The lndemnity Bond made at Agartala this 30ttr day of November, 2018 Between "The ICFAIsociety" a society registered under the societies Registration Act, 1350 and nowgoverned under the ICFAI University Tripura with its Headquarter located at Agartala:SimnaRoad, Kamalghat, West Tripura-799210 frereinafter referred to as the Association (whichexpression shall, unless it be repugnant to"the context or meaning thereof bq deemed to includeits successois, assigns and persons for the time being having conlrol over its assets and affairs);of the one part and the Universiti Grants Commission a body corporate established andconstituted under the University Grants Commission Act, 1956 hereinafter referred as the'Commission' (which expression shall unle5s it be repugnant to the context or meaning thereof,include its successors and assigns of the other par.t.

Whereas the Association as the owner is conducting Various Educational Programmes at itsCampus at Kamalghat, West Tripura, the University known as hereinafter referred to as the'lCFA| University Tripura".

And whereas the "lCFAl University Tripura" is constituted in 2004 under the provisions of an Act(Tripura Act No. 8 of 2004) passed in Tripura Legislative Assembly which was officially notified byGovernment of Tripura vide a Gazette Notification dated 04-09-2004 hereinafter referred to as thesaid University.

And whereas the Commission in carrying out its objects and functions has sanctioned grants outof its funds to the said University,

And whereas in order to regulate and control the use of the grant that may be made by theCommission to the said University as terms and condltions of the grant, the Commission hasrequired the Association to execute this indemnity bond which the Association has agreed to do.

NOW THIS INDENTURE WITNESSED AND IT IS HEREBY AGREED AND DECLAREDBY AND BETWEEN THE PARTIES HERE TO AS FOLLOWS:

The Association hereby guarantees and covenants with the Commission thatevery amount of grant that will be given by the Commission to the said Universityshall when received by the said University solely be used for the benefit andpurposes of the said University in accordance with the terms and conditions of thegrants and not for any other purpose or any other institution run by the saidAssociation and in the event of any part of the said grant being found to havebeen used by the Associations for any purpose other than the purpose of the saidUniversity or for any other institution run by the Association, the same shall be

refunded by the Association wlthout demur to the Commission on demand. Thedecision of the

Gommission as to the misuse of the amount of grant and as to thequantum of the

amount payable by the Association shall be final and binding on the Association,

The Association further covenants with the Commission that the Association shallfurnish to the Commission the balance sheet of the Association every year

alongwith the annual audited Accounts of the said University managed or run by

the said Association, The said Balance Sheet and the Annual Accounts will be

sent to the Commission within two weeks from the passing thereof by the

Association and in any event before the closing of the financial year of the

Association.

The Association hereby agrees to indemnify and keep indemnified the

Commission against any loss that the Commission may suffer on account of the

improper or misuse of the grant or any part thereof made by the said Commission

to the said University or on account of non-use of the said grant for the said

University.

l, Prof Biplab Halder, Pro Vice Chancellor of the ICFAI University Tripura, duly authorized

by the Board of Management of the ICFAI Unifersity Tripura do hereby commit and

undertake on behalf of the ICFAI University Tripura that two thirds of the non-recurring

expenditure and the entire recurring expenditure as well as future appreciation in

capital expenditure, with reference to the UGC Scheme for providing financial assistance

to the constltuent departments of the Univqrsity, shall be borne by sponsored Society.
