DEVELOPMENT ACT 1993, SECTION 46 (1)

PreambleSubsection (1) of section 46 (1) of the Development Act 1993 allows the Minister for Urban Development and Planning to apply

that section to a specified kind of development or project if the Minister is of the opinion that a declaration under that section isappropriate or necessary for the proper assessment of development or a project of major environmental, social or economic importance.

NOTICE

PURSUANT to subsection (1) of section 46 of the Development Act 1993, being of the opinion that a declaration under that section isappropriate for the proper assessment of development of major environmental, social or economic importance, I declare that section 46of the Act applies to all development of a kind specified in Schedule 1, in that part of the State specified or delineated in Schedules 2 and3.

SCHEDULE 1

The following kinds of development are specified if undertaken in, or in relation to, that part of the State specified or delineated inSchedules 2 and 3:

(a) any change in the use of land, and any building work, in connection with the establishment of a marina, boat harbour orwaterways, including (but not limited to):

(i) the excavation of an entrance channel, marina basin or residential canals;

(ii) the excavation or filling, or the excavation and filling, of any land, and the formation of land for allotments;

(iii) the construction of a breakwater;

(iv) the installation of edge treatments or navigational aids;

(v) the construction of a boat ramp or any associated structure;

(vi) the installation of moorings or pontoons;

(vii) the construction of a wharf, a travel lift jetty or any associated structure;

(b) the division of land into allotments, and any associated excavation or filling, or excavation and filling, of any land, formationof land, or construction of infrastructure for water supply, electricity, telecommunications, stormwater disposal, effluentdisposal, roads or parking;

(c) any development associated with realignment of the Eyre Highway (including the construction of a bridge in connection withany such realignment);

(d) the construction of a recreational lake or wetland, and any building work involving the construction of any associatedstructures,

for the purposes of, or ancillary to, establishing or operating a commercial or recreational marina facility, boat harbour, waterfrontresidential development, a coastal community centre or a constructed wetland.

Variation to Existing Approval of Collection Depot

I, STEPHEN RICHARD SMITH, Senior Adviser, Container Deposit Legislation and Delegate of the Environment Protection Authority(‘the Authority’), pursuant to section 69 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby:

Variation to Existing Approval of Collection Depot

Vary the approval of the collection depot, listed at Schedule 1 of this notice, that was granted under the Act prior to the date of thisnotice and impose the conditions of this approval to be as follows:

Approval of Collection Depot

The collection depot identified by reference to the following matters is approved:

(a) the name of the collection depot described in Column 1 of Schedule 1 of this notice;

(b) the name of the proprietor of the depot identified in Column 3 of Schedule 1 of this notice;

(c) the location of the depot described in Columns 4 and 5 of Schedule 2 of this notice; and

(d) the collection area in relation to which the collection depot is approved referred to in Column 6 of Schedule 2 ofthis notice.

The collection depot listed at Schedule 1 of this notice is approved in relation to all classes of containers which were approvedunder the Act, at or subsequent to the date of this notice, as Category B Containers.

Conditions of Approval

Impose the following conditions on this approval:

(a) The person in charge of a collection depot shall ensure the depot premises complies with Council PlanningRegulations and shall be kept in an orderly condition.

(b) The person in charge of a collection depot who wishes to transfer the operation of a depot to another person orintends to change the location of a depot shall notify the Authority in writing within one month of the changeoccurring.

(c) The person in charge of a collection depot who wishes to cease operation of that depot shall give notice in writingto the Authority.

(d) The person in charge of a collection depot shall take such measures as are necessary in the operation andmaintenance of the depot to prevent or control:

(i) A nuisance or offensive condition.

(ii) A risk to health or safety.

(iii) Damage to the environment.

(e) The person in charge of a collection depot is reminded of the general environmental duty, as required by section 25of the Environment Protection Act, to take all reasonable and practical measures to ensure that the activities on thewhole site, do not pollute the environment in a way which causes or may cause environmental harm.

1 corf net with the frame made from 25 mm white PVCtubing. The dimensions of the corf net are 10.5 m3. Themesh of the black aquaculture net is 44 mm lashed on tipwith green twine. There is one hole present in the net, nearthe top that is 30 cm long. The PVC frame is broken in themiddle of one of the top sides of the corf. On each of thecorners of the net is 1 m of white rope.

The above items were suspected to have been used or intendedto be used, in contravention of the Fisheries Act 1982, and weretaken into possession at the rear of Shack 41, Douglas South nearWhyalla on 24 May 2003.

National Parks and Wildlife Reserves—Fire Restrictions

PURSUANT to Regulation 16 (1) of the National ParksRegulations 2001, I, Edward Gregory Leaman, the Director ofNational Parks and Wildlife, impose fire restrictions for NationalParks and Wildlife Reserves as listed in Schedule 1 below.

The purpose of these fire restrictions is to ensure the safety ofvisitors using the Reserves, and in the interests of protecting theReserves and neighbouring properties.

1. EYRE AND FAR WEST DISTRICTSAll reserves: All wood fires or solid fuel fires are prohibitedfrom 1 November 2003 to 15 March 2004. Gas fires arepermitted other than on days of total fire bans.Note: Wood fires are permitted between high water mark andlow water mark in the following parks: Lincoln NationalPark and Coffin Bay National Park, providing the followingconditions are applied: (a) it is not a day of a declared totalfire ban; (b) wood has been supplied from outside the park;(c) an adult is in attendance; and (d) the fire is extinguishedbefore departure.

2. SOUTHERN FLINDERS DISTRICTMount Remarkable National Park, The Dutchmans SternConservation Park, Mount Brown Conservation Park,Telowie Gorge Conservation Park—Year round ban on woodfires in reserves except for Mambray Creek Campground inMount Remarkable National Park where wood fires areallowed in fire places from 1 May to 31 October.Other reserves: All wood fires or solid fuel fires areprohibited from 1 November 2003 to 30 April 2004. 3. FLINDERS DISTRICTThe following reserves: Flinders Ranges National Park,Vulkathunha—Gammon Ranges National Park—All woodfires or solid fuel fires are prohibited from 1 November 2003to 31 March 2004. Gas fires are permitted other than on daysof total fire bans.

4. GAWLER RANGES DISTRICTAll reserves: All wood fires or solid fuel fires are prohibitedfrom 1 November 2003 to 15 April 2004. Gas fires arepermitted on days other than on days of total fire bans.

5. OUTBACK REGIONThe following reserves: Witjira National Park, Lake EyreNational Park, Simpson Desert Conservation Park, SimpsonDesert Regional Reserve and Innamincka Regional Reserve.All wood fires or solid fuel fires are prohibited from1 November 2003 to 31 March 2004 other than forAboriginal people using traditional use of fires for cooking.

6. YORKE DISTRICTAll Reserves: All wood fires or solid fuel fires are prohibitedfrom 1 November 2003 to 30 April 2004. Gas fires arepermitted other than on days of total fire bans.

7. KANGAROO ISLAND REGIONAll Reserves: All wood fires or solid fuel fires are prohibitedthroughout the year. Gas fires are permitted other than ondays of total fire bans.

8. FLEURIEU DISTRICTNewland Head Conservation Park has a total ban on woodfires all year round.All other reserves: All wood fires or solid fuel fires areprohibited from 1 November 2003 to 30 April 2004. Gasfires are permitted other than on days of total fire bans.

9. LOFTY/BAROSSA DISTRICTAll wood fires or solid fuel fires within District reserves areprohibited throughout the year. Gas fires are permittedwithin Morialta Conservation Park, Black Hill ConservationPark, Para Wirra Recreation Park and Sandy CreekConservation Park in designated areas other than on days oftotal fire ban.

10. CLELAND CONSERVATION PARKAll wood fires or solid fuel fires are prohibited from1 November 2003 to 30 April 2004. Gas fires are permittedother than on days of total fire bans.

11. STURT DISTRICTAll Reserves: All wood fires or solid fuel fires are prohibitedfrom 1 November 2003 to 30 April 2004. Gas fires arepermitted other than on days of total fire bans.Belair National Park has a permanent prohibition of all woodfires.

COORONG AND LAKES DISTRICT, UPPER SOUTHEAST AND LOWER SOUTH EAST DISTRICTAll reserves: All wood fires or solid fuel fires are prohibitedfrom 1 November 2003 to 30 April 2004.Wood fires are permitted between high water mark and lowwater mark of foreshore of the following reserves:Piccaninnie Ponds Conservation Park, Little DipConservation Park and Coorong National Park, other than ondays of total fire bans.All wood fires or solid fuel fires are permanently prohibitedfrom the following reserves: Aberdour Conservation Park,Bool Lagoon Game Reserve, Ewens Ponds ConservationPark, Lower Glenelg River Conservation Park, MountMonster Conservation Park, Piccaninnie Ponds Conser-vation Park, above high water mark, and Poocher SwampGame Reserve.

CHIEF MAGISTRATE AND DEPUTY CHIEF MAGISTRATESALARY REVIEW

1. Introduction

1.1 Earlier this year, the Remuneration Tribunal receivedletters from the Chief Magistrate and the Deputy ChiefMagistrate seeking a review of their salaries as a result ofchanges to jurisdiction and changed duties.

1.2 The Tribunal sought further details from the ChiefMagistrate and Deputy Chief Magistrate to enable therequests to be given proper consideration. The infor-mationsought related to those changes in duties which haveincreased the value of the work since the current relativitieswere set in 1992 and confirmed in 1995 and any changes tojurisdiction which may have occurred other than thoserecently considered in the Magistrates Determination of2002 (Determination No. 5 of 2002).

1.3 Submissions were invited from the Premier (as Ministerresponsible for the Remuneration Act 1990) and theAttorney-General in relation to the Chief Magistrate andDeputy Chief Magistrate’s requests for review of salary.

1.4 The Tribunal received further written submissions from theChief Magistrate and the Deputy Chief Magistrate andsubmissions on behalf of the Minister in relation to both theChief Magistrate and Deputy Chief Magistrate’s salaryreviews.

1.5 On 14 August 2003, the Tribunal heard oral submissionsfrom Kelvyn Prescott, Chief Magistrate, and David Watts,the Premier’s representative, in relation to the ChiefMagistrate’s salary review.

1.6 Mr Prescott’s submission provided a summary of thechanges that have occurred within the role of the ChiefMagistrate over the last 12 months. Changes discussedincluded the current social climate and framework; publicexpectations and accountability; role within the courts inconsulting the community and media liaison; establish-ment of new courts and contemporary sentencing; courtadministration and the courts improvement unit; andcomparison with other State magistracies. Mr Prescott alsoreferred to letters received from Justice Selway and SeniorJudge Moss that support the nexus of salary and conditionsof the Chief Magistrate and that of a District Court Judge.Information provided demonstrated that in New SouthWales, Victoria and Queensland the Chief Magistrate waspaid the same salary as a District Court Judge or equivalentin those States.

1.7 Mr Watts’ submission, on behalf of the Minister, did notsupport the application from the Chief Magistrate. Thesubmission outlined the views on behalf of government andin particular that ‘the government believes that the basesalary against which all judicial relativities are decidedshould remain that of a puisne judge of the Supreme Courtof South Australia’. The submission discussed the currentrelativity of the Chief Magistrate’s salary when lastdetermined in 2002 and submitted that the changes injurisdiction for the Magistrates Court, the new specialistcourts and the more complex work associated with thesefunctions were taken into account by the Tribunal when thenew relativities were set in 2002. It also indicated ‘theChief Magistrate has not shown any increased complexityin his work over and above the work expected of a personmanaging and directing the work of a court’.

1.8 On 5 September 2003, the Tribunal heard an oralsubmission from Dr Andrew Cannon, Deputy ChiefMagistrate in relation to his salary review. Dr Cannondiscussed a number of new responsibilities and duties thatwere not previously undertaken by the Deputy ChiefMagistrate, prior to his appointment to the position inDecember 2002. These included the general managementof policy of the three civil divisions of the MagistratesCourt; identifying the need for and drafting amendments tothe Magistrates Court (Civil) Rules 1992 and PracticeDirections; managing the civil court work of the AdelaideMagistrates Court and its circuits; and managing the

judicial aspects and matters of practice and procedure fornew initiatives such as the electronic filing and the videoremand projects.

Dr Cannon also discussed interstate magistracy com-parisons and changes in this State’s magistracy’sorganisation structure. In particular, he highlighted theflatter structure that has existed since December 2002 as aresult of not filling the positions of Supervising Magistrateand Assistant Supervising Magistrate.

1.9 The submission received on behalf of the Minister did notoppose the submission from the Deputy Chief Magistrate.However, specific points made in the Chief Magistrate’ssubmission were reiterated in relation to the salaries ofthese two offices having been reviewed as part of thegeneral review of magistrates’ salaries finalised in mid2002; the requirement under section 101 of the Industrialand Employee Relations Act 1994, to have regard to andapply the principles, guidelines and conditions andpractices or procedures adopted by the Full IndustrialRelations Commission in considering this matter; and thatthere was not sufficient evidence to show that there hadbeen a change in work value since the 2001-2002 review ofmagistrates’ salaries.

2. Work Value Changes

2.1 In determining if there was an increase in work valuewarranting a review of remuneration the Tribunal has hadregard to the State wage fixation principles prescribed inthe State Wage Case decision of July 2003. In particular,Principle 8, Work Value Changes which state:

‘Changes in work value may arise from changes in thenature of work, skill and responsibility required or theconditions under which work is performed. Changes inwork by themselves may not lead to a change in wagerates. The strict test for an alteration in wage rates is thatthe change in the nature of work should constitute such asignificant net addition to work requirements as towarrant the creation of a new classification or upgradingto a higher classification.’

2.2 As detailed above, both Mr Prescott and Dr Cannonpresented submissions based on a change in work value,claiming a number of new and increased responsibilitiesand accountabilities for the work they are presentlyperforming.

In Mr Prescott’s submission he states:

‘More important and fundamental to this request, arechanges to the duties which have increased the value ofwork since the current relativities were last confirmed in1995. In this regard, it is more than fair to say that newand additional responsibilities, constituting a significantnet addition to previous work requirements, haveoccurred since 1995.’

In Dr Cannon’s submission he claims:

• ‘these additional duties involve work of substantialcomplexity, skill, and responsibility additional to the pre-existing and ongoing work done by the Deputy ChiefMagistrate’;

• ‘these new duties involve new levels of policy andmanagement expertise not previously required in theduties of the Deputy Chief Magistrate’;

• ‘these enhanced competencies are now performedwithout the support previously available to the DeputyChief Magistrate’; and that

• ‘they should be reflected in an increased salary’.

2.3 The submission from the Minister’s representative did notsupport an increase in work value for Mr Prescott. Thesubmission states:

‘The Chief Magistrate has not shown any increasedcomplexity in his work over and above the workexpected of a person managing and directing the work ofa court. Best practice, liaison with counterparts andanticipation and forward planning are all tasksundertaken by the Chief Justice and Chief Judge and aretasks expected of any executive of Government and theprivate sector.’


2.4 As stated earlier, the submission in relation to Dr Cannonwas not opposed, however the point in relation to therebeing nothing to show that there had been a change in workvalues since the 2001-2002 review of magistrates’ salarieswas reiterated.

2.5 The Tribunal, in further informing itself on the matters, metwith the Chief Justice who considered that there had beenan increase in the level and range of work as it had becomemore complex, but that this had affected the work of allcourts and not individual positions. It was also understoodthat a review in terms of general productivity would occurin the annual review of the judicial salaries due to takeplace in November this year.

2.6 In July 2002, the Chief Magistrate and Deputy ChiefMagistrate (along with all magistrates) were granted salaryincreases after a detailed work value examination of thework changes that had occurred in the Magistrates Courtsince 1992. Within that examination, a number of factorswere considered and taken into account both in terms ofactual work and the complexity of that work. They includedwork value changes; changes to juris-diction; theintroduction of specialist courts (Aboriginal, mentalimpairment, drug, domestic violence and youth); increasesin the volume and nature of out of hours work, increases inamount of circuit work, judicial relativities, and interstaterelativities. The Tribunal concluded that there weresignificant net additions to work requirements and resultedin salary increases of $7 440 per annum to the ChiefMagistrate and $6 979 to the Deputy Chief Magistrate.

2.7 The Tribunal was not convinced that the changes in dutiesthat have occurred since current relativities were set are asignificant net addition to the work requirements of the twopositions being considered. The basic work require-mentsand responsibilities have not in the Tribunal’s viewchanged so significantly to warrant creation of a newclassification or widening of the salary margins over that ofa Magistrate.

3. Comparison of State Judicial Salaries

3.1 To assist the Tribunal in its considerations the Tribunalchose to examine other State Judicial salaries. The Tribunalnoted that the level of salary paid to the Chief Magistrate inNew South Wales, Victoria and Queensland was the sameas that paid to a District Court Judge or equivalent.However, it also noted that the number of Magistrates inthose jurisdictions was considerably higher than in SouthAustralia.

3.2 In the past, comparisons with the Federal and Interstatejudiciary have been made with the puisne judge andinternal relativities then fixed having regard to the salarydetermined for that office in South Australia. The Tribunalsaw no reason to depart from that practice in this instanceand will continue to fix relativities in this State based onthe puisne judge salary.

4. Determination

4.1 The Chief Magistrate and Deputy Chief Magistratecurrently receive salary margins of $29 760 and $16 550respectively, over and above that of a StipendiaryMagistrate. The Tribunal considers these margins areappropriate and having also had regard to the current salaryof a puisne judge, believes the current salaries for the ChiefMagistrate and Deputy Chief Magistrate should not beincreased.

3—Exemption for certain exhibitors

Pursuant to section 39(2)(e) of the Firearms Act 1977, the holder of a dealer's licence whoexhibits firearms at the Land Warfare Conference at the Adelaide Convention Centre from28 October 2003 to 30 October 2003 (inclusive) is, for the purposes of so exhibitingfirearms, exempt from section 17(4)(a) of the Act.

(i) the wine is produced as part of a course in winemaking offered byGepps Cross Girls High School and sold by or on behalf of aCentral North East Secondary School that contributes as part of itscurriculum to the production, promotion or sale of the wine; and

(ii) the sale is made by and to a person of or above the age of 18 years.

1—Short title

These regulations may be cited as the Public Corporations (Industrial and CommercialPremises Corporation) (Dissolution and Revocation) Regulations 2003.

Act means the Public Corporations Act 1993.

Pursuant to section 25 of the Act—

(a) the Industrial and Commercial Premises Corporation, established by regulationunder the Act as a subsidiary of the Minister and formerly known as MFP IndustrialPremises Corporation, is dissolved; and

(b) the assets and liabilities of the Industrial and Commercial Premises Corporationimmediately before its dissolution are transferred to and vested in or attached to theLand Management Corporation.

5—Revocation of regulations

Postal Voting

The election will be conducted entirely by postal voting. Nopolling booth will be open for voting on polling day. Voting is notcompulsory.

Voting material will be dispatched by post to every naturalperson, body corporate and group listed on the voters roll as at rollclosure on Friday, 29 August 2003.

The mailout will commence on Tuesday, 28 October 2003, withall voting materials to be delivered by Monday, 3 November 2003.

A person who has not received voting material by Monday, 3November 2003 and who believes that he or she is entitled to voteshould apply to the State Electoral Office on 8401 4300.

A pre-paid addressed envelope for each elector entitlement willbe provided. Completed ballot material must be returned to reachthe Returning Officer no later than 12 noon on Monday, 17November 2003.

A ballot box will be provided at the Council Office, 172Montacute Road, Rostrevor for electors who wish to personallydeliver their completed ballot material during office hours.

Place of Counting Votes

The scrutiny and counting of votes will take place at theCouncil Committee Rooms, 172 Montacute Road, Rostrevor assoon as practicable after 12 noon on Monday, 17 November 2003.A provisional declaration will be made at the conclusion of theelection count.

Campaign Donations Return

All candidates must forward a campaign donations return to theCouncil Chief Executive Officer within six weeks after theconclusion of the election.

Amended Notice—Extension of Time

Road Process Order
