The People of NITA
National Institute for Trial Advocacy 2007 Annual Report
2
To Our Community Members:As I write this letter, it is the 40th anniversary of the assassination of Dr. Martin Luther King, Jr., in Memphis, Tennessee. In only a few more weeks, we will also mark the 40th anniversary of the assassination of Senator Robert F. Kennedy, while he campaigned for the Presidential nomination.
Reflecting on those twin events calls to mind the turbulent times in which they occurred, and on the birth of the National Institute for Trial Advocacy a few years later. NITA’s mission, promoting ethical advocacy through the training of lawyers, was forged while the nation struggled to cure the denial of justice. In the ensuing years, this mission has provided
inspiration to the legal careers of those of us involved in NITA’s work. NITA has drawn some of the most driven, ethical, and compassionate professionals to work and volunteer.
Through training more than 100,000 lawyers, many of whom serve the disadvantaged, NITA has always pursued justice. In February 2007, at our landmark Chicago conference we reaffirmed NITA’s core values and brainstormed its future, ensuring that NITA will remain relevant and useful to new generations of advocates through innovation and commitment to excellence.
The dedicated NITA community includes not just staff, board members, and faculty members. It also includes tens of thousands of program alumni, thousands of law school professors who adopt our publications for their classrooms, and hundreds more who demonstrate their commitment by donating to the NITA Foundation.
In 2007, NITA held 311 programs including public, in-house, public service, and co-sponsored programs; almost 50 more than in 2006. NITA also sold more than $2.8 million in publications to program participants, law school students, and attorneys. And NITA continues to expand its influence on justice systems outside the United States through partnering with law societies to conduct training for lawyers in countries as diverse as Northern Ireland, South Africa, and Japan.
As we reflect on the sobering events of 1968, we rededicate our efforts to teaching these values of justice, equality, ethics, and community to new generations of lawyers. Echoing the sentiments of NITA’s President, Lonny Rose, I want to thank each of you for working to attain the goals of Dr. King and Senator Kennedy and pursuing a rational, humane, and lawful method of resolving conflict.
On behalf of the NITA Board of Trustees, thank you for your support of and dedication to this important organization.
Sincerely,
Louise A. LaMothe Chair, NITA Board of Trustees
MissionNITA, a 501(c)(3) charitable organization, is a dedicated team of law practitioners, judges, and professors who believe that skilled and ethical advocacy is a critical component of legal professionalism and all systems of dispute resolution that seek justice. NITA’s mission is to
• Promote justice through effective and ethical advocacy;
• Train and mentor lawyers to be competent and ethical advocates in pursuit of justice; and
• Develop and teach advocacy skills to support and promote the effective and fair administration of justice.

Advocacy TrainingSince 1971, NITA has provided advocacy skills training and continuing legal education programs. The NITA learning-by-doing methodology is unparalleled and continues to be the tried and true route towards joining the world’s most successful litigators. In our 2007 public programs NITA provided outstanding trainings for 2,938 attorneys.
The NITA Education Center (NEC), also NITA’s administrative headquarters, houses thirteen mock courtrooms and fourteen conference rooms equipped with digital recording and playback, presentation technology and wireless Internet access. The fact that our faculty is able to record and playback performances allows each participant one-on-one time with experts in addition to the faculty feedback in the classroom. This critique is what sets NITA apart from other continuing legal education providers. NITA is not just a CLE provider; it encompasses “Teaching the Art of Advocacy.”
NITA is always seeking new, talented faculty to join the cadre of top attorneys, judges, and professors who work with our esteemed program directors and teach at various NITA programs around the world and throughout the year. All faculty volunteer their time and are able to not just lecture, but provide interactive workshops tailored to the NITA method. With a target ratio of one faculty for every four participants, attendees receive personalized feedback and critique that immediately improves their skills. Without all 1,000 of the NITA faculty, we could not provide the trainings we do.
I had a fantastic experience at this seminar, with great instruction, great feedback, and great practice opportunities. Thanks for a wonderful learning experience!

An experience that every lawyer could benefit from tremendously, and is lucky to have once in his or her career. Thank you for the professional and personal enrichment from the outstanding judicial and trial experts you offered during this program. I am very grateful to each of them.

The NITA experience impacted my practice because the faculty showed me how to advocate and how to think on my feet. In Mexico, during my legal studies and practice I only learned the law and learned how to write essays and legal opinions to legal issues, but at NITA I learned how to be a lawyer. For the first time, in the NITA National Session, I felt like a lawyer.

Advocacy Training In-House, On-Site
When it comes to custom litigation and advocacy skills training for legal organizations, NITA is the market leader, training more than 3,000 attorneys in 2007 through over 200 in-house professional development programs, to law firms throughout the US and abroad, including over a third of the National Law Journal’s 250 largest law firms.
NITA in-house programs are delivered by a faculty of over 125 of the nation’s leading law practitioners, judges, and professors who partner with members of the firm to provide a program with depth and breadth. NITA has helped organizations from government agencies to law firms to universities develop their own customized trainings.
Many of NITA’s clients appreciate the ability to do NITA in-house trainings because it meets their professional development goals. Some of those goals include • Compressing the learning curve so that associates can rapidly provide clients with superior—and more billable—work product • Positively impacting associate morale • Providing a competitive advantage in recruiting efforts
• The charges for these programs are significantly less than the cost of developing and conducting programs using internal resources only
NITA has developed highly effective methods for assisting firms in providing in-house training of the highest quality. I always know that NITA’s programs will be right on target, that the NITA faculty will be top-notch, and that our lawyers will enjoy immediate results.
~Carl Circo, Director of Professional Development Stinson, Morrison, Hecker, Kansas City, Missouri
We have run our in-house training programs at facilities, private and public, all over the country, and not one even compares with the NITA Education Center. The layout of the courtrooms and conference rooms, the technology/equipment, and the staff support have no equal anywhere. It’s also, of course, a beautiful place to bring people.
~Steven D. McCormick, PC, Partner Kirkland and Ellis, LLP, Chicago, Illinois

Our firm has been very satisfied with NITA’s in-house training programs. We offer a different program to our associates each year, and every year the program is over-subscribed.

The NITA Foundation The NITA Foundation is committed to fully fund a number of public service programs, as well as give need– based and mission-based scholarships. The free programs build on five areas in which NITA has been active over the last decade: legal services, death penalty, tribal justice, child advocacy, domestic violence, and other public service training. NITA also partners with other organizations such as The Center for Legal Aid Education, Equal Justice Works, Lawyers Without Borders, government agencies and various firms in order to serve specific populations within and outside the United States.
Your contribution to the Foundation supports a number of no-cost or reduced-rate public service programs as well as provides need- and mission-based scholarships. To learn more about the work of the Foundation in these areas, please contact us via e-mail at [email protected] or visit us online at www.nitafoundation.org.
NITA Advocates SocietyFormerly called the NITA Alumni Association, the NITA Advocates Society (NAS) has been expanded to include judges, lawyers, law professors, and all friends of NITA. Members of the NAS are some of the best legal minds in the world who further our work in the legal community by fostering effective and ethical advocacy. NITA Advocates support the work of the Foundation with charitable giving above the basic dues membership fees, and all members receive benefits such as discounts on publications and programs. For more information, please visit www.nita.org/donate. Due to space limitations, we can only acknowledge members of $1,000 and above in this annual report.
This was my first introduction to NITA, and I was incredibly impressed. I feel very fortunate to have taken the training and been taught by the faculty that were there. Thank you.

Our Scholarship Program–Ensuring Justice for AllEvery year, the NITA Foundation awards scholarships to worthy applicants who have demonstrated their commitment to public service by representing the underserved, indigent, and at-risk populations. The Foundation works to ensure that our programs are accessible to all with a special emphasis on those working at nonprofit organizations and legal aid offices. Often attorneys engaged in the public interest are working with the most vulnerable of populations.
Supporting our commitment to ensuring justice for all, the NITA Foundation awarded 268 scholarships totaling more than $372,000 in 2007. In the last two years, the Foundation is proud to have provided more than $744,050 in financial support. When you make a gift to the NITA Foundation’s scholarship program, your act of generosity is magnified by the work of each recipient.
Jim Jeans Memorial Scholarship FundThanks to the generosity of an anonymous donor, a gift of $50,000 began an endowment fund in memory of Jim Jeans. Mr. Jeans was one of NITA’s pioneers, a lawyer well-known for his brilliant storytelling and teaching style. NITA’s community of donors raised over $24,000 to bring the total endowment to $74,134. This fund will provide one full scholarship each year for a public service attorney to attend the National Session, NITA’s premier training program.
Alston Jennings Memorial FundNamed for Alston Jennings, an invaluable member of the NITA faculty and former member of NITA’s Board of Trustees, this scholarship opportunity celebrates his memory and commitment to the community by providing funds to a worthy applicant from the Little Rock area of Arkansas. Mr. Jennings fought tirelessly to improve the skills of attorneys, especially those working on behalf of the underserved and disenfranchised. Through this scholarship opportunity, the legacy of Mr. Jennings continues to make an impact in the legal community, and in turn, all the lives touched by his generosity and passion for his vocation.
Domestic Violence–Ending Violence Against WomenBecause we recognize the urgent need to combat violence against women, we offer vital training to lawyers who assist victims of domestic violence, sexual assault, stalking, and dating violence. Our course is uniquely designed to assist these advocates, many of whom are working under the most difficult of circumstances in shelters and safehouses, to effectively represent these victims in the legal system. In 2007, ninety-four people attended at least one of our three training courses, with one course specifically designed for those advocates working within the tribal system. Our courses are funded by a grant from the Office of Violence against Women, Office of Justice Programs of the U.S. Department of Justice.
The scholarships offered by the NITA Foundation enable attorneys like me who transition into nonprofit legal services from non-trial oriented practices to more effectively serve low-income clients without taxing organizational resources. Certainly, my efforts to improve the lives of our low-income clients and their families is markedly enhanced by [the] NITA Foundation’s scholarship opportunity.

International ProgramsGiven NITA’s reputation as the foremost organization engaged in the training and mentoring of lawyers in the art of effective and ethical advocacy, our staff, board, and faculty have been called upon by lawyers and associations across the globe for assistance. In 2007, twelve programs were held in various countries. We have offered assistance to advocates and judges in Northern Ireland, South Africa, Kenya, Mexico, Liberia, Phillipines, and Japan working to achieve a more ethical and just system of law.
Through a generous grant from the Ford Foundation, NITA provided educational opportunities for seven attorneys traveling from China to attend our Teacher Training Program. These Chinese advocates joined others from Mexico, Kenya, South Africa, Nigeria, and Ecuador to explore the art of teaching effective oral advocacy, along with its ethical underpinnings, to create a more just and democratic legal system in their home countries.
In a separate 2007 partnership we formed important relationships with Southwestern Law School, United States Agency for International Development, and nongovernmental organizations to promote judicial reform in Mexico. To facilitate this reform process, NITA has provided hands-on training and education to judges, law schools, and advocates dedicated to reforming the inquisitorial system in favor of a more open, adversarial system with oral proceedings.
Since our inception in 1971, NITA has supported the work of attorneys and activists across the world to promote the pursuit of justice and to provide human rights for all. We realize that such change only can occur with much preparation, training, and resources. A gift to the NITA Foundation ensures our ability to be a world citizen, championing change and reform in the name of justice.

Justice is how you can equalize things in society, and including how you can help poor people to achieve things that they can’t achieve otherwise.

Learning by Doing in PrintNITA publications have been an important and far-reaching resource in NITA’s programs, law school classrooms, and law firm libraries. Over 750 unique publications have been published in NITA’s time, encompassing a range of subject matters from trial advocacy to negotiation to federal rules. The year 2007 brought a variety of new publications that add value to our current active list of close to 250 texts, case files, reference, and audio-visual materials.
Publications sales generated over $2.84 million in revenue partly due to three new trial advocacy texts that incorporate the NITA learning-by-doing methodology. These new texts are written by authors new to NITA as well. Look for Winning at Trial (D. Shane Read), Winning Jury Trials (Robert H. Klonoff and Paul L. Colby), and How to Try a Jury Case (John F. Kimberling) now on the NITA publication list.
In February 2007, NITA moved its entire inventory from the former South Bend, Indiana, warehouse to Kable Media Services, Inc., in Oregon, Indiana. NITA seamlessly transitioned the entire order fulfillment process encompassing 58,366 textbooks, 31,769 case files, and 710 DVDs for a total of 90,845 units shipped during the calendar year.
As part of NITA’s customer-service oriented publications department, 139 reprint licenses were granted to various individuals and organizations, including law schools, bar associations, legal aid societies, and law firms. Reprints such as these are not only revenue sources, but also provide positive reinforcement that NITA materials are useful to our customers and partners in a wide variety of formats.
In addition to licensing, NITA also provides a special printing service for our own programs as well as our customers. In 2007, 86 different titles were incorporated into special printings and almost 4,500 units were compiled, printed, and sold.
