This has reference to your letter no. CEjMSRDCjA'BADjEnvironmental Clearancej 1328 dated 01.08.2017, SUbmitting the aboveproposal to this Ministry for grant of Environmental Clearance in term of theprovisions of the Environment Impact Assessment (EIA)Notification, 2006under the Environment (Protection) Act, 1986.

2. The proposal for Development of Access Controlled Nagpur-MumbaiExpressway from Jalna-Buldana district Boarder to Aurangabad-Nashikdistrict Boarder by Mj s Maharashtra State Road Development Corporation(MSRDC)Ltd., was considered by the Expert Appraisal Committee (EAC)forInfrastructure, CRZ and other Miscellaneous projects, in its meetings heldon 8th September, 2017 and 29th November, 2017.

3. The details of the project, as per documents submitted by projectproponent, and also as informed during the above said EAC meetings withthe help of EIA Consultant Louis Berger, Gurgaon, Haryana, are reported tobe as under:

(i)' Development of Access Controlled Nagpur-Mumbai Expressway fromNhava village, Jalna Taluka, Jalna District (Border) to Surala village,

Vaijapur Taluka, Aurangabad District (Border) Package III IIIAurangabad Division of 155 km length in the state of Maharashtra) byM/ s MSRDCLimited.

(ii) This is Greenfield alignment and will reduce travel time, fuelconsumption, vehicle operation and maintenance cost in comparisonto the existing alternatives. It IS planned to develop newindustrial/ educational/ commercial/ tourism nodes In vicinity ofexpressway at a regular interval of 40-50 km.

(iii) There is 26.877 ha of forest land. The State Government has givenrecommendation for the diversion of this forest land.

(iv) Total 399 numbers of trees in forest area and 21,627 numbers oftrees/ shrubs in Non-forest area are going to be affected by the projectin entire length. All the felled trees will be compensated as per rules.

(v) Three tier (rows) plantation shall be carried out on each side of theexpressway except the locations where it is not feasible. In the medianshrubs and flowing plants will be planted which will enhance theecology of the area.

(vi) Around 350 KLDwater per day will be required and the contractor willbe procure from the multiple resources like river, ponds, water storedin quarries and underground resource after obtaining duepermissions/ approval from concern authorities.

(vii) Mobile Sewage Treatment Plant will be installed in Camp for treatmentof waste water generated from the labour camps. Recycled water willbe used for irrigation purpose within same area.

(viii) Waste generated from the construction activities will be recycled andused for embankment filling. No hazardous waste will be generated.

(ix) Aerial distance of project site from nearest Protected Area, i.e.,Jaikawadi WildlifeSanctuary is 30 km.

(x) It is not located within 10 km of any Eco Sensitive areas.

(xi) Investment/Cost: The total cost of the project is Rs. 4,704.90 crores.

(xii) The project was accorded ToR vide letter No. 10-41/2016-IA.III dated17thAug 2016.

(xiii) Public Hearing was held on Jalna district 3rd May, 2017 andAurangabad district 6thMay 2017.

(xiv) Benefits of the project:

(a) Implementation of entire project will ensure fast and safe roadtraffic 'movement, reducing travel time to half by achievingspeed of 150km/hour for motor vehicles.

(b) Creation of commercial nodes for multiple development mainlyin industrial, commercial, agricultural, tourism sectors resultingin to employment generation, capacity building as well asconnectivity between industrial places like Butibori, Amravati,Jalna, Chikalthana, Shendra, Waluj, Sinnar to Mumbai, andtourist and religious places at Karanja, Lonar, Sindkhedraja,Verul, Shirdi.

(c) Development of all three regions; Kokan, Marathwada andVidarbha of the Maharashtra state.

(xv) Submitted certificate from QCIjNABET as accredited consultantorganization and self-declaration of EIA consultant organization andexperts involved in preparation of EIAjEMP report.

(xvi) Informed that application for NOC was submitted to theArchaeological Survey of India. It was also informed thatArchaeological monuments are more than 300 m away from theproposed site.

(xvii) Also submitted the justification for choosing selected alignment optionout of four options, which were presented before EAC.

(xviii) Informed that there was a typographical mistake regarding diversionof agriculture land. Total land required for the project 2349.46 ha.

(xix) Submitted Air and Noise Quality Modelling details in tabular form likebase line values, incremental values due to prediction and total valuesat all Air and Noise Monitoring Stations well within the prescribedlimits.

(xx) Submitted the tr-afficdensity study on the proposed Expressway.

(xxi) Submitted details of public hearing issues raised along with thecommitments made by the proponent and time bound action plan.The issues raised include compensation with regard to landacquisition, protection of Nahar-E-Amber channel at Palshi village,obstruction to cross drainage, water flowj supply, tree cutting andplantation.

(xxii) MSRDC Ltd. proposes to use abandoned quarry locations to storewater for construction use. For this, existing abandoned quarries arebeing identified in the vicinity of project site and these quarries shallbe developed for water storage. After completion of project, localcommunity can use these sites for their benefits. It is also informedthat they approached Groundwater Surveys and Development agency(GSDA)to suggest ways for conservation of water.

(xxiii) Informed that 3 tier plantation shall be carried out as per guidelinesfor green highways project by National Green Highways Mission ofNHAI on each side of the expressway at all feasible locations. Inaddition, median plantation shall be carried out as per IRC: SP-21:2009 Guidelines.

(xxiv) Proponent agreed to provide separate budget provision for CSRactivities.

(xxv) Proponent agreed to consult Wildlife Institute of India, Dehradun,regarding mitigation measures in animal crossing areas along theproposed alignment, if any.

4. The EAC, in its 180th meeting held on 29th November, 2017, hasrecommended the project for grant of Environmental Clearance for thedevelopment of the said project, subject to compliance of all genericconditions applicable for such projects, and the additional conditions asmentioned below. As per recommendations of the EAC, the Ministry ofEnvironment, Forest and Climate Change hereby accords EnvironmentalClearance to the project 'Development of Access Controlled Nagpur-MumbaiExpressway from Jalna-Buldana district Boarder to Aurangabad-Nashikdistrict Boarder' by M/ s MSRDC Ltd., under the provisions of the EIANotification, 2006 and subsequent amendments/circulars issued thereon,and subject to the specific and general conditions as under:

PART A - SPECIFIC CONDITIONS

(i) Responsibility for implementation of EC conditions rests with theMSRDCLtd., Government of Maharashtra.

(ii) The proponent needs to obtain necessary c1earance/NOC fromArchaeological Survey of India, if applicable.

(iii) Proponent shall consult Chief Wildlife Warden, Government ofMaharashtra and Wildlife Institute of India, Dehradun, regardingdisturbance to animal movement across the proposed alignment, ifany and the mitigation measures. The report shall be submitted tothe MoEF&CC and concerned regional office within 3 months of theissue of EC.

(iv) The proposal involves diversion of 26.877 ha of forest land, for whichthe proponent shall obtain the stage-I Forest Clearance as requiredunder the forest (Conservation) Act, 1980. Project proponent shallsubmit an undertaking that work on non-forestry land may only beexecuted upto such point (to be selected by the user agency) on either

side of forest land if it is explicitly certified by the user agency that incase approval under the Forest (Conservation) Act, 1980, for diversionof forest land is declined, it is technically feasible to execute theproject along an alternate alignment without involving diversion offorest land. Details of all such stretches along with alternatealignment identified to bypass the forest land should be explicitlyprovided in the proposal seeking approval under the Forest(Conservation) Act, 1980 and the EIA Notification, 2006.

(v) Commencement of work in non-forest land will no! confer any right onthe user agency with regard to grant of approval under the Forest(Conservation) Act, 1980.

(vi) Effective mitigation measures to be taken to control Air Pollutionduring construction phase.

(vii) Noise barriers to be provided along with the length of the road ashabitation/villages located within 250 m from central line on eitherside from the proposed carriageway and also to ensure that noiselevels do not exceed the prescribed standards.

(viii) No ground water to be used during construction phase.

(ix) Proponent shall carry out 3 tier plantation as per guidelines for greenhighways project by National Green Highways Mission of NHAI oneach side of the expressway at all feasible locations. Wherever it isnot feasible, small 2 feet deep rain water storage tanks with foddergrasses, which provide moisture to the plants in rounds the year andlocal animals can also use it. In addition, median plantation shall becarried out as per IRC: SP-21:2009 Guidelines. For example, in themedian, shrubs and high protein fodder grasses and flowering plantslike Bogenwalia shall be planted which will enhance the ecology of thearea.

(x) Third party monitoring and evaluation of plantation to be carried outby the competent agency engaged by the implementing agency. Themonitoring and evaluation report shall be submitted to MoEF&CCandits concerned regional office.

(xi) Proponent shall submit budget (capital and revenue) allocated for CSRactivities along with the details of activities to MoEF&CC and itsconcerned regional officewithin 3 months of issue of EC.

(xii) Details of CER activities proposed along with budget provision headwise under the CER with emphasis on ecosystem balance, rain waterconservation and ground water rejuvenation considering that the areais drought prone region. An action plan related to plantation of those

species which can retain water and recharge the ground water shouldbe given priority.

(xiii) The proponent shall ensure the rehabilitation to religious structures.

PART - B: GENERAL CONDITIONS

(i) Cut and fill works shall be carried out strictly in accordance with thedesign drawings proposed at the time of appraisal of the project.

(ii) The project proponent shall obtain necessary permission from theowning agencies of water bodies/temple/tanks etc., as applicable,before execution of works.

(iii) The project proponent shall obtain necessary permission from theconcerned State(s) Irrigation Department(s) before drawing water fromthe river sources for the purpose of the proposed construction activity.

(iv) Blasting shall be carried out during fixed hours (preferably during mid-day) or as permitted by the concerned authority. The timing shall bemade known to all the people within 1000 m (200 m for pre-splitting)from the blasting site in all directions.

(v) The fly ash shall be used for the proposed project to comply with theFly Ash Notification, 1999, as amended.

(vi) Rehabilitation of project affected families (PAFs) and payment ofcompensation to PAFs shall be carried out as per the extant policy ofthe Central/State Government, as provided under the law. All theIndian Road Congress (IRC) guidelines wherever applicable may befollowed.

(vii) All entry / exit/ access points on this highway shall be appropriatelydesigned and preferably frozen to avoid traffic congestion andpollution.

(viii) Rain water harvesting including oil and grease trap shall be provided.Water harvesting structures shall be located at every 500m along theroad. Vertical drain type rainwater harvesting structures shall be setup to minimize surface runoff losses of rainwater.

(ix) All the recommendations of the EMP shall be complied in both letterand spirit. All the mitigation measures submitted in the EIA reportshall be prepared in a matrix format and the compliance for eachmitigation plan shall be submitted to MoEF&CC.

(x) Green belt development shall be undertaken as suggested in EMP.

(xi) Sidewalk shall be provided along the bridges.

(xii) The seismic nature of the area shall be taken into account whiledesigning the project.

(xiii) IRC guidelines shall be followed for widening & up-gradation of road.

(xiv) The drain shall be at least 1 m away from the toe of the embankmentof the road adopting IRC guidelines.

(xv) Longitudinal drains shall be provided all along the project road toensure proper drainage of the area. In addition, adequate number ofunder passes and culverts to act as cross drainage structures shallalso be provided.

(xvi) The solid waste generated shall be used for rehabilitating the borrowareas.

(xvii) For providing safety to the crossing animals and avoid road accidentsspeed breakers/rumbled strips shall be constructed at the identifiedlocations of the animal movements. Enough hoardings and signagesshall also be put up for the public and vehicles convenience.

(xviii)Necessary clearance / approval shall be obtained for extraction of sandfrom the rivers.

(xix) The embankments/ slopes and the slopes left after cutting shall beprovided with vegetative growth to avoid soil erosion.

(xx) The hot mix plant shall be located at least 500m away from habitationand on the barren land to avoid its adverse impact on the humanpopulation.

(xxi) For road safety, IRC guidelines in respect of road signages, serviceroads, bus bays, inter-sections, pedestrians crossings, etc. shall bestrictly adhered to.

(xxii) The responses/ commitments made to the issues raised during publichearing shall be complied in both letter and spirit. A hard copy of theaction taken shall be submitted to the MoEF&CC and also to itsconcerned Regional Office.

(xxiii) Beside fulfilling obligations under Corporate Social Responsibilities asper Company's Act, 2013, the proponent has to adhere to thefollowings Corporate Environment Responsibilities:

(a) The Company shall have a well laid down Environment Policyapproved by the Board of Directors.

(b) The Environment Policy shall prescribe for standard operatingprocess/ procedures to bring into focus any infringements/deviation/violation of the environmental or forest norms/conditions.

(c) The hierarchical system or Administrative Order of the companyto deal with environmental issues and for ensuring compliancewith the environmental clearance conditions shall be furnished.

(d) To have proper checks and balances, the company shall have awell laid down system of reporting of non-compliances/violations of environmental norms to the Board of Directors ofthe company and/ or shareholders or stakeholders at large.

(xxiv) Appropriate measures must be taken while undertaking diggingactivities to avoid any likely degradation of water quality.

(xxv) Borrow sites for each quarry sites for road construction material anddump sites must be identified keeping in view the following:

(a) No excavation or dumping on private property is carried outwithout written consent of the owner.

(b) No excavation or dumping shall be allowed on wetlands, forestareas or other ecologicallyvaluable or sensitive locations.

(c) Excavation work shall be done in close consultation with theSoil Conservation and Watershed Development Agenciesworking in the area, and

(d) Construction spoils including bituminous material and otherhazardous materials must not be allowed to contaminate watercourses and the dump sites for such materials must be securedso that they shall not leach into the ground water.

(xxvi) As per MoEF&CC's circular no. J-II013/41/2006-IA.II(I) dated22.09.2008, provision shall be made for supply of kerosene or cookinggas and pressure cooker to the labourers, mobile toilets, mobile STP,safe drinking water, medical health care, Creche and temporarystructures for living during construction phase.

(xxvii) Adequate precautions shall be taken during transportation of theconstruction material so that it does not affect the environmentadversely.

(xxviii) Borrow pits and other scars created during the road constructionshall be properly levelled and treated.

(xxix) The project proponent will set up separate environmentalmanagement cell for effective implementation of the stipulatedenvironmental safeguards under the supervision of a SeniorExecutive.

(xxx) Full support shall be extended to the officers of this MoEF&CCand itsRegional Office by the project proponent during inspection of the

project for monitoring purposes by furnishing full details and actionplan including action taken reports in respect of mitigation ~easuresand other environmental protection activities.

(xxxi) MoEFCC or any other competent authority may stipulate anyadditional conditions or modify the existing ones, if necessary in theinterest of environment and the same shall be complied with.

(xxxii) In the event of a change in project profile or change in theimplementation agency, a fresh reference shall be made to theMoEF&CC.

(xxxiii) The project proponents shall inform the Regional Office concerned aswell as the MoEF&CC, the date of financial closure and final approvalof the project by the concerned authorities and the date of start ofland development work.

(xxxiv) The funds earmarked for environmental protection measures shall bekept in separate account and shall not be diverted for other purpose.Year-wise expenditure shall be reported to MoEF&CC and itsconcerned Regional Office.

5. In addition to above mentioned conditions following general guidelinesare to be adhered:

(i) The above stipulations would be enforced among others under theprovisions of Water (Prevention and Control of Pollution) Act, 1974, theAir (Prevention and control of Pollution) act 1981, the Environment(Protection) Act, 1986, the Public Liability (Insurance) Act, 1991, EIANotification, 2006 and its subsequent amendments. All otherstatutory clearances such as the approvals for storage of diesel fromChief Controller of Explosives, Fire Department, Civil AviationDepartment, the Forest Conservation Act, 1980 and the Wildlife(Protection) Act, 1972 etc. shall be obtained, as applicable by projectproponents from the respective competent authorities.

(ii) Officials from the Regional Office of the Ministry who would bemonitoring the implementation of environmental safeguards should begiven full cooperation, facilities and documents/data by the projectproponents during their inspection. A complete set of all thedocuments submitted to MoEF&CC should also be forwarded to itsconcerned Regional Office.

(iii) In case of any change(s) in the scope, the project would require a freshappraisal by the MoEF&CC.

(iv) The project proponent shall advertise in at least two local Newspaperswidely circulated in the region, one of which shall be in the vernacularlanguage informing that the project has been accorded EnvironmentalClearance and copies of clearance letters are available with the StatePollution Control Board and may also be seen on the website of theMinistry of Environment, Forest and Climate Change athttp://www.envfor.nic.in. The advertisement shall be made withinSeven days from the date of receipt of the Clearance letter and a copyof the same shall be forwarded to the concerned Regional office of theMOEF&CC.

(v) A copy of the clearance letter shall be sent by the proponent toconcerned Panchayat, Zila Parishad/Municipal Corporation, UrbanLocal Body and the Local NGO, if any, from whom suggestions/representations, if any, were received while processing theproposal. The clearance letter shall also be put on the website of thecompany by the proponent.

(vi) A copy of the environmental clearance letter shall also be displayed onthe website of the concerned State Pollution Control Board. The ECletter shall also be displayed at the Regional Office, District Industriescentre and Collector's Office/Tehsildar's office for 30 days.

(vii) The proponent shall upload the status of compliance of the stipulatedEC conditions, including results of monitored data on their websiteand shall update the same periodically. It shall simultaneously besent to the Regional Officeof the Ministry, the respective Zonal Officesof CPCB and the SPCB. The criteria pollutant levels namely; PM10,

PM2.5,S02, N02 (ambient levels as well as stack emissions) or criticalsectoral parameters, indicated for the project shall be monitored anddisplayed at a convenient location near the main gate of the companyin the public domain.

(viii) The project proponent shall also submit six monthly report on thestatus of the compliance of stipulated EC Conditions including resultsof monitored data (both in hard copies as well as by email) to theconcerned Regional Offices of MoEF&CC/ CPCB/ SPCB.

(ix) The environmental statement for each financial year ending 31st Marchin Form-Vas is mandated to be submitted by the project proponent tothe concerned State Pollution Control Board as prescribed under theEnvironment (Protection) Rules, 1986, as amended subsequently, shallalso be put on the website of the company along with the status ofcompliance of EC conditions and shall also be sent to the respectiveRegional Offices of the Ministry/ CPCB/ SPCB bye-mail.

6. This clearance is subject to final order of the Hon'ble Supreme Court ofIndia in the matter of Goa Foundation Vs Union of India in Writ Petition(Civil)No.460 of 2004 as may be applicable to this project.

7. Any appeal against this clearance shall lie with the National GreenTribunal, if preferred, within a period of 30 days as prescribed under Section16 of the National Green Tribunal Act, 2010.

8. The Ministry reserves the right to add additional safeguard measuressubsequently, if found necessary, and to take action including revoking ofthe environment clearance under the provisions of' the Environmental(Protection) Act, 1986, to ensure effective implementation of the suggestedsafeguard measures in a time bound and satisfactory manner.
