IN EXERCISE of the powers conferred by section 49 (1) of the

Labour Relations Act (No. 14 of 2007), the Cabinet Secretary for

Labour, Social Security and Services makes the following Order:

(a) New Wide Garments Kenya (EPZ) Limited, of P.O. Box 504,

Athi River to deduct 2.5 per cent of the basic salary every

month from each unionisable employee who is not a member

of the Tailors and Textile Workers Union herein referred to as

EXEMPTION

IT IS notified for the general information of the public—

THAT in exercise of the powers under section 26 of the Competition Act, the Competition Authority has exempted the seven-years’ Joint Venture Agreement between Kenya Airways Limited and KLM Royal Dutch Airline from the provisions of section 21 of the Act.

THAT the Authority shall revoke or amend the exemption if there is a material change in circumstances since the exemption was granted, including changes which may result from renewals of the Joint Venture Agreement, and that the parties shall furnish the Authority with a copy of the Agreement on the date of every renewal of the Agreement.

THAT the exemption does not grant parties immunity from the Competition Act regarding any conduct that is not covered under the Joint Venture Agreement; and

THAT the Authority has granted the exemption because—

(a) the Joint Venture Agreement and similar agreements are indispensable in airline industry worldwide; and

(b) the Joint Venture Agreement will promote technical stability through improved technology, skills and expertise resulting from technology transfer, staff exchanges and training avenues between the parties to the benefit of Kenya’s economy.

INVITATION OF PUBLIC COMMENTS

PURSUANT to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.

The Proponent (Waterman Katani Ltd.) is proposing to put up a petrol station On Plot L.R. No. Mavoko Town Block II/367, in Katani Town, Machakos County .

The following are the anticipated impacts and proposed mitigation measures:

Environmental Impact Mitigation Measures

Poor Housekeeping While Dispensing

Provision to pave the pump island and remote filling area with reinforced concrete as per the designs.

Regular training of staff on pump island operations.

Leakage of Tanks and Product Lines

Insurance against the consequences of a spill contaminating groundwater, soil and surface water.

The tank and lines will be used as per their design life of 30 years and a UST / line replacement programme put in to ensure tanks and lines are replaced prior to failure in timely fashion.

Monitor daily reconciliation of wet stock

and inventory records.

In case of suspect losses, institute tank and line integrity testing.

Conduct a soil gas survey to check the extent of contamination from the leaks.

Waste Water and Waste Oil Management Practices

Carefully collect used oil in drums and dispose of by licensed refuse contractor.

Adhere to wastewater management regulation of the legal Notice 121 and Water quality regulations of the Legal Notice 120.

Conduct wastewater monitoring to check compliance on monthly basis and submit the results to NEMA District Office for immediate approval of the station operations.

Document and train staff in the emergency spill response plan.

Solid waste management. Comply with the requirements of the Environmental Management (Waste Management) Regulations Legal Notice 120.

Prepare a waste management plan.

Stop deposition of waste in open pits.

Clearly designate and construct an appropriate waste collection facility or provide covered refuse skips.

Segregate waste at source.

Monitor waste volumes.

Identify licensed waste disposal contractor to remove from site and monitor performance.

Carefully collect used oil in drums and dispose of by licensed refuse contractor.

Fire and accident Provision and placement of appropriate fire extinguishers and training of personnel to handle emergency situations.

Lane and junction design and signage to meet appropriate standards.

Movement of construction vehicles timed to avoid peak periods.

land that is not required for the

construction works is not disturbed.

Wherever possible, earthworks should

be carried out during the dry season to

prevent soil from being washed away by

Develop a site safety action plan

detailing safety equipment to be used,

emergency procedures, restrictions on

The Conditions of Contract in the tender

documents should stipulate health,

The Proponent (Narupa Community Wildlife Conservancy) is proposing to put up the Headquarters and a Campsite within a 10 acre plot located within Narasha and Rumate areas of the conservancy. The Headquarters will comprise of a meeting hall with two offices on the sides, reception/radio room, sanitation and water storage tanks, and parking area; while the Camp will include tourism accommodation facilities, a dining room, staff quarters, a parking lot and other supporting amenities such as a sanitation system. Water supply for the campsite and company headquarters will be supplied from outside the sites using water boozers and stored in water tanks to be installed at the sites.

The following are the anticipated impacts and proposed mitigation measures:


Hydrology and drainage All new vehicle tracks should have provision for side drains, mitre drains and culverts.

The drains must lead to the safest point of discharge and maintained regularly.

Soil Erosion Minimal bush clearing should be undertaken in designated sites.

Excavations to be confined within the construction sites.

Excavated earth should be held away

from locations susceptible to surface runoff of storm water.

Re-vegetate exposed areas to mitigate further erosion of soil.

Water resources Rainwater harvesting should be undertaken during wet seasons.

IMPORTANT NOTICE TO SUBSCRIBERS TO THE KENYA GAZETTE

THE following notes are for the guidance of persons submitting “copy” for

inclusion in the Kenya Gazette, Supplement, etc.:

(1) The Kenya Gazette contains Notices of a general nature which do not

affect legislation. They are, therefore, submitted to the Government

Printer directly.

(2) Legislative Supplement contains Rules and Regulations which are

issued by the Central Government. Because of this, they must be

submitted to the Government Printer through the office of the

Attorney-General.

(3) Bill Supplement contains Bills which are for introduction in the

National Assembly.

(4) Act Supplement contains Acts passed by the National Assembly.

All “copy” submitted for publication should be prepared on one side of an

A4 sheet no matter how small the Notice is, each page being numbered and

should be typewritten with double spacing. Copy should be clear, legible and

contain no alterations.

Particular attention should be paid to the following points:

(i) Signature must be supported by rubber-stamping or typing the name

of the signatory in capital letters.

(ii) Dates must be correct and filled in where necessary.

(iii) Care should be taken to ensure that all headings to Notices and

references to legislation are up to date and conform with the Revised

Edition of the Laws of Kenya.

EXTRACT FROM THE CODE OF REGULATIONS, SECTION D—

Kenya Gazette

“D 34. (1) Communications for the Kenya Gazette should reach the

Government Printer not later than 9 a.m. on Friday of the week before

publication is desired. The Government Printer will not publish communications

received after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the

cost of advertising in it.

It is emphasized that these notes are for guidance only, but it is requested

that persons submitting copy for publication first satisfy themselves that such

copy is complete in every respect.
