NOTICE is hereby given that pursuant to section 5 (1) of the Air Transport (Route Licensing—Passenger Transport) Act 2002 (‘the Act’), that the route between Adelaide Airport and Port Augusta Airport is to be a declared route for the purposes of the Act. Pursuant to section 5 (2) of the Act, details of the declaration are as follows: (a) The declared route constitutes any route that an aircraft

development control for the Rural Zone (principle 99) the words ‘Horse Keeping’ and associated text listed in parts (a), (b), (c) and (d).

2. – non-complying provisions for the Watershed Policy Area, the Primary Production Policy Area and the Yaroona Policy Area:

ATTACHMENT A Horse Keeping which complies with the following criteria: (a) associated buildings and structures, including stables,

FISHERIES ACT 1982: SECTION 59

TAKE notice that pursuant to section 59 of the Fisheries Act 1982, the holder of Southern Zone Rock Lobster Fishery Licence No. S015, being the estate of T. W. Baker (the ‘exemption holder’), is exempt from Regulations 8 (4a) and 14 (1) (a) (ii) the Fisheries (Scheme of Management—Rock Lobster Fisheries) Regulations 1991, but only insofar as the exemption holder may have less than 40 pot entitlements endorsed on S015 and the licence may be renewed with that pot entitlement, subject to the conditions specified in Schedule 1, from the date of gazettal of this notice until 30 June 2006, unless varied or revoked earlier.

SCHEDULE 1 1. The rock lobster pot entitlement endorsed on the licence must not be less than 34 pots. 2. The exemption holder must not contravene or fail to comply with the Fisheries Act 1982, or any regulations made under the Act, except where specifically exempted by this notice. FISHERIES ACT 1982: SECTION 59

TAKE notice that pursuant to section 59 of the Fisheries Act 1982, John Courtney, 52 Torrens Road, Murray Bridge, S.A. 5253 (the ‘exemption holder’), or a person acting as his agent is exempt from the Fisheries Act 1982, but only insofar as the exemption holder may undertake the removal of non-native fish from the waters listed in Schedule 1 (the ‘exempted activity’), using equipment listed in Schedule 2, subject to the conditions set out in Schedule 3 from 24 November 2005 until 18 November 2006, unless varied or revoked earlier.

SCHEDULE 1 • Riverglades Wetland (Murray Bridge).

SCHEDULE 2 • Large Fyke nets (constructed with 20 mm metal meshing).

SCHEDULE 3 1. All native fish taken pursuant to the exempted activity must be immediately returned to the water.

2. All non-native species must be disposed of appropriately and must not be returned to the water. 3. The exempted activity may also be conducted on the exemption holder’s behalf by Ken Millsteed and Jerry Wilson. 4. The exemption holder must notify PIRSA Fishwatch on 1800 065 522 at least two hours prior to conducting the exempted activity and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the exemption notice at the time of making the call and be able to provide information about the area and time of the exempted activity, the vehicles and boats involved, the number of agents undertaking the exempted activity and other related questions. 5. While engaged in the exempted activity, the exemption holder or a person acting as his agent must be in possession of a copy of this notice. Such notice must be produced to a PIRSA Fisheries Compliance Officer if requested. 6. The exemption holder must not contravene or fail to comply with the Fisheries Act 1982, or any regulations made under that Act, except where specifically exempted by this notice. FISHERIES ACT 1982: SECTION 59

TAKE notice that, pursuant to section 59 of the Fisheries Act 1982, Darren Tressider, 12 Blacker Court, Port Lincoln, S.A. 5606 (the ‘exemption holder’) is exempt from sections 34 and 41 of the Fisheries Act 1982, but only insofar as he may take greenlip abalone (Haliotis laevigata), cyclobates abalone (Haliotis cyclobates), blacklip abalone (Haliotis rubra) and roe’s abalone (Haliotis roei) for the purpose of aquaculture broodstock (the ‘exempted activity’) subject to the conditions in Schedule 1 from the date of gazettal of this notice until 20 January 2006.

SCHEDULE 1 1. The exemption holder may take a maximum of 100 greenlip abalone (Haliotis laevigata) and 40 blacklip abalone (Haliotis rubra). The exemption holder may take a further 70 cyclobates abalone (Haliotis cyclobates) and 70 roe’s abalone (Haliotis roei). All these species may only be taken pursuant to this exemption if they are already a licensed species listed on Landbased Aqua-culture Licence No. FT00043. All abalone may be taken from Spencer Gulf, Franklin Islands or Goat Island waters and must not be taken from any other locations. 2. The exemption holder or his agents must not take any abalone from marine reserves or aquatic reserves pursuant to this exemption. 3. The exemption holder is exempt from the size limit prescribed in Schedule 6 of the Fisheries (General) Regulations 2000, when undertaking the exempted activity in relation to the taking of roe’s abalone and cyclobates abalone. 4. All greenlip abalone (Haliotis laevigata), cyclobates abalone (Haliotis cyclobates), blacklip abalone (Haliotis rubra) and roe’s abalone (Haliotis roei) taken pursuant to this exemption must not be sold or transferred to another party. 5. All greenlip abalone (Haliotis laevigata), cyclobates abalone (Haliotis cyclobates), blacklip abalone (Haliotis rubra) and roe’s abalone (Haliotis roei) taken pursuant to this exemption must be delivered to and retained on the registered aquaculture site of Landbased Aquaculture Licence No. FT00043. 6. The exempted activity may also be conducted on the exemption holder’s behalf by Doug Graske and George Harvey. 7. The exemption holder must notify PIRSA Fishwatch on 1800 065 522 at least two hours prior to conducting the exempted activity and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the exemption at the time of making the call and be able to provide information about the area and time of the exempted activity, the vehicles and boats involved, the name of the person undertaking the exempted activity and other related questions. 8. The exemption holder must, within 50 m of the point of landing of any greenlip abalone, cyclobates abalone, roe’s abalone and blacklip abalone taken pursuant to this notice, complete the PIRSA Fisheries form ‘Broodstock Collection Report Form’. Immediately upon arrival at the exemption holders registered

Prior to release into the registered aquaculture site, all abalone taken pursuant to this notice must be tagged so as to be clearly identified as wild broodstock. 9. The exemption holder must allow a Fisheries Officer to accompany the exemption holder at any time during the exempted activity. 10. While engaged in the exempted activity the exemption holder must carry or have about or near his person a copy of this notice. Such notice must be produced to a PIRSA Fisheries Officer upon request. 11. The exemption holder must not contravene or fail to comply with the Fisheries Act 1982, or any regulations made under that Act, except where specifically exempted by this notice. FISHERIES ACT 1982: SECTION 59

TAKE notice that, pursuant to section 59 of the Fisheries Act 1982, Tom Hyde, P.O. Box 2260, Port Lincoln, S.A. 5607 (the ‘exemption holder’) is exempt from sections 34 and 41 of the Fisheries Act 1982, but only insofar as he may take brownlip abalone (Haliotis conicopora), cyclobates abalone (Haliotis cyclobates), roe’s abalone (Haliotis roei), blacklip abalone (Haliotis rubra), scalaris abalone (Haliotis scalaris) and greenlip abalone (Haliotis laevigata) for the purpose of aquaculture broodstock (the ‘exempted activity’) in the waters specified in Schedule 1, subject to the conditions in Schedule 2 from 1 January 2006 until 31 December 2006.

SCHEDULE 1 South Australian coastal waters.

SCHEDULE 2 1. The exemption holder may take a maximum of 50 brownlip abalone (Haliotis conicopora), 50 cyclobates abalone (Haliotis cyclobates), 50 roe’s abalone (Haliotis roei) 50 blacklip abalone (Haliotis rubra), 50 scalaris abalone (Haliotis scalaris) and 200 greenlip abalone (Haliotis laevigata), however these species may only be taken pursuant to this exemption if they are already a licensed species listed on Landbased Aquaculture Licence No. FT00423. 2. The exemption holder is exempt from the size limit prescribed in Schedule 6 of the Fisheries (General) Regulations 2000, when undertaking the exempt activity in relation to the taking of roe’s abalone, scalaris and cyclobates abalone. 3. All abalone taken pursuant to this exemption must not be sold or transferred to another party. 4. All abalone taken pursuant to this exemption must be delivered to and retained on the registered aquaculture site of Landbased Aquaculture Licence No. FT00423. 5. The exempted activity may only be conducted on the exemption holder’s behalf by Craig Marshall, Doug Graske, Andy Christian, David Buckland. 6. The exemption holder must notify PIRSA Fishwatch on 1800 065 522 at least two hours prior to conducting the exempted activity and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the exemption at the time of making the call and be able to provide information about the area and time of the exempted activity, the vehicles and boats involved, the number of agents undertaking the exempted activity and other related questions. 7. The exemption holder must, within 50 m of the point of landing of any abalone taken pursuant to this notice, complete the PIRSA Fisheries form ‘Broodstock Collection Report Form’. Immediately upon arrival at the exemption holders registered aquaculture site, this form must be faxed to PIRSA Fisheries on (08) 8226 0434. Prior to release into the registered aquaculture site, all abalone taken pursuant to this notice must be tagged so as to be clearly identified as wild broodstock. 8. The exemption holder must allow a Fisheries Officer to accompany the exemption holder at any time during the exempted activity. 9. While engaged in the exempted activity the exemption holder must carry or have about or near his person a copy of this notice.

Such notice must be produced to a PIRSA Fisheries Officer upon request. 10. The exemption holder must not contravene or fail to comply with the Fisheries Act 1982, or any regulations made under that Act, except where specifically exempted by this notice. Dated 21 November 2005.

OPERATION OF ROAD TRAIN VEHICLES IN SOUTH AUSTRALIA

1. REVOCATION OF PREVIOUS NOTICE AND OTHER EXEMPTION INSTRUMENTS

1.1 The Notice entitled “Operation of Road Train Vehicles in South Australia” dated 26 June 2003 and Supplementary Notice dated 14 July 2005, as issued by DTEI is revoked at midnight on 27 November 2005.

1.2 The relevant parts of the Notice titled “Higher Mass Limits for Vehicles fitted with Road Friendly Suspensions” dated 5 May 2005 which exempts approved road trains for travel on specified routes at Higher Mass Limits are hereby revoked.

2. APPROVAL

2.1 I hereby approve Road Trains (including articulated vehicles towing converter dollies) to operate on approved routes subject to the conditions and limitations specified in this Notice.

3. EXEMPTION

3.1 I hereby exempt Road Trains (including articulated vehicles towing converter dollies) from the following provisions of the:

3.1.1 Road Traffic (Mass and Loading Requirements) Regulations 1999, Schedule 1, Table 1, insofar as it relates to:

(i) tandem axle group fitted with dual tyres (8 tyres—for any vehicle other than a pig trailer—16.5 tonnes); and

(ii) triaxle group fitted with dual tyres (12 tyres—for any vehicle other than a pig trailer—20 tonnes).

3.1.2 Road Traffic (Vehicle Standards) Rules 1999 Rule 72 (1)—Height, (4.3 metres).

3.1.3 Road Traffic (Vehicle Standards) Rules 1999 Rule 66 (1)—Width, (2.5 metres),

subject to conditions and limitation in this Notice.

4. CONDITIONS AND LIMITATIONS APPLYING TO THIS NOTICE

4.1 When you are operating under this Notice you must:

4.1.1 operate at all times in accordance with the conditions and limitations specified in the “Code of Practice for Road Trains” dated November 2005, issued by the Department for Transport, Energy and Infrastructure (DTEI);

4.1.2 only travel on the approved routes as shown in the maps and in accordance with the conditions and limitations specified as contained in the map book “Approved Route Network for Road Trains” dated November 2005, issued by DTEI;

4.1.3 carry a legible, current and complete copy of:

(i) this notice; and

(ii) the “Code of Practice for Road Trains” dated November 2005, issued by DTEI; and

(iii) the map book titled “Approved Route Network for Road Trains” dated November 2005; and

(iv) where required a current driver medical certificate;

4.1.4 produce these documents when requested by a DTEI Transport Safety Compliance Officer appointed under the Road Traffic Act 1961 and/or the Motor Vehicles Act 1959 or a Police Officer.

5. COMMENCEMENT OF THIS NOTICE

WATERWORKS ACT 1932 Instrument of Authority to Give Expiation Notices and to make Enquiries under Regulation 46 of the Waterworks Regulations 1996

PURSUANT to a delegation by the former Minister for Infrastructure (now the Minister for Administrative Services) dated 4 May 1997, the South Australian Water Corporation authorises the officers named in the Schedule to give expiation notices under the Waterworks Act 1932. Pursuant to Regulation 46 of the Waterworks Regulations 1996, the South Australian Water Corporation also authorises the officers named in the Schedule to undertake the duties covered by Regulation 46. Part 2—Variation of Natural Resources Management (Financial Provisions) Regulations 2005

4—Insertion of regulation 8A After regulation 8 insert:

8A—Refund of levies (1) In this regulation—

environmental donations licence means an environmental donations licence under the Natural Resources Management (General) Regulations 2005;

donation means a gift for no consideration.

(2) For the purposes of section 114 of the Act—

(a) the donation of the whole or a part of a water allocation of a water licence to the holder of an environmental donations licence (so that the allocation can be assigned to that licence); and

(b) the variation of the conditions endorsed on a water licence so that the licence will become an environmental donations licence,

are recognised as natural resources management practices on which an application for a refund of a water levy may be based.

(3) The maximum proportion of a water levy that may be subject to a refund (the eligible levy amount) is equal to the proportion of the allocation donated, or within the ambit of the relevant condition, in the manner contemplated by subregulation (2).

(4) The amount of any refund will be determined according to the following table:

donation means a gift for no consideration;

environmental donations licence means a water licence—

(a) that relates to water in the River Murray prescribed watercourse; and

(b) that is subject to conditions to the effect—

(i) that any allocation endorsed on the licence may only be used for an environmental purpose in a manner accredited by the South Australian Murray Darling Basin Natural Resources Management Board; and

(ii) that the holder of the licence is accredited by the South Australian Murray Darling Basin Natural Resources Management Board to receive, transfer or use donations of water for environmental purposes recognised by the board for the purposes of these regulations.

(2) Regulation 3—after its present contents as varied by this regulation (now to be designated as subregulation (1)) insert:

(2) The South Australian Murray Darling Basin Natural Resources Management Board must, in deciding whether to issue an accreditation for the purposes of a water licence being recognised as an environmental donations licence, apply any criteria determined by the Minister.

5—Variation of regulation 42—Fees Regulation 42—after subregulation (2) insert:

(3) In addition, the following are exempt from the relevant fees under Schedule 4:

(a) an application for an environmental donations licence (where the applicant has already obtained the necessary accreditation from the South Australian Murray Darling Basin Natural Resources Management Board);

(b) an application made by the holder of a water licence, and granted by the Minister, to vary the conditions endorsed on the licence so that the licence will become an environmental donations licence;

(c) an application to transfer a water licence (either absolutely or for a limited period) where the South Australian Murray Darling Basin Natural Resources Management Board is satisfied that the transfer constitutes the donation of the licence in order to establish an environmental donations licence (and where the board is satisfied that an accreditation should be issued);

Part 1—Preliminary 1—Short title

These regulations may be cited as the Superannuation (Transferred Contributors) Variation Regulations 2005.

2—Commencement These regulations come into operation on the day on which they are made.

3—Variation provisions In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Superannuation Regulations 2001 4—Substitution of regulation 29B

Regulation 29B—delete the regulation and substitute:

29B—Special provision relating to certain transferred contributors (1) Subregulation (2) applies to a contributor who—

(a) is employed by a relevant entity; and

(b) is, while retaining his or her position with the entity (the substantive position), occupying an alternative position whereby he or she is working within or for an administrative unit (the alternative position).

(2) Despite any other regulation (and despite any provision to the contrary in the Act), the salary of a contributor to whom this subregulation applies will, for the purpose of determining contributions and benefits, be taken to be—

(a) if the contributor has occupied the alternative position for less than 12 months—the salary received by the contributor in respect of the substantive position immediately before beginning to occupy the alternative position; and

(b) if—

(i) the contributor has occupied the alternative position for 12 months or more; and

(ii) the contributor's remuneration in respect of that position is the same as, or less than 25 per cent higher than, his or her remuneration in respect of the substantive position immediately before beginning to occupy the alternative position,

the salary received by the contributor in respect of the alternative position; and

(c) if—

(i) the contributor has occupied the alternative position for 12 months or more; and

(ii) the contributor's remuneration in respect of that position is at least 25 per cent higher than his or her remuneration in respect of the substantive position immediately before beginning to occupy the alternative position,

salary calculated in accordance with subregulation (4).

(3) Despite any other regulation (and despite any provision to the contrary in the Act), the salary of a contributor who transfers from employment with a relevant entity to employment with an administrative unit, and whose employment with the entity ceases on or following the transfer, will, for the purpose of determining contributions and benefits, be taken to be—

(a) if the contributor's remuneration in respect of employment with the administrative unit is the same as, or less than 25 per cent higher than, his or her remuneration in respect of employment with the entity immediately before his or her transfer to the administrative unit—the salary received by the contributor in respect of his or her employment with the administrative unit; and

(b) if the contributor's remuneration in respect of employment with the administrative unit is at least 25 per cent higher than his or her remuneration in respect of employment with the entity immediately before his or her transfer to the administrative unit—salary determined in accordance with subregulation (4).

(4) Salary for the purposes of determining contributions and benefits under subregulation (2)(c) and subregulation (3)(b) is to be determined in accordance with the following formula:

1 2 1 S = S + ((S - S ) x 25%) Where—

S is the salary

S1 is the highest level of salary received by the contributor while employed

by, and undertaking duties for, the relevant entity, adjusted to reflect any movement in salaries for the same classification with that employer

S2 is the salary received by the contributor in respect of his or her

employment with the administrative unit, adjusted to reflect any movement in salaries for the same classification with that employer.

(5) For the purposes of the definition of S1 and S

2 in subregulation (4), if the

classification level of the position occupied by a contributor no longer exists when his or her salary is to be determined under that subregulation, adjustments will then be made according to changes in the Consumer Price Index from the day on which the classification level ceased to exist.

(6) In this regulation—

administrative unit means an administrative unit under the Public Sector Management Act 1995;

relevant entity means an entity that has entered into an arrangement with the Board under section 5 of the Act.

Schedule 1—Transitional provision 1—Transitional provision

If an amount taken to be salary under regulation 29B of the Superannuation Regulations 2001 is, for the purpose of determining contributions in relation to a contributor between 13 January 2005 and the day on which these regulations come into operation, higher than the amount taken to be salary under that regulation as recast by regulation 4 of these regulations, the Board may determine the contributor's contributions for that period on the basis of the lower amount.

Strathalbyn Township Local Heritage (updated September 2005) Plan Amendment Report—Draft for Public Consultation
