No. 713/CB—WHEREAS certain draft of byelawsfor regulation of Job Porters in Lansdowne Cantonment waspublished with the notice of the Lansdowne CantonmentBoard No, 713/46/CB, dated the 29th November 1977 asrequired by section 284 of the Cantonments Act, 1924 (2 of1924), for inviting objections and suggestion till the 28December 1977;
AND WHEREAS the said notice was put on the LansdowneCantonment Notice Board on the 29th November, 1977;
AND WHEREAS no objections or suggestions were receivecfrom the public by the Lansdowne Cantonment Board beforithe said date;
AND WHEREAS, the Central Government have dul>approved and confirmed the said draft of the bye-laws *>required by sub section (1) of section "284 of the said act;

in supersession of the notification of the U.P. GovernmentNo. 2133/XI-28-C, dated the 18th August, 1926, the Lans-downc Cantonment Board hereby makes the following bye-laws, namely :—
Short Title and Commencement
1.(1) These bye-laws may be called the LansdowneCantonment (regulation of Job Porters) bye-laws,1978.
(2) They shall come into force on the date of theirpublication in the official gazette.
Definitions
2. In these bye-laws, Unless the context otherwise requirW,-
(a) "Licensing Officer" means the Executive Officer;
(b) /"Porter" includes any person who carries packages,loads, or works as carrier by the job, and casuallabourer,
(c) "Licensee" means a person duly licenced under thesebye-laws.
Area within wlu'ch a Porter may operate
3. No person shall ply or work for hire as a porter withinthe limits of the Lansdowne Cantonment, unless he has takenout a licence under these bye-laws and such licence is opera-tive under bye-law 9 :
Provided that these bye-laws shall not apply to any porterhired for journey which is commenced beyond the Canton-ment limits.
Application for Grant of Licence
4. Every application for a licence shall be made to theLicencing Officer.
Vowtr to refuse Grant of Licence
5. The Licencing Officci may refuse to grant a licence—
(a) When the applicant is reported by the Police autho-rities to be a suspicious or bad character, or
(b) When the applicant is a p'orson whose licence haswithin the two preceding years been cancelled forbreach of any of these bye-laws.
Price of Metal Badge
6. Every applicant for a licence shall, immediately on theisiuc of a licence to him, pay to the Licencing Officer, a sumof rupee one on account of cost of a metal badge, which shallbe given to him by that Officer, together with a table of thecurrent rates specified under these bye-laws :
Provided that if the actual cost incurred by the Board onthe purchase of the metal badge exceeds rupee one, it mayrevise the said price of metal badge to the extent not exceedingthe actual cost incurred by it on its purchase.
Licence and Metal Badge when to be delivered back
7. Upon the expiration, suspension or cancellation of alicence, the Licensee shall be bound to deliver up to theLicencing Officer his licence and badge. |
Licence Fee
8. The fee payable by each licensee shall be 0.50 paise permonth;
Provided that in the case of a labourer employed by any
contractor, the monthly fee payable shall be recoverablethrough the employer of such labourer.
Currency of Licence
9, A licence shall not be operative—
(a) after the 31st March next following the date fromwhich it is expressed to take effect;
(b) in favour of any person other than the person towhom it has been granted and described in thelicence:
(c) unless the licensee is carrying his badge exposed toview.
Circumstances under which Licence /.t liable to be cancelled
10. Every licence shall be liable to cancellation in any ofthe following events, namely, if the licensee—
(a) is found to have, when applying for his licence,given a false name, parentage, or address or failedto deliver up any licence or badge as required underbye-law 7;
(b) has transferred his licence or badge to any otherperson;
(c) fails to produce his licence or badge for inspectionwhen so required by any Magistrate, Police Officer,the Executive Officer or Revenue Inspector or Sani-tary Inspector of the Board authorised in this behalfby the Executive Officer;
(d) fails, within the next 24 hours, to take to the policestation in-charge thereof, any lost or unclaimedproperty coming into his possession;
(e) without leasonnble cause refuses to hire himself;
(f) uses insulting or abusive language, while under conj
tract of hire.
(g) fails to produce hit. table of rates when required todo so, by any person having occasion to check anyclaim or demand made by him for remuneration; or
(h) without sufficient reason prevents or causes to pre-vent any other licensee from entering into a contractof hire.
Licensee to be given an opportunity of showing cau.re beforecancellation of Licence
11. The Licencing Officer, may, after issuing a show caus*notice and after being satisfied that the cause shown is un-satisfactory or when no cause is shown withini the period speci-fied in the said notice, suspend or cancel a licence which hasbecome liable for cancellation under bye-law 10,
Explanation.—The cancellation of his licence shall be no barto the licensee being prosecuted for any offence punishableunder those bye-laws, which he may have committed.
Appeal against cancellation of a Licence
12. An appeal shall lie to the Board from any order of theLicencing Officer passed under bye-1aw 5 or 11.

14. No porter shall demand, a higher rate of hire than thatspecified in bye-law 13,Pi'iiulty
15. Any contravention of these bye-laws shall be punishablewith fine which may extend to one hundred rupees and in thecase of a continuing contravention, with an additional finewhich may extend to five rupees for every day during whichsuch contravention continues, after conviction for the firstsuch contravention.
