS OF CONTRACT

1.0 Scope of Work The scope of this work is to furnish hostel block at JNIBF campus, Gachibowli, Hyderabad. Details of work are contained in the enclosed Drawings, Specification and Bill of Quantities. The work will be taken up in phased manner as decided by the Bank with least disturbance to the working of the institute. The work in 15-20 rooms will be taken up at a time and after completion of the work therein and handing over possession of the rooms , the work in other rooms will be taken up.

2.0 Location of Site The site is located in JNIBF campus,Gachibowli,Hyderabad-500032

3.0 Site Condition

The site where the work has to be undertaken is a training institute where training programs are conducted on continuous basis. Care shall be taken to ensure that the occupants of the premises are least inconvenienced.

4.0 Dimensions & Levels All dimensions and levels shown on the Drawings shall be verified by the Contractor on the Site and he will be held responsible for the accuracy and maintenance of all dimensions and levels. Figured dimensions are in all cases to be accepted and no dimension shall be scaled. Large scale details shall take precedence over small scale drawings. In case of discrepancy the Contractor shall ask for clarification from the Bank / Bank's / Architect's Representative before proceeding with the work.

5.0 Programme of Work & Method of Construction

The Contractor shall submit to the Bank / Bank's / Architect's Representative before the commencement of the work, for his approval all the information relating to programme of the construction.

6.0 Assistance for Bank's/ Bank / Architects Representative

The Contractor shall provide to the Bank / Bank / Architect at all times during the Contract including Maintenance Period a competent Bank / Architectural Staff and/or all such other men as he may require to assist him in recording or checking any measurements, levels, setting out or measuring up of work. The Contractor is also to provide ladders, gangways, etc and the necessary attendance to move and adopt as directed for inspection or measurement of the work by the Bank / Bank's / Architect's Representative.

7.0 Construction Records

The Contractor shall keep and supply to the Bank / Bank's / Architect's Representative full and accurate records of the dimensions and positions of all new work and any other information necessary for the Bank / Bank's / Architect's Representative to be able to prepare complete drawings recording details of the work as constructed.

8.0 Safety of Adjacent Structures

The Contractor shall provide and erect to the approval of the Bank / Bank's / Architect's Representative such supports as may be required to protect efficiently all structures which may be endangered by the execution of the work or otherwise take such permanent measures as may be required by the Bank / Bank's / Architect's Representative to protect the structures and trees.

9.0 Power, Water and other facilities

The Contractor shall be responsible to provide within the scope of work all facilities necessary for the performance of the work including (but not limit to) water, electrical power, electrical power through generator, transportation, labour tools, construction and testing equipment and machinery, borrow areas, access roads and right(s) of way to or about the job site(s) and or borrow area. The owner does not warranty or undertake the provision of any facility aforesaid or otherwise whatever to the Contractor, or assistance in obtaining/procuring the same or other assistance whatever for or in the performance or testing of the work and the Contractor shall not imply by conduct, expression or assurance or by any other means, any promise or obligation on the part of the owner contrary to the provision hereof and any such promise or obligation understood by the Contractor shall not be binding upon the Owner.

Any assistance which the owner renders to the Contractor in terms hereof or otherwise relative to the work by provision of any facility, water, power etc as above shall not for any cause afford a basis or defence to the Contractor for any of his obligations under the contract nor ground for extension of time for completion.

10.0 Power Supply by Employer Without prejudice to the provisions of Clause No. 9 hereof and following clauses thereunder, as and when adequate power supply becomes available for the site, Employer may at his discretion provide supply of power to the Contractor for the work from the nearest sub-station, from which source the Contractor shall at his own cost and initiative make arrangement for temporary distribution of power to Contractor‟s work(s) at the site.

All arrangements for the distribution of power from sources aforesaid and the work relative thereto shall be made/performed/installed in conformity with Indian Electricity Regulations, and shall be subject to prior approval by the Bank / Architect.

The Contractor shall, at his own costs and initiative on completion or prior determination of the work or otherwise during execution of the work, if required by the Bank / Architect because of hindrance caused thereby or for any other cause, forthwith remove or re-route the distribution lines/installations/work or part(s) thereof as the case may be, required to be removed/rerouted.

The Employer shall not charge from Contractor for power consumed by the Contractor from Employer‟s source(s) of supply.

The Employer may at any time without notice or specifying any cause suspend or discontinue power supply as aforesaid to the Contractor, and such suspension or discontinuance shall not entitle the Contractor to any compensation or damages or constitute basis of extension of time for completion.

Power supplied by the Employer to the Contractor shall be entirely at the risk of Contractor as the continuity and regularity of supply, maintenance of voltage and adequacy of load without any warranty by or liability to the Employer in respect thereof and without entitlement to the Contractor on grounds of discontinuance, fluctuation of voltage or inadequacy of load or any other cause whatsoever to claim from Employer in respect thereof or consequences thereof.

11.0 Water Supply by Employer

Without prejudice to the provisions of Clause No. 9 hereof and the following clauses thereunder of the Contractor may be allowed to use the water from the existing boreholes of the tubewell at site after due testing for its construction worthiness. However, shortfall, if any will be augmented by the contractor at his own cost from any other source and the Employer will not be liable for delay on this account in any manners, whatsoever.

All the relevant cost for distribution of water for temporary and permanent work shall be borne by the contractor. The Employer shall not charge from contractor for water consumed by the contractor from the Employer‟s source of supply. Such installation, pipes and other equipment shall be laid out/installed by the Contractor only with the prior approval of the Bank / Architect so as not to interfere with the layout and progress of the other construction work at the site and access to or about the job site. The Contractor shall forthwith on completion of the work or earlier determination of the Contractor or during the execution of the work(s), if so required by the Bank / Architect, on ground of hindrance or obstruction caused thereby or other causes whatsoever at his own cost and initiative remove or re-route, as the case may be, any installations, pipes and/or other equipment or any part or portion thereof installed or erected by the Contractor for the conduction and/or distribution of water, and fill any trenches, ditches or other excavations done by the Contractor for the purpose thereof and restore the site to the same condition, in which it was prior to the installation.

12.0 Procurement of Materials

It shall be the responsibility of the Contractor to procure and bring to site of work all materials required for fulfilling the contract.

13.0 Employer’s Supply of Materials

The Employer, entirely at their own discretion may decide to supply some materials. In such a case the rates of items of work affected due to such supply shall be suitably varied as per analysis of rates as directed by Bank / Architect. No additional claim on this aspect from the Contractor shall be entertained.

14.0 Temporary Services

The Contractor shall provide and maintain all temporary services on or about the site required for the execution of the work and shall remove them on completion.

15.0 Unauthorized Persons

No unauthorized persons are to be allowed on the site. The Contractor shall instruct all such persons to keep out and shall take steps to prevent trespass.

16.0 Keeping Site Clean

During the progress of the work and when directed by the Bank / Bank's / Architect's Representative the Contractor shall keep the site clear of all rubbish and debris including that which may be deposited on the site by any sub-contractors until the date of issue of certificate of completion. The cost of keeping the site clean shall be deemed to have been included for in the rates.

On completion of the work, the Contractor shall at his own expense clear away and remove from the site not later than 7 days from the date of completion of work all constructional plant, surplus material, rubbish and temporary work of every kind and leave the entire site and work clean and in a workmanlike condition to the satisfaction of the Employer and the Bank / Bank's / Architect's Representative.

17.0 Office Accommodation for Contractor, Bank / Bank's / Architect's Representative

and Employer’s Representative. The Contractor shall provide and maintain all necessary office/s, workhops, stores, shelters, sanitary facilities, canteens and other buildings for themselves and their staff at site to the approval of the Bank / Bank's / Architect's Representative.

All such facilities shall be removed at the completion of project or at any later date as approved.

18.0 Lighting for work

The contractor shall at all times provide approved lighting as required for the proper execution and supervision of the work.

19.0 Site Instruction Book

The Bank / Bank's / Architect's Representative shall keep a site instruction book with triplicate pages, on the site in which his or authorized representatives remarks, instructions, decisions and other essential details, of the work shall be recorded. The Contractor shall regularly note the contents of this book and initial it signifying his having done so and take immediate action on the same. A copy of the instruction shall be made available to the Contractor immediately.

20.0 Progress Report

The Contractor shall submit regular weekly progress reports to the Bank / Bank's / Architect's Representative in a form as required by him which shall also include progress photographs of the work arranged at contractors cost.

21.0 Notice to local bodies

The contractor shall comply with and give all notices required uner any Government authority, instruction, rule or order made under any act of parliament, state law as or any regulations or bye laws of any local authority relating to the work.

22.0 Contractor to verify site Measurements

The Contractor shall check and verify all site measurements whenever requested by other specialists, Contractors or by nominated or other sub-Contractor to enable them to prepare their own shop drawings and pass on the information, with sufficient promptness as will not in any way delay the work. A copy of all such information passed on shall be given to the Bank / Bank's / Architect's Representative.

23.0 Charges for Water

The Employer shall not charge the Contractors for the water consumed by them 24.0 Contract Rates

The Contract rates and prices shall be deemed to include all labour, materials, use of plant tools, temporary work and buildings, etc insurance, octroi, sales tax, service tax/VAT, local taxes including tax on work contract and duties, establishment charges, overhead, profit, supervision, transport, sampling, testing, shop drawing and other charges and every expense incurred in the proper and due execution, completion and maintenance of the work, and shall be in full satisfaction and discharge of every obligation imposed upon him by the Contract and nothing extra shall be payable unless so specifically stated in this Contract.

25.0 Time of Completion & Progress of work

The whole of the work as stipulated shall be completed within the stipulated time period starting from the date of receipt of the written order by the Employer to commence the work or three days from the date of handing over of site whichever is later. Time is the essence of the contract and the work must be completed within the time schedule as indicated in the Appendix to the Tender. Any Tender which disagrees with the time schedule of construction and stipulates a longer period is liable to be rejected. The Contractor shall take all special steps he thinks might be necessary to complete the work in the stipulated time including any special plant, equipment, special shuttering and centering system, additional quantity of shuttering and other materials, labour etc and give detailed and specific indication of the same in his tender submission and include the cost thereof in his quoted rates.

26.0 Statutory Obligations, Notices, Fees and Charges

1. a) The Contractor shall comply with and give all notices required by, any act, any instrument rule or order made under any Act, or any regulation or byelaw of any local authority or of any agency which has any jurisdiction with regard to the work or with whose systems the same are or will be connected (all requirements to be so compiled with being referred to in these Conditions as the statutory requirements).

b) If the Contractor shall find any divergence between the statutory requirements and all or any of the contract documents or any variation instruction issued in accordance with these Conditions, he shall immediately give to the Bank / Architect/Bank / Bank's / Architect's Representative a written notice specifying the divergence. c) If the Contractor gives notice under paragraph (b) of this sub-clause or if Bank / Architect/Bank / Bank's / Architect's Representative shall otherwise discover or receive notice of a divergence between the statutory requirements and all or any of the contract documents or any variation, instructions issued in accordance with these Conditions, the Bank / Architect/Bank / Bank's / Architect's Representative shall within 7 days of discovery or on receipt of a notice issue instructions in relation to the divergence. If and insofar as the instructions require the work to be varied, they shall be deemed to be Bank / Architect/Bank / Bank's / Architect's Representative‟s instructions issued in accordance with these conditions. d) i) If in any emergency compliance with paragraph (a) of this sub-

clause requires the Contractor to supply materials or execute work before receiving instructions under paragraph (c) of this sub-clause the Contractor shall supply such limited materials and execute such limited work as are reasonably necessary to secure the statutory requirements.

ii) The Contractor shall forthwith inform the Bank / Architect/Bank / Bank's / Architect's Representative of the emergency and of the steps that he is taking under this paragraph of these conditions. iii) Work executed and materials supplied by the Contractor under sub-paragraph (i) of this paragraph shall be deemed to have been executed and supplied pursuant to an Bank / Architect/Bank / Bank's / Architect's Representative instruction in accordance with these Conditions provided that the emergency arose because of a divergence between the statutory requirements and all or any of the documents referred to in these Conditions or any variations, instructions issued in accordance with these Conditions, and the Contractor has complied with sub-paragraph (ii).

e) Provided that the Contractor complies with paragraph (b) of this sub-clause, the Contractor shall not be liable to the Employer under this Contractor shall not be liable to the Employer under this Contract if the work do not comply with the statutory requirements from the Contractor having carried out work in accordance with the documents referred to these Conditions or any variation instruction issued in accordance with Clause II (i) of these Conditions.

2. The Contractor shall pay and indemnify the Employer against liability in respect

of any fees or charges (including any rates or taxes) legally demandable under

any Act, any instrument, rule or order made under Any Act, law or any regulation or byelaw of any local authority or of any statutory or agency in respect of work.

27.0 Materials and Workmanship to be best of the respective kind

1) All materials, goods and workmanship shall as far as procurable be the best of the respective kinds and standards described in the Contract.

2) The Contractor shall upon the request of the Bank / Architect/Bank / Bank's /

Architect's Representative furnish him with the documentation to prove that the materials and goods comply with sub-clause (1) of this condition.

3) The Bank / Architect/Bank / Bank's / Architect's Representative may issue

instructions requiring the Contractor to open up for inspection any work covered up or to arrange for or carry out any test of any materials or goods (whether or not already incorporated in the work) or of any executed work, and the cost of such opening up or testing (together with the cost of making good consequence thereof) shall be added to the Contract price unless provided for in the Contract or unless the inspection or test shows that the work, materials or goods are not in accordance with the Contract.

4) The Bank / Architect/Bank / Bank's / Architect's Representative may issue

instructions in regard to the removal from the site of any work, materials or goods which are not in accordance with this Contract.

28.0 Samples

Apart from adhering to any special provision made in the specifications regarding submission of samples the Contractor shall produce samples to the Bank / Architect-in-charge as and when advised by the Employer/Bank / Architect alongwith the detailed literature of all materials he proposes to use in the building irrespective of the fact that a specific make/material might have been stipulated. If certain items proposed to be used are of such nature that samples cannot be presented or prepared at the site, detailed literature/test certificate of the same shall be provided instead. Before submitting the samples/literature meet with the requirement of the specification. The Bank / Architect or his representative shall check the samples and give his comments and/or approval to the same. Only when the samples are approved in writing, he shall proceed with the procurement and installation of the same. The approved samples shall be signed by the Bank / Architect or his representative for identification and shall be kept on record at his office until the completion and acceptance of the work and shall be available at the site for inspection/comparison at any time. The Contractor shall keep with him a duplicate of such samples to enable him to process the matter. For items of work where the samples are to be made at the site the same procedure shall be followed. All such samples shall be prepared at a place where it can be left undisturbed until the completion of the project. The Bank / Architect shall give his comments/approval to the samples at his earliest convenience. Any delay that might occur in approving of the samples for reasons of its not meeting with the specifications shall be to the account of the Contractor. In this respect the decision of the Bank / Architect will be final.

On delivery of the supplies at the site, the Contractor shall specifically arrange to get the supply inspected by the Bank / Architect and compared with the approved sample and his specific approval obtained before using the same in the work.

29.0 Shop Drawing

The Contractor shall prepare shop drawings for specialist trades such as Sanitary & Plumbing, Electrical conduct layout. False Ceiling, Aluminium Doors & Windows,

removable partitions and any other item as stipulated in the specifications. The shop drawings shall follow the design and detailing requirements. The shop drawings the Bank / Bank / Architects drawings, specifications and Schedule of quantities and shall incorporate the fabrication details as proposed by the Contractor the features and exact conditions as available at the site of construction, any aspect related to coordination with other disciplines and any other details that the Bank / Architect might stipulated by the Contractor with his comments/approval. Only receiving the approval the shop drawings, further work on the item shall be proceeded with by the Contractor. The Contractor shall submit these shop drawings to the Bank / Architect sufficiently early considering scrutinise the drawings and get it corrected before further processing by the Contractor. Any plea of delay on this aspect by the Contractor shall no be entertained.

30.0 As Built Drawing

The Bank / Architect shall furnish 3 sets of prints and one set of negatives of drawings “as erected” and approved for sanitary / plumbing installations and the electrical, telephone, computer wiring diagram..

31.0 Specialist Sub-Contractor

The Contractor shall get all the specialist work such as the Sanitary & Plumbing, Electrical Work, False Ceiling, Aluminium Doors, etc executed through approved specialist sub-contractors having requisite experience in the particular trade. The list of such specialist sub-contractors the Contractor proposes to use shall be submitted with his tender alongwith details of their experience and on approval by the Bank / Architect the particular sub-contractor only shall be appointed for carrying out the work. The Employer/Bank / Architect shall have the right to reject any specialist Contractor proposed in which case the Contractor shall get the work executed by another specialist sub-Contractor who meets with the approval of the Bank / Architect and no claim by the Contractor regarding this aspect shall be entertained.

32.0 Inspection by the Chief Technical Examiner (Vigilance)

The proposed work covered under this tender, during its progress or after completion of work, can be inspected by the Chief Technical Examiner/Technical Examiner or by an officer of the vigilance cell of the authority on behalf of the Employer/Bank / Architect.

Contractor shall afford all reasonable facilities to the above vigilance staff as also provide them with ladders, tapes, plumb bob, level bottle, chisel and hammer, etc as also necessary labour, skilled/unskilled, to complete their inspection/study/technical scrutiny to ascertain that execution of work has been done with materials and workmanship as stipulated in the Contractor on this account.

33.0 Removal of debris

After every days‟ work the Contractor shall remove all debris and unusable waste materials from and around the site and leave the works in as clean and spic and span conditions as the circumstances could allow.

34.0 Approved Makes

The specifications provide a list of approved makes of some materials specified. The Employer/Bank / Architect has the right to choose any of the approved makes from the list which according to him is the best and most suitable for the purpose and the contractor shall arrange for this make in the work. The tender price quoted shall cover for this aspect. Only when it is not possible to use any of the approved makes, either due to non availability or due to technical reasons, the Contractor shall propose alternative materials and if found suitable these shall be approved by the Bank / Architect for construction but without any extra cost to the Employer.

35.0 Dismissal of Undesirable Persons

The Bank / Architect/Bank / Bank's / Architect's Representative may (but not unreasonably or vexatiously) issue instructions requiring the dismissal from the work of any person employed thereon who is found by him to be undesirable.

36.0 Access to the Work

The Employer/Bank / Architect/Bank / Bank's / Architect's Representative and his nominees shall at all reasonable times have access to the work and to the workhops or other places of the Contractor or his sub-Contractors/suppliers where work is being carried out for the Contract. When work is to be so carried out in workhops or other places of a sub-Contractor the Contractor shall by a term in the sub-contract incorporate a similar right of access to those workhops or places for the Employer/Bank / Architect/Bank / Bank's / Architect's Representatives and their nominees and shall do all things reasonably necessary to make such right effective.

37.0 Supervising Officer’s Instruction

1) The Contractor shall forthwith comply with all instructions issued to him by the Bank / Architect/Bank / Bank's / Architect's Representative in regard to any matter in respect of which the Bank / Architect/Bank / Bank's / Architect's Representative expressly empowered by these Conditions to issue instructions. If within seven days after receipt of a written notice from the Bank / Architect/Bank / Bank's / Architect's Representative requiring compliance with an instruction the Contractor does not comply therewith, then the Employer may employ and pay other persons to execute any work whatsoever which may be necessary to give effect to such instruction and all cost incurred in connection with such action shall be recoverable from the Contractor by the Employer as a debt or may be deducted by him from any monies due or to become due to the Contractor under this Contract.

2) Upon receipt of what purports to be instruction issued to him by the Bank /

Architect/Bank / Bank's / Architect's Representative the Contractor may request the Bank / Architect/Bank / Bank's / Architect's Representative to specify in writing the provision of these conditions which empowers the issue of the said instruction. The Bank / Architect/Bank / Bank's / Architect's Representative shall forthwith comply with any such request, and if the Contractor shall thereafter comply with the said instruction, then he issue of the same shall be deemed for all the purposes of this Contract to have been empowered by the provisions of the contract specified by the Bank / Architect/Bank / Bank's / Architect's Representative in answer to the Contractor‟s request.

3) All instructions issued by the Bank / Architect/Bank / Bank's / Architect's

Representative shall be issued in writing. However any instruction issued orally shall be given immediate effect and shall be confirmed in writing by the Bank / Architect/Bank / Bank's / Architect's Representative thereof within three days.

38.0 Liquidated Damages

If the Contractor fails to complete the work within the stipulated period of completion mentioned in Clause 37 herein above, the Contractor shall be liable and shall pay to the Employer as pre-estimated damages at the rate of half per cent of the final contract price per week or part thereof of delay subject to a maximum of 5% (Five per cent) of the final contract value. In case of the non-completion is limited to certain items/ disciplines/sections/areas which is not preventing the Employers to occupy and use the building effectively as decided by the Bank / Architect then the damages shall be limited to 5% of the cost of the particular item/discipline/section subject to the ceiling as indicated before.

39.0 Occupation of Partially completed Building by the Employer

The Employer shall be entitled to and at liberty to occupy even the partially completed building or any portion there of by themselves or through their agents and servants if they so desire.

40.0 Termination

In the event of the Contractor failing to complete the work within the stipulated period of completion as mentioned in the conditions of contract, the Employer may, notwithstanding anything contained to the contrary in the contract, terminate at any time the contract without being liable in any manner whatsoever to the Contractor, by 30 days notice in writing to the Contractor and proceed to complete or get completed the work which have remained incomplete/not done at the time of such termination at the risk and cost of the Contractor as mentioned herein above.

41.0 Secured Advance for Materials at site

The Contractor will not be paid any secured advance against the materials brought to the site.

42.0 Minimum wages

The Contractor will have to pay his labour wages as stipulated under the Minimum Wages Act at the rates prevailing during the currency of the contract. The Contractor should adhere to all the provision of Contract Labour (Abolition & Regulation) Act,1970

43.0 Escalation The rate quoted shall be firm throughout the tenure of the contract (including extension of time, if any, granted) and will not be subject to any fluctuation due to increase in cost of materials, labour, sales tax, octroi, etc. No escalation in cost is payable either for materials, labour, taxes, etc.

44.0 Exciser, duties, levies, VAT etc.

The Contractor is responsible for all excise, duties, levies, etc. 45.0 Idle Labour

Whatever the reasons may be, no claim for idle labour, additional establishment, working during night, cost of hire and labour charges of tools and plants establishment, cost of hire and labour charges of tools and plants would be entertained under any circumstances.

46.0 Method of Measurement

Unless otherwise mentioned elsewhere in this tender measurement will be on the net quantities or work produced in accordance with upto date rules laid down by IS1200. In the event of any dispute with regard to the measurement of the work executed, the decision of the Bank / Architect/Employer shall be final and binding on the contractor.

47.0 Guarantee for the Specialized Work Whenever provision for submission of a guarantee has been advised, the same shall be submitted from the specialized agency alongwith a counter guarantee by the main contractor engaged for the work. The guarantee shall be furnished on a non-judicial stamp paper of appropriate value. If the contractor is required to submit guarantee/guarantees for any item/items for a period of more than 6 months, the guarantee/guarantees in case of those items shall remain valid even after expiry of the defect liability period of 6 months as stipulated in the contact.

48.0 Income Tax/Sales Tax on Work Contract

Statutory deduction of Income Tax/Sales Tax on work contract shall be made from all interim and final payments as per extended statute.

49.0 Earnest Money & Security Deposit/Retention Money

i) Earnest Money : Earnest money as mentioned in tender notice has to be deposited in the form of Bank Draft/Pay Order/Banker‟s Cheque drawn on any Nationalised/Scheduled Bank in favour of Industrial Development Bank of India Ltd. and shall be enclosed along with the tender. Any tender not accompanied by the Earnest Money deposit shall be rejected.

ii) Retention Money: Apart from Earnest Money Deposit made to constitute 5% (five percent) retention money on the value of the work done upto date, the amount over and above EMD already deposited shall be deducted from the running bills and the same shall be returned against submission of Bank Guarantee. The deduction from the final bill will be so adjusted to make the total security deposit 5% (five per cent) of the value of work done including EMD and retention money deducted from R/A bills and deposited earlier. The entire Retention Money (including earnest money furnished with the tender, and amount deducted from progressive bills) shall be held till the work is completed in all respect to the full satisfaction of the Employer/Bank / Bank / Architects, 50% of the above deposit will be released after virtual completion and the balance after the expiry of the defects liability period/ maintenance period. The Employer shall not pay interest on either the Earnest Money or the Retention Money. All compensation or other sums of money payable by the contractor to the Bank under the terms of this contract may be deducted from, or paid by the sale of a sufficient part of his security deposit or from any sums which may be due or any become due to the contractor by the Employer on any account whatsoever, and in the event of his security deposit, being deducted by reasons of any such deduction or sale as aforesaid the contractor shall within fourteen days thereafter make good in Bank Draft endorsed as aforesaid any sum or sums which may have been deducted from or raised by sale of his security deposit or any part thereof.

GENERAL SPECIFICATIONS GENERAL These specifications are for work to be done, item to be supplied and materials to be used in the work as shown and defined on the drawings and described herein, to the satisfaction of the Employer/Bank / Architect. 1.1. The workmanship is to be the best possible and of a high standard. The contractor shall

take all steps immediately to make up deficiency if any noticed by the Employer / Bank / Architect. Use must be made of special tradesmen in all aspects of the work and allowance must be made in the rates for the same.

1.2. The materials to be provided by the contractor shall be in accordance with the samples

already got approved from the Employer/Bank / Architect by the contractor and in conformity with specification and approved list of manufacturers and brand. The contractor shall produce all invoices, vouchers or receipts for any materials if called upon to do so by the Employer/ Bank / Architect.

1.3. Samples of all materials are to be submitted to the Employer/Bank / Bank / Architects for

their approval before the contractor orders or delivers the material to the site. Samples together with their packing are to be provided free of charge by the contractor and should any materials be rejected they will be removed from the site at the contractors expense. All samples will be retained by the Employer / Bank / Bank / Architects for comparison with materials which will be delivered at site. Also the contractor will be required to submit specimen finishes of colors, fabrics, etc., for the approval of the Employer/Bank / Bank / Architects before proceeding with the work.

1.4. The contractor shall be responsible for providing and maintaining temporary coverage

required for the protection of finished work. He is also to clean out all wood shavings, cut ends and other waste from all parts of the work before covering or in fillings are constructed.

1.5. Contractor shall maintain uniform quality and consistency in workmanship throughout the

execution of the work. 2.0 Joinery in woodwork 2.1 The contact surfaces between internal frame and skinning shall be glued with approved

adhesive in addition to fixing with necessary screws etc. 2.2. After preparing proper surface of skinning by sand-papering etc., the laminates or

veneers shall be fixed on it with the help of approved adhesive. 2.3. Framework for full height partitions shall be rigidly fixed to the floor, walls and ceilings of

it. 2.4. Any portions that are warped or found with other defects are to be replaced. The whole of

the work is to be framed and finished in a workman-like manner in accordance with the detailed drawings and the direction of Bank/Bank / Architect and whenever required, fitted with all necessary metals ties, straps, screws, adhesive, etc. Joinery work generally to be finished with fine sand/glass paper.

2.5. All joints shall be standard mortise and tenon, dowel, or cross-halved. Screws, nails, etc.

will be of standard iron or wire. Tenons should fit the mortises exactly. 2.6. Nailed or glued butt joints will not be permitted.

2.7. Wherever screw heads are on a finished surface those will be sunk and the hole plugged with a wood plug of the same wood and grain to match the colour.

3.0 Timber 3.1 All the Sal wood, CP Teak, BTC to be used shall be properly seasoned, of natural growth

and shall be free from worm holes, loose or dead knots or other defects, sawn square and shall not suffer from warping, splitting or other defects.

3.2 The moisture content shall not exceed 12%. 3.3 All internal framework shall be treated with approved wood preservative and with fire

retardant treatment / paint. 3.4 All wood brought to site be clean, it shall not have any preservative or other coating /

covering. 3.5 All rejected, decayed, bad quality wood shall be immediately removed from site. 3.6 All the dimensions mentioned for T.W. members are finished sizes. 3.7 All exposed T.W. is to receive melamine polish and should be of 1st quality BTC. 4.0 Plywood Plywood shall bonded with phenol formaldehyde, treated with wood preservative. 5.0 Hardware and Metals 5.1 All the screws/bolts with nuts to be used shall have oxidized finish (unless required

otherwise) of approved shape, size and quality. 5.2 Fittings shall be of brass oxidized heavy duty unless specified otherwise. 5.3 Samples of all hardware are required to be approved in advance. 5.4 The agency should cover-up and protect the brass surface by a thick grease or other

suitable material veneer as necessary and subsequently clean it away at the same time of handing over.

5.5 All hardware shall be fitted with good workmanship without the surrounding edges being

damaged. 5.6 All chair stands shall be 5-prong aluminium tilting as approved by Employer / Bank / Bank

/ Architects, with a diameter of 25 ½ inches, and finished with powder coating of high quality. In case M.S. stands are approved, the same shall be embossed with a seven-tank anti-rust treatment procedure before powder coating.

5.7 All castors shall be of approved make, quality and type. They shall be glass-reinforced

nylon castors, with twin wheels having independent movement, and with a load carrying capacity of 100 kg per castors.

6.0 Laminate 6.1 All laminate shall be of 1mm and 1.5mm thickness as specified in Bill of Quantity. 6.2 The contractor shall get the sample showing the surface texture, pattern and colour

approved, by Employer / Bank / Architect. 6.3 All edges, beadings, etc. shall also be finished in laminate. 7.0 Fabrication in metal

7.1 All brazing and welds are to be executed in a clean and smooth manner, rubber down and finished in flat and tidiest way, particularly where exposed.

8.0 Glazier 8.1 All glass is to be of approved manufacture, complying with I.S. 3548-1960, or as per

approved quality and sample, to be of the qualities specified and free from bubbles, air holes, waviness and other defects.

8.2 In cutting glass, proper allowance shall be made for expansion. 8.3 Glass for mirror shall be silvering quality (S. Q.) conforming to I.S. 3458 - 1958 or as

approved sample and quality. 8.4 On completion, all glass surfaces shall be cleaned inside and out. All cracked, scratched

glass / mirror shall be replaced. 8.5 Sun control film shall be non-reflective type, of approved make and shade. The fixing

shall be without any defects such as air bubbles / creases / adhesive marks, etc. 9.0 Paint and Polishes 9.1 All material required for the work shall be specified and approved manufacture, delivered

to the site in the manufacturer's containers with the seals, etc., unbroken and after use empty containers shall be stored till finally cleared by the Employer.

9.2 All iron or steel/metal surfaces shall be thoroughly scraped and rubbed down with wire

brushes and shall be entirely free from rust, mill scale, etc., before applying the primary coat.

9.3 Melamine polish finishes shall be properly finished, without any flow marks, spots,

roughness etc. 9.4 Painting work shall be of high standard, without any brush marks on the finished surface

and no spots on adjacent furniture, glass, etc. 10.0 Civil work 10.1 The contractor shall use cement of approved make only. 10.2 Only first quality ceramic tiles of approved make shall be used. All tile joints shall be filled

up properly using cement slurry mixed with matching pigments. 10.3 Only best quality granite and marble of the basic rate specified and of approved shade

shall be used. (Basic rates wherever mentioned are ex-godown and excluding taxes). The granite/marble shall be from the same lot and without colour / shade variations or any other defects.

10.4 All edge chamfers/cutting of granite/marble shall be mirror polished and no extra shall be

paid for the same. 11.0 Grills wil be of Dynacraft / Aircons air

MODE OF MEASUREMENTS 1. DOORS, WINDOWS AND GRILLS

Clear area over one face inclusive of frame shall be measured. Hold fasts and portions embedded in masonry or flooring shall not be measured.

2. DECORATIVE PANELING OVER WALL OR OVER PARTITIONS The area of cladding shall be measured in square meter, or square feet. The gross area cladded will be measured. No deductions will be made for gaps upto one centimeter between the panels.

3. PAVING AND TILE WORK

The work mentioned in this section shall be measured in sq.mt/Sq.ft. and shall be priced per unit of Sq.m/Sq.ft. In all paving work, the slabs shall be touching the walls and go well under the plaster, but the measurements shall be the clear measurements of the rooms or areas when finished. No allowance shall be made for portions going under the plaster.

4. FALSE CEILING

For false ceiling work, the measurement shall be for the actual area covered. No deductions shall be made for the cutouts, for light fittings, speakers, column upto 5.00 Sq.Ft.

5. WOODWORK

For conversion of inches to feet, the resultant figure shall be taken upto two digits after decimal point. Third digit shall not be taken into account.

9. ELECTRICAL WORK

1.0 SCOPE :

Scope of these specifications relates to the Design, Supply, Installation, Testing and Commissioning of

electrical power distribution and other low voltage systems as described and detailed in this tender.

2.0 Rules, Regulations And Standards :

Entire electrical work shall be carried out in conformity with the Rules, Regulations and various applicable

Indian Standards (with up to date amendments) some of which are mentioned below:-

1. Indian Electricity Act - 1910.

2. Indian Electricity Rules - 1956.

3. National Electrical Code.

4. Tariff Advisory Committee Approvals.

5. IS: 732 Electrical Wiring Installation.

6. IS: 1554 PVC Insulated Cables (Heavy Duty).

7. IS: 1653, IS: 2667, IS: 3837, Rigid Steel Conduits & Fittings.

8. IS: 3043 Code of Practice for Earthing

9. IS: 2509, IS: 3419, IS: 6946 Rigid PVC Conduits and Fittings.

10. IS: 694 PVC Insulated Sheathed & Unsheathed Cables.

The list of Indian Standards given above is only representative and shall not be considered as complete. All

materials supplied and used for electrical works shall fully confirm to the relevant Indian Standard and

shall carry the `ISI' mark. Prior approval of Consultant/our representative shall be taken for use of any

material not bearing the ‘ISI’ mark. In addition, all installation shall conform to the requirements of local

authorities or supply agencies such as PWD, BEST, RELIANCE ENERGY, TEC, Electricity Board or any

other licensing authority as the case may be.

3.0 Wiring for Lighting, Fans & Plug Points :

Electrical wiring installation shall in general conform to IS: 732 and shall be as described further below:-

3.1 Point wiring:

Unless and until separately specified in the BOQ or drawing, the point wiring shall consist of all conduits,

conduit accessories, pull boxes, switch boxes, main circuit wires from final sub-distribution board up to the

lighting switch-board and further wiring from switch board to the ceiling-rose or socket outlet or any other

approved mode of termination, using either surface mounted or concealed rigid conduits as specified in the

B.O.Q. or described otherwise. Supply and installation of necessary control switch, ceiling-rose, socket-

outlet or any connector housed in a junction box as well as continuous earthing from DB to switch-board

to the lighting fixture or socket outlet etc., using PVC insulated green colour copper wire, shall be included

and considered as part of point wiring.

3.1.1 Circuit Wiring:

Unless specified otherwise, the circuit wiring from the respective DB shall be deemed to have been

included in the point wiring and will not be considered separately for payment.

3.1.2 Measurement of Point Wiring:

Wiring of one light-point, fan-point or socket outlet controlled by one controlling switch shall be

considered as one point. In case of more than one lights being controlled by one switch, the first light point

along with the switch shall be taken as primary point and the subsequent light points as secondary points.

Rate quoted against secondary points shall be applicable to such points, unless such points have been

described and quoted separately.

3.1.3 Wiring of Plug and Socket Outlets:

Wiring of individual isolated socket-outlet shall be considered as one full point irrespective of the fact

whether socket and the switch are located at one place or at two separate locations. However in case of a

socket-outlet-cum-controlling-switch being located on a lighting or fan or socket switch-board and wired

from the same circuit, it shall be considered as secondary point and paid as such. In the absence of any rate

for secondary points, such socket-outlets shall be paid at half the rate of point-wiring rate. All socket outlets

shall invariably have their third earth pin connected to main Earthing Grid using insulated green color

copper wires.

3.1.4 No. of Points per Circuit:

Not more than 8 nos. (800 Watts) of light/fan/5A plug-points shall be wired in one circuit where the

circuit wiring is specified as 2.5 sqmm., copper wires and point-wiring is specified as 1.5 sqmm., copper

wires. In case of 15 A, plug points not more than two points shall be wired from one circuit unless specified

otherwise in the BOQ.

3.1.5 Capacity of Conduits:

Not more than 5, 10 and 15 number of copper wires of 1.5/2.5 sqmm. size shall be drawn in rigid conduits

of diameter 20mm, 25mm and 32mm respectively. Any deviation from above shall have to be corrected

by re-pulling of wires as directed at site.

3.1.6 Jointing of Wires:

No jointing of wires using insulation tape etc. shall be allowed in conduits or junction boxes. All

termination shall be properly done on switch-boards, ceiling-rose, socket-outlet or terminal blocks.

3.2 Control Switch & Socket Outlets:

All control switches (5 Amp. and 15 Amp.) used in point wiring, whether surface mounted or concealed

type shall conform to IS: 3854 and carry `ISI' mark. Similarly all 5A and 15A socket-outlets used for point

wiring shall conform to IS: 1293 / IS: 4615 and carry `ISI' mark distinctly. Wherever called for, industrial

type of metal clad sockets and switches conforming to the relevant IS shall be provided. All switches and

socket outlets shall be mounted in a suitable sized box of P.V.C/GI with ample space for connection and

disconnection of wires.

3.3 Ceiling Rose & Lamp Holders:

All ceiling-rose shall conform to IS: 371 and carry `ISI' mark. All lamp holders shall be BC type unless

specified otherwise and conform to the relevant Indian Standard.

3.4 Conduiting:

All conduits used for point wiring whether surface mounted or concealed, shall be heavy gauge

PVC/MS/GI (as specified in BOQ) rigid conduits confirming to IS:2509 and shall distinctly carry `ISI'

mark. Non `ISI' conduits shall not be used in any circumstance what-so-ever. The minimum size of conduit

used shall be 20mm (3/4”) diameter unless specified otherwise. In case of PVC conduits the wall thickness

shall not be less than what is specified for the Heavy Gauge conduits. Wires of only one phase and neutral

shall be generally drawn and bunched in one conduit. Number of wires to be drawn in one conduits shall be

as described at clause 3.1.5 earlier.

3.4.1 Fixing of Conduits:

In case of surface mounted conduiting, all conduit pipes, shall be fixed and supported using suitable saddles

or spacers along with clamps at intervals not more than 600 mm. However near to any fitting or accessory

used on the conduits, the clamps shall invariably be placed at 150 mm, on either side of the fitting/

accessory. In case of recessed or concealed conduiting, the interval of clamping shall be one meter or less

depending on the routing and bends encountered. Neat chasing shall be made in the wall or ceiling and

conduits fully recessed with at least 20mm. space above the conduits for proper re-plastering. All such

recessed conduiting shall be carried out before final plastering of the brick walls. In case of already

plastered walls the refilling up to pre-final coat of plaster shall be included in the scope of the point wiring

item.

3.4.2 Conduit Joints :

All M.S./G.I. conduits shall be jointed using screwed couplers, fitting and accessories. Sufficient number

of inspection couplers or fittings shall be provided in long runs of conduits for proper pulling of wires. In

case of non-metallic PVC conduits all joints shall be made using PVC solvent cement or other suitable

jointing materials supplied by the manufacturer of the conduits. All PVC conduit pipes embedded in the

RCC slabs, beams, columns etc. must be jointed by PVC solvent cement to avoid choking of the same due to

ingress of concrete-slurry at the time of concreting.

3.4.3 Protection of Metal Conduits:

All MS Conduits whether used in concealed, recessed or surface conduiting, shall be given a coat of rust-

preventive zinc-chromate red-oxide paint, before applying final coat of painting.

3.4.4 Conduit Layout Drawings:

Based on the lighting and plug-point layout drawings issued along with the tender, separate working

drawings showing conduit-layouts shall be prepared by the contractor and got approved from the

Consultant. Only on specific approval of such drawings in writing, the work of laying conduits in the RCC

shall be taken up by the contractor.

3.4.5 Conduit Earthing :

All metallic conduit network shall be suitably earthed near to the terminal boxes using suitable earth

clamps and 12 SWG/G.I/copper earth wire. Separate earthing continuity wires (Insulated green colour

copper wires) shall be run within the conduits for providing the earthing to socket outlets, lighting fixtures

and other appliances. In no case the metallic conduits shall be considered as earth continuity for such

purpose.

3.4.6 Conduit Fittings/Accessories:

All conduit fittings/accessories used for laying conduits shall conform to IS:2667, IS:3419 and IS: 3837

and shall carry "ISI" mark distinctly. Non ISI fittings and accessories shall not be used. Fittings shall

preferably be from the same manufacturer as conduits.

3.4.7 Flexible Conduits:

Wherever necessary (due to lack of spaces and complexity of cross over points etc.), the use of flexible

metallic or non-metallic PVC conduits may be made as specified in the BOQ. Such use shall be kept to

bare minimum and in no case be considered as alternative to rigid conduiting. All flexible non-metallic

PVC conduits should conform to IS:6946 and shall be used with proper adapter type end-fittings. In the

case of drops from main ceiling to false ceiling for light points such conduits shall be properly connected to

the junction box using correct size adoptor or end-fitting.

3.5 Wires:

All wires used in point wiring shall be PVC insulated copper conductors conforming to IS:694 and shall

bear ‘ISI’ mark distinctly. The wires shall also have FIA (Fire Insurance Approval) Unless specified

otherwise, 1.5 sqmm copper wires shall be used for wiring from switch-board to the actual point and 2.5

sqmm copper wires for circuit wiring from DB to switch-board, in case of point wiring for light, fan, bell

and 5A plug point. For 15A plug-point, 2.5 sqmm copper wires shall be used from DB to switch-board to

socket-outlet. In case of A/C plug-point directly fed from DB, 4.0 sqmm copper wires shall be used. While

using wires of non-metric sizes, nearest higher sizes of wires/cables shall be chosen. Coils of wires shall be

got approved by the Consultant prior to uncoiling and drawing in conduits. All termination of wires shall be

carried out neatly and rigidly with only appropriate amount of insulation peeled-off. All wires of size

higher than 4.0 sqmm shall be terminated using suitable crimp-type copper lugs.

4.0 Panels and Distribution Boards:

All medium voltage Main Panels, Sub Panels, Distribution Boards and Sub-Distribution Boards used in

electrical distribution network shall strictly conform to IS:8623 and IS:4237. All such panels and boards

shall be of sheet steel construction and shall be dust-proof, vermin-proof and water-proof providing a

degree of protection of IP-42 for indoor use and IP-54 for outdoor use. Sheet steel used shall be cold-rolled

(CRCA) and at least 2.0 mm thick (14 SWG) with proper bracing and supports. The Panels and DB's shall

be cubicle type with hinged, gasketed doors having provision for locking the door and necessary hardware

for housing various components such as ACBs, MCCBs, MCBs, SFUs, motor-starters, bus-bars, mounting

frames, DIN bars, internal earth-bar, knock-outs for cable glands, inter-connecting wiring, ammeters,

voltmeters, selector switches, indicating lamps etc. as required. Complete panels and DBs shall be

phosphated and stove-enamel painted using seven tank process in accordance with IS:6005 and IS:2074.

Each panel or DB shall be suitable for either floor- mounting or wall-mounting as specified and shall have

two distinct earthing lugs of appropriate size, one on either side.

4.1 Main Bus-Bars:

Busbars shall be sleeved and made of either aluminum alloy of E-91E grade or electrolytic grade copper (as

specified in the BOQ ) having adequate cross-section to carry the rated currents and momentary short-

circuit current.

4.2 Feeders:

Each feeder to be controlled from panel or DB shall be provided with a FP/TP/DP/SP isolating switch such

as ACB, MCCB, MCB, SFU, HRC/Re-wirable fuses, contactors as required. There shall be ample space in

the panels/DBs for accommodating incoming and outgoing cables end terminations.

4.3 SFU/ACB/MCCB/MCB/Fuse:

4.3.1 All Switch Fuse Units provided shall be HRC type conforming to IS:4064 and carrying "ISI" mark

clearly.

4.3.2 All MCCBs shall be housed in superior arc-resistant molded enclosure and shall conform to IS:2516.

4.3.3 All MCBs shall have specified breaking capacity and strictly conform to IS:8828-Cat-M3/M9 and

carry distinctly "ISI" mark.

4.3.4 All motor-starters for control of motor loads etc. shall have thermal overload protection and conform

to IS:8544, and shall carry "ISI" mark.

4.3.5 All fuse distribution board and fuse units housing HRC fuses shall conform with IS:2675 and

IS:2086.

4.3.6 HRC fuses used in the panels and DBs shall be of 80 KA rupturing capacity and quick-acting type

having positive indication arrangement in case of fuse blow-out. All fuses shall conform to IS:9224 and

shall bear "ISI" mark distinctly.

4.3.7 Air Circuit Breakers provided in Main-Panel shall be of air-break-draw-out type, mounted on a

wheeled carriage moving on guides. The ACB shall conform with provisions of IS:2576.

4.4 Internal Wiring:

All panels and DBs shall be supplied completely wired and ready for external connections to the terminal

block provided inside. All internal wiring shall be carried out with PVC insulated stranded copper

conductors of adequate capacity. All control, alarm and indication circuits shall be wired using 1.5 sq.mm.

copper conductors PVC insulated wires. All wiring shall be terminated on terminal block with

identification ferrules marked to correspond with the wiring diagram. A General-Arrangement-cum-Lay-

Out drawing along with schematic wiring diagram

shall be submitted by the contractor for approval of Consultant before taking up the fabrication of any panel

or distribution board.

4.5 Labels and Diagram Plate:

Every incoming or outgoing switch mounted inside the panel or distribution board shall be provided with

individual label identifying its rating, designation and feeder number. Also all the panels/DBs shall be

provided with a non-rusting type label on the front, engraved with its designation as per the Electrical

Schematic Diagram. Inside the panel/DB, the circuit diagram shall be pasted on the back of the door for

quick reference.

4.6 Test Reports:

All panels and DBs shall be subjected to High Voltage Test (2000 volts for one minute) and Megger Test

and reports of such tests shall be submitted by the contractor to Consultant before shipping the material to

site.

5.0 Cables:

All medium voltage cables to be supplied and installed shall be heavy duty insulated, armored and overall

sheathed conforming to IS:7098 and shall bear "ISI" mark.

5.1 Cable Accessories:

All cable accessories like glands, lugs, saddle supports, insulation tapes, epoxy compounds, bricks, sand,

cable marker etc., used for laying of cables shall be of high quality and shall conform to relevant Indian

Standard.

5.2 Cable Laying:

Installation of all cables shall be carried out generally as per IS:1255. The cables shall be laid in trenches,

trays, racks, tunnels, conduits, RCC-pipes or directly buried as specified and directed by Consultant. Unless

specified otherwise, the cables shall be laid about 900 mm deep in an excavated trench, in outdoor areas.

The cable shall be laid on a bed of sand and covered by bricks on three sides. The supply of sand and bricks

shall be included in the unit rate for laying of cables where such items are not mentioned separately in the

BOQ. Proper cable markers shall be installed along the routes of cable laid underground in outdoor areas

In indoor areas, the cables shall be clamped on either walls or ceiling using suitable size saddle supports,

spacers and clamps spaced not more than 600 mm. Wherever necessary the use of cable-trays, hangers etc.

shall be made as directed. In all runs of cables, some extra length shall be kept at suitable points, in the

form of a loop, to enable a straight-joint to be made later, if required. Bending radius for any cable shall be

not less than fifteen times the overall diameter of the cables. .

All crossing of brick/RCC walls, floors, ceiling shall be done using a rigid metallic or non-metallic PVC

pipe-sleeve of size higher than the diameter of the cable for easy and smooth passage of cables. Such

structural openings in RCC floors or walls shall be provided by the electrical contractor at the time of

casting, by placing suitable embedment sleeves. The length of cables shall be measured from terminal to

terminal for the purpose of payment. No allowance shall be made for cut lengths, wastage etc. The cables

shall be installed as per the approved drawings and as directed by Consultant taking into account the

prevailing site conditions and available routing.

6.0 Earthing and Lightening Protection:

Earthing of the complete electrical installation shall be carried out strictly conforming to the provisions of

IS:3043. All Panels, Sub-Panels, DBs, Sub-DBs, SFUs, Starter Panels etc. shall be earthed by using two

separate and distinct earthing connection of adequate size. Bare G.I. or Copper, conductor (as specified)

shall be used for earthing of all electrical equipment and other electrical appliances. The size of conductor

shall be as required, however in no case it shall be less than half the cross section of current carrying

conductor. Earthing pits consisting of either copper plate or G.I. pipe (as specified) along with necessary

brick-wall chamber, cover plate, charcoal, salt and watering arrangement as per IS-3043 shall be

constructed and main earthing leads connected. In case of more than one pit, all the pits shall be

interconnected using 25 x 6 mm., G.I/Copper strips.

Lightening Protection of the building wherever specified shall be carried out as per IS:2309. A suitable size

Lightening Arrestor along with down comer leads of 25 x 3mm strip(G.I/Copper) shall be laid and

terminated on a separate Earth Pit.

6.1 Dedicated Earthing:

Dedicated earthing-pit and the relevant dedicated earthing-network shall be created wherever required for

the purpose of computers, EPABX and other such sensitive electronic equipment, as specified in the BOQ.

Such an earthing network shall be fully insulated type, using yellow-green PVC insulated and stranded

copper conductors so as to distinguish from the electrical earthing network. All plug-points meant for the

computers shall be earthed in this manner. The main earthing lead from the computer power DB to the

dedicated earthing pit shall be laid using green-yellow insulated copper conductor through PVC conduit

pipe. The complete dedicated earthing network so created shall be connected only in ‘star-topology’ to

avoid any circulating currents resulting from looping of earth connection. Both types of earthing networks

i.e. Electrical Earth and Dedicated Earth shall not be connected to each other any where in the network

except at the point of origin i.e. Earth Pits.

7.0 Light Fixtures, Fans & Fittings:

All lighting fixtures, ceiling fans, exhaust fans and other such fittings as shown in various layout drawings,

shall be either supplied & installed or only installed as specified in the BOQ. In case the fixtures are

supplied by the owner, only the installation of all such fixtures and fittings shall be included in the scope of

the contractor. Rates against such items shall invariably be quoted separately for supply and installation.

Consultant reserves the right to either include both supply & installation in the contract or only to include

the installation. All such fixtures and fittings shall conform to the relevant standards and shall have prior

approval of Consultant. For this purpose, a sample fitting of each type shall be got approved from the

Consultant, prior to effecting bulk supply. All work associated with the installation of the fittings including

final electrical connection shall be the responsibility of the contractor. Step-less electronic dimmers and

fan regulators shall also be installed and connected by the contractor wherever specified in the BOQ and

drawings.

8.0 Metering Panels/Rooms

In case of construction of new residential or commercial complexes following specifications shall be

applicable for meter rooms and the meter panels to be installed there-in.

8.1 The specifications regarding construction of the metering panels shall be as per the specifications

given above under chapter 4.0, for the LT panels. In addition, the following particular requirements and

specifications are to be followed for the metering panels.

8.2 The metering panels proposed, are either for single phase energy meters or for three phase energy

meters. The single phase energy meters will be direct reading type whereas three phase energy meters may

be either direct reading type or CT operated type as specified in the drawings/BOQ.

8.3 The actual meter cabins/panels shall be constructed as per the specifications and requirement of

the local supply agency with necessary provision for installation of KWH meters, main service cutout

and/or switch and cutout for each meter.

8.4 Meter Rooms:

A detailed layout of each meter room shall be prepared by the contractor clearly showing the locations of

power meter panels, Telephone tag-blocks and TV antenna Splitter Box and submitted to Consultant for

approval. Telephone and TV antenna terminal boards shall be provided in the meter rooms as specified but

segregated from the power meters so as not to interfere with the locations of meter panels. All telephone

and TV antenna cables down coming from individual flats/shops/offices shall be terminated on these Tag-

blocks with proper labeling for easier identification. These tag-blocks shall have enough spare capacity to

accommodate the incoming cables from the Telephone Dept. and Cable TV network.

9.0 HT System:

Whenever specified in the contract, an HT system consisting of a step-down substation comprising a

distribution transformer, HT cable, HT isolator/breaker, CTPT unit, metering, relays, bushings, outdoor

pole structure etc. shall be supplied and installed. The distribution transformer shall conform to IS: 2026/IS:

1180 and shall be installed as per the provision of IS: 10028. The HT cable shall conform to IS: 7098 and

laid as per the routing approved by Consultant. The switchgears and control gears shall conform to the

provisions of IS: 10118 and IS: 2516. The layout of the substation shall be got approved from the local

PWD inspector and submitted to the Consultant.

10.0 Auxiliary Systems:

In addition to the main indoor electrical power distribution system , following auxiliary systems shall also

be supplied and installed as and when specified in the BOQ.

10.1 Outdoor Lighting:

All outdoor lighting such as street-lights, bulk-head lights, garden-lights, post-top-lamps etc. as shown in

layout drawing shall be supplied and installed as directed by Consultant. The contractor shall erect the

necessary M.S./G.I. poles, carry out foundation works, install terminal junction boxes and the assemble and

install the light fittings and carry out necessary wiring, cabling and earthing as required. All pipes for light

poles shall conform to IS: 1239 and foundation concrete shall be M-150 as per IS: 456. Cabling or wiring

shall be carried out as per relevant clauses mentioned earlier.

10.2 Lifts and Escalators:

Necessary cabling and wiring for lifts and escalator shall be carried out as per IS: 4666 and as per the

requirements of the lift manufacturer and lift inspector. The power supply for the lift-machine shall be

terminated on a SFU/MCB/ELCB of minimum 63A, TPN size at suitable location in lift machine-room.

The main power cable for the lift-machine shall be fed directly from the main panel at ground floor with a

disconnect switch, whereas lighting supply for the lift-car shall be from a separate lighting DB. These two

supplies shall not be from the same SFU on the main LT panel at ground floor. Preferably a separate DB

shall be installed in the lift machine room to cater to the lighting and small power requirement of Lift-car,

Lift-machine-room, Lift-well, and perhaps surrounding areas on the terrace.

10.3 Water Pumps:

Adequate power supply with necessary motor-starter panel shall be provided to the pumps in pump-rooms

for water-supply, water-treatment, sewage-treatment etc.. Necessary cables for the same shall be laid from

the concerned LT panel as indicated in schematic diagram. The cabling/wiring shall conform to the

specifications given under earlier clauses.

10.4 Emergency Supply System:

Standby Emergency Power Supply System shall be supplied and installed as specified in the Tender/BOQ.

Such system shall include a Diesel Generator Set of adequate capacity along with AMF Panel/changeover

switch and a separate emergency network of cabling, panels, wiring, conduiting etc. as per approved

schematic drawings and layout plans. The Diesel engine shall conform to BSS:5514 and the generator shall

conform to IS:4722. In case of automatic changeover system, the total time of break of electrical power

shall not exceed two minutes. In case of static (non-rotating) emergency system comprising of DC battery

bank and an inverter system, all components shall be of reputed make and conform to the relevant Indian

Standards. Prior approval of Architect shall be necessary for supply and installation of single wall mounted

emergency lighting fixtures.

11.0 Low Voltage Systems:

In addition to the normal LT & HT electrical distribution system, following low voltage systems shall also

be installed as specified in the tender and as directed by the Consultant.

11.1 Telephone Wiring:

Telephone/intercom wiring from various residential flats and commercial shops/offices to centrally located

‘krone’ type tag-blocks near the meter-room/cabin shall be carried out as shown in drawings and as

specified. Two pair telephone wires of 0.50 mm. dia. tinned annealed copper conductor PVC insulated and

PVC sheathed shall be drawn through separate conduits from each point to the central tag-block. Unless

specified otherwise, minimum two pairs per point shall be provided to facilitate changeover to spare core

in case of fault in the main pair. Laying of conduiting for the purpose shall conform to the specifications of

conduiting laid down earlier and minimum size of conduit shall be 20 mm diameter. In case of commercial

and corporate block, intermediate tag-blocks shall be used at each floor for terminating all the wires of a

particular floor/wing. From such intermediate tag-blocks, proper size multi-pair telephone cables shall be

laid concealed through service shafts up to the main tag-block (MDF) at ground floor. All the telephone

wires shall be tagged/numbered using ferrules at all the ends including at the point of usage.

11.2 Music-cum P.A. System Wiring :

Wiring for central music system shall be carried out in general conformity with IS:1881, and IS:1882.

Speakers located in various areas/room shall be wired using flexible stranded and sheathed wires of sizes

not less than 1.0 sq.mm. (23/36) drawn through separate GI/MS/PVC conduits and terminated at central

music station. For multi-channel music system one pair of wires per channel shall be laid. All speakers

shall be grouped into number of zones depending on the output wattage of each amplifier as well as

different areas of the building. Speakers of one group shall be looped and connected together. Conduiting

shall be as per the specifications laid down earlier. A suitable size amplifier and the associated cassette

deck, microphone etc. as specified in the tender shall be supplied, installed and connected to all the

speakers. The system shall also be coupled to the EPBAX as required to facilitate paging operation. The

full system shall be tested with live performance on completion of the work.

11.3 Cable TV Antenna Wiring :

Antenna wiring for Cable-TV system from various residential flats and commercial shops/offices to the

Central Control Station shall be carried out as shown in the drawings and as specified. Co-axial TV antenna

cable shall be laid through PVC conduits from each flat/shop/office to a common tag-block at ground floor,

using necessary splitters, tap-offs, connectors etc. at terminals and junction points. All such tag-blocks shall

be formed into one group by laying necessary interconnecting co-axial cables laid underground and

connected to the master antenna/disk antenna as specified and as required. All joints shall be made using

appropriate splitters and no direct jointing of antenna cable shall be carried out. Separate conduiting shall

be carried out as per the specification laid down in point-wiring items. Appropriate outlet-plates having RF-

connector shall be installed at plug-in points in each flat/shop/office at the locations shown in the drawing.

11.4 Fire Alarm System:

Electrical wiring for Fire Protection Alarm System shall be carried out as per IS: 2175 and IS: 2189.

Various smoke detectors, heat-detectors, flame detectors provided in the building shall be wired using

FRLS wires drawn in metallic conduits, or armoured FRLS cables. The Alarm System shall be fail-proof

type so as to protect itself against any failure to mains supply, battery charger, open- circuit, earth-fault or

any other fault in various detectors. The source of supply for the alarm system shall be a secondary battery

continuously trickle/float charged from AC mains. The system should have facility for "test" circuiting

during normal operation and maintenance period. The complete installation shall have approval of the local

fire fighting authorities. Wherever specified in the tender, microprocessor based self diagnostic type fire

alarm panel conforming to state-of-the-art shall be supplied, installed and tested to the full satisfaction of

Consultant. Training of the user-staff shall also be the responsibility of the contractor.

11.5 Electronic Security Systems:

Various types of security alarm systems such as Anti-Dacoity-Alarm, Burglar-Alarm, Intruder-Alarm,

Card-Access-Control, CCTV Surveillance etc. shall be installed tested and commissioned as per the

specifications of the tender. Complete technical details including operation and maintenance manuals of

such systems shall be furnished to facilitate the user to get fully familiarized with the same. Necessary

training shall also be imparted to various staff members of the Owner for complete operation and

maintenance of such systems. Prior approval shall be obtained from the Consultant for engaging sub-vender

for supply of these systems.

12.0 Testing and Commissioning:

Before a completed installation, or an extension to an existing installation is put into service, inspection and

testing shall be carried out in accordance with Indian Electricity Rules 1956 and IS: 732 (Part - 3) by the

contractor in the presence of Consultant’s representative. Some of the tests and inspections to be carried out

are:-

12.1 General inspection of complete installation with respect to conformity with Indian

Standards and Indian Electricity Rules.

12.2 General Workmanship (Earthing, cable, bolt connections etc.)

12.3 Testing of Insulation Resistance of all cables and wires.

12.4 Testing of Earth Continuity Path.

12.5 Testing of Polarity of single pole switches.

12.6 Lighting circuits to be tested for resistance to Earth in the following manner:-

(a) All switches `on' and consuming devices in circuit.

(b) All switches `on' with consuming devices removed the IR value between poles and

earth.

(c) All switches `off' with consuming devices in position, the IR value between poles and earth.

12.7 Testing the earth resistance of Earth Pits and full earthing grid as a whole.

12.8 Tests specified by manufactures for particular equipment.

12.9 Check for "Danger Board" sign whenever required.

13.0 General Requirements:

13.1 License:

The contractor shall posses the necessary license/authorization from the local/state licensing board for

carrying out the necessary electrical installation work. Similarly the workmen/electricians/supervisors

deputed by the contractor should also hold valid permits/licenses issued or recognized by the licensing

board of the state/locality in which work is to be carried out. In addition the contractor shall also appoint

and depute qualified and experienced electrical engineer for overall supervision of the work at site.

13.2. Shop Drawings:

A set of drawings and documents issued to the contractor along with the tender shall form part of the

specifications. Such drawings and documents are for the general guidance of the tenderer and shall in no

case be considered as final working drawings. The contractor shall prepare a set of shop drawings showing

exact routing of cables and conduits, exact position of all points, switches, socket-outlets, inspection boxes

etc. and shall get the same approved by the Consultant before commencement of the work. Only on written

approval of such drawings the work of laying conduits at site shall be taken up. Variations in the quantities

of items and changes in the location of points etc. shall be agreed by the contractor as and when required

and as instructed by the Consultant at site.

13.3. Materials:

All materials supplied and installed under the contract shall conform to relevant Indian Standard and bear

`ISI' marking clearly. Use of any non `ISI' marked material shall have prior approval of Consultant in

writing. Any non-approved and non ‘ISI’ material, if used shall be outright rejected and shall not be not

considered for measurement and payment. Such work shall have to be re-done and made good by the

contractor at his own expense.

13.4. Workmanship:

Good workmanship and neat finished appearance are the pre-requisites for complying with various clauses

of these specifications. To ensure good workmanship of all works, only qualified and well experienced

staff shall be deployed by the contractor. Names and particulars of all such staff shall be furnished to the

Consultant before commencement of work. Work at site shall be started only on the approval as above in

writing.

13.5. Site Co-ordination:

The electrical contractor shall cooperate with Civil, Air-conditioning, Plumbing, and other such contractors

at site and shall coordinate his works with the works of these contractors with the least amount of damage

and interference to their works.

13.6. Testing & Commissioning:

All testing and commissioning of the completed electrical works, shall in the responsibility of the

contractor, who shall also obtain the necessary permission of the Electrical Inspector and electricity supply

agency for putting the installation into regular use. All instruments and equipment required for testing shall

be arranged by the contractor.

13.7. Completion and Guarantee :

After completion, testing and commissioning of the entire electrical works, the contractor shall hand-over

the installation to Owner along with a Completion Certificate and Guarantee for twelve months for

successful operation. Any defective material or workmanship shall be replaced/repaired free of cost during

this defect liability period by the Contractor.

13.8. As built drawings

At the completion of work and before issuance of certificate of virtual completion the contractor shall

submit to the Consultant, layout drawing drawn at appropriate scale indicating the complete distribution

system , ‘As installed’. These drawings must show:

1. Run, location and size of conduits, inspection, junction, and pull boxes.

2. Number and size of conductors/wires in each conduit.

3. Location and rating of sockets and switches containing the light and power outlets.

4. Location and details of distribution boards, main switches, HT & LT switchgears, transformers and

other particulars.

5. A complete wiring diagram, as installed and schematic drawings showing all connections in

the complete electrical system.

6. Location of all earthing stations, route and size of all earthing conductors, manholes.

7. Route and particulars of all cables.

8. Routings of complete raceways including numbering of all floor outlet boxes and

distance between each such box.

9. Location of all smoke detectors and other related sensors/indicators along with zone wise cable routings.

8. Location of all music speakers and related volume control switches along with zone wise

cable routings.

14. Scope Of Electrical Works

Scope of work of electrical contractor under this tender include Supply, Installation, Testing,

Commissioning and Handing over of:

1. All the panels, sub-panels, DBs, Sub-DBs and various Switches, Breakers and Isolators as detailed in

the BOQ and shown in the Schematic Single Line Diagrams.

2. All cabling from the Transformer/energy-meters to main panels to each floor Panel to DBs to Sub-DBs

and all the A/C machines and other loads as shown and as required at site.

3. All the point wiring for lighting, plug points, workstation points, exhaust fans etc. as detailed out in the

BOQ and as per the drawings issued by the Consultant/Architect.

5. Complete earthing for electrical safety as well as Dedicated Earthing required for computers, EPABX

and other electronic equipment as specified in the BOQ and tender.

6. Pulling of DATA cables through the floor raceways as per the guidance of LAN Consultant/Vendor.

7. All the decorative and non-decorative light fixtures as per the approval of the Consultant/Architect.

8. Complete Fire Alarm System comprising of main panel/controller, Repeater panel, command centre,

smoke/heat detectors, manual call points, peizo sounders etc. as required for completeness of the system.

9. Complete Music cum Public Address system consisting of music speakers, point wiring and other

accessories as per the specification of the BOQ.

10. Data / Voice point wiring with wall outlet plates/jacks and all related IDFs and final MDF in the

EPBAX room.

Any item not covered above but required for completion of the system as a whole.

10. List of Approved Electrical Makes / Brands

All materials to be supplied and installed by the contractor shall be of approved makes and conform to the

relevant Indian Standard and bear `ISI' marking distinctly. Wherever the make and model of an item is

specifically mentioned in the Bill Of Quantity the same shall be considered and quoted for, in the tender.

However for the guidance of the contractor some of the approved makes of materials are listed below

which can be used when not specifically mentioned in the BOQ. In case the make and model of any item

required to be installed is not available in the following list, the same shall be got approved from

tables, study table, head board, wardrobes etc in the hostel rooms by

pasting 1 mm thick laminate of approved colour ,finish and design (wood

preparing and treating the old surfaces suitably to ensure finish surface

having one flange of 20mm and another flange of 30mm and a web of

27mm along with perimeter of ceiling, screw fixed to brick wall/partition

with the help of nylon sleeves and screws, at 610mm centers. The

suspending G.I.intermediate channels of size 45mm, 0.9mm thick with

two flanges of 15mm each from the soffit at 1220mm centers with

General Terms And Conditions For COMMERCIAL BID

1. The Bids with correction and or overwriting, if not authenticated, will be liable for rejection.

2. The Commercial Bid amount is to be inserted in words as well as in figures in the space provided

and in case of discrepancies between prices written in words and prices written in figures, the

prices written in the words shall be considered to be correct.

3. The Tenders shall submit their offers strictly in accordance with the terms & conditions of the

tender document. Any Tenderer that stipulates conditions contrary to the conditions given in the

Bid document is liable for rejection.

4. Tenderers shall complete the Price Bid form and shall initial each page of the document.

5. Time is the essence of the contract and the works must be started within 15 days from the date of

issue of work order. Any Bidder who disagrees with the time schedule and stipulates a longer

period is liable to be rejected.

6. Before quoting the rates, Bidders are requested to visit and examine the site carefully where the

sample work was carried out. They should also carefully examine the Bid Documents, Conditions

of Contract and Specification in regard to scope of work, schedules etc. In case there should be or

appear to be any ambiguity in or discrepancy between any of the document, they should

immediately refer the matter to the Bank for clarification.

7. Access to inspect the site will be given with prior appointment up to one day prior to the last date

of submission of the tender.

8. The Commercial Bid is not transferable.

9. The Bank reserves the right to adjust arithmetical or other errors in any Bid in the way that it

considers suitable. Any adjustments so made by the Bank shall be stated to the Bidder.

10. The Bank does not bind itself to accept the lowest or any Bid and has the right to accept or reject

any Bid without assigning any reason. The Bank's decision in this regard will be final, conclusive

and binding on the Bidders.
