SPECIFICATIONS FOR FTZ AC MAINTENANCE & REPAIR SERVICES 1 THE FOREIGN-TRADE ZONE NO. 9 AIR CONDITIONING MAINTENANCE SERVICES SPECIFICATIONS 1.01 SCOPE The purpose of this solicitation is to provide Air Conditioning Maintenance Services to the Foreign-Trade Zone No. 9 facility, including the Homer A.     THE FOREIGN-TRADE ZONE NO. 9 AIR CONDITIONING MAINTENANCE SERVICES

    SPECIFICATIONS 1.01 SCOPE

    The purpose of this solicitation is to provide Air Conditioning Maintenance Services to the Foreign-Trade Zone No. 9 facility, including the Homer A. Maxey International Trade Resource Center (HAM ITRC) and the makai administrative office building (FTZ Makai), both located on Pier 2 at 521 Ala Moana Boulevard, Honolulu, Hawaii 96813. At the HAM ITRC, the CONTRACTOR shall provide air conditioning maintenance services for sixty-one (61) fan coil units, seven (7) condensing units, and two (2) exhaust fans (in restrooms). At FTZ Makai, the CONTRACTOR shall provide air conditioning maintenance services for sixty-four (64) individual air conditioning units, and two (2) fresh air handler units.     Centri Master Exhaust Fan Model: XB090E1 Serial No.: 14A152F1 and 14A1525-2 Installed in 2015 At FTZ Makai Mitsubishi Mr. Slim Split-Zone System, M-Series Model: MSY-A24NA Serial No.: 600-7111 Installed in 2007 Sears Kenmore Room Air Conditioner Model: 580.75151500 Serial No.: 503-TAKK-06525 Installed in 2007 At both HAM ITRC and FTZ Makai, CONTRACTOR shall use Farr 30/30 or equivalent high quality filter where/as applicable, and manufacturer recommended parts and accessories for the repair and maintenance of all systems, equipment, and appurtenances as described above. The CONTRACTOR shall provide services as follows: At HAM ITRC

    1. HAM ITRC Fan Coil Units

    a. Monthly Service

    (1) Clean and clear all drip pans and flush all related condensate drain lines with nitrogen. (Note: The CONTRACTOR may be liable for water damage due to clogged drains.) Install pan tablets, if necessary, to control algae growth;

    (2) Change all disposable air filters at least once a month; use Farr 30/30 or

    equivalent as applicable for the building system ACs and manufacturer recommended filters for LG units;

    (3) Operate equipment to check for proper operations, such as unusual noise

    and vibration; adjust or repair all equipment and controls as required; and

    (4) Certify performance of monthly service; verbally report all discrepancies

    to the FTZ Officer-in-Charge (OIC) and correct said discrepancies as

    soon as possible. Submit for STATE approval a written report within five (5) working days of the services performed to include, but not limited to, any discrepancies found and the corrective action taken.

    b. Semi-Annual Service

    (1) Clean cooling coils of dirt accumulation using nitrogen, high pressure

    air/water, steam, or chemical coil cleaner solution; (2) Check pressure and temperature differential across cooling coils and log

    readings utilizing LG’s service software; (3) Clean supply and return air grilles, registers and diffusers and fresh air

    intake grilles and dampers and repair or replace deteriorated bird screens;

    (4) Secure all loose housing components or seal leaks if found; and (5) Certify performance of semi-annual service; verbally report all

    discrepancies to the FTZ OIC and correct said discrepancies as soon as possible. Submit for STATE approval, a written report within five (5) working days of the services performed to include, but not limited to, any discrepancies found and the corrective action taken.

    2. HAM ITRC Air Cooled Condensing Units

    a. Quarterly Service

    (1) Wash cabinet and coils. Perform cleaning per manufacturer’s

    recommendations for cleaning solutions and methods;

    (2) Submit and certify performance of quarterly maintenance service; verbally report all discrepancies to the FTZ OIC and correct said discrepancies as soon as possible. Submit for STATE approval, a written report within five (5) working days of the services performed to include, but not limited to, any discrepancies found and the corrective action taken.

    b. Semi-Annual Service

    (1) Perform systems analysis by utilizing LG service software. Record

    system for minimum of 30 minutes while running all indoor fan coil units;

    (2) Operate equipment to check for proper operations, such as unusual noise and vibration; adjust or repair all equipment and controls as required; and

    (3) Submit and certify performance of semi-annual maintenance service;

    verbally report all discrepancies to the FTZ OIC and correct said discrepancies as soon as possible. Submit for STATE approval, a written report within five (5) working days of the services performed to include, but not limited to, any discrepancies found and the corrective action taken.

    3. HAM ITRC Exhaust Fans

    a. Quarterly Service

    (1) Check motor controlled and back draft dampers for proper operation;

    lubricate linkage for free movement;

    (2) Lubricate fan motors and bearings;

    (3) Check belt wear and tension; adjust or replace as needed;

    (4) Check sheaves for wear, replace as needed;

    (5) Check fan collar, bearings and shaft for wear, repair or replace as needed;

    (6) Replace air filters where installed; remove and wash intake grilles; and

    (7) Certify performance of quarterly fan maintenance service; verbally

    report all discrepancies to the FTZ OIC and correct said discrepancies as soon as possible. Submit for STATE approval, a written report within five (5) working days of the services performed to include, but not limited to, any discrepancies found and the corrective action taken.

    b. Semi-Annual Service

    (1) Check and clean all fan wheels and housing of dust, dirt, and grease;

    (2) Remove and wash all intake grilles and dampers and repair or replace

    deteriorated bird screens; and

    (3) Certify performance of semi-annual fan maintenance service; verbally report all discrepancies to the FTZ OIC and correct said discrepancies as soon as possible. Submit for STATE approval, a written report within

    five (5) working days of the services performed to include, but not limited to, any discrepancies found and the corrective action taken.

    At FTZ Makai

    4. FTZ Makai Fan Coil Units a. Monthly Service

    (1) Clean and clear all drip pans and flush all related condensate drain lines

    (3) Lubricate and oil all fan and motor bearings and connections of dampers

    and vanes;

    (4) Check all drives for wear and adjust belt tension as needed. Replace belt as required;

    (5) Operate equipment to check for proper operations, unusual noise and

    vibration; adjust or repair all equipment and controls as required; clean up all equipment;

    (6) Check time clock for proper operation and time settings; and

    (7) Certify performance of monthly service; verbally report all discrepancies

    to the FTZ Officer-in-Charge (OIC) and correct said discrepancies as soon as possible. Submit for STATE approval, a written report within five (5) working days of the services performed to include, but not limited to, any discrepancies found and the corrective action taken.

    b. Semi-Annual Service

    (1) Adjust alignment of bearings and sheaves; lubricate fan and motor

    bearings. Replace worn or noisy bearings or sheaves;

    (2) Clean cooling coils of dirt accumulation using nitrogen, high pressure air/water, steam, or chemical coil cleaner solution;

    (3) Check pressure and temperature differential across cooling coils and log readings. Clean strainers, check vents and drains on all chilled water coils;

    (4) Clean supply and return air grilles, registers and diffusers and fresh air

    intake grilles and dampers and repair or replace deteriorated bird screens;

    (5) Secure all loose housing, seal leaks and perform touch-up paint work

    after cleaning any and all rust;

    (6) Check and calibrate all electric temperature controls; and

    (7) Certify performance of semi-annual service; verbally report all discrepancies to the FTZ OIC and correct said discrepancies as soon as possible. Submit for STATE approval, a written report within five (5) working days of the services performed to include, but not limited to, any discrepancies found and the corrective action taken.

    5. FTZ Makai Ventilating Fans (Exhaust)

    a. Quarterly Service

    (1) Check motor controlled and back draft dampers for proper operation;

    lubricate linkage for free movement;

    (2) Lubricate fan motors and bearings;

    (3) Check belt wear and tension; adjust or replace as needed;

    (4) Check sheaves for wear, replace as needed;

    (5) Check fan collar, bearings and shaft for wear, repair or replace as needed;

    (6) Replace air filters where installed; remove and wash intake grilles; and

    (7) Certify performances of quarterly fan maintenance service; verbally

    report all discrepancies to the FTZ OIC and correct said discrepancies as soon as possible. Submit for STATE approval, a written report within five (5) working days of the services performed to include, but not limited to, any discrepancies found and the corrective action taken.

    b. Semi-Annual Service

    6. FTZ Makai Temperature Controls

    Quarterly Service

    a. Check control devices for proper operation, sticking stems and calibrations; repair/replace weak or broken springs and all other parts;

    b. Check automatic dampers for tightness in closing, bent blades and defective

    linkage; lubricate connections for free movement and repair as required;

    c. Adjust thermostat to maintain a comfortable room temperature; and

    d. Certify performance of quarterly maintenance service; verbally report all discrepancies to the FTZ OIC and correct said discrepancies as soon as possible. Submit for STATE approval, a written report within five (5) working days of the services performed to include, but not limited to, any discrepancies found and the corrective action taken.

    7. FTZ Makai Time Clocks

    Monthly Service

    a. Clean contacts, replace if necessary; check and adjust time settings as directed or required; and

    b. Certify performance of monthly maintenance service; verbally report all

    discrepancies to the FTZ OIC and correct said discrepancies as soon as possible. Submit for STATE approval, a written report within five (5) working days of the services performed to include, but not limited to, any discrepancies found and the corrective action taken.

    8. FTZ Makai Two (2) Fresh Air Handler Units

    a. The CONTRACTOR shall inspect the fresh air handler units on a semi-annual basis to ensure that said units are functioning properly;

    b. Wire brush, prime and paint rust from equipment and support surface to

    prevent further rusting; and

    c. Certify performance of valves, equipment and supports; verbally report all discrepancies to the FTZ OIC and correct said discrepancies as soon as possible. Submit for STATE approval, a written report within five (5) working days of the services performed to include, but not limited to, any discrepancies found and the corrective action taken.

    9. FTZ Makai Non-Industrial, Stand-Alone Units

    a. One (1) stand-alone non-industrial AC unit, located in the Operations Supervisor’s Office adjoining the Business Office, Suite 101; and

    b. One (1) Mitsubishi split unit located in the Administrator’s Office, Suite 201.

    Units shall be maintained regularly, on a quarterly basis, to include changing of filters and service check to ensure proper function.

    10. Checklist. The CONTRACTOR shall develop a checklist for each of the activities

    described herein and shall submit the checklist with the respective written report required for each set of activities.

    11. Repair Parts. The CONTRACTOR shall supply all necessary repair parts at the rate

    of cost plus ten (10) percent. A copy of the original invoice for the part must be supplied to the FTZ OIC for review and approval prior to purchase. All repair parts which exceed the annual budgeted amount of FIVE THOUSAND AND NO/100 DOLLARS ($5,000.00) shall be solicited by the FTZ with part specifications supplied by the CONTRACTOR. The FTZ shall acquire the part(s) separate from the Contract and supply the part to the CONTRACTOR for installation.

    12. Service Hours. Unless otherwise specified, services shall be provided between the

    hours of 7:30 a.m. and 2:30 p.m., except on weekends and on State holidays. Workers shall report to the OIC prior to commencement of work and also before leaving the premises. The FTZ hours of operation are until 4:00 p.m. on weekdays, and work should be completed well in advance of this time so the warehouse and office areas can be secured.

    1.04 OFFICER-IN-CHARGE (OIC)

    For the purpose of the Contract, Tsurumi Hamasu, Business Manager of the Foreign Trade Zone No. 9, is the Officer-in-Charge; she may also assign a designated Officer-in-Charge (OIC).

    1.05 TERM OF CONTRACT

    1. Term of Contract

    The services by the CONTRACTOR described herein shall commence upon a written Notice to Proceed. The Contract shall be completed within twelve (12) months of the Notice to Proceed, unless sooner terminated as therein provided. The Contract may be extended without the necessity of rebidding, for up to one (1) additional 12-month period. Any extension(s) shall be mutually agreed upon in writing at least 60 days prior to the expiration date of the Contract, provided the Contract price remains the same or lower than the initial price bid, except for any allowable increase related to increased wages of public employees performing similar work.

    2. Non-Performance of Work or Late Deliveries

    In the event the CONTRACTOR fails, refuses, or neglects to perform the services in accordance with the requirements of any contract awarded under this SOLICITATION, the STATE reserves the right to purchase, in the open market, a corresponding quality and quantity of the services specified herein, and to deduct from any monies due, or that may thereafter become due to the CONTRACTOR, the difference between the prices named in the Contract and the actual cost thereof to the STATE. In the event that any monies due to the CONTRACTOR are insufficient for said purpose, the CONTRACTOR shall pay the difference upon demand by the STATE. The STATE may also utilize all other remedies provided by law.

    1.06 COMPENSATION

    1. Award shall be made to the responsive and responsible Offeror submitting the lowest price.

    2. Payments shall be made only after satisfactory completion of each task or service as

    specified herein. 3. If any work is not in full compliance with these specifications, the CONTRACTOR

    shall make all necessary corrections to the full satisfaction of the STATE and at no additional cost to the STATE. The CONTRACTOR shall perform corrective work within the period allowed by the Officer-In-Charge.

    1.07 QUALITY CONTROL

    1. Liquidated damages. Liquidated damages are fixed at the sum of TWENTY-FIVE AND NO/100 DOLLARS ($25.00) for each and every calendar day the CONTRACTOR fails to perform, in whole or in part, any of his/her obligations specified hereunder. Liquidated damages may be deducted from any payments due or that may thereafter become due to the CONTRACTOR.

    In the event the CONTRACTOR fails, refuses, or neglects to perform the services in accordance with the requirements of this SOLICITATION, the STATE reserves the right to purchase, in the open market, a corresponding quality and quantity of the services specified herein and to deduct from any monies due or that may thereafter become due to the CONTRACTOR, the difference between the prices named in the Contract and the actual cost thereof to the STATE. In the event that any monies due to the CONTRACTOR are insufficient for said purpose, the CONTRACTOR shall pay the difference upon demand by the STATE. The STATE may also utilize all other remedies provided by law.

    2. The CONTRACTOR must assure and be responsible for the continuity of service

    activities in the event of staff illness, medical emergencies, vacancies, or other situations that result in program resources that are less than proposed and contracted for. The CONTRACTOR must not require or depend on STATE staff to provide service activities in the event that program resources are not available due to the above situations.

    3. When a disagreement arises between the CONTRACTOR and the STATE in

    regards to the performance of specific service requirements within the Contract specifications, the wishes of the STATE shall prevail. Failure on the part of the CONTRACTOR to comply shall be deemed cause for corrective action and subject to contractual remedies.

    4. The STATE reserves the right to reduce, amend, or expand the “Scope of Services.”

    1.08 WORK CONDUCT

    1. General. The CONTRACTOR shall perform all services in a safe and efficient manner. The CONTRACTOR shall employ the best industry practices to provide services as specified herein. The CONTRACTOR shall further assure that the performance of work specified herein shall be in complete compliance with any applicable rules and regulations of all federal, state, and local governmental agencies. The CONTRACTOR shall have any contractor, vocational and professional licenses necessary to perform this work.

    2. Work performance. The CONTRACTOR shall be solely responsible for the

    satisfactory completion of all work performed in accordance with the specifications herein.

    Services shall be provided with a minimum of interruption to the regular course of FTZ operations. The CONTRACTOR shall perform all work in a professional manner.

    3. Safe performance of work. The CONTRACTOR shall be required to protect the

    occupants and the general public from any unsafe conditions during the performance of services and/or as a result of the services. The CONTRACTOR shall provide and use safety devices such as barricades, cones, barriers and the like, as required.

    4. Protection of work site and damages. The CONTRACTOR shall exercise care and

    provide all necessary protection to prevent injury and/or damage to any existing site amenities.

    5. Occupational Safety and Health Standards. The CONTRACTOR shall adhere to all

    occupational safety and health standards administered by the State of Hawaii, Department of Labor and Industrial Relations’ Division of Occupational Safety and Health (DOSH), including those pertaining to the use of hazardous chemicals at the job site. These requirements shall include, but not be limited to, the following:

    a. Caution signs shall be provided and displayed at each location where there is

    exposure to toxic materials or harmful physical agents. Labels shall be affixed to all toxic materials or harmful physical agents, or their containers, warning of their potential danger;

    b. The CONTRACTOR shall post information (Material Safety Data Sheet)

    prominently regarding hazards posed by toxic materials or harmful physical agents. The information shall include suitable precautions, relevant symptoms, and emergency treatment in case of overexposure; and,

    c. The CONTRACTOR’s employees who are required to handle or use poisons,

    caustics, and other harmful substances shall be instructed regarding safe

    handling and use, and be made aware of the potential hazards, and of personal hygiene and personal protective measures required.

    1.09 BONDS

    Bid, performance, and payment bonds are not required for this solicitation. 1.10 STATUTORY REQUIREMENTS OF SECTION 103-55, HAWAII REVISED

    STATUTES (HRS)

    Offerors are advised that Section 103-55, HRS, provides that the services to be performed shall be performed by employees paid at wages not less than wages paid to public officers and employees for similar work. Offerors are further advised that in the event of an increase in wages for public employees performing similar work during the periods of the Contract, the CONTRACTOR shall be obliged to provide wages not less than those increased wages. In the event of a wage increase to public employees during the Contract period, the CONTRACTOR shall apply for an increase in the Contract price, including additional cost for those benefits required by statute, i.e., federal old age benefit, workers compensation, temporary disability insurance, unemployment insurance and prepaid public health insurance. The CONTRACTOR shall be further obliged to notify its employees performing work under the Contract of the provisions of Section 103-55, HRS, and of the current wage rates for public employees or the CONTRACTOR may include such notice with each paycheck furnished to the employee.

    SPECIAL PROVISIONS

    2.01 QUOTE PREPARATION 1. Offerors are required to submit their quote on the HIePRO website.

    2. Offerors are requested to submit their quotes using their exact legal name, as

    registered with the State of Hawaii, Department of Commerce and Consumer Affairs. Failure to do so may delay proper execution of the Contract.

    3. Tax Liability. Work to be performed under this SOLICITATION is subject to the

    general excise tax (GET) imposed by Chapter 237, HRS, and, where applicable, to the use tax imposed by Chapter 238, HRS.

    4. Hawaii General Excise Tax License. Offerors shall submit their current Hawaii

    GET I.D on their quote.

    5. Bid Price. The bid price shall include all labor, equipment, and transportation; all applicable taxes; and, any and all other costs to be incurred to provide services as specified herein.

    6. References. The Offeror shall submit at least three (3) references for whom Offeror

    has performed similar services and who can, if necessary, attest to the Offeror’s performance. References not specific to the services described in this SOLICITATION shall not be considered acceptable. It is expressly understood that the STATE reserves the right to seek additional references, and that unfavorable references may be grounds for the rejection of any quote.

    7. Offer Guaranty. A bid security deposit is not required.

    8. Notice of Intent to Bid. Prospective offerors are not required to submit any

    notice of intent to bid.

    2.02 SUBMISSION OF QUOTE Offerors shall submit their quotes on the HIePRO website. 2.03 OFFEROR QUALIFICATIONS

    In addition to meeting the legal and other requirements of this SOLICITATION, OFFERORS must meet these qualification requirements at the time of bidding.

    1. All Offerors shall meet the requirements pursuant to Hawaii Revised Statutes

    (HRS) Chapter 103D-310. This shall be demonstrated by a Certificate of Vendor Compliance from the Hawaii Compliance Express (HCE). Offerors shall have a valid, current compliance certificate in order to be considered a qualified offeror for

    2. All Offerors shall have local office/representative(s) in-place on the island of Oahu,

    as of the offer due date and time. All Offerors shall list contact information for its local office and/or responsible individuals who can be contacted by the STATE on matters concerning this SOLICITATION.

    3. This SOLICITATION is issued under the provisions of Chapter 103D, HRS, and

    Subchapter 3-122, HAR. All Offerors are charged with presumptive knowledge of all requirements of the cited authorities. Submission of a valid, executed quote by any Offeror shall constitute admission of such knowledge on the part of such Offeror.

    2.04 CERTIFICATION OF INDEPENDENT COST DETERMINATION

    By submission of a quote in response to this SOLICITATION, the Offeror certifies as follows:

    1. The costs in this SOLICITATION have been arrived at independently, without

    consultation, communication, or agreement with any other Offeror, as to any matter relating to such costs for the purpose of restricting competition.

    2. Unless otherwise required by law, the costs which have been quoted in any offer

    have not been knowingly disclosed by the Offeror, directly or indirectly, to any other Offeror or competitor prior to the opening of the quotes.

    3. No other attempt has been made or will be made by the Offeror to induce any other

    person or firm to submit or not to submit a quote for the purpose of restricting competition.

    2.05 CANCELLATION OF SOLICITATION AND QUOTE REJECTION

    The STATE reserves the right to cancel this SOLICITATION and to reject any and all quotes, in whole or in part, when it is determined to be in the best interest of the STATE, as provided in Sections 3-122-95 through 3-122-97, HAR. The STATE shall not be liable for any costs, expenses, loss of profits, or damages whatsoever, incurred by the Offeror in the event this SOLICITATION is cancelled or a quote is rejected.

    2.06 AWARD

    All quotes and other material submitted by Offerors become the property of the STATE and may be returned only at the STATE’s option.

    The STATE’s award, if any, will be made within 90 calendar days after the offer due date. Unless extended by mutual agreement, the quote shall remain firm for the 90 day period.

    2.07 DISQUALIFICATION OF QUOTES

    The STATE reserves the right to consider as acceptable only those quotes submitted in accordance with all requirements set forth in this SOLICITATION and which demonstrate an understanding of the scope of services. Any quote offering any other set of terms and conditions contradictory to those included in this SOLICITATION may be disqualified without further notice. Each quote shall be submitted on the HIePRO website in the format prescribed in this SOLICITATION and all portions shall be addressed.

    2.08 AWARD OF CONTRACT

    Award, if made, shall be made to the responsive, responsible Offeror submitting the lowest total quote price. Award shall be contingent on the availability of funds. The STATE reserves the right to cancel this SOLICITATION and/or reject any and all quotes, in whole or in part, when it is determined to be in the best interest of the STATE. The notice of award letter(s), if any, resulting from this SOLICITATION shall be posted on the HIePRO website.

    2.09 EXECUTION OF CONTRACT

    No performance or payment bond shall be required for this Contract. If an award is made, the STATE shall forward to the successful Offeror a formal contract to be signed by the Offeror and returned within ten (10) days or as may otherwise be allowed by the STATE. No work is to be undertaken by the Offeror prior to the official commencement date specified on a formal Notice to Proceed letter issued by the STATE upon execution of the Contract by both parties. The State of Hawaii is not liable for any work, contract, costs, expenses, loss of profits, or any damages whatsoever incurred by the Offeror prior to this official commencement date.

    2.10 NOTICE TO PROCEED

    No work is to be undertaken by the CONTRACTOR prior to the official commencement date specified on the formal Notice to Proceed (NTP). The STATE is not liable for any work, contract, costs, expenses, loss of profits, or any damages whatsoever incurred by the CONTRACTOR prior to this official commencement date.

    2.11 QUOTE AS PART OF THE CONTRACT

    This SOLICITATION and the successful quote will be part of the Contract.

    2.12 PROTEST

    A protest shall be submitted in writing within five (5) working days after the aggrieved person knows, or should have known, of the facts giving rise thereto; provided that a protest based upon the content of the SOLICITATION shall be submitted in writing prior to the date set for receipt of quotes; and further provided that a protest of an award or proposed award shall be submitted within five (5) working days after the posting of award of the Contract. The Notice of Award, if any, resulting from this SOLICITATION shall be posted on the HIePRO website. Any protest pursuant to §103D-701, HRS, shall be submitted in writing to the Department of Business, Economic Development and Tourism, Foreign-Trade Zone No. 9, 521 Ala Moana Boulevard, Suite 101, Honolulu, Hawaii 96813.

    2.13 RESPONSIBILITY OF OFFERORS

    Offerors are advised that prior to award of a contract under this SOLICITATION, Offerors shall furnish proof of compliance with the requirements of HRS 103D-310(c) using the Hawaii Compliance Express (HCE). HCE allows businesses to register online through a simple wizard interface at http://vendors.ehawaii.gov/hce/splash/welcome.html to acquire a “Certificate of Vendor Compliance.” HCE provides current compliance status as of the issuance date. The “Certificate of Vendor Compliance,” indicating that the vendor’s status is compliant with the requirements of HRS Section 103D-310(c), shall be accepted for both contracting purposes and final payment. Vendors will be required to pay an annual fee of $12.00 to the Hawaii Information Consortium, LLC (HIC). The above certificate should be applied for and submitted to the Foreign-Trade Zone Business Office (address and location provided in section 1.03) as soon as possible. If a valid certificate is not submitted on a timely basis for award of a contract, an Offeror otherwise responsive and responsible may not receive the award.

    2.14 CAMPAIGN CONTRIBUTIONS BY STATE AND COUNTY CONTRACTORS

    If awarded a contract in response to this solicitation, Offeror agrees to comply with HRS §11-355, which states that campaign contributions are prohibited from a State or county government contractor during the term of the contract if the contractor is paid with funds appropriated by the legislative body between the execution of the contract through the completion of the contract.

    2.15 PAYMENT

    Section 103-10, HRS, provides that the STATE shall have 30 calendar days after receipt of an invoice or satisfactory performance of the services to make payment. For this reason, the STATE will reject any quote submitted with a condition requiring payment within a shorter period. Further, the STATE will reject any quote submitted with a condition requiring interest payments greater than that allowed by Section 103-10, HRS, as amended. The STATE will not recognize any requirement established by the CONTRACTOR and communicated to the STATE after award of the Contract, which requires payment within a shorter period, or interest payment not in conformance with Section 103-10, HRS.

    2.16 RIGHTS AND REMEDIES FOR DEFAULT

    In the event the CONTRACTOR fails, refuses or neglects to perform the services in accordance with the requirements of any contract awarded under this SOLICITATION and Attachment 4, “General Conditions,” as specified herein, the STATE reserves the right to purchase, in the open market, a corresponding quality and quantity of the goods or services specified herein and to deduct from any monies due or that may thereafter become due the CONTRACTOR, the difference between the price named in the Contract and the actual cost thereof to the STATE. In the event that any monies due to the CONTRACTOR are insufficient for said purpose, the CONTRACTOR shall pay the difference upon demand by the STATE. The STATE may also utilize all other remedies provided by law.

    2.17 INSURANCE

    CONTRACTOR must carry Commercial General Liability insurance in the amount of $1,000,000 combined single limit (per occurrence) for bodily injury and property damage, and $2,000,000 aggregate coverage. Also, the CONTRACTOR must carry automobile contractual liability in the amount of $1,000,000 per vehicle, per accident, and uninsured and underinsured motorist coverage in the amounts of $1,000,000 per person and $1,000,000 per accident. In addition, the CONTRACTOR must carry basic no-fault and personal injury protection insurance in the amount of $1,000,000 property damage per accident.
