About NBCC

We Are Advocacy in Action In 1991, The National Breast Cancer Coalition launched a revolution when it declared a mission to end breast cancer. Since that time, NBCC has challenged business as usual, and faced controversy head on. There has been progress, but not enough. In the United States, we still lose more than 40,000 women every year to breast cancer, and around the world that number is nearly 500,000. That is not success. In September 2010, NBCC again launched a revolution in the battle to end breast cancer with a new weapon— Breast Cancer Deadline 2020®—the end of breast cancer by January 1, 2020. Backed by a coalition of hundreds of organizations and tens of thousands of individuals, NBCC is creating a paradigm shift in the breast cancer world that is changing the conversation and refocusing resources and efforts to the areas that will end breast cancer: 1. Primary Prevention: How do we stop people from getting breast cancer in the first place? 2. The Causes & Prevention of Metastasis: How do we stop people from dying of breast cancer? NBCC has four strategies to achieve its goal: • Targeted research, including new research strategies and research collaborations • A public policy approach, including federal legislation • Grassroots advocacy and education of a large corps of activists to engage their communities • Communications and media outreach to change the conversation to ending breast cancer by 2020

We Challenge Business as Usual and Create Change NBCC has a long history of taking on big issues in breast cancer. Our two sister organizations NBCC, our advocacy arm, and the National Breast Cancer Coalition Fund, our education and research organization, have changed the world of breast cancer.* The Coalition’s advocacy has resulted in nearly $2.5 billion of new federal funding for innovative breast cancer research. NBCC demanded—and won—a place for advocates wherever decisions are made in breast cancer research and health care. Through innovative training programs such as Project LEAD® and the Annual Advocate Summit, NBCC prepares advocates to provide an informed patient perspective in designing research, setting a research agenda, determining quality care and other highly specialized areas of breast cancer activism. NBCC created and fought for passage of federal and state laws ensuring that underserved and uninsured women diagnosed with breast or cervical cancer were guaranteed access to quality treatment, launching a system of health care for thousands of uninsured women. NBCC keeps a watchful and critical eye on media and publications about breast cancer, and offers unbiased analysis of research and health care through media alerts, position papers and our Beyond the Headlines program. NBCC has evaluated and analyzed systems of health care delivery as the basis for our Guide to Quality Breast Cancer Care, which is provided to the public free of charge, so women with the disease can make informed decisions and promote systems change. For more than a decade, NBCC has made access to quality health care for all a top legislative priority and in 2008 released a Framework for a Health Care System Guaranteeing Access to Quality Health Care for All. NBCC supported the March 2010 passage of the Patient Protection and Affordable Care Act (PPACA), which marks an unprecedented step forward and reflects many of the principles and priorities NBCC adopted in the Framework.

Congressional Record of Support for NBCC Legislative and

Public Policy Priorities – Overview

The National Breast Cancer Coalition (NBCC) presents its Congressional Record of Support for NBCC’s legislative priorities in the 111th Congress. In this Congress, the Coalition’s priorities included both specific legislation and public policies for which no legislation had yet been introduced. This record credits Members of Congress for their support on NBCC’s priorities and gives an assessment of Congressional support for NBCC’s public policy goals. This Record contains information about NBCC’s legislative and public policy priorities only – it does not include all votes and bills related to breast cancer. NBCC’s legislative priorities were developed after a great deal of research and analysis, and with input from women across the nation and their families. The Coalition’s legislative and public policy agenda stem from its mission and goals. NBCC is dedicated to helping Members of Congress make informed decisions about breast cancer and to educating women and men across the country about this important public policy issue. To that end, NBCC has compiled a Congressional Record of Support annually to remind public policy officials and their constituents that breast cancer is both a health issue and a political issue. NBCC and its advocates have worked for years to develop strong relationships with Members of Congress; letting them know what issues are important for women and men with breast cancer and their families and asking them to support legislation to address those issues. The 111th Congress was helpful for women living with breast cancer and their families. The Patient Protection and Affordable Care Act passed in April 2010 marked a significant and unprecedented step forward and reflected many of the principles and priorities NBCC adopted in our Framework for a Health Care System Guaranteeing Access to Quality Health Care for All back in 2007. While not perfect, the legislation opens the door to coverage for those who have been shut out due to a pre-existing condition. It means that the insurance coverage patients expect will be there when it’s needed. For the tens of thousands of women with breast cancer and their

families, it means no longer having to worry about losing their insurance coverage if they lose their job or having to go into bankruptcy when their coverage runs out. It also means much needed support for individuals and small businesses to purchase coverage that has long been out of reach. In addition, the 111th Congress continued to provide significant support and funding for the Department of Defense (DOD) peer reviewed Breast Cancer Research Program (BCRP). This support and funding allowed the DOD BCRP to continue to lead the way in forging new and innovative directions for breast cancer research and remain a model others continue to replicate. The additional $300 million dollars appropriated in the fiscal year 2010 and fiscal year 2011 Department of Defense Appropriation bills brings the overall DOD BCRP funding total to more than $2.5 billion since the start of the program.

Priority # 1

Guaranteed Access to Quality Health Care for All

Goal: Comprehensive health care reform that will guarantee access to quality health care for

all.

What NBCC Asked Member of Congress To Do:

2009

Vote for HR 3962, the Affordable Healthcare Choices for America Act (passed by the House on

11/7/2009) and vote in support of a modified version of HR 3590, the Patient Protection and

Affordable Care Act (passed by the Senate on 12/24/2009).

2010

Vote for the final health care reform bill, Health Care and Education Reconciliation Act (H.R.

4872) of 2010 (signed into law by President Obama March 30, 2010).

Background:

For more than a decade, the National Breast Cancer Coalition (NBCC) has made access to

quality health care for all a top legislative priority. In 2007, the NBCC grassroots Board of

Directors approved a Framework for a Health Care System Guaranteeing Access to Quality

Health Care for All outlining the essentials to creating a fair and effective health care system.

The Coalition has a longstanding commitment to advancing evidence-based medicine and

training consumers to strive towards systems change. Therefore NBCC supported passage of

the Patient Protection and Affordable Care Act (PPACA).

NBCC is pleased by a number of provisions in the legislation, including those that may:

Expand access to meaningful, quality and affordable coverage provisions,

Tackle health care system costs,

Emphasize quality improvement in care delivery,

Provide for research in the comparative effectiveness of treatments and

Ensure that consumers and patients have a significant role in health care decision

making at several junctures in the health care system.

We believe these core elements are vitally important not only to women and men with and at

risk for breast cancer, but to everyone.

We know that the work to truly reform and transform our health care system is just beginning.

The new health care reform law, while important, does not address many areas of concern. For

those it did address, many compromises were required along the way. The bill falls short of the

original vision and goal in NBCC’s Framework: to achieve a well thought out and well designed

health care system available to everyone.

The bill does quite a bit to expand access to coverage to those who are uninsured or at risk of

losing their coverage but is limited by the fact that it builds upon the existing employer-

sponsored system. In addition, it remains to be seen whether coverage will be affordable for

all. Moreover, more progress must be made to control spiraling health care costs.

Additionally, we must forge ahead on a system that is driven by quality improvement and

founded on a delivery model of medical care and treatment based on science and evidence.

Status:

Since passage of the Patient Protection and Affordable Care Act in March 2010, several

essential insurance reform provisions of the Patient Protection and Affordable Care Act have

gone into effect. These new provisions are important first steps toward meaningful and

positive progress for women with breast cancer and will mark a significant improvement in our

insurance system over time.

Access to insurance coverage through temporary new high risk pools for people who

have been denied coverage and are uninsured because they have a history of breast

cancer.

Private health insurance reforms that will eliminate pre-existing condition exclusions,

require guaranteed issue, prohibit plan rescission except for fraud or intentional

misrepresentation, and ban lifetime and restrict annual coverage limits.

Health care information and support through state offices of consumer assistance and

a federal web portal with relevant materials on coverage options and plan rules, as well

as stronger consumer protections against health insurance plan abuses (including access

to an external appeals process) and cost increases.

The Road Ahead on Health Care Reform

As the implementation process moves forward, NBCC believes that trained patient advocates

should play a key role in achieving this goal and in reforming our health care system. NBCC is

closely following developments at the federal and state level. We look forward to our

continued work to implement the many important provisions in the health care reform law and

to make certain that the voices of those living with breast cancer are heard every step of the

way.

Affordable, Accessible and Comprehensive Coverage: Thousands of additional individuals will

have access to more affordable and comprehensive coverage due to:

An expansion of Medicaid to 133 percent of the federal poverty level and below,

New private health insurance options for individuals and small businesses through

health insurance exchanges,

Premium assistance through a sliding scale refundable tax credit for individuals between

100 and 400 percent of poverty to purchase qualified coverage.

As the Secretary of HHS works to define what constitutes ‘qualified coverage’, NBCC will be

pushing to ensure the benefits package guarantees coverage for care that is based on scientific

evidence and is continuously reviewed and updated based on available best practices.

Coverage should provide access to care that is medically effective, cost efficient, and most

important, appropriate and truly affordable.

Access to Clinical Trials: Clinical trial participants are assured that routine costs will be covered

and they do not risk losing their insurance coverage.

Quality Improvement: NBCC strongly supports the research and analysis to determine the most

effective and appropriate treatments for women and men with breast cancer through the

Patient Centered Outcomes Research Institute. The development of quality measures through

a multi-stakeholder consensus process as well as testing of innovative payment and delivery

models through the Center for Medicare and Medicaid Innovation is a good start toward

integrating into our health care system a process for measuring what is working so quality of

care can be improved continuously.

Role for Educated Consumers: There are a number of areas that will have an impact for women

with breast cancer and all consumers, where their voices should be heard. NBCC believes that

educated health care consumers should:

Play a role in all aspects of the health care system,

including shaping what constitutes essential

health insurance benefits,

Assist in the development of quality measures,

formulating comparative effectiveness research

priorities,

Determine how information regarding coverage

and treatment options should be presented and

articulated to consumers and patients, and

Work with the scientific community to determine

barriers and make recommendations regarding

the successful translation of basic science.

Medicaid Coverage for Breast and Cervical Cancer: NBCC

is also working during this transition to make sure that

low-income, uninsured women diagnosed with breast or

cervical cancer through the CDC screening program will

continue to have access to Medicaid coverage for their

treatment. All 50 states and the District of Columbia have elected to include this option in their

Medicaid programs under the Breast and Cervical Cancer Treatment Act (P.L. 106-354), which

NBCC fought for to protect vulnerable women diagnosed with breast or cervical cancer.

NBCC believes that the new health care reform law is a good beginning. However, many

important provisions were not in the final reform package, including the establishment of a

public option for health insurance. Additional polices are needed to ensure a system in which

health insurance benefits are based on interventions proven to be efficacious, safe, cost-

appropriately contributing to the evidence base. Our health care system will not successfully

overcome the problems due to significant cost pressures until coverage is informed by the best

available science.

Priority #2

$150 million for FY2010 and FY2011 for the

Department of Defense Breast Cancer Research

Program

Goal: Appropriation of $150 million for the Department of

Defense Breast Cancer Research Program (DOD BCRP) for fiscal years (FY) 2010 and 2011.

What NBCC Asked Member of Congress To Do:

Sign a letter to the Chairmen and Ranking Members of the Senate and House Defense Appropriation Subcommittees requesting an appropriation of $150 million for the DOD BCRP for FY2010 and FY 2011.

Status:

2009:

During the first session of the 111th Congress, 171 Members of the House and 52 Senators signed on to the letter in support of this program. NBCC commends Congress for enacting $150 million dollars for the fiscal year 2010 Department of Defense peer reviewed Breast Cancer Research Program.

2010:

During the second session of the 111th Congress, 174 Members of the House of Representatives and 49 Senators signed on to the letter supporting $150 million for the DOD BCRP. NBCC commends Congress for including $150 million dollars for the Program for fiscal year 2011.

Background:

The Department of Defense peer reviewed Breast Cancer Research Program (DOD BCRP) was created as a result of NBCC’s 1992 “$300 million more” campaign. NBCC launched the original 1992 campaign to support its goal of increased federal funding for breast cancer research. At that time, the federal government was spending only $100 million on breast cancer research. NBCC held a research hearing, during which testimony was given by 15 of the nation’s most prominent breast cancer research scientists. Based on the hearing and other research, NBCC determined that an additional $300 million would be needed in 1993 to study breast cancer. Led by NBCC, women arrived in Washington, D.C. by the busload and swamped Congress with constituent visits. In addition, phone calls, faxes and telegrams through NBCC’s hotline were sent to the Hill demanding $300 million more for breast cancer research.

NBCC succeeded and Congress passed an appropriation of more than $400 million -- the first-ever significant increase in federal breast cancer funding. A substantial portion of that increase, $210 million, came from the defense budget of the Department of the Army to establish the DOD BCRP. Due to its outstanding success and bipartisan support as a result of NBCC’s advocacy, Congress has continued to fund this Program each year bringing its total to more than $2.5 billion for peer reviewed breast cancer research.

The DOD BCRP has led the way in forging new and innovative directions for breast cancer research and is a model that others have replicated. At the urging of NBCC and the Institutes of Medicine (IOM), the Program incorporates unique features such as the inclusion of consumer advocates at every level, including the scientific merit review and programmatic review levels. The DOD BCRP is also a model for accountability and transparency in federal research programs. This was demonstrated again at the fifth DOD BCRP “Era of Hope” meeting held in June 2008, where BCRP-funded investigators were required to share their results with the scientific community, policymakers and the public. The meeting also allowed investigators from different fields to share knowledge and ideas that could lead to novel approaches to difficult research problems.
