NOTICE UNDER SECTION 3 (1) Definition of Premium Gaming Areas

TAKE notice that pursuant to Section 3 (1) of the Casino Act 1997, the ‘Premium Gaming Areas’ defined as being a gaming area or part of a gaming area within the casino premises will as from 7 p.m. on 4 December 2014 be re-defined by the Liquor and Gambling Commissioner. The following plans indicate such parts of the first floor of the casino premises (previously defined by his Excellency the Governor in Executive Council and depicted by a purple line for information purposes only) which are to be regarded as being a gaming area, or part of a gaming area (previously defined and depicted by an orange line), that is set aside for premium customers and depicted by a light blue line which shall only be accessible to other customers in accordance with the Adelaide Casino Approved Licensing Agreement. The defined premium gaming area on the ground floor of the casino premises remains unchanged as gazetted on 18 September 2014. Dated 4 December 2014.

6574 THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE 4 December 2014 FISHERIES MANAGEMENT ACT 2007: SECTION 115 TAKE notice that pursuant to Section 115 of the Fisheries Management Act 2007, Catherine Bell, Department of Environment, Water and Natural Resources (DEWNR), 11 Helen Street, Mount Gambier, S.A. 5290, (the ‘exemption holder’) or his agents are exempt from the provision of Sections 70 and 71 of the Fisheries Management Act 2007 and Regulations 7 and 10 and Clauses 21, 96 and 114 of Schedule 6 of the Fisheries Management (General) Regulations 2007, but only insofar as he may engage in the collection of native and non-native fish (the ‘exempted activity’) from waters as specified in Schedule 1, using the gear specified in Schedule 2, subject to the conditions specified in Schedule 3, from 21 November 2014 until 30 October 2015, unless varied or revoked earlier.

SCHEDULE 1 The South East region of South Australia, including wetlands, streams, drains and coastal waters, but excluding marine parks.

SCHEDULE 2 • 2 Seine nets with maximum length of 25 metres and

minimum mesh size of six millimetres. • 1 Dip net per person with a diameter of 0.5 metres and

minimum mesh size six millimetres. • 20 Fyke nets with maximum width of 10 metres and

minimum mesh size of three millimetres. • 20 Crab pots (Munyana nets) with 60 millimetres stretch

mesh, 0.76 metre diameter steel hoops with two eye shaped 0.18 x 0.12 metre flexible entrances—for sampling of Glenelg Spiny Crayfish only.

• 12 Bait nets with maximum length of 400 millimetres, minimum mesh size one millimetre and maximum inlet size 60 millimetres.

• 20 Yabby pots (Opera House nets) with a maximum dimension of one metre, minimum funnel diameter 7.5 millimetres with no more than two fixed entrances.

SCHEDULE 3 1. All native fish must be returned alive to the water immediately on completion of scientific evaluation. 2. All non-native fish species collected must be destroyed and disposed of appropriately. 3. The specimens collected by the exemption holder and agents are for scientific and research purposes only and must not be sold. 4. The exempted activity may only be conducted by the exemption holder or her nominated agents. Agents include: Cath Bell, Raelene Mibus, Tania Rajic, Steve Clarke, Natasha

Dawson, Abigail Goodman, Cassie Hlava, Melissa Herpich, Ross Anderson, Kiran Liversage and Barry Schriever of DEWNR and consultants Nick Whiterod and David Mossop.

Any exempted activity is to be conducted in the presence of a DEWNR employee. 5. While engaging in the exempted activity, the exemption holder and agents must be in possession of a copy of this exemption. It must be produced to a Fisheries Officer if requested. 6. Before conducting the exempted activity, the exemption holder or agents must contact PIRSA Fishwatch on 1800 065 522 and answer a series of questions about the exempted activity. They will need to have a copy of the exemption at the time of making the call, and be able to provide information about the area and time of the exempted activity, the vehicles and/or boats involved, the number of agents undertaking the exempted activity and other related questions. Exemption No. ME9902738. 7. The exemption holder must provide a report in writing detailing the outcomes of the collection of fish pursuant to this notice to the Executive Director Fisheries and Aquaculture, (G.P.O. Box 1625, Adelaide, S.A. 5001) within 14 days of expiry of this exemption, giving the following details: • the date and time of collection; • location of collection site; • the description of all species collected; and • the number and length of each species collected.

FISHERIES MANAGEMENT ACT 2007: SECTION 115

TAKE notice that pursuant to Section 115 of the Fisheries Management Act 2007, SA Water corporation (the ‘exemption holder’) and its employees listed in Schedule 1, are exempt from Section 70 of the Fisheries Management Act 2007 and Regulation 7, Clauses 72 and 121 of Schedule 6 and Schedule 7 of the Fisheries Management (General) Regulations 2007, but only insofar as the exemption holder shall not be guilty of an offence when the persons listed in Schedule 1 empty a ‘Carp separation cage’ at the sites listed in Schedule 2 (the ‘exempted activity’), subject to the conditions specified in Schedule 3, from 21 November 2014 until 31 August 2015, unless varied or revoked earlier. Exemption No. ME9902739.

Non-native species must not be returned to the water and must be disposed of appropriately. 3. All non-native species collected by the holder of a commercial River Fishery licence must be recorded in the catch and return logbook of that licence holder. 4. Any native species taken in the course of the exempted activity must be returned to the water immediately. 5. Information on native species taken in the course of the exempted activity must be recorded and reported to South Australian Research and Development Institute (SARDI) Aquatic Sciences within 15 days of the end the month to which it relates. 6. A copy of the exemption notice must be kept at each Lock location, and the staff carrying out the activity must be able to produce a copy of the notice if required by a Fisheries Officer. Box 3428, Mildura, Vic. 3500, (the ‘exemption holder’) or a person acting as his agent, is exempt from the provision of Section 70 and 71 of the Fisheries Management Act 2007 and the Regulations 7 and 10 and Clauses 39, 43 and 72 of Schedule 6 of the Fisheries Management (General) Regulations 2007, but only insofar as he may engage in the collection of fish (the ‘exempted activity’) from the area described in Schedule 2, using the gear specified in Schedule 1, subject to the conditions set out in Schedule 3, from 21 November 2014 until 20 November 2015, unless varied or revoked earlier.

SCHEDULE 1 • Small fyke nets (2 mm stretch mesh); • Large fyke nets (32 mm stretch mesh); • Light Traps (for larval fish); • Beach seine (5 mm mesh); • Push net (7 mm mesh); • 40 bait traps, 3 mm stretch mesh; • Trawl net (with 0.5 m radius circular opening with

All native fish taken pursuant to the exempted activity must be immediately returned to the water as soon as information is collected unless kept as voucher specimens. 3. All non-native fish must be destroyed and disposed of appropriately. 4. The exemption holder must operate in accordance to the Australian Code of Electrofishing Practice 1997, requirements. 5. The exempted activity may only be conducted on the exemption holder’s behalf by the following people: David Wood, Taylor Pay, Braeden Lampard, Greg Cranston,

Danielle Linklater, Michelle Kavanagh, Rochelle Petrie, Scott Huntley, Paul McInerny, Chris Davey, Thelma Vlamis, Rohan Rehwinkel, Iain Ellis and Leigh Pyke.

6. Before conducting the exempted activity, the exemption holder must contact PIRSA Fishwatch on 1800 065 522 and answer a series of questions about the exempted activity. You will need to have a copy of your exemption with you at the time of making the call, and be able to provide information about the area and time of the exempted activity, the vehicles and/or boats involved, the number of agents undertaking the exempted activity and other related issues. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007, or any regulations made under that Act, except where specifically exempted by this notice. FISHERIES MANAGEMENT ACT 2007: SECTION 115 TAKE notice that, pursuant to Section 115 of the Fisheries Management Act 2007, Reg Brown, 101 Wells Street, Streaky Bay, S.A. 5680 (the ‘exemption holder’) is exempt from Section 70 of the Fisheries Management Act 2007, and Regulation 7, and Clauses 61 and 118 of Schedule 6 of the Fisheries Management (General) Regulations 2007, but only insofar as he may remove Razorfish (Pinna bicolor) from the seabed (the ‘exempted activity’) contained within the intertidal aquaculture licence site authorised under the Aquaculture Act 2001, as described in Schedule 1, subject to the conditions in Schedule 2 from 7 November 2014 until 7 November 2015, unless varied or revoked earlier.

SCHEDULE 1 Aquaculture intertidal licence sites FM00212 and FM00324 in the Point Gibson aquaculture zone, Streaky Bay.

SCHEDULE 2 1. All razorfish removed from the licence sites must be disposed of appropriately by the exemption holder. 2. Razorfish may only be removed from underneath and adjacent to farming structures to a maximum distance of 2 metres from farming structures. 3. The removal of razorfish may only be undertaken using Razorfish tongs or by hand. 4. The exempted activity may be conducted on the exemption holder’s behalf by his agents namely employees of R. Brown Enterprises Pty Ltd trading as Streaky Bay Oysters. 5. While engaged in the exempted activity the exemption holder or his agents must carry or have about or near their person a copy of this notice. Such notice must be produced to a Fisheries Officer upon request. Exemption No. ME9902749. 6. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007, or any regulations made under that Act, except where specifically exempted by this notice. FISHERIES MANAGEMENT ACT 2007: SECTION 46

TAKE note that pursuant to subsection 46 (1) (b) of the Fisheries Management Act 2007, the Management Plan for the South Australian Charter Boat Fishery is amended in the following manner: Page 41, 2nd paragraph by deleting: ‘Licence holders are

limited to registering the number of charter fishing boats which were being used pursuant to their business at 28 November 2003. This means that if an applicant demonstrated and provided evidence that they were operating two boats at any one time under their charter boat fishing business at 28 November 2003, they are eligible to register two charter fishing boats on their licence today. Licence holders may upgrade their fishing boat at any time, but must deregister the original boat when making application to register a new boat’ and;

By replacing the deleted paragraph with ‘Licence holders may register up to five boats on their licence at any one time. Licence holders must only pay boat fees for each boat that is able to be operated at any one time according to the condition on the licence. This means that if you have three boats registered on your licence, but you are only able to use two boats at a time, then you must only pay boat fees for the two greater surveyed boats’.

Amendment 52 to the Magistrates Court Rules 1992 PURSUANT to Section 49 of the Magistrates Court Act 1991 and all other enabling powers, we, the undersigned, do hereby make the following amendments to the MAGISTRATES COURT RULES 1992 as amended. 1. These Rules may be cited as the ‘Magistrates Court Rules 1992 (Amendment 52)’. 2. The Magistrates Court Rules 1992 as amended by the following amendments apply to and govern all actions commenced in the criminal division of the Court on and after the date on which these amendments are gazetted. 3. Rule 24.00 is deleted and re-inserted as follows: 24.00 PROCEDURAL PROVISIONS—C.L.C.A 24.01 The following provisions of the Criminal Law Consolidation Act

1934 apply (with necessary adaptations and modifications) to the trial or sentencing of a person charged with a minor indictable offence:

So much of Rule 6 of Schedule 3 as relates to the naming of the owner of property, and rule 10 of Schedule 3.

Sections 19B (3), 19B (4a), 19B (5), 25, 285B, and 290. 4. Rule 29A.00 is inserted as follows: 29A.00 APPLICATION TO QUASH OR STAY PROCEEDINGS 29A.01 An application to quash or stay proceedings (including an application

made on the ground of an abuse of process) must comply with Form 23.This application must be filed 14 days prior to the date set for trial.

29A.02 An affidavit complying with Form 115 must be filed with the application.

29A.03 The Registrar must serve a copy of the application and supporting affidavit on the interested parties.

5. Rule 29B.00 is inserted as follows: 29B.00 PRELIMINARY HEARINGS 29B.01 When in the course of any criminal proceedings: (a) a person charged with an offence set for trial seeks separate

trials of different charges alleged against him in the same information or complaint;

(b) a person charged with an offence set for trial seeks a separate trial from that of another person charged with an offence set for trial and charged in the same information or complaint;

(c) a party seeks to raise any question relating to the admissibility of evidence or any other question of law affecting the conduct of the trial prior to the opening of the case for the prosecution or the calling of witnesses;

(d) a party desires to make an application which, if granted, would have the effect of postponing or delaying a trial which has been listed for hearing;

(e) a party desires to make some other application which cannot reasonably be made without notice to the other party or parties;

(f) a Magistrate directs that a written application should be made; the application is to be made by issuing and serving an application in Form 23.

PURSUANT to Section 49 of the Magistrates Court Act 1991 and all other enabling powers, we, the undersigned, do hereby make the following amendments to the MAGISTRATES COURT (CIVIL) RULES 2013 as amended. 1. These Rules may be cited as the ‘Magistrates Court (Civil) Rules 2013 (Amendment 7)’. 2. Return to Work Act (Commencement) Proclamation 2014

1—Short title This proclamation may be cited as the Return to Work Act (Commencement) Proclamation 2014.

2—Commencement of Act (1) Subject to subclauses (2), (3) and (4), the Return to Work Act 2014 (No 16 of 2014) (the Act)

will come into operation on 4 December 2014.

(2) The following provisions of the Act will come into operation on 4 December 2014:

(a) sections 1 to 3 (insofar as those provisions are not already in operation);

(b) section 4(1) to (7) (inclusive);

(c) section 4(14), (15) and (16);

(d) section 6;

Crown Land Management (Revocation of Dedication) Proclamation 2014 under section 19(2) of the Crown Land Management Act 2009

Preamble 1 The following land is dedicated as a reserve for electricity generation purposes (see Gazette

5.4.1984 p840) and has been granted in fee simple:

Allotment 3 in Deposited Plan 55666, Hundred of Davenport, County of Frome, being the whole of the land comprised in Certificate of Title Register Book Volume 5843 Folio 706.

2 It is now intended that the dedication of the land be revoked.

3 On revocation of the dedication the land reverts to the status of unalienated Crown land (see section 19(4) of the Crown Land Management Act 2009).

1—Short title This proclamation may be cited as the Crown Land Management (Revocation of Dedication) Proclamation 2014.

2—Commencement This proclamation comes into operation on the day on which it is made.

2—Commencement This proclamation comes into operation on the day on which it is made.

3—Designated day For the purposes of the definition of designated day in clause 27(1) of Schedule 9 of the Return to Work Act 2014, 1 July 2015 is appointed as the designated day for the purposes of each provision in Part 10 of that Schedule (other than clause 27(1)) in which the term is used.
