John Price was denied a review of a Mass Media Bureau action denying his complaint that, as a political candidate, he was the target of a personal attack by WFBQ -FM in Indianapolis, IN. Price had argued that he was entitled to equal opportunities under Section 315 of the Communications Act because WFBQ opposed his candidacy. After investigating his complaint, the Bureau found that while WFBQ denied that it
personally attacked the candidate, the station had twice offered Price the
opportunity to reply. The Bureau deemed the station's offer to be reasonable and that it satisfied the intention of the rule by giving the candidate an opportunity for rebuttal. As a result, the Bureau said the station's actions did not warrant an evaluation based on Section 315. The Bureau ruled that Price's request to
appear on the station based on the equal opportunities provision did not apply in
this case, because no candidate appeared during the programming in question. The
Commission denied the review of the Bureau's decision because the application lacked sufficient grounds to warrant a reversal or alteration of the ruling.

Three pirate radio station operators who were arrested last year for illegally operating two unlicensed Texas stations over the "Pirate Radio Network" were sentenced in U.S. District Court last week. The operators, who all pled guilty, are Thomas Eugene Barnes, who was sentenced to six months in prison to be followed by a supervised release for one year; and Mark Anthony and Richard Lane, who were ordered to perform 100 hours of community service and were placed on three years probation. Barnes is a repeat offender who was fined $750 by the Commission's Portland office in 1986 for operating a pirate station in Elgin, OR. The three were arrested after an investigation by the FCC, U.S. Border Patrol, U.S. Marshal's Service, and the Odessa (TX) Police Department.
The FCC denied Ocean Pine Broadcasting Associates' request for a review of the dismissal of its application for a new FM station at 97.1 MHz at Ocean Pines, MD.
The Mass Media Bureau had dismissed the application because Ocean Pines failed to
include data for three of the required eight radials in computing its antenna height above average terrain. Ocean Pines requested the review of the Bureau's decision, arguing that it had included the three radials in its application, and that other applicants with incorrect HAATs were allowed by the Bureau to file curative amendments. Ocean Pines said the Bureau was arbitrary and capricious because it did not allow the filing of a curative amendment in its case. The
Commission denied the review because Ocean Pines failed to demonstrate that the staff had eared in returning its application, or that the application was treated differently than those of a similar nature. The FCC said Ocean Pines' examples of
applicants with curative amendments were not applicable to its situation. One case involved a different kind of HAAT computation methodology, and the other did not involve an HAAT error that constituted a rule violation.
In other actions, the FCC: ordered Culpepper Communications, licensee of WPFM in
Panama City, FL to forfeit $15,000 for failure to comply with the Commission's EEO requirements; dismissed Lt. Colonel Cyrus Edward's petition for court review and reversal of a ruling in the proceeding involving two competing applications for a
new station at 95.1 MHz in Shawnee, OK.
The FCC will hold the third of its six Emergency Broadcast System Regional Workshops, February 19, in Norcross, GA, near Atlanta. At the workshop federal, state, and local officials will update state and local EBS plans. Attendees will

Satellite CD Radio, Inc. (SCDR) and Strother Communications, Inc. (SCI), have filed requests for pioneer's preference for Digital Audio Radio Services, which were accepted for comment last week by the FCC. The requests were given the
following file numbers: SCDR - PP -24 in Docket No. 90 -357, and SCI -- PP -25 in

Former American Radio Network partner Ed Graham has signed on as a program consultant with the new Baltimore -based United Talk Radio Network. The network is
headed by attorney and financial consultant Michael Hodes, who is CEO; Baltimore area businessmen Douglas Strouse, president, and Walter McManus, Jr., vice
president. United began airing its programs last week on a free trial basis to
stations across the country from the studios of WCBM, Owings Mills, MD. After the
initial two weeks, stations can sign with the network on a barter basis.
According to United, several of the network's approximately 90 verbally- confirmed affiliates are former ARN stations. In addition to Graham, United has hired 20 of
ARN's former staff members. United's weekday programming includes: Sean Casey,
6:00 -9:00 a.m. (ET); Paul Bicknell and Gary St. Ours, 9:00 a.m. -noon; Bob Kwesell, noon -2:00 p.m.; Tom Marr and Less Kinsolving, 2:00 -5:00 p.m.; United CEO Michael Hodes, 5:00 -6:00 p.m.; Ellen Ratner, 6:00 -8:00 p.m.; Mark Scheinbaum, 8:00 -10:00 p.m., and Overnight Sports from 10:00 p.m. -6:00 a.m. Casey, Marr, and Kinsolving have local talk programs on WCBM, while Ratner and Bicknell have both appeared on
national broadcasts. The network is also carrying weekend specialty programming addressing such topics as: law, finance, the elderly, automobiles, sports, ar.d

The Radio Advertising Bureau had a record 1234 attendees at its Managing Sales Conference '92 last week. Conference events included: a panel of radio station and ad agency executives who debated the importance of gearing agency creative work toward the radio medium in order to improve advertising, and how executives from both groups don't appreciate radio's potential; a keynote speech by economist Gene Stanaland, who said that the idea of the current economic recession is a myth perpetuated by politicians and the media; and talent keynoter Rush Limbaugh, who urged station managers not to accept the arguments of potential advertisers who won't buy time because certain programs are too controversial. Limbaugh said, "Most radio managers tend to meekly accept the 'too controversial' excuse as
something they can't do much about. We meet these objections head -on." He said that he investigates the advertisers' claims, which he calls "reverse bigotry," and often finds that advertisers don't have enough information on his program or its audience to make such a decision.
In other Rush news, the not -too -controversial (his words) talker will deliver his unique commentary and observations on "The Rush Morning Update," a short -form feature which will =.:r over Limbaugh's Excellent - Broadcasting Network weekdays, from to 10:00 a.m. starting March 2.
In what may be a new competitive trend, adult contemporary station WOMX- P.M /FM in
Orlando, FL issued a press release to its "valued clients and friends" in an effort to short- circuit Cocoa Beach AC rival WSTF(FM)'s promotional tease campaign using the latter's new moniker "Variety 101 FM" in lieu of its earlier "Star." WOMX, a.k.a. "Mix 105.1," decided to provide "straight answers" about an implied change in WSTF's format. In its press release, WOMX asked and answered what it
felt were clients' burning questions about WSTF, as follows: Q: "What is
happening at Star ?" A: "WSTF is changing to Variety 101." Q: "Why are they changing their name ?" A: "Perhaps they think it will help them." Q: "What other differences will I notice ?" A: "Not much. It's like a new cover on an old chair." In its closing, WOMX poked further at WSTF's format "change," saying, "Mix 105.1 says hello /goodbye to a new /old friend."
Clear Channel Communications and the Noble Broadcast Group have entered into a
local marketing agreement in Houston, by combining the sales efforts of Clear Channel's urban AC KHYS with that of Noble's urban /rap stations KMJQ and KYOK.

The FCC ordered Dakos Broadcasting, Inc., licensee of WOKD and WXKT in Arcadia,
FL, to forfeit $18,000 for repeated failure to comply with Commission EEO
provisions. The Commission had issued a notice of apparent liability to the
stations last June in which it cited the stations' inadequate EEO efforts, including failure to recruit minorities and failure to analyze the stations' recruitment efforts. Dakos is liable for the forfeiture because it failed to
respond to the FCC's notice.
Evergreen Media's WLUP(AM) in Chicago is getting closer to having its day in
court, as the FCC has asked the Justice Department to start civil enforcement proceedings against the station for not paying its $6,000 forfeiture for
broadcasting indecent programming. After the FCC had twice requested payment, Evergreen said it will not pay, making it clear to the Commission that "the
licensee wishes to contest the matter in court." The fine was levied because of
two violations of the Communications Act, both occurring on WLUP's Steve and Garry
show in 1987 and 1989.
The FCC shut down Mexican station XEKAM's Hollywood, California studio link
operation because the station lacked an FCC permit. The talk -formatted station had been producing its programs in Hollywood and broadcasting via a Rosarito Beach, Mexico transmitter into Southern California. The station had applied for
an FCC permit in December, but the application is still pending. In the meantime, XEKAM is producing its programming from Mexico, with a rather long commute for the
California personnel who choose to stay with the station. The FCC notified XEKAM
that it could be fined up to $10,000 a day for each day of illegal broadcasting, with a maximum fine of $75,000. According to the Commission, XEKAM's unauthorized California broadcasts may have been in operation since last June.
According to the Wall Street Journal, FCC Commissioner Sherrie Marshall is leading
the way in advocating a relaxation of broadcasting regulations. Marshall issued a
memo to Chairman Alfred Sikes that urged the easing of current 12 -12 -12 ownership restrictions and duopoly rules. Marshall's suggestions are a result of a review
initiated by Sikes three years ago requesting ideas on easing or eliminating certain FCC rules. Marshall and other Commission members believe that such a
change in rules will help the economy by spurring investment and creating new
jobs
The NAB elected eight radio broadcasters to its Radio Board of Directors last
week, with four other seats to be determined in run -off elections in Districts 2,
4, 8, and 22. New board members include Carl Venters, Jr. of Voyager
Communications, Raleigh, NC, in District 6, and Ray Lockhart, of KOGA- AM /FM,
Ogallala, NE, in District 16. The re- elected incumbents are Charles Blake,
WIKY- AM /FM, Evansville, IN, in District 10; Gene Millard, KFEQ, St. Joseph, MO, in
District 12; Don Seehafer, WOMT /WQTC -FM, Manitowoc, WI, in District 14; Dick
Oppenheimer, Signature Broadcasting Co., Austin, TX, in District 18; Alan Harris,
KUGR /KYCS, Green River, NY, in District 20; and Robert Fox, KVEN /KHAY, Ventura,
CA, in District 24. Ballots for the run -off vote will be mailed to members February 14, with final results to be announced March 17.

Concert distributor Radio Vision International (RVI) has signed an agreement with
radio syndicator Global Satellite Network to broadcast concerts and other music programming to radio stations in the U.S., Europe, Asia, and Australia. The joint
venture is called Global Vision, and will start airing this month with radio
simulcasts of television pay -per -view concerts produced by RVI's television company, PPV. The first broadcast will be a Rod Stewart concert on February 14,

The CBN Radio Network will be discontinuing most of its Christian Music service as
of February 24, while continuing its Christian news and information programming. The network's remaining music programming, which is broadcast overnight, will end
in the spring, coinciding with the planned launch of the Morningstar Radio Network
by Burt and Patsy Perrault. CBN is authorizing its affiliates to tape its
remaining music programming for future use until Morningstar goes on satellite.
CBN has a history of terminating networks. Last year it discontinued the NTR
News -Talk Radio Network. And the dropping of the Christian Music service is the
second time CBN has discontinued a contemporary Christian music format. In the
early 80's, it dropped The Continental Radio Network, a full -time satellite -
delivered music format.

The new Morningstar Radio Network will broadcast a personality adult contemporary Christian format from Houston, TX. The network will be live 24 hours a day in digital. Morningstar's program director is George McNerlin, formerly with Christian Countdown America. The network is targeted to air in April or May. Ir. an unusual remote broadcast last weekend, the North East Satellite Entertainment (NESE) network aired the Toronto productions of the Andrew Lloyd Webber musicals, "The Phantom of the Opera," and "Aspects of Love," wive from the Pantages and Elgin theatres, respectively. The broadcast was carried exclusively over NESE's affiliates in thirteen northeastern U.S. states.
Broadcast Programming's Consulting Group is celebrating its first anniversary this month. The group represents stations with country, adult contemporary, oldies and rock formats, and claims to have helped 80% of its clients improve their ratings. V.P. John Sherman attributes the firm's success to its "philosophy to give stations specific ideas that are actionable in the areas of programming, sales, promotion and marketing, in addition to providing musical and philosophical input." WASHINGTON THIS WEEK
The FCC has eliminated its spousal attribution policy, under which the media interests of one spouse were presumptively attributed to the other in applying multiple and cross -ownership rules. The Commission said it changed the policy because the presumption of spousal attribution could impede the entry of women into ownership and managerial positions, thus placing the attribution policy at
odds with FCC equal employment opportunity policies. With the change in policy,
spouses will be attributed in the same manner as other family relationships. Marital status will not be the sole criterion when attributing media interests. The FCC will review the relationship between spouses, and between the spouses and
their respective media interests, to determine whether attribution of such
interests is necessary to preserve the objectives of economic competition and diversity. If after a review of spouses' disclosures, the FCC finds media interests of spouses to be under common influence or control, such interests will
be attributed to both spouses. Conversely, if the FCC's review shows media
interests to be independently held by spouses, the spouses' interests will not be
attributed.
The FCC denied R. Donnie Goodale's request for reconsideration of the Mass Media
Bureau's dismissal of his application for a new station at 103.3 MHz in Lenoir,
NC. The Bureau dismissed Goodale's application as inadvertently accepted for
tender because the geographic coordinates listed on the application conflicted with those plotted on the site map. Goodale conceded the discrepancy, but argued
that the Commission could have easily resolved the problem, since the site map had
the correct coordinates. In concurring with the Bureau, the Commission said it
could not adequately determine the correct coordinates in Goodale's application from the information in the application. In support of his request for
reconsideration, Goodale cited examples of other stations with coordinate discrepancies. The Commission said the examples cited were significantly different from Goodale's situation because the other applications proposed the
mounting of antennas on existing, licensed towers. In such cases, the FCC permits its staff to take official notice of the existing towers' licensed coordinates. In addition, the FCC rejected Goodale's argument that he should be given the
opportunity to amend his application, because the FCC's curative amendment policy was altered in 1985 under the Commission's FM "hard look" processing procedures.
In other site map news, the FCC denied Apple Communications a review of the
dismissal of its application for a new station at 93.7 MHz in Sebastopol, CA.
Apple's application was dismissed by the Mass Media Bureau because it didn't
contain the full scale topographic site map, as required under the "hard look"
processing standards. Apple requested the review because it believed the language
under the 1985 Public Notice did not specify submission of a full scale map, and
that alternative submissions are permitted, provided that they contain clearly
designated coordinate markings which would enable Commission staff to accurately verify the site location and elevation. Apple argued that its application met
such criteria, and therefore, should have been reinstated. The FCC disagreed with
Apple's arguments, stating that the "hard look" standards have always required the
submission of a full scale site map or a portion thereof, and that the standards have been applied consistently since their adoption. Under the "hard look"
notice, if sites are not plotted on a scale map, and if alternate methods for
utilizing a full scale map aren't met, an application will be returned "without
further review." No indication is made in the Public Notice allowing for the
submission of a reduced site map. Apple had cited several cases in which it
believed the "hard look" rules had not been applied, but the Commission rejected
the examples because in each instance the cases were decided prior the adoption of
the "hard look" rules.
The Commission denied Cumberland Plateau Broadcasting Co., Inc.'s request for
review and upheld a staff action which upgraded the frequency 106.9 from class A
to class C2 in Monterey, TN, and accordingly amended the construction permit of
First Media of Monterey's WRJT -FM. Cumberland, former licensee of WAEW and
WXVL -FM, in Crossland, TN, alleged that the upgrade would cause unwarranted
competitive injury to its stations by putting them at a competitive disadvantage

WASHINGTON THIS WEEK(Cont'd) and would specifically preclude the improvement of WXVL -FM. In addition, Cumberland alleged that First Media committed four acts of misconduct which violated FCC rules and the Communications Act. The Mass Media Bureau denied Cumberland's allegations, dismissing its argument regarding potential economic injury as invalid. The Bureau also said that the resolution of any misconduct by First Media was beyond the scope of the rulemaking proceeding, irrelevant to the upgrade proposal, and more appropriately raised outside the rulemaking process. After Cumberland filed its application for review, First Media applied for a
transfer of control of WRJT -FM. Cumberland then filed a petition for review to deny the transfer, alleging the same misconduct issues as in the rulemaking proceeding. The Mass Media Bureau granted First Media's application for transfer because Cumberland failed to prove any of its allegations of misconduct. Cumberland did not request a review of the Bureau's decision in the transfer. The Commission denied Cumberland's review of the allocation because the misconduct allegations were already addressed in the petition to deny the transfer.
After a review of the EEO procedures of ten Louisiana stations, the Commission granted the license renewals of all ten stations. Six of the stations, WFPR(AM) /WHMD(FM), Hammond; WYNK(AM) /FM, Baton Rouge; WCKW, Garyville; and WCKW -FM, LaPlace, were granted unconditional license renewals. Media Properties' KACY(AM) /KSMB;FM) in Lafayette were renewed subject to FEO reporting conditions, while AmCom of Louisiana, Inc.'s comboKRMD(AM) /FM was granted short -term renewals with notification of an apparent liability of $20,000 for EEO violations. KRMD(AM) /FM failed to initiate an EEO program or self- assess the stations' EEO efforts until 10 months before its license expired. The short -term licenses will end June 1, 1994.
In a separate challenge to the KRMD(AM) /FM's license renewal, the Louisiana Consumer's League (LCL) argued that AmCom suppressed the stations' non -news programming based on economic pressure from sponsors, indicating a violation of public trust. The LCL's contention stems from a simulcast of a live talk show featuring a speaker who was in town to lead a seminar on car buying. During the program, the speaker warned listeners not to trust car dealers and their sales methods. LCL said that local car dealers called during the show to complain, with threats to withdraw advertising support. The consumer group added that the station cut the live interview short, failed to broadcast a taped interview with the speaker that had been scheduled to air later in the week, and broadcast editorials criticizing the speaker and in support of local car dealerships. LCL said that such actions by the stations were a violation of the public trust, since the programming decisions were based on the licensee's own economic interest rather than the public interest. The FCC rejected LCL's allegations because of
broadcasters' First Amendment rights and the Communications Act's express prohibition of Commission censorship under which the FCC has very limited authority to interfere with a licensee's decision to select, or change its mind regarding its programming. The Commission said that the licensee's programming did not cause "a substantial risk of serious harm to listeners," which is the criterion the Commission uses to determine whether it should intervene.
The Commission terminated the operating authority and deleted the call letters of
the following silent AM stations: KLEI, Kailua, HI; WFJT, Inez, KY; WKZX, Presque Isle, ME; and KPDN, Pampa, TX. All the statinJ have been silent for some time.
In other FCC actions, the Commission: denied Bree Walker Lampley's complaint against KFI in Los Angeles, that the station violated the FCC's personal attack rule; dismissed the request by Design Media, Inc. for review of the ALJ's decision granting in the proceeding for a new FM station at 92.5 MHz in Zebulon, GA; upheld the Review Board's decision dismissing the application of Innovative Women's Media Association for a new station at 102.9 MHz in Shreveport, LA; granted Herbert Regenstreif's application for a new station at 107.9 MHz, after finding that a
competing applicant, Midway Communications, Ltd. had failed to file a timely appeal of the Administrative Law Judge's earlier order dismissing Midway's application.
According to the Los Angeles Times, the University of Southern California's KUSC has filed a formal complaint with the FCC regarding interference of the station's signal by Mexican border station XHTIM -FM. XHTIM recently moved its frequency from 103.3 to 91.5 MHz, which is the same frequency as KUSC. The move had been approved last year by the Mexican government, with an agreement by the FCC. Under the grant, XHTIM was licensed to broadcast from a location 15 miles south of the
California- Mexico border. KUSC's lawyer said that station officials believe XHTIM's signal is actually originating from Tijuana, which is located right at the border. In its complaint to the FCC, the L.A. station argued that the Commission

WASHINGTON THIS WEEK(Con't) should have issued prior notification about XHTIM's change because of the effect on KUSC's signal, which is obscured by XHTIM in such areas as southern Orange County and San Diego, and received with static by many listeners in Los Angeles. KUSC is also concerned about the Mexican station's effect on KUSC's pending application for an increase to 15500 watts and a transmitter location change. This is not the first border skirmish for XHTIM. The station had moved from its first frequency, 103.7 MHz, after complaints by San Diego outlet, KJQY, also located at 103.7.
ELSEWHERE
The latest figures from the Radio Advertising Bureau show a 1.6% increase in
network advertising revenues for year -end 1991, compared with 1990 figures.
Combined local and national spot revenue was down 3.1% in 1991 compared with 1990, with local revenue down by 3.0% and national down 3.3 %. Local and national spot
revenue for the month of December showed a slight gain over :he same month in
1990, with an increase of 0.1 %, which is the first increase since July 1991.
Local December revenue was down 0.5 %, while national was up 1.9 %, a vast
improvement over national's poor -7.7% November showing. Network revenue for
December was up by 0.6 %. Regionally, the best December showings were national
revenues in the southeast and midwest, wich increases of 8.0% and 11.3 %,
respectively. Local revenue was also up in the midwest with an increase of 2.9 %.
The southwest led in local December revenue increases with 4.6 %. Not
surprisingly, the east posted the greatest December decline, with -3.8% in local
revenue and -5.3% for national. In commenting on the year -end figures, RAB
president Gary Fries said, "This has been a difficult year for all of us in the
media business, but I believe that the radio industry has entered 1992 stronger and healthier as a result of the challenges we faced this past year." Fries also
noted that radio finished the year in much better shape than such other media as
magazines, newspapers and television.
In this week's LMA activity, NewCity's San Antonio combo KKYX(AM) and KCYY(FM) has
inked an agreement with Vision Communications' combo KMMZ and KMMX -FM. There is
no word yet on programming plans. In another LMA, Adams Radio's KHIH in Boulder,
CO, has entered into an agreement with Western Cities' KQKS, in Longmont, CO.
Both stations serve the Denver market.
According to the Arkansas Democrat Gazette, Demaree Media, Inc., owner of 12
stations in Arkansas, Oklahoma, and Missouri, is planning to file for Chapter 11
bankruptcy. Demaree has already shut down three of its stations, KOLX in Barling,
AR, which has a sale pending, and Sallisaw, OK combo KKID(AM) /FM. The company
said it is planning to continue operations at Arkansas stations KOLZ in
Bentonville, KFAY(AM) /KKEG(FM) in Fayetteville, and KZNG(AM) /KQUS -FM in Hot
Springs.
Duquesne University station WDUQ, in Pittsburgh, PA, lost its antenna in a fire at
the station's tower location just outside the city on Mt. Washington. As a result
of the blaze, the station will be broadcasting at 500 watts, a considerable reduction from its usual 25000 watts, until the antenna can be replaced.
Boise State University's new station KBSU(AM), Boise, ID, is planning to air some
specialized programming, including instruction in foreign languages. Toward that
effort, the station is negotiating for programming with Japan's NHK, Radio Moscow,
and Radio Beijing. In addition, the station plans to air Spanish -language
programming, targeted at southwestern Idaho's large Basque community.
World View is broadcasting two new conservative Christian talk programs, Worldview
and America Talks, both with host Craig Smith. Worldview will be carried on the
CBN Radio Network, weekdays from 12:00 - 2:00 p.m. (ET) and America Talks can be
heard on the For the People network from 2:00 - 3:00 p.m. For more information,

The FCC was closed on February 17 in observance of Presidents' Day.
The U.S. Court of Appeals for the D.C. Circuit struck down the preference given female applicants in comparative proceedings for new stations. The 2 -1 decision was written by current Supreme Court Justice Clarence Thomas, who is a former member of the Court of Appeals. Under the ruling, such preferences to female applicants were found to be unconstitutional. Justice Thomas said there was no
indication that women owners would be more likely to program women's or minority oriented programming and that the policy was unconstitutional because "the
government has failed to show that its sex -preference policy is substantially related to achieving diversity on the airwaves." The FCC did not indicate whether it will appeal the ruling.
In a letter to FCC Chairman Alfred Sikes, the House Committee on Energy and
Commerce urged "vigorous enforcement" of FCC's political broadcast rules, while
commending the Commission's recent action clarifying the rules. The committee strongly advocated Commission "audits" of licensees to verify compliance, and said
that licensees made aware of impending audits "will be scrupulous in their
compliance with the Commission's policies," and that the audits and rules
clarification "will help to assure that Section 315 serves the purposes for which
it was enacted."
The FCC issued a Notice of Apparent Liability to WYBB in Charleston, SC, for a
forfeiture of $3,750 for violation of the Commission's policy on the broadcast of
indecent language. The broadcast in question occurred during WYBB's "The Morning
Show" on August 8, 1990. According to tapes provided to the FCC, a two person
exchange went as follows: "Maybe it's nine." "I don't know and who really gives
a crap ?" "Oh, oh." "No, we can say crap." "We can say crap ?" "Yeah." "Crap,
crap, crap, crap, crap, crap." "That's right, just can't say shit." "Oh, then we
won't." "That's right." According to the FCC's Roy Stewart, "the scatological

to heighten the audience's awareness of and attention of the subsequent use of the term 'shit' by the announcer." Stewart added that the material fits the FCC's definition of indecency because it "contained patently offensive language" and
because it aired at a time when children were likely to be listening to the
station. M Street: What about classic rock stations that play Steve Miller's "Jet Airliner ?"
The Commission denied the Mass Media Bureau's petition for reconsideration of a
Review Board decision in a proceeding for a new station on 105.7 MHz at
Queensbury, NY. In its petition, the Bureau argued that one of the applicants, Normandy Broadcasting Corporation, had provided untruthful information in its
threshold showing of the non -entertainment programming of its station WYLR, in
Glens Falls, NY. The Board had dismissed Normandy's application for the new
station because of the lack of a transmitter site, and did not find it necessary to question the issue regarding WYLR's programming. The Bureau said that WYLR is
involved in a comparative hearing regarding its license renewal and requested that
the Board reconsider the Queensbury decision and resolve adversely the
misrepresentation issue against Normandy. The Board'.apheld its decision because Normandy's application had been dismissed squarely on the transmitter site issue,
and said it would not interrupt the Queensbury proceeding to determine an issue
more directly relevant to WYLR's renewal proceeding.
The Commission affirmed a Review Board decision upholding the dismissal of the
application of Carmel Broadcasting Limited Partnership (CBLP) for a new station at
95.5 MHz in Carmel, CA. The application was dismissed because CBLP failed to
produce an essential witness. The Administrative Law Judge added issues against
the applicant to determine whether Frederick Osborne, who is president and
majority stockholder of CBLP's limited partner, had abused the FCC's processes in
the Carmel and other application proceedings. The ALJ based his action on
allegations that Osborne was the real party -in- interest behind CBLP, and that
CBLP's purported limited partnership was not bona fide. In addition the ALJ said
Osborne was a limited partner in an application for a new station in Fresno, CA,
which was found by the Board to be a sham applicant. In response to a request by
parties to the proceeding, the ALJ ordered CBLP to produce the witness. CBLP
failed to produce Osborne, and said it intended to meet the issues added against
it based on hearing exhibits and testimony of its general partner Richard Osborne, Frederick's brother. After CBLP presented its case, the concerned parties still
believed that the witness was necessary to resolve the added issues, and the ALJ
again ordered CBLP to produce the witness. After CBLP's counsel said the witness would not be produced, the ALJ dismissed CBLP's application, finding the inability
tc produce the witness to be in defiance of the ALJ's directives. The Review Board affirmed the Judge's decision and the FCC concurred with the Board, saying
that no hearing system can function effectively if parties deliberately disregard an ALJ's orders.
The FCC denied Gulf Dunes Broadcasting, Inc., current licensee of
WOKD(Am) /WXKT(EM) in Arcadia, FL, reconsideration of imposed license renewal
conditions. Gulf Dunes had requested that the FCC eliminate the reporting
conditions and grant its license for a full term. Gulf Dunes had received its
license for the station in a transfer from Dakos Broadcasting, Inc. in December of
1989. In a separate action, the FCC issued a forfeiture order to Dakos for
$18,000 for its violation of FCC EEO rules. Dakos was still the licensee of the
stations at the time the FCC renewed the license for a short term with reporting
conditions subject to a Notice of Apparent Liability (NAL) for $18,000. The
Notice was issued to Dakos for past EEO violations. Because Dakos did not respond
or pay the NAL, the FCC issued the forfeiture order. The short -term renewal and
reporting conditions were transferred from Dakos to Gulf Dunes when the FCC
renewed the licenses in June of 1990. Gulf Dunes responded by filing its request
for reconsideration, which was denied because Gulf Dunes could not justify removal
of the conditions or prove the FCC's renewal decision was in error.
The FCC affirmed its actions ordering MEG Associates, Ltd., former licensee of
WDAR(AM) /FM, in Darlington, SC, to forfeit $12,000 for willful and repeated
violation of FCC EEO rules. The action denied MEG's request to eliminate the
forfeiture and current licensee Radio Carolina Limited Partnership's petition for
reconsideration of the reporting conditions and short -term license renewal. The
FCC had granted the transfer of license from MEG to Radio Carolina in February
1989 while the former licensee's renewal applications were still pending. The FCC
conditioned the previous assignment grants subject to any action it would
ultimately take on the pending renewal applications. The licenses were renewed in
July 1989 for a short term, subject to reporting conditions, with a forfeiture of

MEG sought reconsideration of the action, arguing that no discrimination occurred and that it always had an equal opportunity policy, and that a forfeiture was excessive because MEG had already suffered severe financial losses. Radio Carolina argued against the short -term license renewal and reporting conditions because it was not the party found in violation of the EEO rule; and that because it acquired the stations before it was given notice of the FCC's actions, Radio Carolina did not know it had purchased stations with a questionable EEO program. After considering all of the factors used to determine the amount of a forfeiture penalty, and due to the lack of information from MEG regarding its inability to pay the forfeiture, the Commission affirmed its decision. In regard to Radio Carolina's petition, the Commission reiterated that the short -term renewal and reporting conditions for the stations were appropriate.
The Commission vacated the Review Board's decision granting the application of Elizabeth M. Younts for a new station at 102.5 MHz in Southern Pines, NC, and remanded the proceeding for further hearings. The ALJ had earlier granted the application of Green Broadcasting, Inc. because it found Younts' application lacking in candor and refused to credit her integration proposal. The Board disagreed with the ALJ, finding nothing that cast doubt on Younts' testimony, and credited Younts' integration proposal and awarded her the grant. The Board found Younts to be the superior applicant under the comparative issue, but did not resolve issues concerning the other two applicants -- Green's integration proposal and a bankruptcy proceeding against another competing applicant, Richardson Broadcasting Group. Green and Richardson had requested a review of the Board's decision. In its review, the Commission found Younts to be evasive, that she testified falsely, and was not qualified to be a licensee. In addition, the FCC found that Richardson's bankruptcy proceeding raised issues concerning Richardson's present financial qualifications, and subsequently added issues to determine such qualifications and Richardson's integration proposal.
In other actions, the FCC granted the license renewal application of Group Six Communications, Inc. for WWOC-FM, Avalon, NJ, subject to reporting conditions and notified the licensee of apparent liability for forfeiture for $20,000 for EEO violations; denied the application of Bobby Duffy for reconsideration of a staff action which dismissed his application for a new station at 92.9 MHz in Anchorage, AK, and designated three other applications for a comparative hearing. Duffy and two other applicants had specified facilities below the minimum height required for a class C FM station and requested a waiver of the rule, which was denied.
According to the National Supervisory Network, the FCC has been issuing letters to
several stations that detail certain areas in which the stations need improvement. Among the areas specified were failure to meet Emergency Broadcast testing requirements and incomplete public inspection files. In addition, some letters detailed specific fine amounts that could levied for such violations as improper base fences at AM stations ($20,000), AM direct antenna parameters not within tolerance ($12,500), and over -power operation ($12,500). The letters also said that compliance with FCC requirements would be verified in field inspections "in
the near future."

Westwood One has dropped Scott Shannon's Top 30 Countdown show. Shannon said he is currently negotiating for a new network home for the show, which will have its final Westwood airing the weekend of March 21 -22. Shannon's show ran on Westwood for over seven years.
Vanguard Audio Features is offering a daily short form feature called "Personal Performance Digest," which will address mental performance techniques in both work and leisure. The two -minute feature is hosted by sport psychologist Dr. James E. Loehr, who will discuss such topics as "How to put fun into a pressure -packed workplace," "Using humor to stay in control of our meetings successful: Putting visualization to work."
