FOREWORD This Terminal Report on Barangay Forest Protection and Management Scheme (BFPMS) is divided into two (2) volumes.

Volume 1 provides discussions on how the scheme was implemented and a summary of accomplishments for the three (3) covered barangays namely; Maibo, Tantangan; Albagan, Tampakan and Miasong, Tupi.

Volume 2 presents in a per barangay basis the plans and

necessary documents in the strict implementation of the scheme.

I. Background

A. The Philippine Scenario The Philippines has 30 million hectares of upland area. In 1990, according to MBRLC, the natural forest – 750,000 hectares, crop land – 9 million hectares, and marginal land – 12 million hectares with population of 70 million Filipinos. But by 2020, according to statistics, natural forest – 0, crop land – 7 million hectares, marginal land – 15 million hectares with a population of 120 millions.

B. The Upland Scenario Of the 30 million hectares, half of this or 15 million is forest land. According to the Food Agriculture Organization (FAO), land degradation is one of the major problems in the upland wherein 5.2 million hectares are severely eroded or 2,046 metric tons of upland

soil is being lost per year. Mindanao shares the biggest severely eroded area. The forest cover losses range from 200,000 to 550,000 hectares per year or an average of 375,000 hectares per year or an equivalent of 42 hectares per hour.

Another major problem identified was the population in the uplands. According to FAO (1995), population in the upland reached to 20 million wherein 6 million people farming in the 18% slope. Growth rate is 3.2% per annum higher compared to the average lowland growth rate of 2.67%.

II. The BFPMS A. Concerns and Issues that BFPMS want to address;

• Lack of appreciation of the communities and LGUs on the value of forest as source of water supply and protective cover to minimize soil degradation.

• Lack of commitment and capacities of the barangay government units and local communities in protecting and managing the barangay forests.

• Inefficient community-based extension services to disseminate information on forest protection and management.

B. Objectives of BFPMS;

• To mobilize the Barangay Local Government Units and the local community organizations (such as the Upland Barangay Association) in protecting and managing the remaining forestlands in upland communities.

• To introduce the scheme of community-based and “site-specific” forest management projects.

• To promote partnership among stakeholders like the Barangay LGU, Municipal LGU, DENR, NCIP, and the local communities in managing the forestlands at the barangay level and define operational structure.

C. Why the Barangays? The Barangay has a perfect form of government system . . . for reasons that;

• It has executive, legislative, and legal functions. • The Barangay Captain/officials are recognized under Local

Government Code 7160 and the DENR to have police powers; 1. Apprehend; 2. Report illegally cut logs and other natural

resources or any other violations within the protected area • Have direct access and control of its people in the protection

and management of forest areas. • Can adopt, impose local ordinances on environmental

protection policies and implement environment activities.

III. BFPMS Implementation A. Institutional Mechanisms 1. Orientation and Briefing

Hand in hand with the series of courtesy calls to the MLGUs, BLGUs and other partners, was the orientation regarding the

scheme by the Forest Development Officers (FDO) of WATERCARE. The rationale behind was explained and at the end of the discussions, these partners wanted to adopt the BFPMS knowing its importance especially for the future generations. Hence, verbally, they committed their full

support for the project and initially formulated and drafted an agreement.

Situational analysis facilitated by the FDO through IEC (see Modules in Annex 1) relative to the scheme was first conducted in the covered sitios for the communities to fully understand this activity. In depth study and investigation was done during the conduct of IEC and community meetings. In Barangay Maibo, issues on water utilization were resolved. Since the neighboring barangays of Cabuling, Libas, and New Iloilo are all beneficiaries of the water system where the water source is from the proposed protected area, active participation of the 3 barangays, particularly the barangay chairpersons was observed. Maibo has the biggest number of BFPMC because of the involvement of the neighboring barangays. The 3 barangays have already extended

their support to the project by contributing some planting materials. Level of awareness on the protection and rehabilitation of the remaining forest was already radiated to the adjacent barangay because of this scheme. In Miasong and Albagan, actual claimants of the area were tapped during the identification and validation of the proposed protected area.

In Barangay Miasong, the identified protected area was based in the formulated LUB-BDP. However, with the implementation of the scheme it was re-validated and re-surveyed with the participation of BLGU, MLGU, and DENR as a basis for the specific area to be declared as protected

area. For Barangay Maibo and Barangay Albagan, since mapping for the LUB-BDP is still on-going, the detailed FDOs and ATs with active participation from MLGU especially from MPDO and with DENR representatives put much effort for the immediate conduct of perimeter survey of the area to be protected as identified by the Barangay Council and directly involved communities.

3. Barangay Forest Protection and Management Committee (BFPMC) Formation and Identification of Forest Guards

While the final mapping of the areas proposed for protection, rehabilitation and enrichment were being finalized, the FDOs assisted the BLGUs concerned to create the BFPMC to ensure that the scheme will be strictly and properly implemented. Members of the committee are from BLGU, MLGU, DENR, NCIP, DEP ED, PNP, NGOs, COOPs, and UBAs. A Barangay Resolution of each barangay was prepared to formalize the creation of the BFPMC. (see volume 2 of the report) Other selected members of the group are key informants from the sitios like the sitio leaders and tribal chieftains. A resolution was also passed to designate barangay forest guards. Existing

4. Signing of the Co-Management Agreement and Declaration

of the Area as Protection Zone. After series of consultation meetings called by the BFPMC

Chairman among the stakeholders, the DENR, NCIP, MLGU, it was agreed that they would formulate a MOA to state their full support and the specific roles and responsibilities. The reading of the Barangay Ordinance on Declaration of Protected Area and the signing of the Co-Management Agreement

were done during the launching of the Project (see volume 2). The activity was attended and witnessed by most of the community residents and even representatives (teachers and students) from the different school levels in the barangays. It was in this occasion also that the heads of the schools pronounced their interest to participate in the

protection of the remaining forest. In this event also was the Oath Taking of the Barangay Forest

Guards by the Local Chief Executive or representative to ensure their acceptance and commitment in this tough task given to them with the inculcation of the spirit of volunteerism.

5. Creation of MENRO Office

To further ascertain the strong support of the MLGUs to the scheme and its replication to other barangays, the FDOs had lobbied to the LCE through the Kagawad on Environment the creation of MENRO Office. The Municipality of Tampakan has now a full time Municipal Environment and Natural Resources Officer (MENRO) with regular annual budget while Tantangan and Tupi have designated point persons while the Kagawads on Environment are continuously leg-working for the creation of the office.

B. Capacity Building and Strengthening 1. Deputation of the Barangay Forest Guards

A special orientation of the identified Barangay Forest Guards on the Barangay Ordinance in the Declaration of the Protection Zone focusing on the Section of Prohibitions was conducted to further educate them.

of the forest guards also was the conduct of training on Forest Protection and Law Enforcement where staff from

the DENR was the main resource persons. This training is also a pre-requisite for the Barangay Forest Guard to become full-pledged Deputized Environment and Natural Resources Officer (DENRO), hence, certificates were issued to the training participants. Since at present there is an order for temporary deferment of DENR to deputize, the FDOs facilitated the deputation of Barangay Tanod by Local Chief Executives (LCEs) in the meantime for the immediate lawful performance of their duties and responsibilities while waiting for the lifting of the suspension of deputation by the DENR.

For the participants to really

internalize the message of the above training, part of it was role playing and workshops and the preparation of action plans. During the last day of the training, the participants had an exposure trip at the Forest Protected Area of Barangay Lake Seloton, Lake Sebu, South Cotabato where they had the chance to meet some members of the Lake Seloton BFPMC and sharing of experiences was facilitated by the FDOs as part of capacity-building.

2. Continuous Information-Education Campaign

IEC activities were considered as critical components of this project. UDP management in PPO 5 was very particular on what topic and methodologies to be used. As a result IEC modules were formulated and approved (see annex 1). WATERCARE staff was guided by this module in the conduct of the said activities.

Modules 1 to 3 and 6 were conducted at the sitio level to

ensure that all occupants became aware on this project as well as to draw their support and active involvement. Since IEC was thoroughly conducted relevant issues and concerns were given due attention both by MLGU and BLGU. Modules 4, 5 and 7, 8 were conducted at committee level and at Barangay Council

level but handed down to the community during public hearing and project launching.

7,8 Dec 11-15 16 C. Formulation of Site Protection and Management Plan The BFPMC formulated a five (5) years development plan for forest protection area. These plans (see volume 2) of the 3 barangays

stated their visions, the problems identified, the objectives and proposed strategies and activities to answer the problems. The process was very participative wherein actual occupants of the area were invited. These plans were being reviewed and polished by the stakeholders during one of their meetings. It was also agreed, that Maibo and Albagan Forest Protection and

Management Plan will be incorporated as part of their soon to be packaged Barangay Development Plans while that Miasong will be attached as an addendum to their packaged LBU-BDP. BFPMCs will be the one to monitor in the implementation of this plan and directly supervised by the Barangay Council, hence they need further strengthening.

D. On-site Projects On going projects being

implemented in this scheme, aside on the capacity building of the institutions is the tree planting activities. BFPMC had already accessed some resources like planting materials from private

sectors. Critical area

under forest protection was given priority attention especially in Maibo. Practice of STOP or contour farming within and along the perimeter of the protected areas was intensified both in Miasong and Albagan

with the supervision of the detailed ATs. There was an agreement that the farmers-occupants will no longer expand their cultivated areas.

DENR Primary Agency in ENR Management

(Mandated by EO 192 of 1987) This doesn’t mean DENR should be the only one responsible for ensuring effective FFM...yet, when all things are considered, everyone is really responsible. DENR which couldn’t be expected to do its job well because of lack of personnel/ resources and other reasons. LGUs which do not have the capability and full authority to manage local natural resources, other reasons. DENR always the CULPRIT? But whenever there are disasters (i.e., flash floods, landslides), people readily point to DENR as solely to blame. Quezon & Aurora 2,000 dead/ missing/ injured: many of them are children. Ormoc 7,000 dead and many ar still missing. Everyone is really responsible... Local communities either they are engaged in illegal activities, have an indifferent attitude, or do not know what they can do to help. Tenure holders who either abuse the forests for profit or simply abandon the lands place under their care. Others like the PNP and military that don’t help enforce the laws for various reasons. What should DENR do? Make its life and job easier with 1 forest guard for every 4,000 ha. of forest lands, how can the agency be expected to perform its job well. How? Is to make others active partners in FFM. Work in partnership with other agencies, organizations and projects. Start with the LGU, why? Because LGUs are the key stakeholders, they are where the forests and forests lands are. They are the first to be affected when something wrong occurs and the first to benefit when something right happens. LGUs have the resources (e.g., manpower and funds) which DENR does not have. Many LGUs are willing to take on a new role in FFM. They are mandated by law to work in partnership with the DENR in managing the country’s resources environment and natural resources. DENR mandated to support local autonomy.... (and) shall further devolve other functions to LGUs.

What else can DENR do?

1. MFO 1 – initiative, generate and coordinate required ENR policies, pertinent advocacy services.

2. MFO 2 - protect, enhance, rehabilitate ecosystems. 3. MFO 3 - manage resource use / access within the framework of sustainable

development and equity consideration. 4. MFO 4 - enforce ENR laws, policies, pertinent rules, regulations and monitor

compliance in coordination with pertinent law enforcers and development agencies.

5. MFO 5- adopt and develop environment-friendly resource production and utilization technologies, provide TA.

(Management Framework Objective) - MFO The entry point is Forest Land Use Plan (FLUP). FLUP can help address urgent issues such as illegal cutting and forest lands conversion. FLUP can close open access and help resolve boundary, claim and resource use conflicts. It also rationalizes forest land use and be used as a tool in enforcing and monitoring effective on-site FFM. And FLUP can be the basis for issuance of tenure to close open access areas. Like in Wao, Lanao del Sur LGU leads the fight vs. illegal activities; has set aside funds to co-manage forest lands; a big private firm signified its interest to invest millions of pesos into plantations. In Taliban, Bohol, a 580 ha mangrove area placed under co-management; mechanism for resolving conflicts in place. And in Nueva Viscaya at least 15 investors are willing to put in capital to develop its forest areas. Through various efforts such as training (Community Resource Management Framework) or CRMF preparation, paralegal and enforcement, financing and enterprise development, etc.) This will enable DENR to service the needs of the LGUs that will need FLUP assistance in the future. ILLEGAL LOGGING AS AN OFFENSE “Illegal logging” is the term commonly used to refer to acts punished under Sec. 68 of PD No. 705, otherwise known as the “Revised Forest Code of the Philippines” and promulgated in 1975. Modes of committing the offense, Sec. 68 of PD 705 punishes but one offense. There are, however, three ways or modes of committing it. These are:

1. Cutting, gathering, collecting or removing timber or other forest products from any forest land without authority.

2. Cutting, gathering, collecting or removing timber from alienable and disposable ( A&D) public land or from private land without authority.

3. Possessing timber or other forest products without legal documents. “Forest lands” as the term is used in the decree under the first mode means public forest lands and includes the public forest, permanent forest or forest reserves and forest reservation. ( PD 705, Sec. 3d ) The cutting of timber even from private or titled requires a license or permit such as a Private Land Timber Permit (PLTP) or a Special Private Land Timber Permit (SPLTP). Thus, under the second mode , even the owner of private land who cuts timber (i.e. naturally growing trees as well as Benguet pine and premium hardwood species regardless of whether naturally growing or planted ) in said land without the necessary license or permit is guilty of the offense of illegal cutting. Table shows the distinctions among the three modes of committing the offense of illegal cutting.

FIRST MODE The accused cuts, gathers, collects or removes timber or other forest products. The timber or other forest products are cut, gathered, collected or removed from forest land.

The cutting, gathering, collecting or removal of timber or other forest products is w/o authority.

SECOND MODE The accused cuts, gathers, collects or removes timber. The timber is cut, gathered, collected or removed from alienable or disposable public land or private land.

The cutting, gathering, collecting or removal of timber or other forest product is w/o authority.

THIRD MODE The accused accused possesses timber or other forest products. His possession of timber or other forest products is w/o legal documents as requred by existing forest laws and regulations.

CONFISCATION OF FOREST PRODUCTS AND CONVEYANCES Sec. 68 of PD 705, provides that the court shall further order the confiscation in favor of the government of the timber and forest products illegally cut, gathered, collected or removed as well as the machinery, equipment implements and tools used in the area where the timber or forest products are found.” Thus, the conveyances used in the transport of forest product illegally cut or w/o necessary documents are subject to judicial forfeiture wherever they were found or apprehended. Sec. 68 – A was added to PD 705 by EO no. 277 (1987). Under this provision, the DENR officials concerned are empowered to confiscate the forest products, conveyances and other instruments of the offense. Sec. 68- A was inserted by EO 277 precisely to make our forestry laws more responsive to present realities and to provide stronger deterrence to violations of PD 705.
