REQUIREMENTS AND USAGE OFPT PLN (Persero) E-PROCUREMENT WEBSITE(TERMS AND CONDITIONS)That each users of PT PLN (Persero) e-Procurement website shall comply with and / or bonded with all these provisions.I. GENERALPT PLN (Persero) e-Procurement website (abbreviated: PLN e-Proc) is a web-based application tool to make the process of procurement / contracting services / other services at PT PLN (Persero) online.In accordance with PLN capability, PLN may provide a means of Bidding room which is equipped with a PLN LAN network and printer. If in the bidding room is not equipped with a computer, the members / participants will follow the procurement must bring a PC / laptop and connect to the LAN network PLN.If Bidding space is not available / not sufficient then the members / participants can implement the e-procurement process Bidding / e-Auction on their respective places (eg: Members / participants office, internet cafe, etc.) and are connected to the Internet network.The members / attendees are participants / users of PLN e-Proc, which must have made their own login ID and registered in PLN e-ProcLogin ID is the User ID and Password that are single / characteristic (unique) for being used in PLN e-Proc.The login ID which still active can be used by members / participants to follow the procurement via PLN e-Proc throughout Indonesia.The login ID which still active can be directly used to follow a public tender or e-Auction by PLN e-Proc PT PLN (Persero) throughout Indonesia.Manufacturers / contracting services / other services are business entities, legal entities, individuals whose business activities to provide goods / services.Members / participants must comply with all the requirements of these provisions and rules of procurement of goods / services and other applicable policies on PT PLN (Persero).The process of procurement through PLN e-Proc which being done by pre / post-qualification is accordance with provision of PT PLN (Persero).The reference time for procurement process through PLN e-Proc is Western Indonesia Time (WIB) of PLN e-Proc servers.By becoming members / participants of PLN e-Proc then each provider of goods / contracting services / other services was considered to have understood and agreed to all contents in PLN e-Proc Terms and Conditions.Members / participants must sign above duty stamp and company stamped on The Statement of following procurement process of goods / services by using e-Bidding or e-Auction via PLN e-Proc (attached) and handed over to PLN before the implementation of procurement activities.II. MEMBERSHIP AND TERMSA. MEMBERSHIPProviders of goods / contracting service / other services (Candidates / participants) to become a PLN e-Proc member / participant must register and fill out the company's data correctly and accurately via PLN e-Proc.Every provider of goods / contracting service / other services are only allowed to have one (1) ID Login (account ID).Members / participants must maintain, update the data according the latest condition and must follow this provision.Membership will end if:Members / participants resign by sending an e-mail to the local PLN (where members / participants registered) or in writing and receive e-mail confirmation or a written reply on the revocation of membership.The member / participant membership revoked unilaterally by PLN because they have violated the conditions set PLN.If a Member / participant has a record of performance / bad track record based on the judgment PLN.B. REQUIREMENTSMembers / participants must agree that the transaction via PLN e-Proc must not violate the provisions in force in PT PLN (Persero) and legislation in force in Indonesia.Members / participants must submit and obey to all regulations in Indonesia related to the network and data communications usage either in Indonesia or in and out of Indonesian territory through this site.Members / participants are fully responsible for the content of the transaction (contents of data) via PLN e-Proc.Members / participants are prohibited from disturbing each transaction processes or services through PLN e-Proc.Members / participants agreed that an attempt to manipulate the data, disrupt computer systems and networks are illegal.III. RESPONSIBILITIES OF ID-Login USAGEMembers / participants are fully responsible for confidentiality, security and misuse of the login ID (user-id and password) hers and all the activities of procurement / contracting services / other services.Members / participants are required to change their passwords periodically to maintain confidentiality and the possibility of abusing olehi other parties who are not eligible.If the members / participants forget the password, should immediately contact the administrator of e-Proc in local PLN (where members / participants registered), then the administrator will reset their password and then members / participants should immediately change the default password.Members / participants are required to immediately notify the local PLN (where members / participants registered) if aware of any misuse of ID-Login hers by other parties who are not eligible or if there are other issues on the ID-Login hers.IV. RULES FOR GOODS / SERVICES PROCUREMENTGENERAL REQUIREMENTSMembers / participants will follow the procurement / contracting services / other services shall comply with all the requirements of these provisions and rules of procurement of goods / services as well as other applicable policies on PT PLN (Persero).The method of procurement / contracting services / other services are following the guidelines for procurement of goods / services PT. PLN (Persero) which includes a public auction, limited bidding, direct elections, direct appointment or direct purchase, the first following the process of pre / post-qualification.Members / participants will follow the procurement / contracting services / other services must be able to meet procurement administrative and criteria / specification of goods / contracting services / other services which have been established by the Committee / Procurement of Goods / Services which have appointed by PLN.Members / participants must enter the bid price of goods / contracting services / other services in online PLN e-Proc.Delays in entering bid price of goods / contracting services / other services on sixty (60) seconds before the closure is become participants risk.Members / participants are prohibited from providing the supply of goods / contracting services / other services which prohibited sold / distributed / done under the rules of law in Indonesia.BID PRICEMembers / participants must provide the best Bid Price of goods / contracting services / other services and should be accountable.The offer price of goods / contracting services / other services already incorporate the elements of cost: the price of goods / contracting services / other services, transport insurance, freight costs and benefits (ROK).The offer price manually / hardcopy printout is derived from the bid price at the PLN e-Proc online.Members / participants can enter the bid price of goods / contracting services / other services more than 1 (one) times and put through PLN e-Proc direct / online, during the span of the offer price revenue.If the same bid price obtained, then the winner is the determination of members / participants to submit offers in the PLN e-Proc in advance online, by e-Proc server time PLN pm in units of time (day, date, hours, minutes and seconds ).B.1. PRICE OFFERS e-BiddingPLN entitled to establish Own Calculation Price / HPS (Harga Perhitungan Sendiri) and the total value of HPS is not secret, but the secret to price details, until proposed winners being set out.Only the lattest bid price of goods / contracting services / other services were recorded in the PLN e-Proc.The bid price of goods / contracting services / other services which was submitted manually / hardcopy is derived from bid price printout at online PLN e-Proc and should be given a sufficient duty stamp and signed by the Director with company seal.If the bid price of goods / contracting services / services were put online and manual / hardcopy is not same, then declared as invalid and disqualified.B.2. PRICE OFFERS e-AUCTIONPLN entitled to determine the Initial Price and reduction percentage in bid price of goods / contracting services / other services.Members / participants must submit bid price of goods / contracting services / other services in online PLN e-Proc if passed in administrative and technical specifications of procurement of goods / contracting services / other services.All of the bid price that meets criteria will be recorded into PLN e-Proc and printed in the log book of procurement bidding results.PLN has a right to clarify the price to get the best of PLN price.If until the deadline for procurement, there is no conformity with PLN price, so that PLN is eligible to redo / cancel the procurement process.WARRANTY OF OFFERMembers / participants at every procurement in e-Proc PLN must enter the data / information of bid warranty by online.Value of Bid Warranty is set by the Committee / procurement official designated by PLN.Bid Warranty must be delivered to PLN no later than the time of bid price submissionMembers / participants who do not submit a Bid Warranty is considered as resignation.Procurement members / participants who resign, then the bid guarantee will be melted by PLN.D. TIME PROCUREMENTApplicable procurement time for e-Bidding / e-Auction is based on WIB time unit in PLN e-Proc server.Procurement time is assigned by Committee / Procurement official who designated by PLN and registered in PLN e-Proc.PLN is eligible / can repeat / add more time to procurement process if:Until procurement time limit which has been set become expired, without any participants bid.Until procurement time limit which has been set become expired, procurement administration and technical specifications required by PLN are not in accordance with all participants submission.Until specified procurement time limit expired, no Bid Price agreement was reached by participants.Participants do not comply with requirements which stipulated in the provisions and rules of goods / services procurement as well as other applicable policies of PT PLN (Persero).In terms of goods / services procurement being process via e-Proc PLN, there are some reason or another which affect goods / services procurement can not be done perfectly (technical and non technical disruption).Event of procurement termination by the Committee / procurement official who appointed by PLN.Closing of procurement time, in case of there is no cancellation by the Committee / Procurement official, will be made by PLN e-Proc automatically.V. CONFIDENTIALITY MEMBERSDuring the procurement process, members / participants is able to know the name of other participant company.Members / participants are not given the right to know identity detail of other members / participants.Members / participants proposed as a winner or declared as the winner, their identity will be opened to rightful party in accordance with PLN regulations.For the sake of legal or judicial investigations, audits, and PT. PLN (Persero) Interest, PLN have a right to provide all members / participants data which are required.VI. PROCUREMENT PROCESSMembers / participants who acted as bidders can make a clarification on the procurement of goods / services are perceived is less clear, in terms of both administrative and technical, in the period that has been determined by the Committee / procurement official designated by PLN.In the e-bidding process, there will be proposed three potential winners, based on applicable provisions in PLN, as follows:a) Administration (legitimate or illegitimate)b) Technical specifications (meets or does not meet)c) Price Bookd) Time Offer fastest (time e-Proc servers PLN in GMT)In the process of e-Bidding, the winning proposal is Members / participants who offer the best prices, has met administrative requirements and technical specifications as well as meet other requirements and rules of procurement of goods / services and other applicable policies of PT PLN (Persero).In the process of e-Bidding, if for some reason when PLN failed to make buying and selling with the best bidder, then the PLN may negotiate with the second best bidder and so on.In the process of e-Auction, all offers considered under the provisions applicable in PLN, as follows:a) Specificationsb) The lowest pricec) The fastest time (PLN e-Proc servers time in WIB).d) The delivery scheduleIn the process of e-Auction, the proposal is the winner of Members / participants who offers the lowest price, according to the specifications and the fastest time and fulfill all requirements of these provisions and rules of procurement of goods / services as well as other applicable policies of PT PLN (Persero).VII. PROCUREMENT PROCESS COMPLETIONThe procurement process is completed, if stipulated as a winner by the Committee / Procurement officials / designated by PLN, after getting approval from goods / services user.The completion of the procurement process through e-Proc PLN, has not been officially / legally become procurement transactions. Procurement transactions valid if each parties have responsibilities and rights in accordance with prescribed rules in PLN.Winners are required to complete the procurement process procurement outside the site's e-Proc by PLN.Having determined the winner via e-Proc PLN, PLN will contact the winner to complete the transaction pengadaanya immediately after the end of the procurement process.All the participants who followed a procurement by the end of the procurement may determine the winner via e-Proc PLN.VIII. CANCELLATION / TERMINATIONPLN eligible / can cancel / decide the procurement process if :Up to the time limit of procurement / contracting services / other services that had been set to expire, yet / no bid.Until the time limit had been set to expire procurement, criteria / specifications required by the company did not correspond to that presented by all participants.As of the time limit that has been set to expire procurement, no price agreement.The member / participant does not comply with all the requirements of this provision, the rules of procurement of goods / services and other applicable policies of PT PLN (Persero).No designated as the winner by the Committee for Procurement of Goods / Services Procurement designated or PLN.If the procurement process assessed false / unnatural.In the case of being the process of procurement of goods / services via e-Proc PLN, for some reason or another that resulted in the procurement of goods / services can not be done perfectly (disruption of technical and non technical).IX. ASSESSMENTPLN entitled to assess the performance of members / participants who demonstrate the credibility of the members / participants (track record) with the following criteria:a) The price of goods / services contracting / other services (Price)b) Quality of Products / Services chartering / other services (Quality)c) The quantity of goods / services contracting / other services (Quantity)d) Time Delivery (Delivery Lead Time)e) Services (Services)Where a Member / participant has a record of performance / track record is bad, then the PLN entitled to / may prohibit the members / participants of the procurement process of goods / services and or revoke the membership is concerned at the e-Proc PLN for a certain period.
