BUILD NYC RESOURCE CORPORATION PUBLIC HEARINGS The Build NYC Resource Corporation (the “Corporation”) is a not-for-profit local development corporation organized under Sections 402 and 1411 of the Not-for-Profit Corporation Law of the State of New York. In accordance with the aforesaid law, and pursuant to its certificate of incorporation, the Corporation has the power to issue non-recourse revenue bonds and to make the proceeds of those bonds available for projects that promote community and economic development in The City of New York (the “City”), and to thereby create jobs in the non-profit and for-profit sectors of the City’s economy. The Corporation has been requested to issue such bonds for the financings listed below in the approximate dollar amounts respectively indicated. As used herein, “bonds” are the bonds of the Corporation, the interest on which may be exempt from local and/or state and/or federal income taxes; and, with reference to the bond amounts provided herein below, “approximately” shall be deemed to mean up to such stated bond amount or a greater principal amount not to exceed 10% of such stated bond amount. Approximately $8,000,000 tax-exempt note transaction (the “Loan”) for the benefit of The Birch Wathen Lenox School (the “School”), a New York not-for-profit education corporation exempt from federal taxation pursuant to Section 501(c)(3) of the Internal Revenue Code of 1986, as amended, as borrower. Proceeds of the Loan will be used by the School to: (1) refund in whole the outstanding New York City Industrial Development Agency Civic Facility Revenue Bonds (The Birch Wathen Lenox School Project), Series 2004, in the original aggregate principal amount of $15,750,000 (“Series 2004 Bonds”), the proceeds of which were used to provide for (i) the improvement and equipping of an existing approximately 38,806 square foot building located at 210 East 77th Street, New York, New York, including (a) the construction of an addition to accommodate a new soundproof gymnasium, (b) the expansion of the rear of the existing building to house an improved and enlarged auditorium and (c) the expansion of the east and west sides of the existing building to provide additional air circulation and a fire escape, all for use by the School as classrooms, auditorium and gymnasium space and for other related facilities and (ii) certain costs incidental and related to the issuance of the Series 2004 Bonds and (2) pay certain costs incidental and related to the Loan. The financial assistance proposed to be conferred by the Corporation will consist of such tax-exempt financing and exemption from City and State mortgage recording taxes. Pursuant to Internal Revenue Code Section 147(f), the Corporation will hold a public hearing on the proposed financings described hereinabove at the offices of the New York City Economic Development Corporation (“NYCEDC”), located at 110 William Street, 4th Floor, New York, New York 10038, commencing at 10:00 A.M. on Thursday, January 9, 2014. Interested members of the public are invited to attend. The Corporation will invite comments at such hearing on the proposed financings. In addition, at such hearing the Corporation will provide the public with an opportunity to review the financing application and the cost- benefit analysis for each of the proposed financings. In order to carry out the purposes and provisions of thisResolution, the #uses# of #buildings or other structures# andthe open #uses# of #zoning lots#, or portions thereof, havebeen classified and combined into Use Groups. A briefstatement is inserted at the start of each Use Group todescribe and clarify the basic characteristics of that UseGroup. Use Groups 1, 2, 3, and 4 and 6, including each #use#listed separately therein, are permitted in #ResidenceDistricts# only as indicated in Sections 22-11 to 22-14 22-15,inclusive.

The following chart sets forth the Use Groups permitted inthe #Residence Districts#.

* * *Whenever a #use# is specifically listed in a Use Group andalso could be construed to be incorporated within a moreinclusive #use# listing, either in the same or another UseGroup, the more specific listing shall control.

Chapter 2 Special Regulations Applying in the Waterfront Area

* * *62-50GENERAL REQUIREMENTS FOR VISUAL CORRIDORSAND WATERFRONT PUBLIC ACCESS AREAS

* * *62-52Applicability of Waterfront Public Access AreaRequirementsWaterfront public access shall be provided for all #waterfrontzoning lots# with a #lot area# of at least 10,000 square feetand a #shoreline# of at least 100 feet that are #developed#,and for all #developments# on #floating structures#, inaccordance with the provisions of the following Sections:

* * *(b) #Waterfront public access areas# required in

conjunction with the following #developments#shall be subject to the minimum #waterfront publicaccess area# set forth in the table in Section 62-57and the requirements of Section 62-58 (Requirementsfor Water-Dependent Uses and Other Developments):

(1) #developments# comprised #predominantly#of the following WD #uses#: docks for non-commercial pleasure boats, ferries,sightseeing, excursion or sport fishingvessels, #boatels# or commercial beaches;

(2) #developments# on #piers# or#platforms# that involve existing#buildings or other structures# that areeither New York City-designatedlandmarks or have been calendared forconsideration, or are listed or eligible tobe listed in the National or New YorkState Registers of Historic Places; or

(3) changes of #use# or #extensions# within#buildings# existing on October 25, 1993,which involve, in aggregate, an amount of#floor area# that is less than 30 percent ofthe maximum #floor area# permitted onthe #zoning lot# for either #commercial#or #residential use#, whichever is greater.

In Community District 1 in the Borough of Brooklyn, on#zoning lots# with #developments# comprised exclusively ofdocks for ferries with a vessel capacity of up to 399passengers, and #accessory# amenities for such dockingfacilities, such #zoning lots# shall be exempt from thewaterfront public access requirements of this Section,provided that such docking facilities are certified by theChairperson of the City Planning Commission, pursuant toSection 62-813 (Docking facilities for ferries or water taxis incertain waterfront areas). However, for any subsequent#development# on such #zoning lot# that is not comprisedexclusively of docks for ferries, the public accessrequirements of this Section shall apply, and any publicaccess exemptions for such docks for ferries shall no longerapply.

* * *62-60DESIGN REQUIREMENTS FOR WATERFRONTPUBLIC ACCESS AREAS

* * *62-611Permitted obstructions #Waterfront public access areas# shall be unobstructed fromtheir lowest level to the sky except that the obstructionslisted in this Section shall be permitted, as applicable.However, no obstructions of any kind shall be permittedwithin a required circulation path.

(d) In Community District 1 in the Borough of BrooklynIn Community District 1 in the Borough ofBrooklyn, any amenity #accessory# to dockingfacilities for ferries or water taxis shall beconsidered a permitted obstruction only where suchamenity is certified by the Chairperson of the CityPlanning Commission in conjunction with thedocking facility, pursuant to Section 62-813(Docking facilities for ferries or water taxis incertain waterfront areas).

* * *62-63Design Requirements for Public Access on Piers andFloating Structures

62-631Design requirements for public access on piersThe design requirements of this Section shall apply to#waterfront public access areas# on #piers#, pursuant toSection 62-54.

(a) Circulation and accessAt least one circulation path having a minimumclear width of ten feet shall be provided throughoutthe public access area required on the #pier#.

(b) Permitted obstructionsIn addition to permitted obstructions pursuant toSection 62-611, #pier# public access areas mayinclude one freestanding open or enclosed publicpavilion, provided such structure does not exceedone #story#, is no taller than 30 feet and has anarea no larger than 1,600 square feet. At least 50percent of the perimeter wall area on all sides, upto a height of 15 feet, shall consist of clear or glazedmaterials which may include #show windows#,glazed transoms, glazed portions of doors orlatticework. Such structures shall be exempt from#building# spacing requirements on #piers#provided they maintain a spacing of at least 12 feetfrom other #buildings# and from any water edge ofthe #pier#, except that when a #pier# is 30 feet orless in width, a pavilion may abut one water edge.

In Community District 1 in the Borough ofBrooklyn, any amenity #accessory# to dockingfacilities for ferries or water taxis shall beconsidered a permitted obstruction only where suchamenity is certified by the Chairperson of the CityPlanning Commission in conjunction with thedocking facility, pursuant to Section 62-813(Docking facilities for ferries or water taxis incertain waterfront areas).

(c) SeatingAt least one linear foot of seating is required forevery 100 square feet of #pier# public access area,subject to the provisions of paragraphs (a) through(d) of Section 62-652.

62-81Certifications by the Chairperson of the City PlanningCommission

* * *62-813Docking facilities for ferries or water taxis in certainwaterfront areas

In Community District 1 in the Borough of Brooklyn, dockingfacilities for ferries or water taxis set forth in paragraph (a)of this Section shall be permitted, provided that theChairperson of the City Planning Commission certifies to theCommissioner of the Department of Buildings that suchdocking facilities comply with the standards for requiredamenities set forth in paragraph (b) of this Section and,where provided, the standards for permitted amenities setforth in paragraph (c) of this Section. In conjunction withsuch certification, parking and drop-off and pick-up arearequirements for docking facilities with a vessel capacity ofup to 399 passengers shall be waived, as applicable. Wheresuch docking facilities are proposed within a #waterfrontpublic access area#, such docking facilities shall also complywith the provisions of paragraph (d) of this Section. Wheremodifications to a docking facility certified pursuant thisSection are made, including the amount or configuration ofdocking facility amenities, establishment of, or modificationto, #waterfront public access areas# on the same #waterfrontzoning lot#, or the cessation of ferry or water taxi service tosuch docking facility, the provisions of paragraph (e) of thisSection shall apply.

The amount of amenities permitted or required pursuant toparagraphs (b) and (c) of this Section shall be calculated foreach docking facility on the #waterfront zoning lot# and notaccording to the number of vessels a single docking facilitycan accommodate.

(a) Docking facilitiesThe following docking facilities are subject to thecertification provisions of this Section:

(1) docks for water taxis, with a vesselcapacity of up to 99 passengers, as listedin Use Group 6C, when located within R6through R10 Districts, or C1, C2, C4, C5,C6 or C8 Districts, and as listed in UseGroup 14A, when located in C2, C3, C7 orC8 Districts and #Manufacturing Districts#;

(2) docks for ferries, other than #gamblingvessels#, with a vessel capacity of up to399 passengers, as listed in Use Group6C, when located within R6 through R10Districts or C1, C2, C4, C5, C6 or C8Districts, and as listed in Use Group 14A,when located in C2, C3, C7 or C8 Districtsand #Manufacturing Districts#; and

(3) docks for ferries with an unlimitedcapacity, as listed in Use Group 10A, inC4, C5, C6, C8 Districts and#Manufacturing Districts#.

(b) Required amenitiesPassenger queuing space, bicycle parking and atrash receptacle shall be provided in accordancewith the applicable provisions of this paragraph,(b), inclusive. All applications shall include a siteplan denoting the location of each requiredamenity, dimensioned plans and elevations ofindividual amenities, as applicable, as well as anyother material required to demonstrate compliancewith such provisions.

(1) Passenger queuing spacePassenger queuing space shall beprovided in accordance with the provisionsof this paragraph, (b)(1), inclusive.

(i) AmountA minimum of four square feetof queuing space per passengershall be provided on the#waterfront zoning lot# for 40percent of the U.S. Coast Guardcertified passenger capacity ofthe largest vessel proposed todock at such facility. Queuingspace may be either standingspace or seating space, and maybe either open to the sky orprovided within a shelteredspace for passengers inaccordance with the provisionsof paragraph (c)(1), inclusive, ofthis Section.

(ii) Standing spaceAll standing queuing space shallbe contiguous and clear ofobstructions, except for anyinterruption by circulationpaths required for access todocking facilities through agangway, or pier access thereto.However, such standingqueuing space may be non-contiguous and temporarydividers may be permitted asobstructions within suchqueuing space where theapplicant signs an affidavit, orprovides materials demonstratingin a manner that is satisfactoryto the Chairperson, that anattendant will manage queueswhenever such measures areimplemented.

(iii) Seating spaceA minimum of ten percent ofrequired queuing space shall beprovided as seating, and up to50 percent of required queuingspace may be provided asseating. However, no seatingshall be required within apreviously approved#waterfront public access area#.For the purpose of applyingseating towards the queuingrequirement, one linear foot ofseating shall equal one squarefoot of queuing space.

All seating provided for queuingspace shall comply with theapplicable dimensional criteriaof Section 62-652 (Seating), butneed not comply with thepercentage requirements fordifferent types of seatingrequired pursuant to suchSection. However, moveablechairs shall not constituteseating for queuing.

Any seating space providedpursuant to this Section withinan existing or proposed#waterfront public access area#shall not count towards themaximum amount of seatingpermitted to be located seawardof the #shore public walkway#pursuant to paragraph (b) ofSection 62-62 (DesignRequirements for Shore PublicWalkways and SupplementalPublic Access Areas).

(iv) LocationQueuing space shall be providedon the #waterfront zoning lot#within 150 feet of the landwardterminus of the gangwayleading to the docking facility.

(2) Bicycle parkingBicycle racks sufficient to provide at leastfour bicycle parking spaces shall beprovided on the #waterfront zoning lot#.Such bicycle racks shall comply with thestandards of Section 62-657.

(3) Trash receptacleOne trash receptacle shall be provided onthe #waterfront zoning lot# within 25 feetof the landward terminus of the gangwayleading to the docking facility. Such trashreceptacle shall comply with thestandards of Section 62-658.

(c) Permitted amenitiesPassenger queuing shelters and ticketing machinesmay be provided only in accordance with theapplicable standards of this paragraph, (c), or,where applicable, the authorization provisions setforth in Section 62-824 (Modifications to passengerqueuing shelters for ferry or water taxi dockingfacilities).

All applications shall include a site plan denotingthe location of such amenities, dimensioned plansand elevations of individual amenities, as well asany other material required to demonstratecompliance with the following standards:

(1) Passenger queuing shelter Where provided, passenger queuingshelters shall comply with the provisionsof this paragraph, (c)(1), inclusive. Allheights are measured from adjoininggrade.

(i) Maximum dimensions andpermitted enclosing wallsThe maximum height of ashelter shall be ten feet. Below aheight of seven feet, themaximum width shall be fourfeet, and above a height of sevenfeet, the maximum width shallbe eight feet. The maximumlength of a shelter shall notexceed 16 feet, except thatwhere a ticketing machineprovided pursuant to paragraph(c)(2) of this Section is locatedwithin such shelter, suchmaximum length may beincreased to 20 feet.

Shelters shall be permitted atotal of three enclosing walls,one along the long dimension ofthe shelter, and one along eachnarrow end.

(ii) Support structures below the roofA maximum of two verticalcolumns may support theenclosing walls and the roof of ashelter, except that where aticketing machine providedpursuant to paragraph (c)(2) ofthis Section is located withinsuch shelter, an additionalcolumn shall be permitted. The

maximum width and depth ofsuch columns shall not exceedtwelve inches. All such columnsshall be aligned so that whenviewed in elevation view alongthe narrow end of the shelter,only one column shall be visible.

Below a height of 30 inches, onehorizontal structural elementshall be permitted along thelong dimension of the shelter.The maximum depth and heightof such structural element shallnot exceed twelve inches.Between a height of 30 inchesand seven feet no horizontalstructural elements shall bepermitted, and above a height ofseven feet, horizontal structuralelements shall be consideredpart of the roof structure.

Additional support structuresneeded to support glazing in theenclosing walls are permitted,provided that such structuresare to the minimum amountnecessary.

(iii) Roof structureThe roof of the shelter, includingall associated structural elementsand materials, shall be locatedabove a height of seven feet.

The maximum depth of the roof,including all associatedstructural elements andmaterials, shall not exceedtwelve inches, as measuredperpendicular to the roofsurface. In addition, within sixinches of the edge of any portionof the roof that cantilevers overpassenger queuing space, asviewed in elevation along thenarrow end of the shelter, thedepth of the roof shall be limitedto three inches.

No slopes or curves shall bepermitted in the roof along thelong dimension of the shelter.Along the narrow end of theshelter, slopes not to exceedfifteen degrees and curves witha radius of at least ten feet shallbe permitted. Where two slopesare provided, in no event shallboth portions of the roof angledownward from the same point.

(iv) Materials, lighting andpermitted signageOn each narrow end of theshelter, the enclosing wall orassociated vertical supportcolumn may accommodate up tosix square feet of way-findingferry #signs#, with a width notto exceed twelve inches. Inaddition, the enclosing wall onthe long end of the shelter or aface of a ticketing machineprovided in accordance withparagraph (c)(2) of this Sectionmay accommodate up to sixsquare feet of materials relatedto ferry operations, includingmaps and schedules of ferryservice. No #advertising signs#shall be permitted.

All structural elements shall becomposed of unpainted, metallicmaterials. The entire surfacearea of all enclosing walls shallbe composed of untinted,transparent materials, exceptfor transparency distractionmarkers and any supportstructures or signage permittedpursuant to this paragraph,(c)(1). A minimum of 50 percentof the surface area of the roofshall be composed of translucentmaterials, except that anyportion occupied by solar panelsshall be excluded from suchcalculation. Benches providedwithin a shelter shall eithermatch or complement suchshelter materials.

Where lighting is providedwithin a shelter, the luminaireshall be shielded so the lightsource is not visible.

(v) Location and orientationShelters shall be provided onthe #waterfront zoning lot#within 100 feet of the landwardterminus of the gangwayleading to the docking facility.

The long dimension of theshelter shall be oriented so as tobe within 15 degrees of beingperpendicular to the shorelineor, where located on a pier,within 15 degrees of beingparallel to such pier.

Where a shelter is providedwithin a previously approved#waterfront public access area#,the Chairperson may modify thelocation and orientationprovisions of this Section, to theminimum extent necessary,where site limitations wouldmake compliance with suchprovisions infeasible.

(2) Ticketing machinesTicketing machines provided inconjunction with a docking facility shallcomply with the provisions of thisparagraph, (c)(2).

(i) Maximum square footageThe maximum area of all ticketmachines, as measured in planaround the furthest extent ofsuch machines, shall not exceed12 square feet.

(ii) LocationTicketing machines shall beprovided on the #waterfrontzoning lot# within 100 feet ofthe landward terminus of thegangway leading to the dockingfacility.

Where a passenger queuingshelter is provided inconjunction with the ferry orwater taxi docking facilitypursuant to paragraph (c)(1) ofthis Section, ticketing machinesshall be located either within, orimmediately adjacent to theupland portion of such shelter.

Any ticketing machine notplaced within a passengerqueuing shelter shall be placedin a location open to the sky.

Ticketing machines shall eitherfront directly upon a requiredcirculation path or shall beconnected thereto by a walkwaywith an unobstructed minimumclear width of at least five feet.

Where a ticketing machine isprovided within a previouslyapproved #waterfront publicaccess area#, the Chairpersonmay modify the locationprovisions of this Section, to theminimum extent necessary,where site limitations wouldmake compliance with suchprovisions infeasible.

(d) Provisions for adding amenities for dockingfacilities to a #waterfront public access area#Docking facilities proposed within a previouslyapproved #waterfront public access area# or inconjunction with a certification for such approval,pursuant to Section 62-811 (Waterfront publicaccess areas and visual corridors), shall complywith the applicable provisions of this paragraph, (d).

(1) Permitted obstructions

In no event shall amenities providedpursuant to paragraphs (b) or (c) of thisSection be permitted to encroach upon theminimum circulation paths requiredpursuant to the applicable provisions ofSections 62-62 (Design Requirements forShore Public Walkways and SupplementalPublic Access Areas), 62-63 (DesignRequirements for Public Access on Piersand Floating Structures), and 62-64(Design Requirements for UplandConnections).

(2) Providing amenities in previouslyapproved #waterfront public access areas#All seating, bicycle parking and trashreceptacles provided for docking facilitiesin accordance with the provisions ofparagraph (b) of this Section, within apreviously approved #waterfront publicaccess area#, shall be provided in additionto the amount of seating, bicycle parking,or trash receptacles required for such#waterfront public access area# pursuantto the applicable provisions of Section62-60 (DESIGN REQUIRMENTS FORWATERFRONT PUBLIC ACCESSAREAS). Where excess seating, bicycleparking or trash receptacles have beenprovided within such previously approved#waterfront public access areas#, suchadditional amenities may be appliedtowards compliance with the provisionsfor docking facilities of this Section,provided that such amenities comply withthe applicable provisions of paragraph (b)of this Section. Where previouslyapproved #waterfront public accessareas# are #non-complying# as to theprovision of required amenities, in noevent shall the minimum amount of

amenity provided for docking facilitiespursuant to paragraph (b) reduce thedegree of #non-compliance# of such#waterfront public access area#.

All seating, bicycle parking and trashreceptacles provided in accordance withthe provisions of paragraph (b) of thisSection in an existing #waterfront publicaccess area# shall either match or shallbe comparable with such existingamenities, with regard to quality,materials, finishes, and form.

Modifications to a previously approved#waterfront public access area# in orderto accommodate amenities to be providedfor a docking facility in accordance withparagraphs (b) or (c) of this Section shallnot constitute a design change to such#waterfront public access area#, and shallnot necessitate a new certificationpursuant to Section 62-811, provided thatthe applicant demonstrates to theChairperson of the City PlanningCommission that such modifications areto the minimum extent necessary in orderto accommodate the amenities beingprovided for such docking facility.

(3) Providing amenities in conjunction with anew #waterfront public access area#All amenities provided for dockingfacilities in accordance with theprovisions of paragraph (b) of this Sectionshall be provided in addition to allrequired seating, bicycle parking, or trashreceptacles for a #waterfront public accessarea# being #developed# in conjunctionwith the provision of a docking facility.All such proposed amenities for thedocking facility shall complement theproposed amenities for such #waterfrontpublic access area#.

(e) Modifications of certified docking facilitiesAny modification to a docking facility certifiedpursuant to this Section, shall comply with theapplicable provisions of this paragraph, (e).

(1) Modification of amenitiesAny modification of the required orpermitted amenities for a docking facilitycertified pursuant to this Section,including the configuration of suchamenities, shall be subject to a newcertification pursuant to this Section.Any ferry or water taxi servicemodification resulting in a reduction ofpassenger capacity of the largest vesseldocking at such facility shall not besubject to a new certification providedthat the amount of queuing spacerequired at the time of approval, pursuantto paragraph (b) of this Section, is notdiminished.

(2) Establishment of or modifications to#waterfront public access areas#Any establishment of a #waterfront publicaccess area# or modification to apreviously approved #waterfront publicaccess area# where a docking facilitycertified pursuant to this Section islocated, shall require a new certification,pursuant to this Section, in conjunctionwith the certification set forth in Section62-811 (Waterfront public access areasand visual corridors).

(3) Cessation of ferry or water taxi serviceWhere ferry or water taxi service ceasesoperations to a docking facility certifiedpursuant to this Section, and ferrydocking infrastructure is removed fromthe #waterfront zoning lot# which wouldpreclude further service, the followingshall apply:

(i) Passenger queuing shelters andticketing machines providedpursuant to paragraph (c) ofthis Section shall be removedfrom the #waterfront publicaccess area#;

(ii) Seating, bicycle racks, and litterreceptacles provided pursuantto paragraph (b) of this Sectionneed not be removed; and

(iii) any breach in a guardrail alonga #pier# or along the #shorepublic walkway# toaccommodate a gangway to adocking facility shall berepaired and shall match theadjacent guardrail.

* * *62-82Authorizations by the City Planning Commission

62-821Modification of requirements for ferries andsightseeing, excursion or sport fishing vessels

(a) In C1, C2, C3 and C7 Districts, the City PlanningCommission may authorize modification of the#use# regulations of Section 32-10 (USESPERMITTED AS-OF-RIGHT) in order to allowdocks for ferries with an operational passenger loadgreater than 150 passengers per half hour, or inCommunity District 1 in the Borough of Brooklyn, a

vessel capacity larger than 399 passengers,provided the Commission finds that:

(1) such facility will not create seriouspedestrian or vehicular traffic congestionthat would adversely affect thesurrounding area;

(2) the #streets# providing access to suchfacility will be adequate to handle thetraffic generated thereby; and

(3) such #use# is so located as to draw aminimum of vehicular traffic to andthrough local #streets# in adjoiningresidential areas.

* * *62-824Modifications to passenger queuing shelters for ferryor water taxi docking facilities

In Community District 1 in the Borough of Brooklyn, the CityPlanning Commission may authorize a ferry passengerqueuing shelter exceeding the dimensions set forth inparagraph (c)(1) of Section 62-813 (Docking facilities forferries or water taxis in certain waterfront areas), providedthat the Commission finds that:

(a) the public benefit derived from the proposed sheltermerits the larger dimensions authorized;

(b) the proposed shelter utilizes the design standardsset forth in paragraph (c)(1) of Section 62-813regarding permitted support structures, materials,signage and roof construction to the greatest extentfeasible;

(c) any modification to such provisions of Section62-813 will not unduly limit views from the#waterfront public access area#; and

(d) the design of the proposed shelter will result in aquality structure that complements the #waterfrontpublic access area# or the publicly accessible area ofa #waterfront zoning lot# accommodating the ferryor water taxi docking facility.

62-83Special Permits by the City Planning Commission

* * *62-832Docks for ferries or water taxis in Residence DistrictsIn all #Residence Districts#, except R1 and R2 Districts, andexcept within Community District 1 in the Borough ofBrooklyn, where the certification provisions of Section 62-813(Docking facilities for ferries or water taxis in certainwaterfront areas) shall apply, the City Planning Commissionmay permit docks for ferries or water taxis as listed in UseGroup 6., provided that: As a condition for granting a specialpermit, the Commission shall find that:

(a) such facility will not create serious pedestrian orvehicular traffic congestion that would adverselyaffect surrounding residential #streets#;

(b) such #use# is so located as to draw a minimum ofvehicular traffic to and through local #streets# inthe adjoining residential area;

(c) there is appropriate landscaping along #lot lines# toenable such #use# to blend harmoniously with theadjoining residential area;

(d) #accessory# off-street parking spaces are providedin accordance with Section 62-43 (ParkingRequirements for Commercial Docking Facilities)and the entrances and exits for such #accessory#parking facilities are so located as to not adverselyaffect #residential# properties fronting on the same#street#; and

(e) such #use# will not impair the character or thefuture use or development of the surroundingresidential area.

The Commission may prescribe additional appropriateconditions and safeguards to minimize adverse effects on thecharacter of the surrounding area and to protect#residential# properties which are adjoining or across the#street# from the facility. Such additional conditions andsafeguards may include provisions for temporary parking ofvehicles for passenger drop-off and pick-up, additional#accessory# off-street parking spaces and limitations onlighting and signage.

What rules govern the rulemaking process? DSNY mustmeet the requirements of Section 1043 of the City Charterwhen creating or changing rules. This notice is madeaccording to the requirements of Section 1043 of the CityCharter.

Statement of Basis and Purpose of Proposed Rule

Local Law 69 of 2013 makes original equipmentmanufacturers (“OEMs”) responsible for the lawful recoveryof refrigerants from their refrigerant-containing applianceswhen their appliances are discarded by residents. Despitethis requirement, the Department will continue to provide itsown refrigerant removal program in which OEMs canparticipate for a fee. OEMs can also choose to establish theirown recovery program or participate with other OEMs in arefrigerant recovery program. The fee imposed by this rulewill allow the Department to recover a portion of the programcosts incurred through servicing OEMs’ appliances.

The purpose of the proposed rule is to carry out therequirements of Local Law 69 of 2013 by establishing therequirements for OEMs’ refrigerant recovery programs forappliances that are being disposed of by “residentialgenerators” in the city of New York. “Residential generators”are any person, entity, agency, or institution in the city ofNew York that receives solid waste or recycling collectionservice from the department.

Specifically the proposed rule:● Establishes the registration requirements for

OEMs of refrigerant-containing appliances,● Requires that OEMs indicate whether they plan to

establish their own refrigerant recovery program,participate with other OEMs in a refrigerantrecovery program, or have their appliances servicedby the Department’s refrigerant recovery program,

● Establishes the fee that an OEM must pay ifrefrigerant is removed from an OEM’s appliance bythe department,

● Establishes annual reporting requirements for anyOEM who establishes its own refrigerant recoveryprogram or participates with OEMs in a refrigerantrecovery program, and,

● Establishes violations and fines for failure tocomply with certain requirements of the proposedrule.

DSNY’s authority for these rules is found in sections 753 and1043(a) of the New York City Charter and section 16-485 ofthe New York City Administrative Code.

This proposed rule also repeals the current Chapter 17 ofTitle 16 of the Rules of the City of New York, which relates tothe collection, recycling and reuse of electronic equipment,because the local laws that authorized Chapter 17, LocalLaws 13 and 21 of 2008, were preempted by New York Statelaw through Chapter 99 of 2010. DSNY’s authority for thisrepeal is found in sections 753 and 1043(a) of the New YorkCity Charter.

Section 1. Chapter 17 of Title 16 of the Rules of the City ofNew York, relating to the collection, recycling and reuse ofelectronic equipment, is REPEALED.

§ 2. Title 16 of the Rules of the City of New York is amendedby adding a new Chapter 17 to read as follows:

Chapter 17

RECOVERY OF REFRIGERANTS

§17-01 Definitions. When used in this chapter:

“Appliance” means any device that contains refrigerants andcan be used for household purposes including, but not limitedto, room air conditioners, refrigerators, water coolers, orfreezers.

“Original equipment manufacturer” (“OEM”) means (1) aperson or entity whose brand name appears on an appliancesold, offered for sale or distributed in the city or (2) a personor entity who manufactures or has manufactured anappliance sold, offered for sale or distributed in the city.

“Recover” or “recovery” means to remove refrigerants from anappliance in such a way that the refrigerants are not releasedinto the atmosphere pursuant to subpart F of part 82 of title40 of the code of federal regulations.

“Refrigerants” means any substances consisting in whole orin part of a class I or class II ozone-depleting substance,which are used for heat transfer purposes and provide acooling effect, including, but not limited, tochlorofluorocarbons, hydro-chlorofluorocarbons, or any othersubstitute substance as may be defined by the United Statesenvironmental protection agency. A class I or class II ozone-depleting substance shall be those substances as defined bythe United States environmental protection agency in section602 of the United States clean air act. A “substitutesubstance” shall be any environmental protection agencyapproved replacement for a class I or II ozone-depletingsubstance in a refrigeration or air-conditioning end-use.

“Residential generator” means any person, entity, agency, orinstitution in the city of New York that receives solid wasteor recycling collection service from the department.

“Room air conditioner” means any electrical appliance thathas a compressor, a condenser, an evaporator and a fan tocool and dehumidify the surrounding air and that is capablein ordinary usage of being mounted in a window or through awall.

“Serviced by the department” means the recovery ofrefrigerants by the department from appliances that are setout for department collection in the city of New York.

§17-02 OEM Responsibility for Recovery.

(a) On or after July first, two thousand fourteen, OEMs shallbe responsible for the lawful recovery of refrigerants fromtheir appliances that are disposed of by residential generators.

(b) An OEM may elect to (i) establish its own refrigerantrecovery program, (ii) participate with other OEMs in arefrigerant recovery program or (iii) have its appliancesserviced by the department under the department’srefrigerant recovery program. No program establishedpursuant to paragraph (i) or (ii) of this subdivision mayinclude curbside collection of appliances. All such programsmust comply with applicable federal, state and localregulations regarding the lawful recovery of refrigerants.

§17-03 OEM Registration Requirements.

(a) By July first, two thousand fourteen, OEMs must registerwith the department on a form provided by the department.Such form may be obtained from the department’s website orby written request to:

(b) Such registration shall include:

(1) the name and billing address of the OEM;

(2) a statement indicating whether the OEM has elected to (i)establish its own refrigerant recovery program, (ii)participate with other OEMs in a refrigerant recoveryprogram, or (iii) have its appliances serviced by thedepartment in the refrigerant recovery program providedpursuant to subdivision a of section 16-482 of theAdministrative Code of the City of New York;

(3) a list of all brand names owned by the OEM;

(4) If an OEM has elected to establish or participate in arefrigerant recovery program pursuant to paragraph one ortwo of subdivision b of section 16-481 of the AdministrativeCode of the City of New York, the registration shall alsoinclude:

(i) the name, title and contact information of the persondesignated by the OEM as the liaison for its refrigerantrecovery program;

(ii) a toll-free telephone number and/or the address of awebsite where residential generators may obtain informationregarding the OEM’s refrigerant recovery program; and

(iii) a brief description of the OEM’s refrigerant recoveryprogram.

§17-04 Departmental Refrigerant Recovery Program.

(a) The department shall provide a refrigerant recoveryprogram for appliances set out for department collection byresidential generators who contact the department to arrangefor the department’s recovery of refrigerants. The departmentshall charge OEMs a fee of twenty dollars for each of theirappliances serviced by the department.

(b) The department shall bill OEMs bi-annually forappliances serviced by the department. The department shallprovide OEMs with a statement indicating how manyappliances were serviced by the department. Payment shallbe due no later than 30 days after the date of the bill. Thedepartment shall first seek to bill the OEM whose brandname appears on the appliance sold, offered for sale ordistributed in the city. If the department is unable to find thebrand name, the department shall seek to bill the OEM whomanufactures or has manufactured the appliance sold,offered for sale or distributed in the city.

(c) The department shall provide a list on its website of allOEMs that elect to (i) establish a refrigerant recoveryprogram, or (ii) participate with other OEMs in a refrigerantrecovery program. Such list shall include a toll-free telephonenumber and/or a link to the address of a website whereresidential generators may obtain information regarding theOEMs’ refrigerant recovery program, if such telephonenumber or website address has been provided to thedepartment as required by section 17-03 of this chapter.

§17-05 Annual Reporting.

(a) By July first, two thousand fifteen and annuallythereafter, an OEM who elects to (i) establish its ownrefrigerant recovery program or (ii) participate with otherOEMs in a refrigerant recovery program shall submit to thedepartment an annual report on a form provided by thedepartment. Such form may be obtained from thedepartment’s website or by written request to:

(b) An OEM’s annual report shall include:

(1) a brief description of the OEM’s refrigerant recoveryprogram and any changes thereto;

(2) a listing of the OEM’s current brand names;

(3) the number of appliances by appliance type and the totaltonnage of appliances by appliance type serviced under theOEM’s refrigerant recovery program; and

(4) the volume of refrigerants by refrigerant type recoveredunder the OEM’s refrigerant recovery program.

§17-06 Enforcement.

(a) It shall be a violation of this section for an OEM to fail tosubmit a registration or annual report required by thischapter. Any such violation shall be punishable by a fine oftwo hundred and fifty dollars per violation.

(b) It shall be a violation of this section for an OEM tounlawfully recover refrigerants from appliances that areserviced pursuant to an OEM’s refrigerant recovery program.Any such violation shall be punishable by a fine of fivehundred dollars per violation.

MOTOR VEHICLES BY THE DEPARTMENT

NOTICE IS HEREBY GIVEN in accordance with therequirements of Section 1043 of the New York City Charterand pursuant to the authority vested in the Commissioner ofthe Department of Sanitation by section 753(a) and (b) of theNew York City Charter that the Department adopts thefollowing rule amending the rule governing the impoundmentof motor vehicles by the department. This rule amendsSection 5-08 of Chapter 5 of Title 16 of the Rules of the Cityof New York. The Department published a Notice ofOpportunity to Comment on the proposed rules in the CityRecord on October 7, 2013. On November 8, 2013 theDepartment held a public hearing on the proposed rules.

STATEMENT OF BASIS AND PURPOSE

The Commissioner of the New York City Department ofSanitation is authorized to adopt rules relating to thecleanliness of the streets and the disposal of waste pursuantto section 753 of the New York City Charter. Pursuant to §§ 16-119 (e) of the New York City Administrative Code, theCommissioner is authorized to promulgate rules governingthe impoundment and release of vehicles.

The purpose of the rule amendment is to expand theDepartment’s existing rules governing impoundmentprocedures to cover other applicable violations under Title 16of the New York Administrative Code beyond impoundmentsperformed pursuant to § 16-119 of the Code. Since the initialrules regarding the impoundment of vehicles for violations ofthe illegal dumping law were originally promulgated, thenumber of laws that authorize the Department to impoundvehicles has increased. This rule amendment will update theDepartment’s rules to address additional circumstances inwhich the Department is authorized to impound vehicles.

“Shall” and “must” denote mandatory requirements and maybe used interchangeably in the rules of this Board, unlessotherwise specified or unless the context clearly indicatesotherwise.

Section 1. Subdivision (b) of section 5-08 of Chapter 5 of title 16 of the rules of the city of New York is amended to read as follows:

(b) Redemption Procedure:

(1) Upon impoundment of any vehicle [as provided forby §16-119(e) of the Administrative Code] by the Department,the Commissioner shall notify the owner of such vehicle bycertified mail that such vehicle is being held by theCommissioner. Such notification shall contain a briefdescription of the vehicle, the office at which an application toredeem the vehicle may be made, and a statement as to theapplicable charges, fees, and penalties due.

(2) [Whenever] Except as specifically providedotherwise by law, whenever the Department impounds anyvehicle [as provided for by §16-119(e) of the AdministrativeCode], such vehicle shall not be released until the vehicleowner has complied with the following:

(i) submitted proof to the Commissioner, including butnot limited to the registration for such vehicle issued by theappropriate agency, establishing to the Commissioner’ssatisfaction his or her identity as owner of the vehicle;

(ii) paid the prevailing removal charge and storagecharge as specified in the notification set forth in paragraph(1) of this subdivision for each day or fraction thereof of theimpoundment of such vehicle. The storage charge shall befifteen dollars ($15.00) for each of the first two days, and tendollars ($10.00) for each additional day thereafter;

(iii) where the vehicle is impounded pursuant to §16-119(e) of the Administrative Code, paid a fee of two hundreddollars, or posted a bond or letter of credit in such amount, aspayment or partial payment of cleaning costs for the illegallydumped material. If the Department estimates that itscleaning costs will be more than two hundred dollars, theDepartment may require as a condition of releasing thevehicle that such estimated costs be paid, or that a bond orletter of credit in the amount of such estimated costs beposted, as a condition of releasing the vehicle, provided theowner of the vehicle is notified of the estimated cleaning costsand the basis for such costs in the notification set forth inparagraph (1) of this subdivision. If the Department incursno cleaning costs, or its actual costs are less than the amountcollected by the Department pursuant to this subparagraph,the Department shall reimburse the owner and/or operatorany amount collected in excess of the Department’s actualcosts. If the Department’s actual cleaning costs are morethan the amount paid pursuant to this subparagraph, theowner and/or operator shall be liable for such additional costsas provided for in §16-119(e) of the Administrative Code.

Such cleaning costs shall be determined by the total of thefollowing charges: (A) hourly wages paid to those employeesof the Department, including supervisory personnel, for thetime actually expended in cleaning, and removing anddisposing of the illegally dumped material from the property;(B) costs for the disposal of the illegally dumped materialactually removed from the property by Departmentemployees and that is delivered to and received at aDepartment disposal facility, or another facility that acceptssolid waste for the purpose of subsequent transfer to anotherlocation for disposal, including the cost incurred by theDepartment to export the illegally dumped material fordisposal out of the City at the time such material wasremoved from the property, as such cost is fixed contractuallybetween the Department and a vendor providing exportservices to the Department; and (C) vehicle and equipmentcharge for any Department vehicle and equipment used toclean and remove the illegally dumped material determinedby the fair market rental value of a comparable vehicle orequipment.

(iv) exhibited proof to the Commissioner that the ECBproceedings against the owner and operator, if the operatordoes not also own the vehicle, have been disposed of and thatapplicable penalties, if any, have been paid, or that a bond inthe amount of Seven Thousand Five Hundred Dollars($7,500) has been deposited with the ECB as security for thepayment of any penalty prior to the final disposition of theECB proceedings.

(v) Notwithstanding the provisions of this paragraph,the Commissioner may, in his or her discretion, waiverequirements for payment of the removal charge, storage feeand/or cleaning costs prior to release of the vehicle wheresuch vehicle is owned by a rental or leasing company and noviolation was issued to such company [pursuant to §16-119 ofthe Administrative Code] or, if a violation was issued, thecompany has submitted proof that the violation was disposedof in the company’s favor.

(3) Upon compliance with all of the provisions ofparagraph (2) of this subdivision, the Commissioner shallissue a redemption form authorizing the person in whosename it has been issued to redeem his or her vehicle.

(4) Procedure for Refund of Charges and Fees. In theevent that [an owner and operator have been found not guiltyof violating §16-119 of the Administrative Code] anyunderlying notices of violation issued to the owner oroperator leading to the impoundment of the vehicle aredismissed by the ECB, then such owner shall be entitled to arefund of any [money] fees paid to the Department or anyagent of the Department under these rules upon writtendemand to the Department or agent of the Department,setting forth the amount claimed, the dates upon which suchamounts were paid and furnishing a copy of the ECBdecision[. In], provided however, that in the event that theowner has been found not [guilty of violating §16-119 of theAdministrative Code] liable for the underlying violationleading to the impoundment of the vehicle but the operatorhas been found [guilty of violating such section] liable forsuch violation, the owner shall not be entitled to a refund ofsuch [money] fees.

(5) Failure to Redeem Impounded Vehicles. Anyvehicle (other than a vehicle for which a forfeiture proceedinghas been commenced pursuant to paragraph (2) ofsubdivision (e) of §16-119 or paragraph (4) of subdivision (d)of § 16-464 of the Administrative Code) which is notredeemed and removed from City property pursuant toparagraphs (1), (2) and (3) of this subdivision within 10 daysfollowing the making of a request by the Commissioner’srepresentative to remove it shall be deemed to be anabandoned vehicle pursuant to §1224 of the Vehicle andTraffic Law and shall be disposed of by the Commissionerpursuant to such Law. Such request shall be sent by certifiedor registered mail, return receipt requested, to the registeredowner of the vehicle, at the address contained on theregistration of such vehicle.

WATER STREET CORRIDOR STREETSCAPE IMPROVEMENTS – Request forProposals – PIN# 4848-2 – DUE 02-03-14 AT 4:00 P.M. – NYCEDC is seeking a consultant orconsultant team to implement streetscape improvements on Water Street in lower Manhattan.The design shall provide for intersection improvements; right-of-way bioswales and treeplantings; and improvements to Whitehall Plaza, Coenties Slip Plaza, Goveurneur Lane Plaza,and Moore Street. The project site is located along Water Street from Whitehall Street toFulton Street in lower Manhattan.

NYCEDC plans to select a consultant on the basis of factors stated in the RFP, which include,but are not limited to: the quality of the proposal, experience of key staff identified in theproposal, experience and quality of any subcontractors proposed, demonstrated successfulexperience in performing services similar to those encompassed in the RFP and theconsultant’s proposed design schedule.

This project has Minority and Women Owned Business Enterprises (“M/WBE”) participationgoals and all respondents will be required to submit an M/WBE Sub-Contractors ParticipationPlan with their response.
