In his first bill of the 113th Congress, U.S. Senator Tom Udall is seeking to expand opportunities for small businesses to secure federal contracts, and make the reporting requirements for those awarded more transparent.The Assuring Contracting Equity (ACE) Act of 2013, would raise the Small Business Administration's (SBA) government-wide small business contracting level from 23 to 25 percent. It would also increase the contracting goal from 5 to 10 percent for businesses owned by veterans, women and economically disadvantaged individuals.

SECTION 1. SHORT TITLE. 3

This Act may be cited as the ‘‘Assuring Contracting 4

Equity Act of 2013’’. 5

SEC. 2. FEDERAL CONTRACTING GOALS. 6

(a) INCREASE IN CERTAIN GOALS.—Section 15(g)(1) 7

of the Small Business Act (15 U.S.C. 644(g)(1)) is 8

amended— 9

(1) in the second sentence, by striking ‘‘not less 1

than 23 percent’’ and inserting ‘‘not less than 25 2

percent’’; 3

(2) by striking ‘‘not less than 5 percent’’ each 4

place that term appears and inserting ‘‘not less than 5

10 percent’’; and 6

(3) by striking ‘‘not less than 3 percent’’ each 7

place that term appears and inserting ‘‘not less than 8

6 percent’’. 9

(b) LIMITATION ON NUMBER OF CATEGORIES FOR 10

WHICH A BUSINESS MAY QUALIFY.—Section 15(g) of the 11

Small Business Act (15 U.S.C. 644(g)) is amended by 12

adding at the end the following: 13

‘‘(3)(A) In this paragraph, the term ‘specified cat-14

egory’ means small business concerns, small business con-15

cerns owned and controlled by service-disabled veterans, 16

qualified HUBZone small business concerns, small busi-17

ness concerns owned and controlled by socially and eco-18

nomically disadvantaged individuals, and small business 19

concerns owned and controlled by women. 20

‘‘(B) Except as provided subparagraph (C), a Federal 21

agency may include a business concern in not more than 22

2 specified categories for purposes of determining whether 23

the Federal agency has met the Government-wide goals 24

under this subsection for the award of contracts to busi-1

ness concerns in specified categories. 2

‘‘(C) A Federal agency may not include a small busi-3

ness concern that is participating in the program under 4

section 8(a) in any specified category except the category 5

‘small business concerns owned and controlled by socially 6

and economically disadvantaged individuals’ for purposes 7

of determining whether the Federal agency has met the 8

Government-wide goals under this subsection for the 9

award of contracts to business concerns in specified cat-10

egories.’’. 11

SEC. 3. IMPROVING TRANSPARENCY TO ASSIST SMALL 12

BUSINESS CONCERNS. 13

Section 15(g)(1) of the Small Business Act (15 14

U.S.C. 644(g)(1)) is amended by inserting after the sec-15

ond sentence the following: ‘‘For purposes of this sub-16

section, in addition to the existing reporting requirements, 17

the Administrator shall include the percentage of small 18

business concern participation for the total value of all 19

prime contract awards for a fiscal year, including the value 20

of each prime contract awarded for the fiscal year, without 21

regard to whether the prime contract was awarded as the 22

result of unrestricted competition or any determination by 23

the Administrator with respect to the potential for a small 24

business concern to perform the prime contract or a sub-1

contract under the prime contract.’’. 2

SEC. 4. COMPLIANCE WITH SMALL BUSINESS SUBCON-3

TRACTING GOALS. 4

The Administrator of the Small Business Administra-5

tion shall consult with the heads of other Federal agencies 6

to develop and implement standards for procurement offi-7

cers to take into consideration the past compliance of po-8

tential contractors with small business subcontracting 9

goals when making contract awards. 10
