THE TAMIL NADU MUNICIPAL LASTGRADE SERVICE RULES, 1975

1. Short title .—These rules may e called the Tamil Nadu Municipal Last Grade ServiceRules, 1975.

1. U it o# $%%oi t&e t .— -!r the purp!se !" app!intment and pr!m!ti!ns, pr! ati!nand seni!rity, dischar+e "!r ant !" vacancies and reapp!intment, p!stin+s and trans"er andapp!intment !" "ull mem ers, the unit shall e the Municipalities c!ncerned.

'. A%%li($)ilit* o# Ge er$l R"le!.+ The General Rules shall n!t apply t! this service.

2. Metho o# $%%oi t&e t .— &pp!intment t! the p!sts in the service shall e made ydirect recruitment.

/. Re(r"iti - $ A%%oi ti - A"thorit* .— The Recruitin+ &uth!rity in respect !" the p!sts in this service shall e the &pp!intment *!mmittee, and the app!intin+ auth!rity shall e the *!mmissi!ner !" the Municipality c!ncerned.

7. "$li#i($tio !. — #a% N! pers!n shall e app!inted t! any !" the p!sts in the service, i"he has c!mpleted !r ill c!mplete 0 23 years4 !" a+e !n "irst day !" uly !" the year in hichthe selecti!n "!r app!intment is made (

The *!mmittee shall then, select the re uirednum er !" candidates !n the asis !" an intervie !nly. B" su""icient num er !" candidates"r!m the Ampl!yment A'chan+e is n!t availa le, the *!mmissi!ner shall advertise thevacancies in the l!cal dailies !" the district and invite applicati!ns "r!m eli+i le candidatesand c!mpile them. The applicati!ns s! c!mpiled shall e placed e"!re the &pp!intment*!mmittee. The &pp!intment *!mmittee shall, then, select the candidates !n the asis !" anintervie !nly. B" selecti!n is t! e made "r!m such !" th!se pers!ns h! are empl!yees !"Municipal *!uncils, the Ampl!yment A'chan+e need n!t e c!nsulted. The names !" thecandidates selected "!r app!intment shall e selected in the !rder !" pre"erence in each list.

De(l$r$tio o# %ro)$tio .—N!t ithstandin+ anythin+ c!ntained in Rule 1$ !" theserules, e'cept in cases here seri!us char+es are pendin+, all pers!ns app!inted y directrecruitment !" these rules and h!se pr! ati!n has n!t yet een declared shall, under thisrule and ith!ut "urther e'aminati!n !" their individual cases, e declared t! have c!mpletedtheir pr! ati!n "r!m the date !n hich they ere eli+i le "!r such a declarati!n (

14. Di!(h$r-e and reapp!intment.— #i% The !rder in hich pr! ati!ner and appr!ved pr! ati!ner in any p!st shall e dischar+ed "!r ant !" vacancy shall e "irst, pr! ati!ners inthe !rder !" Funi!rity D and sec!nd, appr!ved pr! ati!ners in the !rder !"Funi!rity.

2'. Alter$tio o# $te o# )irth .— #a% The date !" irth !" a mem er !" a service shall ethe date "!und !n rec!rd in the S.S.L.*. !r Matriculati!n Re+ister !r any sch!!l certi"icate

hich he pr!duces at the time !" his app!intment t! the service. B" a mem er !" a serviceclaims su se uently that his date !" irth is di""erent "r!m that entered in the S.S.L.*. !rMatriculati!n Re+ister !r Sch!!l *erti"icate he shall ma e an applicati!n t! the app!intin+auth!rity e'plainin+ h! the mista e !ccurred and als! pr!duce the evidence !n hich herelies.

# %&n applicati!n "!r alterati!n !" the date !" irth sh!uld n!t n!rmally e accepted ythe app!intin+ auth!rity i" it is made "ive years a"ter the mem er had entered service, unlessthe applicant "urnishes ade uate reas!ns "!r n!t ma in+ his applicati!n earlier.

# %The app!intin+ auth!rity shall send the relevant rec!rds t! the *!llect!r !" thedistrict c!ncerned, h! shall have the matter en uired int! y an !""icer !" the Revenue@epartment n!t l! er in ran than the Revenue @ivisi!nal ;""icer. The *!llect!r shall"!r ard ith his remar s, i" any, the rep!rt !" the Revenue @ivisi!nal ;""icer c!ncerned andall the relevant rec!rds t! the @irect!r !" Municipal &dministrati!n. Thereup!n, the @irect!r!" Municipal &dministrati!n shall su mit the case t! the G!vernment ith hisrec!mmendati!n, and the G!vernment shall pass !rders there!n.

#c%Bn c!nsiderin+ the uesti!n !" permittin+ an alterati!n in the date !" irth as enteredin the !""icial rec!rds, even hen such entry is pr!ved t! have een due t! a mista e, theG!vernment !r the app!intin+ auth!rity shall ta e int! c!nsiderati!n the circumstances

hether the applicant !uld n!rmally e eli+i le "!r app!intment t! the p!st at the time !"entry int! service had his a+e een c!rrectly stated and hat !uld have een its e""ect !n theservice, and the G!vernment may permit the alterati!n, su Fect t! such c!nditi!ns as theymay deem "it t! imp!se.
