V.Sc.&A.H.,R.K.Nagar,WestTripura,Tripura–799008,India”.EMDDemandDraftshouldbevalidfor45daysfromthedayofContractAward.Incaseofun-successfultendererstheEarnestMoneydeposit(EMD)willbereleasedoncetheSupplyOrderisissuedtotheSuccessfulTenderer.

7. Thesuccessfulbidderwillhavetodeposit05%of theorderedvalue as security money within 10 days from the date ofissueofthesupplyorder/contract,inshapeofD-call/Bankdraft from any nationalized bank in favour of the Principal,CollegeofVety.Sciences&A.H.,R.K.Nagar,Tripura(w).Thesecuritymoneywillbereleasedafter thecompletionof thefullandsatisfactorysupply.

8. Thesupplyhastobeexecutedwithin90(ninety)daysfromthedateof issueof thesupplyorder.Apenalty@1%on the totalvalueshallbechargedforeveryweekorpartofweekofdelaybeyond stipulated date of supply. However, relaxation will beentertainedonlyinspecialcircumstances(Naturalcalamitiesoranyothersituationbeyondthehumancontrol). Incase, failureof supply of the ordered item/items in full within stipulatedperiod,both theearnestmoney&Securitydepositmoneyarelikelytobeforfeitedwithoutfurthercorrespondence.

9. G.S.T&othertaxesmaybedeductedfromtheBillasperGovt.ruleasapplicable.

10. Any enhancement of the rate within the validity period ofcontractwillnotbeconsideredexceptforimpositionofanylevyor increase in existing levy by the Government. Any unduerequestmayleadtocancellationoftheOrderandforfeitofBid

Securitymoney.11. Ifanysuppliedinstrumentsarefoundtobeofsub-standard

quality,theseshouldbereplacedbynewstandardqualityattheirowncostonreceiptoftheintimationfromPrincipal,CollegeofVety.Sciences&A.H.,R.K.Nagar,Tripura(w).

12. PaymentofthesuccessfulTenderershallbemadeonbillbasisonly after completion of supply and satisfactory installation ofthe item/items as ordered for. No advance payment will beentertained in any circumstances. Principal, College of Vety.Sciences &A.H., R.K.Nagar, Tripura (w)will take all possiblesteps to pay the Bills within 90 days from the date of thecompletionofsupply& installationsubjected to theavailabilityoffund.

13. TheratesshouldbequotedbothinfiguresandwordsclearlyasperSpecificationinAnnexureintheBOQ.TherateshouldbequotedinIndianCurrencyonly.

14. The supply orderwill be issued once/at a timeor in phasedmannersubjecttoavailabilityoffundandasperrequirement.Thequantityofaccessoriesmaybereducedorextend.

15. Any default or breach of contract by the suppliers will besubjecttoforfeitureofearnestmoney/securitymoney&willbeconsidered as blacklisted/delisted for participating in futuretender as per the discretion of Principal, College of Vety.Sciences&A.H.,R.K.Nagar,Tripura(w).

16. In case of any legal dispute the jurisdictionwill be theHighCourtofTripura,AgartalaBench.

17. ThePrincipal,C.V.Sc.&A.H.,R.K.Nagar,reservestherighttounilaterally terminate thecontractorcancelacceptanceofrate or supply order at any time without notice before theexpiryoftheperiodforwhichtheratesarenowinvited.

18. ThePrincipal,C.V.Sc.&A.H.,R.K.Nagar,reservestherightto accept or reject any/all tenders without assigning anyreason thereof and may accept or reject part of thetender/tenderers.

19. ItemsshouldbesuppliedasperDNITIfthesuppliedItemsarenot as per Specification of the DNIT, the supply should betaken back. The payment/SecurityMoneywill be held up tillthe items are taken back by the concerned agency at theirowncost.

20. The Technical Bids of the Bidders will be first evaluate byconcerned technical committee and the technically qualifiedBidderscanonlyparticipateintheFinancialBids.

21. FortechnicalevaluationconcernedtechnicalcommitteewillexaminetheeligibilityofthebidderasperthetechnicaldocumentuploadedinTripuratender.Bidsofthebiddernotsatisfyingtheeligiblecriteriaandanytechnicaldeviationwillberejected.

22. For financial evaluation,financialbidsofthetechnicallyqualifiedbidderwillbeevaluated.ThebidsfoundlackinginstrictcompliancetotheBOQformatshallberejectedstraightway.AllthefinancialbidshallthanberankedaccordingtothefinancialbidinincreasingorderwiththebidderquotingtheleastamountrankedL1;thebidderquotingnexthigherfigureasL2andsoon. L1 will be declared as successfulbidder and his Offer will be processed further. However, theCollegereservestherighttoofferthecontracttotheL2andL3BiddersaswellasifthereareanycomplianceintheTechnicalandFinancialBidquotedbytheL1Bidder.

23. No. Insurance charge is admissible and the successfulTenderer/Supplier will be responsible for any breakage,damageandlossintransitonthewaytodestination.

2. Biddocumentsshallbeuploaded in twobidsystemwithall

3. To participate in bid, the bidder shall have a valid Class

2/Class 3 Digital Signature Certificate (DSC), obtainedfrom the certifying authorities enlisted by Controller ofCertifyingAuthorities(CCA)athttp://cca.gov.in

4. Bid will be opened online through website

5. EachBiddershallsubmitonlyonebidforthework.Abidder

6. RateQuotation:BOQshouldbedownloadedfromthee-

procurement application https://tripuratenders.gov.in andthesameBOQshouldbefilledupproperlyanduploadedasapartofbidwithdigitalsigning.BiddershallquotetheRateforall itemsmandatorilyonly in theBillofQuantity (BOQ)which is in MS-Excel (macro enabled) and Name of thebidder/company/firmmustbewritten in theappropriate fieldofBillofQuantity(BOQ)bybidder.

8. TheBidders shall have to scan all the required documents

mentionedinthisDNITintoPDFformatof100dpiresolution,foruploadingaspartofBid.

9. Bill of Quantity (BOQ), which is in MS-Excel shall be

downloaded, filled up properly and uploaded with the bidafterdigital signing.TheBiddershallalwaysopen theBOQsheetwithMacroEnabled.

10. Thedatesstipulatedinthebidnoticearefirmandunderany

circumstances, they will not be relaxed unless officiallyextended.

11. Biddersareallowedtobid24x7untilthetimeofBidclosing,

with option for Re-Submission, wherein only their latestsubmitted Bid would be considered for evaluation. The e-Procurement website will not allow any Bidder to attemptbidding,afterthescheduleddateandtime.

12. Even though the biddersmeet the abovequalifying criteria,

theyare liable tobedisqualified/debarred / suspended /blacklistediftheyhave.

a. Furnished false/ fabricated particulars in the forms,

statements and / annexure submitted in proof of thequalificationrequirementsand/or

b. Not turned up for entering into agreement, when called

upon.

c. Evenwhileexecutionof thework, if found that theworkwas awarded to the Bidder based on false/ fakecertificates of experience, the Bidder will be blacklistedandnecessaryactionwillbetakenasperrules.

d. Any definite attempt of profiteering by any bidder will

render himself liable to be debarred permanently frombiding or for such period as the bid accepting authoritymaydecide.Thebidderoverall rateshouldbebasedonthecontrolledpricesforthematerials,ifany,fixedbytheGovernmentor thereasonablepricespermissible for thebiddertochargeaprivatepurchaserundertheprovisionsof clause-6 of the hoarding and profiteering preventionordinanceof1943asamendedfromtimetotimeandonsimilar principle in regard to labour supervision on theconstruction.

e. Each Bidder shall submit only one Bid for the work. A

bidder who submits more than one bid will causedisqualificationofallthebidssubmittedbythebidder

BIDOPENINGANDEVALUATION:

1. BidOpening1.1ThebidswillbeopenedonlinebytheBidopenersonbehalf

ofthePrincipal,CollegeofVeterinarySciences&A.H.atthetime,dateandvenueasspecifiedinthebiddocuments.BidsshallbescrutinizedinaccordancewiththeconditionsstipulatedintheBiddocument.Incaseofanydiscrepancyofnon-adherenceConditions,theBidacceptingauthorityshallcommunicatethesamewhichwillbebindingbothonthebidOpeningauthorityandtheBidder.Incaseofanyambiguity,thedecisiontakenbytheBidAcceptingAuthorityonbidsshallbefinal.

2. BidEvaluationandComparisonofBids.2.1All the statement, documents, certificates, BOQ (bill of

quantity)etc.,shallbesubmitted/uploadedbythebidderwillbe verified, for evaluation of bids. The clarifications,particulars,ifany,requiredfromthebidders,willbeobtainedbyaddressingthebidders.Bidswillbeevaluatedagainstthespecified parameters / criteria same as in the case ofconventionalbidsandthequalifiedbidderswillbeidentified.The result of bids evaluation can be seen in the e-procurement application https://tripuratenders.gov.in by allthebidderswhoparticipatedintheBid.

2.2The ‘BOQ Comparative Chart’ generated & displayed by

system through the e-procurement portal, after the openingofBid,willshowtheamountcalculatedbasedonpercentagerate quoted by the bidders. The bidder shown as lowest(L1) in thebid rankof the ‘BOQSummaryDetails’,maynotbethelowestalways.Theprescribedauthority(i.e.BidOpening Committee) in the Department will prepare a‘ComparativeStatement’consideringallparametersasperconditions given in the bid document. This ‘ComparativeStatement’, declaring lowest bidder (L1), will bedisplayedinthee-procurementportalsubsequently.

2.3NO NEGOTIATION WILL BE CONDUCTED WITH THE

LOWESTBIDDER.

2.4Detailsof ‘BidEvaluationCommittee’shallbeuploadedin the e-procurement portalhttps://tripuratenders.gov.inand all the bidders canaccessthesame.

2.5TenderInvitingAuthoritymaycancelthetenderatanystage

withoutanypriornotice.3. DiscrepancyinBidratequoted.

3.1Bids shall be scrutinized in accordance with the conditionsstipulated in theBid document.Biddershallquote rate infigures only. BOQ (in MS-Excel format) shall be open



with Macro Enabled for automatic conversion fromfigures to words. In case of any ambiguity, the decisiontaken by the Bid Accepting Authority on Bidders shall befinal.

4. ProcesstobeConfidential.

4.1Information relating to the examination, clarification,evaluationandcomparisonofBidsandrecommendationsfortheawardofacontractshallnotbedisclosedtotheBiddersor any other persons not officially concerned with suchprocess until the award to the successful Bidder has beenannounced by the bid accepting authority. Any effort by aBiddertoinfluencetheprocessingofBidsorawarddecisionsmayresultintherejectionofhisBid.

4.2Before recommending / accepting the bid, the bid

recommending / accepting authority shall verify thecorrectness of certificates submitted to meet the eligibilitycriteria and specifically experience. The authenticatedagreementsofpreviousworksexecutedbythelowestbiddermaybecalledfor.

AWARDOFCONTRACT

1. AwardCriteria

1.1ThePrincipalwillawardorrecommendtotheCompetentbidacceptingauthorityforawardofthecontracttotheBidderwhoisfoundTechnicallyQualifiedaspertheBidconditionsandwhoseOfferRateislowest(ConditionapplyasmentioninSlNo22).

1.2The bid accepting authority reserves the right to accept orrejectanyBidorallbidsandtocanceltheBiddingprocess,at any time prior to the award of Contract, without therebyincurringanyliabilitytotheaffectedBidderorBiddersoranyobligation to inform the affected Bidder or Bidders of thereasonsforsuchaction.

2. NotificationofAwardandSigningofAgreement.

.1TheBidderwhoseBidhasbeenacceptedwillbenotifiedtheawardofcontractbyanyauthorizedofficial,priortoexpirationoftheBidvalidityperiodbypublishingtheAwardofContractinthe Tripura Tenders portal and also may send the samethroughregisteredletter.

.2Thebiddershouldappearbefore the tender invitingauthoritywithin07daysafterthebidderhasbeenawarded.Thewrittenagreement to be entered into between the Bidder and theGovernment shall be the foundation of the rights andobligations of both the parties and the contract shall not bedeemed to be complete until the agreement has first beensignedbytheBidderandthenbytheproperofficerauthorizedtoenterintocontractonbehalfoftheGovernment.

.3The successful bidder has to sign an agreement within aperiodof10daysfromthedateofreceiptofcommunicationofacceptance/awardofhisbid.

3. CorruptorFraudulentPractices

3.1The Government requires that the bidders / suppliers /Bidders underGovernment financed contracts, observe thehighest standard of ethics during the procurement and

executionofsuchcontracts. Inpursuanceof thispolicy, theGovernment

(a)Defineforthepurposesoftheprovision,thetermssetforthbelowasfollows:

(i)“Corrupt practices” means the offering, giving,receiving or soliciting of anything of value toinfluence the action of a Government official inprocurementprocessorincontractexecution:and

(ii)“Fraudulentpractice”meansamisrepresentation

of facts in order to influence a procurementprocess or the execution of a contract to thedetriment of the Government and includescollusivepracticeamongBidders(priortoorafterBid submission) designed to establish in Bidprices at artificial non-competitive levels and todeprive the Government of the benefits of freeandopencompetition.

(b)WillrejectaproposalforawardifitdeterminesthattheBidderrecommendedforawardhasengagedincorruptorfraudulentpracticesincompetingforthecontractinquestion.

(c)Willblacklist/ordebarafirm,eitherindefinitelyorforastatedperiodoftime,ifatanytimedeterminesthatthefirmhasengagedincorruptorfraudulentpracticesincompetingfor,orinexecutingaGovernmentContract.

Furthermore,BiddersshallbeawareoftheprovisionsstatedintheGeneralConditionsofContract.

Note:Bidder shouldnot temper theBOQelse thebidwillberejected.

Eligibility/Pre-QualificationCriteriaoftheBidder:-

1)The Bidder should satisfy the Technical Compliance asmentionedintheANNEXURE-III,TechnicalSpecification.BidsfailingtosatisfythecomplianceoftheTechnicalSpecificationwillberejected.

2)The Bidder should not be debarred or blacklisted by anyState/Central Government /PSU. A self Certificate must befurnishedbytheBiddertosupportthesame.

3)TheAgencyshouldpossessnecessaryGSTRegistrationfromthecompetentAuthority.

4)The agency should have registered and should possessnecessary license from Statutory body/organization withTAN/PANandcopyoftheregistrationfirm.
