In partial modification of Government Order No. 860-GAD of 2006dated 12-07-2006, it is hereby ordered that clause (v) shall be substituted asunder :—

“v(a) The General Administration Department shall invitenominations from the Administrative Departments for Chief

Minister’s Gold Medal to be received latest by 5th July every yearand in case that day happens to be public holiday, on next workingday.

v(b) Each Administrative Department shall constitute a committeefor purposes of shortlisting the names to be recommended to theGeneral Administration Department, before the specified date. TheGeneral Administration Department shall also entertain nominationsreceived from the agencies, other than the Government Departments,which shall be placed before the Screening Committee prescribedunder clause (vii) of the Government Order No. 860-GAD of 2006dated 12-07-2006.

v(c) The Screening Committee shall recommend sufficient namesfor consideration of the Awards Committee, so that it is in a positionto select nominations from a larger group”.

Notice Inviting Tender

(Terms and Conditions)

1. Keeping in view the poor response and shortcomings found intenders Group A, B, C and D, again on behalf of the Governor of J&KState, sealed tenders affixed with Rs. 5.00 (Rupees five only) revenuestamps are invited from Registered Contractors/Firms/Suppliers for thesupply of items as mentioned in Group A, B, C and D for the year 2016-17as given hereunder :––

2. Tender can be obtained from the Office of the Superintendent,District Jail, Kathua on cash payment for Rs. 500/- (non-refundable) pertender on any working day during office hours till 18-06-2016.

3. The tenders shall be received in the Office of Superintendent,District Jail, Kathua on or before 22-06-2016 up to 2.00 P. M. along withsamples wherever required howerver the samples of Dry Ration must be inplastic cantainers duly sealed end signed by the tenderer and the envelopecontaining tenders for each group separately should be supersribed as “ten-der for group A, B, C and D of this NIT”. Tender affixed with seal of thefirm should be sent either by post or delivered personally on or before thescheduled date and time.

4. The rates quoted in the tender shall be F. O. R. District Jail, Kathuaand written both in words and figures inclusive of all taxes and VAT ; whereapplicable which should be free of cutting/overwriting.

5. The tenders will be opened on 23-06-2016 in the Office of theSuperintendent, District Jail, Kathua at 01.00 P. M. by the District LevelPurchase Committee in presence of the tenderers who may like to be present.In case of any unforeseen/unavoidable circumstances the tenders will beopened on any other convenient date to be notified separately.

6. Tender should be filled in with one ink or clear typing, but nooverwriting or alteration should be made therein. Corrections, if any, donemust be signed by the tenderer.

7. Tenderer should sign the tender at each page at the end and ifthere is any space left blank in the tender, the same must be marked cross.

8. Conditional tender will not be accepted/entertained.

9. Tenders without CDR/FDR shall not be entertained and shall bestraightway rejected. Besides, samples of the various items as per theenclosed Annexures (wherever applicable) should be sent along withthe tender/offer. The samples should bear the name of the firm/supplierclearly. No sample or any tender document after the expiry of last datei. e. 22-06-2016 will be entertained.

10. The tender must be accompanied by the earnest money in theshape of CDR/FDR of a Recognized Bank duly pledged to the Superintendent,District Jail, Kathua as specified hereunder for each group.


11. The tenderer should be a registered one and should append thelatest Income Tax Clearance Certificate from Income Tax Department andSales Tax Clearance Certificate from the Sales Tax Department. Thetenderer should require to attach copy of PAN and TIN along withtender form.

12. The tenderer must have at least three years’ experience of supplyof dietry items, fresh items, medicines and misc. items to any GovernmentDepartment. The last three years turnover is required to be appended withtender form.

13. Soon after the acceptance of the tender is communicated to thesuccessful tenderer, the contract shall be binding on him and he shall haveto make an agreement with the department. The earnest money/CDRs ofthe tenderer who backs out or withdraws his tender or fails to abide by theterms and conditions of NIT, shall be forfeited under rules, besides takingother remedies which may be available to the department under law.

14. The successful tenderer shall have to arrange the supplies withinthe period mentioned in the supply order.

15. If successful tenderer fails to supply the goods of the prescribedspecifications or fails to deliver the goods within the stipulated time asspecifically mentioned in the supply order, the department shall be at libertyto arrange the supplies otherwise, after giving at least 07 days notice to thesuccessful tenderer. The extra costs so involved will either be made goodfrom other bills of the contractor, if any, or by way of forfeiture of theamount of earnest money deposited with the department or other remedieswhich may be available to the department under law for the time being inforce in the State.

16. In the case of rejection/replacement of supplies, the loss so causedshall be entirely borne by the supplier. The rejected goods/stores shall haveto be lifted by the supplier within one week and the department shall in nocase be responsible for any loss or damage while these are in the Jailpremises.

17. The material so ordered and supplied should be according to theapproved specifications/samples and shall first be inspected, accepted andthen taken on stock and after its verification, the payment shall be made.No advance payment shall be made.

18. Bank Commission charges on account of Bank Drafts shall beborne by supplier.


19. The contract/supply order can be repudiated at any time if thesupplies shall not be made in accordance with the approved sample,specification, size or brand by the successful tenderer.

20. The rate contract shall remain in force for one year from the dateof entering into the agreement or till the finalization of the new rate contract.

21. The supplier shall not sublet the contract or any part thereof toany other firm or agency.

22. Purchase Committee reserves the right to accept or reject anytender without assigning any reason.

23. All legal proceedings arising out of any dispute between the partiesshall have to be instituted in courts situated in Kathua/Jammu. In case ofany dispute, the decision of the Director General of Prisons shall be finaland binding upon both the parties.

THE JAMMU AND KASHMIR ENTRY TAX ON GOODS(AMENDMENT) BILL, 2016

A Bill to amend the Jammu and Kashmir Entry Tax on GoodsAct, 2000.

Be it enacted by the Jammu and Kashmir State Legislature inthe Sixty-seventh Year of the Republic of India as fellows :––

1. Short title and commencement.––(1) This Act may be calledthe Jammu and Kashmir Entry Tax on Goods (Amendment) Act, 2016.

(2) It shall come into force from the date of its publication inthe Government Gazette.

2. Amendment in section 3, Act No. IV of 2000.––In sub-section (1) of section 3 of the Jammu and Kashmir Entry Taxon Goods Act, 2000,––

(i) clause (i) of proviso shall be omitted ; and

(ii) clauses (ii) and (iii) shall be renumbered as clauses (i)and (ii) respectively.

STATEMENT OF OBJECTS AND REASONS

As per section 3 of Entry Tax Act on Goods Act, 2000, theentry tax is collected on goods the value of which not exceedsRs. 5000/-. With the change in trend in the business techniques theonline shopping has become quite common and consumers prefer buyinggoods from companies like jabong, snapdeal, amazon, flipkart, myntra,shopclues, telebrands, e-bay, rediffshop, sulekha etc. delivering goodsat destination booked through their online portals. Statistics collectedfrom the minor checkpost (passenger side only) show that most of theconsignments are shown below Rs. 5000/-, and hence no entry tax canbe levied. In case of the passenger side minor checkpost at JammuRailway Station only, per day billing of consignment below the valueof Rs. 5000/- is Rs. 15-18 lacs. Further, the local trade is being hitby such transactions and the dealers dealing in sale and purchase ofmobile phones have approached Commercial Taxes Department andrepresented that the online invoices being competitive have taken overthe market as they do not pay any tax and incur any other incidentalexpenses.

It is also apprehended that the online delivery is split into severalbills so as to reduce the value of invoice to avoid entry tax. For example,if consumer has booked goods for Rs. 20,000/- and has sought deliveryof 05 goods, separate 05 invoices showing the value of goods belowRs. 5000/- value are issued.

In this backdrop we may think of doing away with the limit forlevy of entry tax or reducing the same so as to enhance the tax baseand boost revenue collection. If we enhance the taxable imports ofRs. 15.00 lacs per day, we will get additional revenue on account ofentry tax about 1 lac per day which comes to Rs. 30.00 lacs per monthand Rs. 3.50 crores per year from passenger side only. It is to bringto your notice that huge quantity of such online goods is cleared atAirport of Jammu and Kashmir and at Lakhanpur also. This resourceneeds to be trapped looking into the changing trade practices of the

companies. Further, more players like Reliance and TATA are alsoin a process of resorting to same kind of trade practice which willfurther have the affect of giving jolt to our tax collection. It is pertinentto mention that the registered dealers (importers) are paying tax onall the commodities bought by the consumers irrespective of the priceof commodity.

Hence the Bill.

FINANCIAL MEMORANDUM

The proposed Bill provide for certain changes/amendments in theexisting law to address the exigencies encountered in the implementationof law as also the changes necessitated due to proposed enactmentof the Jammu and Kashmir Entry Tax on Goods (Amendment) Bill,2016. The provisions sought to be introduced/amended are more ofregulatory nature and do not involve any expenditure from out of theConsolidated Fund of the State.
