Report of the Elections and Boundaries Commission on the Parliamentary By-Election held on Monday 4th November 2013

The Elections and Boundaries Commission (the Commission) is bound by sub-rule (6) of rule

108 of the Election Rules in the Representation of the People Act, Chap. 2:01 (the Act) to prepare a printed report on the Parliamentary By-election held in the electoral district of St. Joseph on 4th November, 2013, giving:

"(a) the number of votes polled for each candidate, by polling divisions; (b) the number of rejected ballots; (c) the number of names on the revised lists of electors and on the list of

special electors; and (d) any other information that it may deem fit to include,"

and to forward a copy of said report to the Speaker of the House of Representatives.

In compliance therefore with these provisions, the Commission submits its report.

The information in respect of (a) and (b) is given in Appendix I, and, that in respect of (c) in Appendix II.

Other information deemed pertinent as required under (d) is provided by the following:

1. Electoral Registration and Revised List

Pursuant to Section 30 of the Act, an Electoral Registration was conducted with effect from Wednesday rd October, 2013 to Thursday 10th October, 2013. The Registration

Area Offices of San Juan and Tunapuna were involved in the electoral registration. The

Electoral District of St. Joseph comprises forty-three (43) Polling Divisions; thirty-three (33) from the Registration Area of San Juan and ten (10) from the Tunapuna

Registration Area.

During the period of the Electoral Registration thirteen (13) transactions altogether were effected. These are: one (1) first-instance registration; nine (9) changes of address from one registration area to another, and three (3) within registration areas. Eleven (11) of the transactions were completed at the San Juan Registration Area Office while the other two (2) were made at the Tunapuna Registration Area Office.

The number of electors on the Revised List of Electors for the Parliamentary Election

held on Monday 24th May, 2010 for the electoral district of St. Joseph was twenty-five thousand, nine hundred and forty-three (25,943) whereas the number for the By-Election

on Monday 4th November, 2013 had increased by eight hundred and seventy-nine (879) to twenty-six thousand, eight hundred and twenty-two (26,822); an increase of

approximately 3.4%.

2. Polling Stations and Staffing

The number of Polling Stations established totalled fifty-three (53) and were located at

nineteen (19) venues. Refer to Appendix III.

The St. Joseph By-Election was held a mere two (2) weeks after the Local Government

Election of Monday 21St October, 2013. As a result, the polling-station staff utilized at

the fifty-three (53) polling stations for the Local Government Election were again recruited. Having undergone a period of training for the Local Government Election, there was no need for further training for the purpose of the By-Election.

The poll day staff comprised fifty-three (53) Presiding Officers; fifty-three (53) Deputy Presiding Officers; one hundred and six (106) Poll Clerks; fifty-three (53) Officers-in-Charge of Ballot Boxes; seventeen (17) Information Officers, three (3) Roving Officers and three (3) Reserves for a total of two hundred and eighty-eight (288) persons.

3. Contesting Parties and Conduct of the Poll

Nomination Day was fixed as Monday 14th October, 2013. At the close of Nomination

Day proceedings five (5) candidates including an Independent were nominated to contest the By-Election. The Independent candidate, Mr. Errol Eversly Fabien chose the Heart as his symbol in accordance with Election Rule 23 (1) of the Act. The names of the

The total number of persons who cast their vote in the St. Joseph By-Election amounted

to fourteen thousand, two hundred and forty-nine (14,249). That is to say, approximately 53% of the listed electorate exercised their franchise. There were thirty-four (34)

rejected ballots or approximately 0.24% of the ballots cast.

The total number of electors who qualified to vote as special electors was one hundred and eighteen (118) or 0.44% of the St. Joseph electorate. Ninety-six (96) of those voted.

4. Commission Monitoring

On election-day the Chairman and other members of the Commission were deployed in such a manner as to permit observation of conduct of the poll in all fifty-three polling stations. Overall it was found that electors were free to express their will. However, two important incidents were brought to the Commission's attention. These were the disablement to vote of one person who had been previously registered as a non-elector and who had since attained the age of eighteen but had not been deemed as an elector; and, the assignment of persons living at the same address to different polling divisions.

Also, it was observed that ramps were not provided at several locations thereby making it difficult for the differently-abled electors to exercise their franchise.

5. Results

Mr. Terrence Deyalsingh of the People's National Movement was declared the winning candidate having received six thousand, three hundred and fifty-seven (6,357) votes or approximately 44.6% of the votes cast. The candidate of the United National Congress secured five thousand, five hundred and seventy-seven (5,577) or just over 39% of the votes cast. The Independent Liberal Party candidate obtained one thousand, nine hundred and seventy-six (1,976) or nearly 13.9% of the votes polled. The candidate from

the Democratic National Assembly got five (5) votes whereas the Independent Candidate polled three hundred (300) votes. Thus, the latter two candidates lost their deposits.

6. Election Campaign

As in the three previous elections held earlier in the year, it was very glaring, the vast sums that were expended on media advertising particularly in the Press, Radio and

Television, in support of candidates and parties.

Weeks before election-day the air waves vibrated with a gallimaufry of media messages, the mantra "The following is a paid political announcement." punctuated television

programmes incessantly to the point of sensory deprivation. Live entertainment and assorted performances on the hustings were combined with openly insulting behaviour

between political rivals.

In previous reports mention was made of the Commission's submission to Government of recommendations on Registration of Political Parties and Political Party Financing-

and Campaign-Financing. During the preparation of this report, plans were afoot for the Commission, in collaboration with a number of regional and extra-regional agencies to partner with the Trinidad and Tobago Transparency Institute in mounting a Symposium on these very same topics, to which political parties, civil society organisations and other

stakeholders would be invited. The plan was also being designed to include separate meetings with political-party participants at the Symposium on the two days immediately following the event in order to determine their attitude to the issues raised at the meeting and to arrive at points of consensus which could be used in the drafting of

the structure of appropriate legislation.

The Symposium on Registration and Funding of Political Parties was duly held on 4th

December 2013 at the Century Ballroom, Queen's Park Oval and meetings with political

parties were held over the period 5th-6th December 2013. The Commission intends to

hold future meetings with these stakeholders.

7. The Case of Ian Leslie Alleyne

An issue which attracted a great deal of public attention — a veritable cause celibre —

surrounded questions relating to his residential qualifications and entitlement to vote in the St. Joseph By-election of 4th November 2013, of the UNC candidate, Mr. Ian Leslie

Alleyne.

By Election Rule 16 of the Act a Returning Officer is required to give Notice of Taking a Poll, as soon as possible after Nomination Day, by causing to be published in one or

more daily newspaper, the name, address and occupation of each nominated candidate.

In the Notice of Taking a Poll published by means of paid advertisement in the local

press on 14th October 2013, Mr. Alleyne's address was stated as No. 21 Sevilla, Brechin Castle, Couva in the Registration Area of Couva where he was not registered as an elector. However, in the Revised List of Electors published by the Commission for the

November 4th By-Election, his address was recorded as 49 Palm Road, Valsayn, which is

located in the constituency of St. Joseph.

Thus, there arose public concern about Mr. Alleyne's entitlement to vote in the election given the contrariety of addresses in the Notice of the Poll and in the Revised List, and the announcements in the Press about the polling station in the constituency of St. Joseph where he had planned to vote, its location and the time when he would do so. Speculation was voiced in at least one television broadcast that the appearance of Mr. Alleyne's name on the Revised List of Electors at the registered address in Valsayn was the result of some species of malfeasance on the part of a member or members of

Commission.

The Chairman of the Commission requested the Chief Election Officer to conduct an

immediate investigation in order to ascertain the registration and electoral status of

Mr. Alleyne.

The investigation revealed that since 1997 Mr. Alleyne's registration record has carried the address, 49 Palm Road, Valsayn South. Further, the Commission's registration records indicate that no one by name Ian Leslie Alleyne is registered in any electoral district in Trinidad and Tobago other than at the address in St. Joseph as aforementioned. Neither is there any evidence that Mr. Alleyne had notified any Registration Area Office

of any change or impending change of address.

It is Section 12 of the Act which defines the qualification requirement of an elector for an electoral district at a Parliamentary, or Tobago House of Assembly election, viz.

citizenship of Trinidad and Tobago or of the British Commonwealth, and residence in a particular electoral district for at least two months preceding the qualifying date.

Prior to the enactment of the Representation of the People (Amendment) Act, No. 51 of 2000, Section 12(c), now repealed, but at present referred to in Section 11(2), was worded: "has resided in that electoral district for a period of at least two months preceding the qualifying date". These are the exact words stated in Section 12(1) of the extant ROP. To quote eminent Counsel: "Clearly, Parliament like Homer "nodded" when it failed to amend Section 11(2) to replace 'c' after 12 with "I". However, there can be no doubt that it is to Section 12(1) that Section 11(2) refers." Thus, Section 11(2) of the Act which deals with "Franchise and Registration" should correctly be stated as:

"Where an elector for an electoral district has ceased to reside in that electoral district he shall not on that account cease to be qualified to be an elector for that electoral district until he has become qualified under Section 12(1) to be an elector for another electoral district."

Clearly, the intent of the Act, according to Senior Counsel is that: "no person registered as an elector in a particular electoral district shall lose his (or her) entitlement to be an elector for that electoral district even if he (or she) has moved from that electoral area unless and until he (or she) becomes qualified as an elector in another electoral district by reason of him (or her) residing in that other electoral district for a minimum of two

(2) months before the qualifying date as defined in Section 2(1) of the Act (the ninth day after the commencement of an electoral registration by Proclamation)."

The foregoing also implies that a person while being qualified to be an elector in one electoral district, but having moved to another electoral district and being registered there, is still entitled to vote in the former electoral district, so long as the person has not resided in the latter electoral district for a minimum of two (2) months before the qualifying date, and is accordingly not yet qualified to vote there.

It was therefore concluded that Mr. Ian Leslie Alleyne was entitled to vote in the By-

Election held in the St. Joseph constituency on 4th November, 2013. It is to be noted

however that Mr. Alleyne elected not to vote in this by-election.

Having, for the purpose of nomination for the November 4th By-Election for the St. Joseph parliamentary constituency, stated his address as No. 21 Sevilla, Brechin Castle, Couva, the Registration Officer for Couva Registration Area is to contact Mr. Alleyne to have his registration rectified.

8. Closure

For the first time a procedure of texting and faxing the results of the poll to the Commission's Head Office proved to be a boon to its operations and facilitated earlier disclosure of results to the media than before.

The Commission is of the view that the result of the poll is an accurate reflection of the will of the electorate who exercised their franchise.
