THE LABOUR RELATIONS ACT

DEDUCTION OF AGENCY FEES

IN EXERCISE of the powers conferred by section 49 (1) of the Labour Relations Act (No. 14 of 2007), the Minister for Labour orders:

(a) Karuturi Limited to deduct from the wages of each unionisable employee who is not a member of the Kenya Plantation and Agricultural Workers Union herein referred to as “Union” but is covered by the Collective Bargain Agreement between the Union and Flower Growers Group of Agricultural Employers Association a sum of KSh. 50 from wages of every employee who earns not more than (KSh. 2,500) per month or 2% from every employee who earns more than KSh. 2,500 per month.

(b) Deductions to commence within thirty (30) days of receiving the order.

(c) To remit within ten (10) days the sums deducted under item (a) by crossed cheque made payable to the union into that union’s account No. 0102019732300 at the National Bank of Kenya, P.O. Box 1013–20100, Nakuru.

NOTICE is given that the next statutory meeting of Nairobi Liquor Licensing Court will be held in the Provincial Commissioner’s boardroom, Nyayo House, 5th Floor, on 11th November, 2010, at 10.00 a.m.

ENVIRONMENTAL IMPACT ASSESSMENT STUDY REPORT FOR THE PROPOSED KILIMAMBOGO–THIKA–GITHAMBO – KIGANJO (NYERI) AND THIKA–KIGANJO (GATUNDU) 132 KV TRANSMISSION LINES AND ASSOCIATED SUB-STATIONS

INVITATION OF PUBLIC COMMENTS

PURSUANT to regulation 21 of Environmental (Impact Assessment and Audit) Regulations, the National Environment Management Authority, (NEMA) has received an environmental impact assessment study report for the implementation of the proposed 132kv transmission lines and associated sub-stations.

The proposed project involves construction of a 170 km of 132kV power transmission line from Kilimambogo in Thika through Githambo in Murang’a to a terminal station in Kiganjo (Nyeri) and Thika–Kiganjo (Gatundu). A section of the proposed transmission line, from Kilimambogo to Mangu will be a double circuit which will be separated to proceed to the Githambo–Kiganjo (Nyeri) route while the other line to Kiganjo in Gatundu where a terminal substation will be constructed.

The main components of the proposed project include:

(a) Construction a total of 170km 132kV transmission line in 175 mm2 conductor comprising:

Approximately 15km double circuit between Kilimambogo and the proposed Thika substation and further 5km from the substation to the junction at Makwa.

50km single circuit between the proposed Thika substation and Githambo

(b) Construction of new 132kV substation at Thika. The substation shall be double bars equipped with five 132kV bays and two 30MVA 132/66 transformers shall be connected to a new 66kV double bus bar substation which shall be equipped with four outgoing 66kV feeder bays.

(c) Construction of a 132/33kV substation equipped with 23MVA 132/33kV transformers and four outgoing 33kV feeder bays.

(d) Construction of a 50km 132kV transmission link between Githambo and Kiganjo 132kV substation equipped with a takeoff bay at Githambo substation and an entry bay at Kiganjo 132kV substation.

(e) Construct a 50 km 132kV transmission link between Karakuta and Kiganjo (Gatundu).

(f) Construction of a 132kV/33kV terminal substation at Kiganjo.

Possible Impacts Mitigation Measures Air pollution by dust

generated during construction process

All personnel working on the project shall be trained prior to starting construction on methods for minimizing air quality impacts during construction.

Construction of heavy earth moving vehicle drivers shall be under strict instructions to minimize unnecessary trips, refill petrol fuel tanks in the afternoon and minimize idling of engines.

Careful screening of construction site to contain and arrest construction-related dust.

Exposed stockpiles of e.g. dust and sand, shall be enclosed, covered, and watered daily, or treated with non-toxic soil binders.

All workers on the site shall be required to wear protective clothing while on duty.

Noise pollution by construction activities

Use of equipment designed with noise control elements will be adopted where necessary.

Trucks used at construction site shall be routed away from noise sensitive areas where feasible.

Idling time for pickup trucks and other small equipment shall be minimized to limited.

All workers operating in noisy areas or operating noisy equipment shall be provided with earpieces to protect against extreme noise.

Excessive solid waste Wastes to be collected regularly to control air pollution and vermin/insects etc.

Receptacles shall be provided for waste storage prior to collection.

Resource recovery shall be encouraged once the project takes off so as to shrink waste stream and recover non-recyclables.

Refuse collection vehicles shall be covered to prevent scatter of wastes by wind.

Wastes will be collected by a licensed operator to avoid illegal final dumping at unauthorized sites.

All persons involved in refuse collection shall be in full protective attire.

Visual Intrusion and obstruction

The proposed development entails construction of a petrol station complete with a parking bay, toilets, offices and filling pumps.

The proposed project is located along Kangundo Road off Outering Road in Umoja Estate on plot LR. NO. 209/9491. The site is located fifty metres away from Petrocity petrol station and about one hundred metres away from total Kenya petrol station along Kangundo Road.

PURSUANT to regulation 21 of Environmental (Impact Assessment and Audit) Regulations, the National Environment Management Authority, (NEMA) has received an environmental impact assessment study report for the implementation of the proposed 84MW medium speed diesel engine power plant.

The proposed project involves the development of an 84mw medium speed diesel power plant along the Nairobi – Mombasa highway in Athi River of Mavoko Municipality in Machakos district.

The project anticipates the following impacts and mitigation measures:

Noise and vibration Contractor’s plant and equipment shall comply as a minimum with requirements of L.N. 25: Noise Prevention and Control Rules, 2005.

The Proponent shall comply with the requirements of L.N. 25: Noise Prevention and Control Rules, 2005 and L.N. 61: Noise and Vibration Pollution Regulations, 2009.

Damage to roads and other transport infrastructure

Develop and implement measures to prevent damage to regularly used roads to the project site especially the Nairobi – Mombasa highway fronting the project site;

Ensure that contractor vehicles comply with axle load limits.

Develop and implement a traffic management plan to take advantage of off-peak hours for delivery of construction materials and abnormal loads during the construction phase;

PURSUANT to regulation 21 of Environmental (Impact Assessment and Audit) Regulations, the National Environment Management Authority, (NEMA) has received an environmental impact assessment study report for the implementation of the proposed development of a petrol station development.

The project involves construction of a Petrol Station for the provision of petroleum fuel, lubricant oils, LPG, break fluids, battery acid and battery water, car wash, tyre repairs and vehicle servicing, shop, restaurant and among related facilities.

The proposed project will be located on plots. Nos. Chania/Kanyoni/1916, 1917 and 1918, Thika District.

The project anticipates the following impacts and mitigation measures:

MOMBASA ROAD


PURSUANT to regulation 21 of Environmental (Impact Assessment and Audit) Regulations, the National Environment Management Authority, (NEMA) has received an environmental impact assessment study report for the implementation of the proposed petroleum service station and liquefied petroleum gas depot.

The proposed project entails construction of a petrol station and an LPG depot. Other facilities will include a parking bay, toilets, offices, filling pumps and an LPG filling plant.

The proposed project located on L.R. No. 20616 along Mombasa Road, is about 500m ahead of Mlolongo Town at the diversion leading to 102 South Park Estate, Mavoko Municipality.


Solid waste Segregation of solid waste and collection into bins should be observed.

Disposal of waste should be done through the laid down council procedure.

Reuse where possible or sale to authorized waste handlers/collectors.

Occupational heath and safety

All workers will be provided with protective clothing i.e. overalls, helmets, gloves and safety boots among others to guard against injuries and other bodily harm.

Clean water will be provided to the workers for drinking.

In the unlikely event of accidents, the labour laws governing reporting and management of the same i.e. OSHA 2007, shall be applied.

Adequate safety signs shall be provided on site to prevent all workers and the general public of any dangers.

The proposed project entails construction of the Nairobi Southern By-pass within Nairobi Road Network Master Plan covering a total of 28.6 km. The Nairobi Southern By-pass is designed to the Class A—International Trunk Road Standard.

Starting from the South-eastern Nairobi, the Proposed road project, in the form of a by-pass, will link up other major road trunks in Nairobi area including Mombasa Road, Outering Road, Langata (C58), Ngong (C60), Dagoretti (C63), Thogoto (D411) and then passes through Ondiri River and a Railway; and finally join Kabete–Limuru Road (A104) in the town of Kikuyu located south-west Nairobi.


Curb Right of Way Conflicts

Avoid or minimization of involuntary resettlement and relocation of public utilities to the extent possible.

Resettlement of displaced people as per the resettlement plan.

Draft, finalize, and implement land acquisition, compensation and resettlement plan for affected households, businesses, public utilities, and other groupings using participatory approach.

Restrict project within the corridor set by the GoK as much as possible.

Secure official permission from concerned Local Government Units (LGU) regarding entry in project for research purposes.

(2) Legislative Supplement contains Rules and Regulations which are issued by the Central Government. Because of this, they must be submitted to the Government Printer through the office of the Attorney-General.

(3) Bill Supplement contains Bills which are for introduction in the National Assembly.

(4) Act Supplement contains Acts passed by the National Assembly.

All “copy” submitted for publication should be prepared on one side of an A4 sheet no matter how small the Notice is, each page being numbered and should be typewritten with double spacing. Copy should be clear, legible and contain no alterations.

Particular attention should be paid to the following points:

(i) Signature must be supported by rubber-stamping or typing the name of the signatory in capital letters.

(ii) Dates must be correct and filled in where necessary.

(iii) Care should be taken to ensure that all headings to Notices and references to legislation are up to date and conform with the Revised Edition of the Laws of Kenya.

EXTRACT FROM THE CODE OF REGULATIONS, SECTION D—

Kenya Gazette

“D 34. (1) Communications for the Kenya Gazette should reach the Government Printer not later than 9 a.m. on Friday of the week before publication is desired. The Government Printer will not publish communications received after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the cost of advertising in it.

It is emphasized that these notes are for guidance only, but it is requested that persons submitting copy for publication first satisfy themselves that such copy is complete in every respect.
