1.IntroductionTheintentofBurton’sSustainableChemicalsManagementProgramistoprotectcustomers,workersandtheenvironment by eliminating toxic chemical substances from our supply chain, manufacturing processes,products, and packaging. To support this objective, we have partnered with bluesign technologies andpublishedaRestrictedSubstancesList (RSL). TheRSL isa subsetof testable substancesextracted fromthebluesign® System Substances List (“BSSL”). The BSSL (see link below) is a larger comprehensive list thatincludesallglobalsubstancerestrictionsbeyondfinishedproducts.AllBurtonsuppliersshallcomplywiththeRSLforfinishedproducts.WealsoencourageallsupplierstocomplywiththeBSSL.BSSL:http://www.bluesign.com/industry/infocenter/downloads#.VP2xgSni4RmTheRSLappliestoallrawmaterials,parts,trims,components,hardware,chemicals,mixtures,coatings,andotheritemssuppliedtoBurtonand/orusedinthemanufactureofBurtonfinishedgoodsandpackaging.Itisrequired that you implement input-stream chemical management systems in order to know and addresschemicalcomponentinput,sourcing,sampling,andtestingofmaterialsusedinourproductsandpackaginginordertomeettherequirementsoftheRSL.Suppliersshallimposetheserequirementsupontheirvendorsandsub-suppliersinturntoensurealignmentthroughtheentiresupplychain.PleasenotethattheRSLandBSSLareupdatedregularlyinordertokeeppacewithemergingregulationsaswell as to achieve the goalswe set for ourselves beyond regulatory requirements. As such, youwill needresourcesavailabletoadequatelyandcontinuallymeetallrequirements.Findthemostup-to-dateversionoftheRSLatvendor.burton.com.Werecognizethechallengesassociatedwithaccomplishingthisgoal.Thoughitisyoursoleresponsibilitytoensure that the products and packaging you provide us complywith all global product and environmentalregulations,wecanprovideyouwithassistanceintheformofeducationandtraininguponrequest.Wecanalsoprovideyouwithalistof3rdpartylaboratories,asyouwilllikelyneedthoseservices.2.ContactsForanyquestionsregardingthisPolicyandRSL,pleasesendane-mailtosustainability@burton.com3.KeyVendorRequirementsPlease fulfill items 1 - 7 below and send all information, reports, etc.… to the email address above. Thesupplier is responsible forall costsassociatedwithanalytical testing. Shoulda supplierdemonstratea testfailure,wereservetherighttoincreasethefrequencyoftestingrequiredofthesupplierforoneyear(fromthe date of the test) or until the supplier adequately demonstrates the specific issue has been properlyaddressed.

2. All youth category products require annual lead testing in order to satisfy the requirements of theConsumerProductSafetyImprovementAct(CPSIA).Providethesereportstousannuallypriortobulkproduction.
3. SuppliersmusttestdesignatedmaterialsannuallyforcompliancewiththeRSLandprovidethosereportstousuponreceipt.Eachsupplierwillreceive:
a. Alistofmaterialsthatrequirechemicaltesting.b. Acleardescriptionofthetestpackage:
i. BasicCPSIAcertificationtesting.ii. ChemicalsofHighConcerntesting(FocusChemicals).iii. CompleteRSLtesting.
4. Supplierswillberesponsiblefor:a. Confirmingtestmaterialsampleavailability.b. Shipmentofsamplestothelaboratory.c. Confirmationoftesttimelines.
5. VendorshallsubmitproductionqualitysamplestoanISO17025certifiedlab(suggestionsattachedbelow).
a. Samplesmustmeetminimumsamplesize/massrequirements.b. Samplesmustbeindividuallypackagedandlabeled.

4.Definitions4.1ArticleAnarticleisanobjectwhichduringproductionisgivenaspecialshape,surface,ordesign,whichdeterminesits function toagreaterdegree thandoes its chemical composition (fibers, textile fabrics,buttons, zippers,etc.).4.2CASNumberCAS registry numbers are unique numerical identifiers for chemical elements, compounds, polymers,biologicalsequences,mixtures,andalloysassignedbytheChemicalAbstractsService(“CAS”).4.3ChemicalSubstanceAChemicalSubstanceisachemicalelementanditscompoundswithconstantcompositionandproperties.ACASnumberdefinesit.4.4Detectionlimit(DL)Thedetectionlimit isthelowestquantityofasubstancethatcanbedistinguishedfromtheabsenceofthatsubstancefollowingaprescribedanalyticalmethod.4.5LimitValueTheLimitValueisthevaluesetanddefinedbyaconsumersafetylimit(s)forchemicalsubstance(s)inArticles.4.6UsageBanA Usage Ban is defined as a prohibition of the use of a chemical or group of chemicals in a particularmanufacturingprocess,application,material,component,orproduct.

12.GuidanceonMetalPartsandFinishesonMetalPartsExtremecareshouldbetakeninthesourcingofmetalsusedinthemanufactureofArticles.Greatcareshouldalsobeexercised intheselectionofprocessesusedtocreatefinishesonmetalparts. Toxic,restricted,andundesirableheavymetalsmustbeeliminatedfromallsupplychainsourcesandfinishingprocesses.We require that all supplierswhoprovideuswithmetalparts andor finishes, regardlessofwhether theseparts are nominated or not, and regardless of where the supplier resides in the supply chain, to request,obtain,andmaintainaccuraterecordsofallrawmaterialcertificatesofconformance,certificatesofanalysis,specifications,andanyandallotherrecordspertainingtothecontentandlimitsofoffspecelementsinsourcemetalsandthefinishedpartsthatareultimatelyincorporatedintoourproducts.Similarly,asitrelatestotheprocessesusedinapplyingfinishestometalparts,werequireoursuppliersandtheir suppliers in turn to create andmaintain accurate records of all process input chemistries used in theapplicationoffinishestometalpartsusedinourproducts.Should banned heavy metals be found we require our suppliers to determine the root cause of thecontaminationandimplementcorrectiveactionsinordertoeliminatethemfromthesupplychain.13.GuidanceonPhthalatesSimply,phthalatesareharmful substancesandarebanned inallBurtonproducts. We requireall suppliersprovideuswithproofandassurancesthatallmaterials(plastics,glues,adhesives,inks,paints,etc.)arefreeofthesesubstances.Shouldphthalate(s)befound,werequireoursupplierstodeterminetherootcauseofthecontaminationandimplementcorrectiveactionsinordertoeliminatethemfromthesupplychain.14.GuidanceonLeadinPaints,Substrates,andSurfaceCoatingsLeadhasbeenabannedsubstanceformanyyears.Yet,itcanstillbeasignificantcontaminantinmanysupplychains.Werequireoursupplierstotakeeveryreasonablemeasuretoeliminateallpotentialsourcesofleadfrom entering our supply chain and finished products.
