These appointments are for terms to expire on February 1, 2005. Governor Bush reappointed Kent T. Starr, D.D.S., Waco, to a six year term on the board as well. On behalf of the board and staff of the SBDE, may I extend congratulations to our new board members. I would like to take this opportunity to express my sincere appreciation to those members going off the Board. Since the State Board of Dental Examiners was reconstituted in 1995, Dr. Hadley Hall has served with distinction not only as Board Secretary in 1995, but also as President in 1996. Thank you Hadley for all the long hours you dedicated reviewing complaints and the many trips you made to Austin working with staff to get the enforcement process back on track since sunset. Since the September, 1998, issue of the Newsletter many have asked when will the next Newsletter be published. I apologize for the delay, but there was so much information to relay to our licensees especially with the legislature in session that we have waited until now to publish this issue.

To begin with, on April 13, 1999, Governor Bush announced to the Senate of the 76th

Legislature his appointments to the State Board of Dental Examiners. They are J. Kevin Irons, D.M.D., Austin, replacing Dr. J. Hadley Hall; Martha Manley Malik, D.D.S., Victoria, replacing Dr. Sheryl Beltrane; Nathaniel Tippit, D.D.S., Houston, replacing Dr. Miro Pavelka; Amy Landess Juba, Amarillo, public member, replacing Jerry Burley, public member, and Karen Flo Hembry, Dallas, public member, replacing Felipe Reyna, public member. These appointments are for terms to expire on February 1, 2005. Governor Bush reappointed Kent T. Starr, D.D.S., Waco, to a six year term on the board as well. On behalf of the board and staff of the SBDE, may I extend congratulations to our new board members.

I would like to take this opportunity to express my sincere appreciation to those members going off the Board. Since the State Board of Dental Examiners was reconstituted in 1995, Dr. Hadley Hall has served with distinction not only as Board Secretary in 1995, but also as President in 1996. Jerry Burley was one of our most active public members who represented the Board at the national level as liaison to the Dental Interaction Simulations Corporation (DISC). Thank you Jerry for always expressing yourself in such a straightforward and enthusiastic manner not only at our board meetings but also at national meetings.

Felipe Reyna, attorney at law and public member provided wise counsel to the Board, especially when the issues would become difficult to assess. Felipe served in an exemplary manner on the Examination Committee, the Legislative Committee, the Credentials Committee and especially on the Enforcement Committee. Felipe is an excellent "story teller" and he used them to illustrate his points in an unforgettable fashion. Thank you Felipe for always keeping us focused on the issues at hand.

Finally, I want to express my appreciation to Dr. Kent Starr, who was reappointed to the Board for another six years. Thank you Kent for your leadership and guidance as Board Secretary in 1996 and President in 1997. We are very fortunate to have you back on the Board.

Since our September, 1998, issue of the Newsletter, the Board has adopted a rule clarifying that communications from a dentist to the public concerning dental services shall inform the public that the communicator is a dentist; adopted a rule that establishes categories for dental complaints as mandated by the Texas Legislature through the Dental Practice Act; amended a rule that clarifies to the public the rights and responsibilities of the parties to a complaint that alleges a violation of the Dental Practice Act and/or rules and regulations of the Board; and adopted a rule that provides that dentists who refuse to access to their premises to board investigators could have their practices temporarily closed. The text of these rules can be found of pages 5 - 6 of this Newsletter.

The first round of random audits for compliance for continuing education (CE) requirements began in February 1999. To date, the SBDE has audited 150 dentists and 92 dental hygienists. The agency continues to receive calls regarding CE requirements as well as the audit process. I encourage everyone to read Chapter 104 of the SBDE rules and regulations for all CE requirements and rules 107.200 and 107.201 which outline the penalties for non-compliance of CE.

At the March 26, 1999 SBDE meeting, the Board appointed Dr. Ernie Luce, San Antonio, replacing Dr. Charles Rader and Dr. David Ferguson, Austin, replacing Dr. Mark Sivley, to serve as Anesthesia Consultants assisting the Board in anesthesia related matters. The Board extends its appreciation to Dr. Rader and Dr. Sivley for their services as Anesthesia Consultants.

And, finally, as the 7 6 th Legislative Session draws to an end several bills were filed that could impact the dental profession should they pass and become law. Specifically, SB 964 filed by Senator Lucio makes considerable changes to the Dental Practice Act. Other bills filed include HB 2633, relating to the confidentiality of dental patient records, HB 2635, HB 3533 and HB 3534, all relating to the practice of dental hygiene, SB 524 relating to the public disclosure of disciplinary actions, including the issuance of warning letters, SB 1906 relating to the confidentiality of dental patient records and HB 3155 which recodifies the Dental Practice Act. Our next Newsletter will provide a complete update on legislation that is enacted that amends the Dental Practice Act.

DENTAL HYGIENE ADVISORY COMMITTEE REPORT Lana Crawford, RDH, Chair

The Dental Hygiene Advisory Committee (DHAC) met on January 6, 1999 with all members present. DHAC appreciates the supportive role of the agency staff that attends our meetings and provide valuable guidance and legal counsel. The interest and support of public visitors present are also appreciated.

The announcements of the new appointments of a dental hygiene member and a public member have not been made by this publication. Bea Wohleb, our public member from Temple, and Lisa Cooper, RDH, our dental hygiene member from Coppell, have served faithfully and brought valuable leadership to the tasks of the committee.

Examination schedules have been made by the Western Regional Examining Board (WREB). Assignments include Dr. Paul Stubbs, as a new chief examiner for the dental hygiene exams. Two new dental hygiene examiners, Jan Horvath, RDH, and Alisa Phoenix, RDH, both from San Antonio, were appointed by the SBDE at the August 14, 1998 meeting.

Please refer to page 19 of the Newsletter for continuing education (CE) information. With random auditing of CE credit now a possibility, one would recognize the benefit of being highly effective in the organization of all CE certificates.along with a copy of the rules.

Prior to enrolling for any CE course the following should be considered: Is the sponsor of the course listed or endorsed by a SBDE approved provider in rule 104.2? If yes, then determine whether or not the courseis technical or scientific relating to clinical care. If you cannot determine that from the course description, contact the PROVIDER of the course to give you that information. The SBDE cannot and WILL NOT determine that for you. They have vested the authority with the course providers.

There is a statutory law regarding state agency advisory committees known as Truan's statute. Section 2110.008 of the Government Code addresses the duration of advisory committees and became effective September 1, 1997, following the approval of the 75th Legislative Session. The composition and work of the Dental Hygiene Advisory Committee is defined in the Dental Practice Act. However, DHAC would only continue to exist if the governing body of the SBDE votes affirmatively. The committee would have been automatically abolished on the 4th anniversary of the date of its creation.

On January 15, 1999, the SBDE unanimously voted to continue DHAC demonstrating the Board's approval of the usefulness and importance of the committee. This vote also affirms the concept of the team approach to the profession of dentistry.

DHAC congratulates and welcomes the new Board President, Joe David Zayas, DDS, and once again pledge our support to his leadership on the Board.

It has been an honor to serve as chair of DHAC for the second term. Sincere thanks for commitment and synergism to all committee members, SBDE members and agency staff, and many dental professionals who have interest in dental hygiene issues.

BOARD ADOPTS RULES

The Board, at its regularly scheduled meeting on November 6, 1998, adopted the following rule, effective November 29,1998. (Please note new language is shaded)

(New Rule) Rule 109.145 Dental Degree Required on Written Communication to Public A Texas dental licensee, in any professional written communication concerning dental services, shall include the dentist's dental degree or the dentist may use the words

"general dentist", "general dentistry", or an ADA approved dental specialty, if the dentist is a specialist in the field designated.

(new rule 109.145, provides that communications from a dentist to the public concerning dental services shall inform the public that the communicator is a dentist. This rule is intended as a companion to rule 109.204 (11)

effective February 10, 1995, which requires inclusion of a licensee's dental degree in all advertising concerning dental services offered as a failure to do so results in false and misleading advertising. For example, qualified dentists perform cosmetic surgery. Some dentists, however, were advertising availability of surgical services provided by a "surgeon" with no indication that the provider was a dentist. Board members expressed concern

that non-advertising communications by dentists concerning dental services when the dentist is not identified as a dentist could be equally misleading. This rule requires that dental licensees identify themselves as such in non-advertising communication to the public).

The Board, at its regularly scheduled meeting on January 15, 1999 adopted the following rules, effective February 15, 1999. (Please note new language and amended language is shaded)

(Amended rule) Rule 107.101 Guidelines for the Conduct of Investigations (a) Every complaint shall be classified into one or more of the following categories:

(1) Quality of care: failure to treat a patient according to the standard of care in the practice of dentistry or dental hygiene.

(2) Sanitation: failure to maintain the dental office in a sanitary condition. (3) Professional Conduct: violations arising out of the day-to-day practice of

dentistry, not including administrative requirements. (4) Administration: failure to follow the administrative requirements of the Dental

Practice Act/and or the Board's Rules and Regulations. (5) Dental Laboratories: violations of the Dental Practice Act and/or the board's

Rules and Regulations pertaining to the operation of dental laboratories. (6) Business Promotion: violations arising out of efforts to obtain business, such

as advertising and referral schemes. (b) Every complaint shall be assigned a priority classification. Priority 1 represents more serious allegations of violations, including but not limited to, Patient Mortality, Patient Morbidity, Practicing Without a License, and Sanitation. Priority 2 represents less serious threats to the public welfare, including but not limited to records-keeping violations and Advertising. (c) Upon receipt, every complaint shall be evaluated by the Director of Enforcement to

determine whether temporary suspension, in compliance with Article 4548h, Section 2(d), should be considered.

(the amended rule 107.101 establishes categories for dental complaints as mandated by the Texas Legislature

through the Dental Practice Act. Rule 107.171 has established six categories that will allow a more meaningful

assignment to a category. Under the old 17 categories, it was difficult to appropriately assign a category on the

basis of a review of the complaint, which often resulted in unintended distortions of categories reported. The new categories are broad enough that complaints can be assigned accurately on the basis of review of the

complaint. The rule will allow the board to come to a more useful understanding of the nature of all complaints filed. The board is of the opinion that the new categories more accurately reflect the types of conduct over which the board has jurisdiction).

(Amended rule) Rule 107.102 Procedures in Conduct of Investigations (a) An investigative file accounting for each complaint filed with the Board shall be maintained under the supervision of the Director of Enforcement. (b) Every complaint shall be reviewed by the Director of Enforcement to determine jurisdiction. If jurisdiction exists, a complaint shall be investigated to determine the facts concerning the complaint. All investigators shall be state employees. (c) If, upon initial review, the complaint reveals a possible threat to a person's welfare, the complaint shall be referred to the Board or an executive committee of the Board, for consideration of temporary suspension, pursuant to Article 4548h, Section 2(d). (d) During the course of an investigation, the complainant shall be given an opportunity to explain or comment on the allegations made in the complaint. At the initiation of the investigation, the respondent shall be provided a copy of the complaint to facilitate a response, unless to do so would jeopardize an undercover investigation. (e) The parties to the complaint shall receive notice of the status of the complaint, at least quarterly, until final disposition of the complaint, unless such notice would jeopardize an undercover investigation. (f) Upon completion, the Board Secretary or designee shall review the investigative file. The Secretary may: dismiss the case; refer the case to the State Office of Administrative Hearing; refer the case to an informal settlement conference; refer the case to the Executive Director or a subcommittee of the Board for imposition of an administrative penalty; or, direct further investigation. (g) No case will be dismissed without appropriate consideration. A letter shall be sent to the complainant, explaining why the case was dismissed. If the complainant objects to closure and provides new evidence to support the allegations, the case shall be reviewed by at least three members of the Enforcement Committee to determine whether further action is appropriate.

(amended rule 107.102 is intended to ensure that the procedures comply with the requirements of Article 4548h, Section 1 of the Dental Practice Act. The old rule does not accurately reflect the requirements set forth in the Dental Practice Act; the amended rule does. This compliance will result in a clearer understanding by the public of the rights and responsibilities of the parties to a complaint that alleges a violation of the Dental Practice Act and/or the Board rules and regulations).

(New Rule) Rule 109.132 Access to a Dental Office A person practicing dentistry in the State of Texas shall, upon demand by the officers, agents or employees of the State Board of Dental Examiners acting pursuant to a sanitation complaint, grant immediate access to the entire dental office premises to those persons making such demand. Failure to grant such access may subject a practitioner to temporary license suspension, pursuant to Article 4548h, Section 2(d).

(new rule 109.132 provides that dentists who refuse access to their premises to board investigators who are acting pursuant to a sanitation complaint could have their practices temporarily closed. The Board is of the opinion than an unsanitary dental office could pose a serious threat to the health and welfare of the people of Texas. Presently, if a dentist refuses access to an investigator who is acting pursuant to a sanitation complaint, the Board has no effective recourse. In the meantime, the unsanitary condition, if severe enough, poses a threat to the health of patients. By operation of the rule, the board finds, or will find, that refusal by a licensee to allow board investigators access to investigate a complaint about unsanitary facilities poses such a threat if it continues unabated. It is anticipated that the mere knowledge that a recalcitrant dentist might face temporary suspension will result in cleaner offices. Article 4548h, Section 2(d) provides adequate procedural safeguards for the property rights of the practitioner).

DISCIPLINARY ACTIONS August 28;1998 through November 30,1998

RESPONDENT FINDINGS BOARD ACTION

Mary E. Rush, DDS Tx. License #15666

As the result of poor record keeping and failure to adequately stay apprised of a continual and progressive periodontal condition, the Respondent failed to timely diagnose periodontal disease in a patient under her care.

Respondent permitted a person (Reg. Nurse) to induce and maintain parenteral conscious sedation and failed to maintain, personal supervision of patients during induction of conscious sedation. The Registered Nurse was supervised and trained by Respondent during approximately five hundred prior procedures: Respondent failed to make adequate records of his patients' informed consents and failed-to fully document medical treatments provided to his patients, and failed to include adequate data in his patients' dental records concerning the'dispensing and administering of controlled substances. The record keeping requirements of the triplicate prescription program and the controlled substance ledgers are not in controversy. Respondent administered anesthetic agents to his patients in excess of recommended dosages.

Texas License #15666 is hereby suspended for an indefinite period. Texas License #15666 is to participate with the terms and conditions of the Texas Peer Assistance Program.

Texas License #7045 is hereby Suspended for a period of (3) three beginning on the effective date of this Order, however, the suspension is probated in-its entirety. Texas.License #7045 shall complete a total of 30 hours of Continuing Education courses, within three (3) years of the effective date of this Order. CE courses are to be completed in increments of at least 10 hours per a year. Texas License #7045 will pay fine for $2,500 to be paid within one year of the effective date of this Order.

Practitioner's dental license was suspended for ten (10) years or 120 months, all probated except for thirty (30) days down time to be served beginning November 25, 1998 through December 24,1998. On June 14, 1995, Practitioner was convicted of two counts of felony mail fraud in the US District Court, Northern District of Texas, Ft. Worth Division, and sentenced to 18 months' incarceration, 13 of which were actually served in various federal prisons. The underlying facts that resulted criminal activity in 1989 and 1990 that involved fraudulent billing practices to insurance companies in practitioner's occupation as a dentist.

Texas License #11510 suspended for ten years, all probated except thirty days. During the period of non-probated suspension, Texas License #11510 cannot practice dentistry in the State of Texas. On September 27, 1993, the license was issued in the name of Kyle Patrick Little, DMD. Before his Texas license was activated on September 27,1993, Respondent changed his name with the SBDE from Randall Kyle-Patrick Little to Kyle P. Little.

Practitioner while on probation from January 15,,1988 until January 15,1998 prescribed controlled substances, to himself and others for non-dental purposes during the years of 1996, 1997 and 1998. In 1996, 1997, and 1998, failed to keep an adequate centralized inventory of the dispensation of controlled substances from his dental office. In 1996, 1997, 1998 failed to.maintain records pertaining to controlled substances in accordance with the Texas Controlled Substances Act.

Admitted addiction to the use of crack cocaine.

Non compliance with requirements of modified 1996 Agreed Settlement Order. Failure to maintain adequate dental records and drug records. Failure to pay fine. Failure to take jurisprudence examination. Failure to complete 50 hours of CE. Prescribed controlled substances dangerous drugs, and/or narcotic drugs approximately 86 times to or for dental patients during the period of license suspension in 1996.

Reprimanded. 10 hours of CE within one year of Order.

Suspension of dental license for a period of 10 years, all probated. Participation in Texas Dental Peer Assistance Program. Controlled substance registration certificates are to be reregistered with DEA or DPS with prior Board authorization and appearance before the Board. 20 Hours of community service per month for the entire probated suspension period.

Suspension of dental license for a period of ten (10) years, beginning on the effective date of this Order, all probated. Participation in Texas Dental Peer Assistance Program. Surrender of DPS and DEA narcotic certificates, substances, anesthesia permits, and prescription forms to the DPS and DEA respectively. Copies of documents of surrender to be sent to SBDE.

Admitted to not signing the prescriptions or work-orders for dental laboratory work. Failed to make, maintain and keep adequate records as to the diagnosis made and the treatment performed for and upon each dental patient.

Suspended for a period of 3 years, the suspension is probated in its entirety except for a consecutive thirty (30) days. 12 hours of CE courses within (1) one year in Record Keeping and Risk Management. Take and pass the Board's jurisprudence examination within 1 year of Order.

Violated the standard of care in that the dosage of sedative drugs given during sedation of his patients and dosage was excessive. Demonstrated a lack of knowledge of the use of anesthetic agents and the protocol differences between parenteral conscious sedation and deep sedation/general anesthesia. Parenteral deep conscious sedation/general anesthesia procedure was inappropriate as to the length of time the patient was placed under sedation for a routine extraction of her erupted wisdom teeth. Excessive and unwarranted amount of time to perform the surgical extraction of teeth #1,#16, #17 and #32 (four wisdom teeth, placing anesthetized patient at increased risk). Violated the standard of care in that the dosage of Marcaine given during the surgical procedures on the subject patients was excessive under the circumstances.

NOTICE OF EXPIRED LICENSES AND REGISTRATIONS

Listed on pages 13 - 17 are licensees whose licenses or registrations are expired as of August 1, 1998. The SBDE notifies each licensee by mail of the impending expiration of a license or registration at least 60 days prior to the expiration date; however, each licensee is responsible to maintain current status by timely payment of annual fees.

The SBDE's intention is to ensure that all dentists, dental hygienists, and dental laboratories are eligible and within legal parameters to practice in Texas. Therefore, the SBDE publishes this list to notify other licensees, registrants, and the public that each of these individuals is not eligible to practice either dentistry or dental hygiene nor to operate a dental laboratory until his/her license or registration is renewed.

Because of the time lapse between the data retrieval of expired licenses and registrations and publication of this Newsletter, some names listed on the following pages already may have renewed in which case they are practicing legally.

CHANGE OF ADDRESS

You are responsible for notifying the SBDE office in writing within 60 days of the change of your address [Dental Practice Act, Article 4550 Sec 1]. License renewal notices are mailed to the address of record and if you have not updated your address, you may experience a late license renewal requiring that a late penalty be paid if your address is not current.

RENEWAL APPLICATIONS

Notice of renewals are mailed to licensees approximately 60 days prior to expiration of the license. If you do not receive your renewal, you may submit a written request to this office for a duplicate. COMPLIANCE IS THE RESPONSIBILITY OF THE LICENSEE.

TEXAS DENTAL PEER ASSISTANCE PROGRAM

Included in the cost of your annual renewal is a fee to support the Texas Dental Peer Assistance Program (TDPAP). The fee for dentists is $9.00; for dental hygienists is $2.00. The TDPAP is a non-profit corporation that has served as dentistry's peer assistance program since 1986. The TDPAP is available to provide confidential assistance to dentists, dental hygienists, dental students, and dental hygiene students who are experiencing mental, emotional, or substance abuse problems. The TDPAP is your service! For more information, contact Bob Robinson, LCDC, CAS, NCAC II, TDPAP Executive Director at 1-800-9456302 or 512-451-9040.

The Dental Practice Act requires any dentist administering nitrous oxide/oxygen inhalation conscious sedation, parenteral conscious sedation, or general anesthesia to have a permit. Accomplishing required training does not imply that a sedation/anesthesia permit is automatically issued. All dentists desiring a sedation/anesthesia permit must apply to the SBDE for issuance.

Permit applications may be obtained from the SBDE office. They are submitted to the SBDE, Director of Licensing and Examinations, and are reviewed and approved by the SBDE at regularly scheduled SBDE meetings.

Please Note: if you do not have an approval letter from the State Board of Dental Examiners to administer conscious or general anesthesia, you are not legally permitted to do so.

RADIOLOGY EXAMINATIONS

Texas dentists wishing to order radiology examinations for dental auxiliaries must submit a written request along with $30.00 (per exam) to the SBDE office. Instructions for administering the examination will be included in the packet of information mailed.

CONSUMER INFORMATION SIGN

Pursuant to SBDE Rule 109.10, a licensed Texas dentist may obtain a copy of the Consumer Information sign from the SBDE office by written request along with a fee of $3.00.

CONTINUING EDUCATION

Pursuant to Rule 104.5(e), Continuing Education audits began January, 1999.

All dentists and dental hygienists licensed on or before December 31, 1995 will be eligible for audit when their license expires in 1999.

A total of 36 hours of technical or scientific continuing education hours are required to maintain licensure.

Only those licensees randomly selected for audit will be required to submit documentation.

DO NOT submit CE documentation to the SBDE office unless you have been asked to do so.

Be aware that some organizations offering CE courses may be misleading Texas licensees taking these courses by stating that these course are eligible for CE credit in Texas. These courses may not qualify as "technical and scientific as related to clinical care" as outlined in Rule 104.1(5). The SBDE strongly recommends all licensees exercise good clinical judgment when seeking CE courses. Licensees should review the CE rules for appropriate providers.

The SBDE recognizes that numerous licensees practice in more than one location and that it may be troublesome for such licensees to transport their original dental licenses in order to meet the requirements of Article 4548d. Therefore, the SBDE's position is that a licensee may display at secondary locations a copy of the original dental license that is certified by a notary public as a true and correct duplicate of the original. The original dental license, however, needs to be displayed at the designated primary practice location.

CERTIFICATION TO APPLY PIT AND FISSURE SEALANTS

Pursuant to Rule 115.2, Permitted Duties, for a dental hygienist to obtain certification to apply sealants in Texas, he/she must submit the following documents to the SBDE office:

(1) a written request which includes the hygienist's name, mailing address, social security number, and Texas license number.

(2) proof of successful completion of a pit and fissure sealant course at a CODA dental or dental hygiene school or college. This may be either (a) a course certificate, (b) a copy of the dental hygienist's transcript and a course description, or (c) a letter from the Dean or Program Director attesting to dental hygiene training and competency to apply sealants.

NOTE: the letter must be written on school letterhead.

The Texas Dental Practice Act (statutory law as passed by the Texas Legislature ) and the SBDE Rules and Regulations (as promulgated by the Board) may be viewed on our WEB SITE at www.tsbde.state.tx.us. You may still obtain a copy of the rules and regulations by written request along with a fee of $10.00. There is no fee for obtaining a copy of the Dental Practice Act.
