OF THE PUBTIC ATTORNEY'S OFFICEFOR THE YEAR 2018
PREFATO RY STATEMENT
Socrosonct in the Constitution is the occess to justice by the
underprivileged. Such ideolism ripened into reolity upon the
creotion of the Public Attorney's Office (PAO). With the strong
leodership ond effective monogement of its officiols, the PAO
progressed into the country's primory ond prominent low office
which provides free legol ossistonce ond other services to
pouper litigonts ond other quolified clients.
The PAO is delighted to present this Accomplishment
Report which documents its ochievements ond strotegies in
ottoining its objectives of o swift ond foir odministrotion of justice;
qnd occessible, efficient, ond effective delivery of legol services
to its clients for the Yeor 20,l8.
Very recently, the PAO, through the strong omnipresence
of its Chief Public Attorney ond the solid colloborotion of its
employees, wos issued o Quolity Monogement System (OMS)
(lSO 9001:2015) Certificotion by TUV Nord Philippines, lnc., on
occredited ISO-certificotion body. The soid Certificotion covers
oll the fronline ond support processes of the PAO Centrol Office
os well os the regionol offices of Regions lv-A (CALABARZON)
ond Cordillero Autonomous Region (CAR), ond the District
Offices of Posig City ond Conner, Apoyoo. Ultimotely, the PAO
intends to hove oll its regionol offices ond district offices ISO-
certified. This endeovor is in line with the priorities of the
Administrotion of President Rodrigo Roo Duterte for o

Notobly, in criminol coses, the number of ocquitlols(twenty-six thousond nine hundred thirty-two 126,932)) ondfovoroble resolutions (two hundred ninety-four thousond ondfive hundred lwenty-four 1294,5241 obtoined by the PAO

obove self, the PAO, through its Chief Public Attorney ond itsForensic Teom, heoded by Alty. Erwin P. Erfe, M.D., who, in spite
of being lhe torget of persistent vilificolions ond even debosingpersonol oltocks, brovely ond sleodfostly stond up to fight for
the couse of the viclims of the mossive inoculotion of the foulty
Dengvoxio voccine. As of December 2018, the PAO Forensic
Teom wos oble lo exomine the codovers of one hundred six
(106) Dengvoxio recipienls ond conlinues lo receive requesls for
forensic exominotion from lhe fomilies of the voccine recipients.
Of the one hundred six (106) outopsied victims who monifesled
the fotol risks previously identified by the Sonofi Posteur. the
monufocturer of Dengvoxio, seventeen (17) civil coses for
domoges hove been instituted before the Quezon City Regionol
Triol Courts (RTC) while thirty (30) criminol comploints for reckless
imprudence resulting in multiple homicides ond violotions of the
Anti-Torlure Acl ond Consumer Act hove been filed of the
Deportment of Juslice ogoinsl lhe speorheoders, proponenls,
monufoclurer, ond distributor of the Dengvoxio voccine.
Moreover, six (6) coses of Obstruction of Juslice were filed
ogoinst the Deportment of Heollh (DOH) Secretory, Dr. Froncisco
T. Duque lll. The PAO will be undeterred by the boseless ond

stotioned of the centrol office ond vorious regionol ond districtoffices notionwide whose dedicotion, professionolism,
resourcefulness ond lenocity yielded significont ond voluobleresults in the odministrotion of justice in the counlry os shown bylhe stolisiicol doto below.
ln 2017 olone, the PAO ossisled o totol of eleven million six
hundred sixteen thousond nine hundred sixteen ,11,616,916)
clients or thirty-one percent (3.l%), higher os compored with lheprevious yeor. For yeor 20'18, the totol number of clients ossisled
by PAO increosed lo lhirteen million three hundred forly-fourthousond ond lhree ( I 3,344,003). higher by fifteen percent ( 1 5%)
os compored with the previous yeor. This only shows the ever-growing need by the indigents ond other quolified persons forPAO's free legol services in the ottoinment of justice.
Among the morginolized clienls of the PAO ore, inter olia,
the PDLs (Persons Deprived of Liberty) who were benefitted byRepub/ic Acf (R.A.) No. 10951 vis-d-vis the Hernan vs.
Sondigonboyon cose (G.R. No. 217874,5 December 2017). As of3'l December 2018 ond in totol, public ottorneysnolionwide olreody ossisled lwo thousond one hundrednineteen (2,119) PDLs in consononce with R.A. No. 10951. The
former pursued the necessory legol remedy/ies for them in
deference lo the Order of the Supreme Court in the
oforementioned cose, ond to continue the PAO's noble work forlhis volued group in its roster of clienis.

THE OFFICE
Republic Act (R.A.) No. 94A6, entitled "An Act Reorgonizingqnd Strengthening the Public Attorney's Office (PAO)"
estoblished the PAO os on independent ond outonomous Officeottoched to the Deportment of Justice only for the purpose ofpolicy ond progrom coordinotion. The low exponded the
mondote of the PAO to include providing free legol services ondossistonce to indigent clients, other quolified persons, ond in the
exigency of the seryice, when colled upon by propergovernment outhorities, to render such service to other persons,
subject to existing lows, rules ond regulotions, in oll criminol, civil.

spoces like the PAO-Monilo Districl Office, etc.

Despite the high turn-over role of Public Altorneys, primorily
due to resignotion to engoge in privole low proctice, lronsfer to
the Notionol Prosecution Service (NAPROSS), to the judiciory, or
to other government ogencies ond government owned ond

On their scheduled duties, the public ottorneys ond stqff ofthe PAO-Centrql Office hove been olternotely providing legol
ond inquest proceedings ossistonce even during night time,
weekends ond holidoys since October 2009. For this purpose,
the PAO hotlines, 929-9436, 426-2801, 426-2450, 426-2987, ond426-2683 (locol 106 or 107 during office hours ond /ocol 159 ofteroffice hours) ore open to the public 2417.
ln September 2010, the coveroge of this progrom wos
exponded to serve the people covered by the regionol ond
district offices of the PAO, notionwide. Since then, the soid
offices hove been rendering /ego/ ossislonce (e.9. legol odvice,ottending to the legol needs of suspects in the police stotions
within the territoriol jurisdiction of the concerned PAO
regionol/district offices) up to 10:00 P.M. everydoy (including
weekends ond holidoys). Further, the ossigned PAO inquest
public ottorneys ond stoff therein remoin on coll, even beyond
PAO ACCOMPLISHMtrNT RtrPORT F'OR THE YEAR 2018 I)age 11 of 38

notionwide.

The policemen who were indicted in the cose of Kion Loyd
Delos Sontos (Kion) were found guilty of Murder by RTC Judge
Rodolfo P. Azuceno, Jr. on November29,2018.
Kion wos the 17-yeor-old minor who died on August 16,2017
while cerloin members of ihe Coloocon Police were conducting
on onli-illegol drug operotion in Coloocon City. The police
conlended thot o shoot-out led to Kion's deoth. However, this wos
controry to lhe CCTV footoge which showed thol Kion wqs
drogged by the police to lhe ploce where he wos killed. The
evidence on the videotope bolstered ihe verociiy of the findings
of the forensic exominolion conducled by the PAO Forensic
Loborotory led by its Director, Alty. Erwin P. Erfe, M.D. The soid
forensic exominotion showed lhot Kion sustoined three (3)
gunshot wounds - two (2) in the heod which moy hove been
inflicted while he wos on the ground on o prone position ond one

Since the undersigned's ossumption of office, it hos been
her bottle cry to put into oblivion the troditionol impression ofpublic offices littered with office supply ond obsolete ond/orworn out office equipment. With the purchose of the foregoing

1. PAO.NLRC SUB-STATION
By virtue of o lr4emorondum of Agreement (MOA) befween
the Public Attorney's Office (PAO) ond the Notionol Lobor
Relotions Commission (NLRC), the Office mointoins its sub-stotion
of the NLRC, locqted in Bonowe in Quezon City, to serve its
clients.
The sub-stotion focilitotes the rendition of legol ossistonce
to comploining workers before the NLRC ond oims to expedite
the proceedings; hence, it mokes its services more occessible to
comploining workers.

occomplished by the Public Attorney's Office through the Legol
Reseorch Service.
3. ADMTNISTRATIVE COMPLAINTS AGAINSI PAO EMPTOYEES
From Jonuory to December 2018, I54 coses were resolved
ond terminoled oul of 295 active odministrotive comploinfs
received by the PAO - Legol Reseorch Service. As o result of
ihese coses, severol PAO Personnel received odministrotive
sqnctions, ofter due notice ond heoring pursuont to the Revised
Rules on Administrotive Coses for the CivilService.
