CONDITIONS OF ENTRY 1. The Sale is conducted under the “General Conditions of Sale” which are exhibited in the Market

and in accordance with the Regulations as approved by The Luing Cattle Society Limited. 2. Please note: Stock will be sold as they appear in the ring. Any prospective buyer wishing to

purchase one of a pair must consult the vendor prior to them entering the ring to see if they are prepared to sell them as singles.

3. All bulls will be subject to the Society’s upset price of 1,500gns. 4. There will be no transfer fee for bulls or heifers bought at official Society Sales. 5. All Luing Cattle Society Sales are conducted under the National Beef Association terms and

conditions of sale incorporating bull breeding and female breeding warranties. To cover the cost of the warranty service detailed on the following page, a charge of £4.00 + vat per bull and £2.00 + vat per female will be split equally between purchaser and seller, applied by the Auctioneer at the point of sale.

HEALTH INFORMATION

The Luing Cattle Society was the first to run a BVD-safe sale with its Premier Sale in February 2007. Since 2010 all official Luing Cattle Society Sales, including this one, are run under the same health rules and are therefore BVD-safe. To qualify for this, all stock must come from herds which are members of a CHeCS accredited health scheme (for this sale all herds are in one of the SAC Premium Cattle Health Scheme or the HiHealth Herdcare Scheme) and are either BVD accredited free or the sale stock have tested negative for the virus. Additionally all stock forward are double-vaccinated against BVD. For herds testing for Johne’s, you will notice new Risk Level categories are displayed; these are defined as follows: Status Level Risk Level 1 This is directly equivalent to the previous CHeCS Accredited Free status. Level 1 status is

associated with the lowest risk source when buying in stock. Health plan required. Risk Level 2 Herds with level 2 status have had one or two clear consecutive herd tests. Health plan required. Risk Level 3 Herds with level 3 status have reactors identified at the annual herd test, but these are no more

than 3% of animals tested. Health plan required. Risk Level 4 Herds with level 4 status have reactors identified at the annual herd test, and these amount to

more than 3% of the animals tested. Health plan required. Risk Level 5 Any herd that is not carrying out the required testing or does not have a suitable health plan in

place falls into this category. Level 5 status is considered to be the greatest risk source when buying in stock.

NBA BREEDING WARRANTIES All procedures are covered under the terms and conditions, a full copy of which can be obtained from the Auctioneers or from the National Beef Association, The Mart Centre, Tyne Green, Hexham, Northumberland, NE46 3SG but the following points should be noted: Bull Breeding Warranty Each bull is sold with the warranty by the vendor that it is capable of getting stock by natural service. This shall be deemed to be fulfilled as soon as six females or 50% of the herd (whichever is the lesser number of the animals put to the bull) are in calf to the bull by natural service subsequent to the sale. Trial period six months from date of sale or within 6 months of attaining the age of 14 months,

whichever is the later. Female Breeding Warranties Maiden Heifers: Every maiden heifer over the age of twelve months at the date of sale is sold with warranties by the Vendor That it shall be fertile up to the age of twenty eight months That it is not in calf

Females in Calf: Every cow or heifer stated in the Sale Catalogue or by the Auctioneers at the time of the sale to have been served on a date not less than twelve weeks before the date of the sale is sold with warranties by the Vendor That it is in calf That it is in calf to the bull described in the Sale Catalogue, or by the Auctioneers at the time of the

sale That the expected calving date will be within a period of 263 to 303 days of the service date

Females with veterinary surgeon’s certificate of positive pregnancy diagnosis: Scanning is a matter of opinion and not a warranty. Every cow or heifer stated in the Sale Catalogue or by the Auctioneer at the time of the sale to be sold with a Veterinary Surgeon’s certificate of positive pregnancy diagnosis is sold with the same warranties by the Vendor as described for Females in Calf (above). Please note time limits below. Claims and Time Limits A claim by a purchaser will only be valid if the purchaser has given notice in writing to the Auctioneers of the intended claim with following time limits: Bull Within six calendar months from the date of the sale.

Maiden Heifer or recently served heifer: Within three calendar months from the date of the sale or Within one calendar month from the date when the heifer attains the age of twenty-eight months

whichever is the later date. Cow or heifer sold as being in-calf or as running with the bull and which proves not to be in-calf: Within twenty eight days from the date of the sale.

IMPORTANT – Extending the breeding warranty

If it is found impracticable to try the bull/female fairly within the time limits stated, due to the purchaser’s normal calving programme, the purchaser shall (at the discretion of the vendor), ON THE DAY OF THE SALE, or within the next seven days, give the auctioneer notice in writing of the month in which it is proposed to commence using the bull/running the heifers with a bull.
