1. Consider the minutes from the February 10, 2017, Board meeting.
2. Law Enforcement Basics Seminar Survey Results.
3. TCAA June 14-16, 2017, Summer Conference final program,
including attendee list, Galen Sparks/Susan Rocha and Outstanding
Mentor Award winners.
4. Authorize expenditures for hotel accommodations for 3 nights for
future award winners.
5. Authorize staff to prepare TCAA Fall Conference in Houston,
scheduled for October 4, 2017.
6. Sponsorship of 2017 ICMA Conference.
7. Adopt TCAA budget for fiscal year 2017-2018.
8. Discussion of TCAA Day during 2018 IMLA Conference in Houston.
9. Next TCAA Board meeting to be held at 6:00 p.m. on October 3,
2017, location TBD in Houston, TX.
10. Other business.

Board President Kathy Davis called the meeting to order at 12:30 p.m.

1. Consider the minutes from the October 5, 2016, board meeting.
Motion by Dottie Palumbo was made and seconded by Slater Elza to approve the minutes
and the minutes were unanimously approved.
2. TML affiliate legislative guidelines.
Staff briefed the board on the TML affiliate legislative guidelines. Specifically, staff
pointed out that TCAA may not adopt any legislative program that conflicts with the
TML legislative program.
3. Approve 2017-2018 TML affiliate services agreement.
A motion was made by Alan Bojorquez and seconded by Slater to allow the agreement to
roll over with the slight dollar increase, and the motion was unanimously adopted.
4. UT Land Use Conference Sponsor Request.
After discussion, the board took no action in relation to the request and directed staff to
report that to UTCLE. (Note: Staff reported so shortly after the board meeting.)
5. Ideas for TCAA support of IMLA 2018 in Houston.
The board had some discussion of ways to help IMLA in 2018, among them:
Have a Texas moderator for every session.
TCAA seed money in some amount.
Recruiting local firms to sponsors.
Have a TCAA booth.
Hold TCAA 2018 fall conference in conjunction with IMLA.
A conference call subsequent to the board meeting yielded additional information.
6. Approve program for 2017 Summer Conference in Bastrop.
A motion was made by Slater and seconded by K.O. to approve the program with some
minor changes and to direct staff to implement it, and the motion was unanimously
adopted.
7. Other business.
After a short staff briefing, a motion was made by Ron and seconded by Alan for TCAA
to support Kevin Pagan and Snapper Carr in their bids to serve on an FCC right-of-way
committee.
8. Adjourn.
The next TCAA Board meeting to be held in South Padre Island at 4:00 p.m. on June 14,
2017.

complying with the michael morton act in municipal court, dealing with sovereign citizens
This seminar was targetted towards law enforcement personnel and was perfect for that end. I would add more legal topics but those topics are likely better for a TCAA prosecutors seminar.

This was a great seminar. I wish it had also been available as a live streamed webinar, or at least recorded for later review, because I had at least one person at PD that wanted to attend but was unable to make it to Austin.
Most useful one day seminar I have ever attended.

I really like this format. It fits the time and monetary budget!
Liked the time and price. Very relevant.
I thought that the officer safety presentation was great. I wasn't expecting that it would be relevant with what I doin municipal court, but it was really enlightening and told me a lot of things that I had never thought about or considered. very helpful!This is a great seminar for law enforcement and department heads regarding law enforcement. I am a prosecutor and some of the topics were not as relevant as others for myself, but the ones that were relevant were very effective. I would target this seminar towards police departments and try to get participation from officers; maybe invite city attorneys to bring their police chiefs. I enjoyed Warren Spencer's talk and the discussion with Curtis Howard. Overall, it was an effective seminar!

NOMINATION OF MARCUS NORRIS FOR TCAA OUTSTANDING MENTOR AWARD
I enthusiastically nominate Marcus Norris as a TCAA Outstanding Mentor. Because of his sterling reputation, I honestly believe I could end my statement at this point and that would be enough; he is that well thought-of among the municipal attorney ranks.
Marcus began his municipal law career in 1993 with the City of Killeen, first as Police Legal Advisor, then as Deputy City Attorney and finally City Attorney. In 2000, he became City Attorney for the City of Amarillo, where he served until 2015. He is currently a Shareholder with the Underwood Firm in Amarillo.
Marcus was the Deputy City Attorney in Killeen when I was first hired as their Police Legal Advisor, 21 years ago. He had just completed several years in that position, and boy, did he leave behind big shoes to fill. We all know how finicky police and fire can be, but they loved Marcus. It was my first “real” lawyer job, and Marcus mentored me in the finer points of being a police legal advisor, all while introducing me to the myriad of other responsibilities and aspects of being a municipal attorney.
Every day, Marcus demonstrated thoughtful common sense in his approach to problem solving. His inherently calm demeanor, tact and diplomacy lent itself to getting the job done, with buy-in from all necessary parties. One especially important project he spearheaded while in Killeen was negotiation of a contract with the U.S. Army and Army Corp of Engineers to create a joint military-civilian airport for the City of Killeen and Ft. Hood, which consisted of an almost inconceivable number of issues, federal, state and local, and also required special Congressional legislative action. This was the first such joint-use airport created in more than 50 years and as such, there was no blue print to follow, and no one to call for advice on how to make this project successful. Now Marcus is the one to call!
As City Attorney for the City of Amarillo, Marcus also participated in a series of groundwater rights transactions culminating in vast holdings of groundwater reserves for the City of Amarillo and its partner, the Canadian River Municipal Water Authority. This was followed by construction contracts for the City of Amarillo’s Potter County Well Field, one of the largest single municipality-owned groundwater well fields in Texas. In conjunction with outside counsel, he also successfully negotiated an affordable settlement in the infamous Tulia drug sting civil rights litigation, which could have been financially damaging to the City with its dozens of claimants.
Even though Marcus left Killeen for Amarillo in 2000, he has never stopped being my mentor. Even now, as an attorney still following behind him and trying (unsuccessfully) to fill his shoes, he is the first person I call with a unique legal issue. Even if it is not something he has previously dealt with, I know, without a doubt, that he will help me find the right solution. He is one of the most generous, honest, hardworking, ethical human beings I have ever had the privilege of knowing, and I know that the Outstanding Mentor Award was created with a career such as his in mind.

I have known Marcus Norris since 1999, when he was the City Attorney for Killeen and he hired me as the municipal court prosecutor. Like Kathy, this was my first “real” job and Marcus instantly took me under his wing. He gave guidance on how to function and survive as a young lawyer, particularly in a court with non-lawyer judges and a staff working for a different department. He quickly exposed me to other parts of city government that normally I would not have seen as prosecutor, and it served me well in developing as a municipal attorney.
Although Marcus left for the City of Amarillo not long after I joined Killeen, he remains a person whose knowledge and counsel I seek, knowing he will always know the answer or point me in the right direction. Most recently I emailed Marcus on a complex issue and his response was nothing short of a treatise. I joked with the City Attorney that I could easily copy and paste his email as my staff report to the City Council.
Marcus has been a stellar model of all aspects of professionalism to me throughout my legal career, setting the standard for what it means to be a municipal attorney.

I started my career in municipal law as an assistant city attorney for the City of Amarillo. Marcus was our City Attorney.
As attorneys we all know the value of time. Those of us in private practice live and die by the billable hour. Marcus was always willing to give this precious commodity to me and to all the legal staff at the City of Amarillo.
Marcus spent much of his time supporting and mentoring our staff. He assigned tasks with the purpose of allowing each of us to grow in our practice and learn other areas of municipal government. He encouraged each of us to challenge ourselves on each project, while at the same time always being accessible to discuss ideas and provide guidance.
He truly cared about each of his employees, on a personal and professional level. I truly appreciate all of the time he spent with me.

I am doing this paper for our Hogwild event. Also, in my research, I found a paper from 2012 by
Edwin Voss for HOT Topics for Texas Cities. Probably can update and expand from a legal
perspective.
Our firm settled a case where someone made an ADA complaint for a Board room where he
went to meetings- our client had to put in a new door to accommodate a wheelchair and better
automatic opening, buy new hearing and listening devices and the lawyer got attorney’s fees.
Pflugerville (our client) just won an MSJ for an issue with police allegedly not accommodating
someone who ended up getting hit by a car after we dropped him off at the ER; and there is a
new 2016 5th
Circuit case on this issue too.

(What to do when City officials are charged with crimes)
Presenters will use recent examples from municipalities across the Country to demonstrate the
municipal attorney's responsibilities to government officials and employees under investigation
or indictment for criminal offenses. Presenters will provide a road map for dealing with public
officials, the community, and media during the crisis. Additionally, presenters will provide the
legal framework of the ABA Model Rules of Professional Conduct and the interplay of the Code
of Criminal Procedure and Texas Disciplinary Rules of Professional Conduct.

I am City Attorney for the City of Southside Place, and a member of the TCAA. In my private
practice, I also represent the billboard industry, and as such, have closely watched SB 2006 in
this Legislative Session. You spoke recently on this bill at TxDOT’s stakeholder meeting, but
you left before I could get a chance to visit with you. As you know, it now appears quite likely
that SB 2006 will be passed out of the Legislature and be presented to the Governor. Given the
timing of this new law, and its impact along with the Auspro and other First Amendment
challenges to signage on cities across the State, I thought a presentation on this topic might be

(a) Professional Codes of Conduct at City Hall: This presentation will touch on the many
state, national and international codes promulgated by professional associations that
affect how city officials do their jobs (e.g., ASPA, APA, ICMA, etc.). Aside from state
laws or muni ordinances and personnel policies, there are standard rules governing most
aspects of municipal operations, from City Secretaries to Building Officials, which I
doubt many city attorneys are aware of. These codes sometimes come into play when
there are accusations of ethical misconduct. They certainly should be addressed when
conducting ethics training for city employees.

“So You Think You Need A Forensic Audit”
This presentation will explain what a forensic investigation is (and what distinguishes it from an
“audit”), how to find a qualified forensic resource and what result to expect (demand) from the
process. The presentation will provide the following guidance.
How to evaluate the “need” for an investigation, identifying the relevant issues define the
required forensic resources.

How to effectively draft an RFP/RFQ that will produce qualified candidates who can
provide the appropriate forensic resource(s).
How to evaluate candidates, including getting reliable and comparable fee estimates
therefrom.
What deliverable should be expected (demanded) from the candidates.
Clarify the investigative process, and
What expert testimony, if necessary, can be expected and which individuals will provide
same.
The educational goal will be to enable City officials to effectively engage “appropriate” forensic
resources, within authorized fee budgets and resulting in the required deliverables (including
recommendations for appropriate remedial actions).
I have been conducting forensic investigations for over 35 years, many of which involved
governmental agencies. As a former FBI Agent, CPA and licensed attorney I am uniquely
qualified to guide city officials through this unfamiliar territory.

I’m interested in presenting on Texas Competitive Low Income Housing Tax Credits (LIHTC).
I’ve worked on both sides of this issue for several years; for a city that wanted a LIHTC
development and one that didn’t. The Texas Department of Housing and Community Affairs
(TDHCA) changed its scoring criteria in 2015, after the U.S. Supreme Court ruled that the Texas
point system caused a disparate impact in violation of federal fair housing laws. See Tex. Dep't
of Hous. & Cmty. Affairs v. Inclusive Cmtys. Project, Inc., 135 S. Ct. 2507 (2015). Part of
TDHCA’s solution was to change the points awarded for local government support, which
requires a resolution in support of the project from the city council for maximum points. This
places cities in the awkward position of violating fair housing laws if they openly oppose a
project, or angering citizens if the city has no objection or supports the project to avoid violating
federal law. The LIHTC rules also change every year with the approval of a qualified allocation
plan by the Governor’s office.
