Minesing/October 9, 2018 – Encourage your kids to unplug this fall and bring them to the Simcoe County Museum for our Victorian Kids Club. The program runs every Saturday morning for the month of November and encourages participants to learn what life was like for people living in Victorian times through cooking, crafts and games. The Victorian Kids Club is suitable for children ages 6 to 12, and costs $48 for the four week program. Space is limited so advanced registration is required. Next Steps for Municipal Governments A. What is Happening? The Standing Committee on Social Policy completed its work today and the Bill will be report to the Legislature for 3rd Reading and anticipated Royal Assent for October 17th. Many groups, including AMO recommended changes to clarify elements of the framework, the Committee made only one change. It clarifies that the amount of cannabis sold at one time to an individual is limited to 30 grams, in line with individual possession limits under federal legislation. Bill 36 will be the framework for sales, retailer licensing, store licensing, places of use and other cannabis rules on Wednesday, barring any unforeseen events. While the Committee did not accept the amendments AMO proposed, AMO will now focus on the regulation-making process to try to safeguard municipal input to the AGCO on siting and buffers from sensitive sites. For more information on AMO’s Submission to the Committee, see AMO’s Recommended Amendments to Bill 36. B. What Do You Need To Do? Next Steps for Municipal Governments Municipal staff need to become familiar with Bill 36 and the legal framework for recreational cannabis. Municipal staff need to understand the Bill and be ready to respond to inquiries about where people are able to use cannabis in public and manage nuisance complaints. See AMO’s Cannabis Briefing for more on the Smoke Free Ontario Act and how it deals with places to smoke. A council may review its bylaw to be more restrictive. Staff should also begin to research the information needed by council to take a decision on whether to opt-out of retail licensing which is required before January 22, 2018. To ensure sufficient time is available for council’s decision-making, staff will need to consider a work-back schedule taking into account the council meeting schedule and procedural by-law. AMO will continue to inform members of any significant developments that affect municipal council decisions and local services including the status and content of any regulations that put the legislative framework into effect. Remember, Bill 36 exempts retail stores from municipal business licensing and land use planning. The Standing Committee chose not to explicitly require only areas zoned for commercial use as eligible for cannabis retail operations. We are hopeful that we can achieve this in the days ahead and a clear process for input to AGCO on cannabis retail store siting. In the meantime, AMO recommends that the appropriate municipal staff begin looking at siting considerations. Ontario municipal governments will share at least $40 million of the provincial portion of the federal cannabis excise tax to help manage the transition to legal recreational cannabis. Individual municipalities will have access to at least $10,000 and more if cannabis retail stores are to be located in

AMCTO RESPONDS TO ANNOUNCEMENT OF THE BETTER LOCAL GOVERNMENT ACT
Dear AMCTO Members: Last week several municipal reforms with significant ramifications, were put forward by the Honourable Premier Doug Ford and Minister of Municipal Affairs and Housing, Steve Clark. While we look forward to reviewing the upcoming legislation, the announcement and several aspects of the proposed legislation has created widespread concern within our sector, regarding timing, implementation, and lack of engagement with local government professionals. Reserving any specific comment on the policy, AMCTO is concerned with how these reforms were brought forward, notably:
This legislation will be introduced on the eve of the 2018 municipal elections and will impact provisions within the Municipal Elections Act. AMCTO has long believed that senior orders of government should engage local government professionals and representative associations, early and more importantly, provide the appropriate amount of time to ensure that public policy implementation is effective at the local level. The timing of this legislation will make this extremely challenging.
This new legislation will create changes to existing election processes within the sector. Ambiguity exists with how to balance the currently enforced rules and regulations with those of the new legislation. Naturally, this ambiguity hinders the ability of local government professionals to implement provincial public policy in a fair and effective manner.
Finally, AMCTO is concerned that the lack of engagement or notice for these reforms to municipal legislation signals a step backwards in the belief that the municipal sector is recognized as a mature, responsible order of government.
AMCTO staff and members will review the legislation once it is released, and will look for ways to provide our technical expertise on how to support public policy implementation at the local level. We continue to believe this value is best served when our members and association are engaged early in the policy development process.

from the Southern Georgian Bay Detachment Commander. Detachment Commander Inspector Ferguson provided a comprehensive review of the Southern Georgian Bay Detachment Police Services Report for the period of February 8 to May 31, 2018, and responded to questions from the Board.

8. OTHER BUSINESS a) Records Management Chair Dixon advised that Town Administration has requested the remaining records of the MPS in the Town’s custody be reviewed by an external records management professional to develop an inventory and assign applicable retention to the records.

Canning Whereas the Corporation of the Town of Midland has custody of the remaining Midland Police Service Board (constituted under section 31 of the Police Services Act, R.S.O. 1990 “Act”) records that existed on February 8, 2018 and that were not transferred to the OPP when the OPP became responsible for policing the Town of Midland; And whereas the Midland Police Services Board, now governed by Section 10 of the Act, considers it necessary and expedient for these remaining records to be systematically catalogued and to allow items to be located when needed and to identify records suitable for destruction; Therefore the Midland Police Services Board hereby requests the Chief Administrative Officer of the Corporation of the Town of Midland to requisition the necessary resources to catalogue these records, to recommend appropriate retention periods and to recommend records suitable for immediate destruction; and to provide an update to the Board not later than December 31, 2018. CARRIED.
b) Update on Midland Police Services Board Policies
The Board discussed policies to be rescinded as outlined in Report MPSB-2018-02.

Cannabis Statute Law Amendment Act, 2018

Ontario is introducing legislation that, if passed, would bring in stricter controls to safeguard
young people and combat the criminal market, and provide safer ways to buy recreational
cannabis legally.
The proposed Cannabis Statute Law Amendment Act, 2018 introduces new controls, in addition
to introducing amendments to various acts to make them stronger.
Supporting licensed and regulated private cannabis retail sales
The Cannabis Act, 2017 would be amended to permit the Ontario Cannabis Retail Corporation (OCRC) and stores authorized under the proposed Cannabis Licence Act, 2018, if passed, to sell recreational cannabis privately in Ontario.
It would be made an offence for an unlicensed store to claim it is authorized to sell recreational cannabis, including misusing the cannabis retail seal.
Places of use
The Smoke-Free Ontario Act, 2017 and the Cannabis Act, 2017 would be amended to clarify where the smoking and vaping medical and recreational cannabis is permitted as well as where it is prohibited, such as in enclosed public places and enclosed workplaces, vehicles and boats.
The maximum fine for using cannabis in a prohibited place would be $1,000 for a first offence, and $5,000 for a subsequent offence, the same fines that apply to smoking tobacco or using an electronic cigarette in a prohibited place.
Licences and authorizations
The proposed Cannabis Licence Act, 2018 would set out a licensing and regulatory regime for private cannabis retail stores administered by the Alcohol and Gaming Commission of Ontario (AGCO). This new statute would establish eligibility criteria for the issuance of licences and authorizations.
Those interested would be able to apply for two types of licences - a retail operator licence (ROL) and a cannabis retail manager licence - and a retail store authorization (RSA) for specific cannabis retail store locations. A person would require an ROL before they could be issued an RSA, though they would be permitted to apply for both an ROL and an RSA at the same time.
The proposed legislation would make it clear that persons operating in contravention of prescribed provisions of that Act, the Cannabis Act, 2017 or the Cannabis Act (Canada) would not be eligible for a retail operator's licence.
The AGCO would be required to give public notice of an application for an RSA before issuing one. The notice would include a request for the municipality and its residents to make written submissions to the Registrar in respect of whether the RSA is in the public interest.
Licensed producers under the Cannabis Act (Canada) would only be allowed to establish one store only, onsite at a production facility.
Sale of cannabis and operation of cannabis retail stores
The proposed Cannabis Licence Act, 2018 would establish requirements for the sale of cannabis in cannabis retail stores and the operation of cannabis retail stores.
Enforcement
The proposed Cannabis Licence Act, 2018 would be enforced by the AGCO through regulatory measures such as licence sanctions (e.g. suspensions and revocations, and monetary penalties enabled under the Alcohol and Gaming Regulation and Public Protection Act, 1996).
The act would also establish general offences respecting the licensing scheme, including prohibitions against hindering inspectors or investigators and against retaliating against a person because of any disclosure to the Registrar or to an inspector or investigator.
Municipalities
The proposed Cannabis Licence Act, 2018 would permit a local municipality to pass a resolution by January 22, 2019, to opt-out of retail sales. The prohibition could be lifted by a later resolution passed by the municipality. However, once a prohibition has been lifted, the municipality would not be able to prohibit cannabis retail stores from being located in its community at a later date.
Given the robust proposed role of the AGCO, the Cannabis Licence Act, 2018 would ensure that cannabis retail could not be designated as a separate land use from retail generally, and cannabis retail stores would be exempt from municipal licensing requirements.
Municipal funding
The province will provide $40 million over two years to help municipalities with the implementation costs of recreational cannabis legalization, with each municipality receiving at least $10,000 in total.
As soon as possible this year, the province would make the first payment to all municipalities on a per household basis, with at least $5,000 provided to each municipality.
The province would then distribute a second payment following the proposed deadline for municipalities to opt-out, which would be January 22, 2019.
o Municipalities that have not opted-out as of that date would receive funding on a per household basis.
o This funding would support initial costs related to hosting retail storefronts. o Municipalities that have opted-out would receive only a second $5,000 each.
The province is considering setting aside a certain portion of the municipal funding in each of 2018-19 and 2019-20 for unforeseen circumstances, and priority would be given to municipalities that have not opted-out.
Finally, if Ontario's portion of the federal excise duty on recreational cannabis over the first two years of legalization exceeds $100 million, the province will provide 50 percent of the surplus only to municipalities that have not opted-out as of January 22, 2019.
First Nation reserves
The proposed Cannabis Licence Act, 2018 would permit a First Nations Band Council to request that the Registrar not issue retail store authorizations for cannabis retail stores to be located in their communities. The Registrar would be required to comply with such a request, as well as with any future request to amend or rescind the original request.
The AGCO would be required to publish a list of First Nations communities which prohibit cannabis retail stores on its website.
The First Nations Band Council would need to approve the location of a proposed store before the Registrar could issue an authorization for that store.
Ontario Cannabis Retail Corporation governance
Amendments to the Ontario Cannabis Retail Corporation Act, 2017 would provide the OCRC with the exclusive right to sell cannabis in Ontario online and by any means other than by operating physical stores.
OCRC would also be the exclusive wholesaler of cannabis to authorized cannabis retail stores and would be expressly prohibited from operating retail stores, directly or indirectly.
Changes are also proposed to the governance of the OCRC, so that it would cease to operate as a subsidiary of the LCBO. For example, members of the OCRC's board of directors would be appointed by the Lieutenant Governor in Council, rather than by the LCBO.
