WHEREAS, There has been presented to the Mayor and Council Members of the Borough of North Arlington, the attached list of invoices requesting payment for the work, labor, services and materials to the Borough; and

WHEREAS, said attached list specify the exact line item in the budget or Ordinance to be charged therewith: $ 4,036,807.00.

WHEREAS, each of the purchases by said invoices have been duly authorized by the purchasing department, agent or office in respect to the goods and services received, as well as the Chief Financial Officer in regard to availability of funds; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of North Arlington, that the CFO is hereby authorized to pay the claims.

RESO RE:INTERLOCAL SERVICE AGREEMENT PISTOL RANGE

WHEREAS, the Mayor and Council of the Borough of North Arlington authorize Interlocal Services Agreement pursuant to the Interlocal Services Act, N.J.S.A. 40:8A-1 et seq and;

WHEREAS, the need exists for North Arlington to enter into Interlocal Service Agreements with the following Police Departments so that they may have authorization to use the North Arlington Pistol Range:

Belleville Police Department

Bloomfield Police Department Bogota Police Department

Cliffside Park Police Department Fort Lee Police Department

Hackensack Police Department Harrison Police Department Kearny Police Department

Leonia Police Department Lyndhurst Police Department

NOW THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of North Arlington, that the Borough is hereby authorized to enter into Interlocal Service Agreements with the above referenced entities for a payment of $500.00 per week or each week that it is used, Certification of Insurance in the amount of $1,000,000.00, and Hold Harmless Agreement. BE IT FURTHER RESOLVED, that the Mayor and Borough Clerk are hereby authorized and directed to execute an agreement with each respective Police Department.

RESO RE: AUTHORIZATION TO NEGOTIATE A SALE OF BOROUGH OWNED EASEMENTS RELATED TO 100

PORETE AVENUE

WHEREAS, 100, LLC is the owner of property located within the Borough of North Arlington (“the Borough”) at 100 Porete Avenue (“the Property”); and WHEREAS, the Borough is the holder of two easements on the Property as follows:

(1) an Access Easement which contains 1.22± acres from a portion of the property designated as Block 171, Lot 1 on the official tax map of the Borough and commonly known as Porete Avenue; and

(2) a Public Purpose Easement which contains 2.12± acres from a portion of

the property designated as Block 173.04, Lot 1 on the official tax map of the Borough and commonly known as End Porete Avenue; and

WHEREAS, McNerney & Associates, Inc. completed an appraisal as to the fair market value of

the easements dated September 15, 2015 (“the Appraisal”); and

WHEREAS, 100, LLC has expressed interest in purchasing the easements described herein from the Borough based, in part, on the value established by the Appraisal; and WHEREAS, the Governing Body of the Borough has, after extensive deliberation, determined that it is the best interests of the Borough to enter into negotiations to potentially sell/extinguish the easements described herein to 100, LLC; and

NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of North Arlington that the Borough Attorney and other Borough representatives (as is necessary) are hereby authorized and directed to enter into negotiations with 100, LLC and its representatives with regard to a possible contract for sale of the easements described herein; and BE IT FURTHER RESOLVED that, if the Borough Attorney and 100, LLC and its representatives are able to reach an agreement with regard to an appropriate contract for sale, such contract shall be presented to the Governing Body for its review and shall be executed on behalf of the Borough only upon passage of an appropriate Resolution and authorizing such sale and the completion of any other necessary supporting legal actions.

RESO RE: AUTHORIZING APPOINTMENT OF MUNICIPAL REPRESENTATIVES TO THE BERGEN

COUNTY COMMUNITY DEVELOPMENT REGIONAL COMMITTEE

WHERAS, the Municipality of North Arlington has entered into a three year Cooperative Agreement with the County of Bergen as provided under the Interlocal Services Act N.J.S.A. 40A:8a-1 et seq. and Title 1 of the Housing and Community Development Act of 1974; and WHEREAS, said Agreement requires that the Municipal Council to appoint a representative and alternate and that the Mayor appoint a representative and alternate for the FY 2017-2018 term starting July 1, 2017 and ending on June 30, 2018. NOW, THEREFORE, BE IT RESOLVED that the Municipal Council hereby appoints Councilwoman Allison Sheedy as its representative and that the Mayor hereby appoints Borough Administrator Stephen Lo Iacono as his/her representative to serve on the Community Development Regional Committee for FY 2017-2018; and BE IT FURTHER RESOLVED that an original copy of this resolution be forwarded to the Bergen County Division of Community Development, One Bergen County Plaza, Fourth Floor, Hackensack, New Jersey 07601 for receipt no later than Friday, August, 11, 2017.

RESO RE: EXECUTION OF THE POLICE CHIEF’S EMPLOYMENT CONTRACT

WHEREAS, the Police Chief, Scott Hedenberg, was duly appointed as Chief of Police of the Borough on May 11, 2017 with an effective date of July 1, 2017; and WHEREAS, the Mayor and Council of the Borough have determined that it is desirable to formalize the terms and conditions of employment of the Chief of Police; and WHEREAS, the Mayor and Council of the Borough directed the Borough Labor Attorney to draft a formal contract setting forth all of the terms and conditions of the employment of the Chief of Police; and WHEREAS, a copy of the written contract of employment of the Chief of Police is attached hereto; and NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of North Arlington, Bergen County, New Jersey, that the Mayor and Borough Clerk are hereby authorized and directed to execute the attached contract for the employment of the Chief of Police, Scott Hedenberg.

WHEREAS, circa 2001, the Borough of North Arlington declared the Ridge Road corridor as an area-in-

need-of-redevelopment; and

WHEREAS, a Ridge Road Redevelopment Plan was prepared by Heyer, Gruel & Associates, PA.,

Community Planning Consultants; and

WHEREAS, on or about November 27, 2001, the Ridge Road Redevelopment Plan was adopted by the

Governing Body by Ordinance No. 1823, entitled: “An Ordinance Amending the Code of the Borough of North

Arlington and more Specifically Chapter 50A thereof Entitled Redevelopment Agency and Creating Article III

thereto Entitled Ridge Road Redevelopment Plan”; and

WHEREAS, the Borough is permitted to amend, from time to time, the Redevelopment Plan/Ordinance

pursuant to the Local Redevelopment and Housing Law at N.J.S.A 40A:12A-7(e); and

WHEREAS, a development has been proposed by Opus Development, LLC (hereinafter, the

“Petitioner”) which would require a variance with regard to the height of the proposed structure at the property

located at Block 10, Lots 49 & 50 on the official tax map of the Borough of North Arlington, County of Bergen

(hereinafter “the Property”), which is more commonly known as 77-85 Ridge Road, North Arlington; and

WHEREAS, the Governing Body has been designated as the North Arlington Redevelopment entity and,

as such, is empowered to address and deal with any and all issues relating to the Redevelopment Area in the

Borough; and

WHEREAS, the Governing Body, acting as the redevelopment entity, reviewed the conceptual drawings

for the redevelopment project proposed by the Petitioner at a meeting conducted May 11, 2017 and determined that

it was consistent with the Redevelopment Plan; and

NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Borough of North Arlington

that Chapter 50A, Article III of the Ridge Road Redevelopment Ordinance is hereby amended as follows:

2. Relationship to Ordinance. Unless specifically set forth herein, all sections of the Ridge Road Redevelopment Ordinance related to bulk standards, design standards and other guidelines shall be adhered to as set forth elsewhere herein. Notwithstanding the foregoing, the Planning Board shall be permitted to grant waivers and variances to the standards and requirements during the site plan hearing as required.

ADDITIONAL PROVISIONS

1. The foregoing sections shall be added to the Ridge Road Redevelopment Ordinance.

2. All other sections of the Ridge Road Redevelopment Plan/Ordinance shall remain unchanged and in full force and effect.

3. If any section or provision of this ordinance shall be held to be invalid in any court of competent jurisdiction, the same shall not affect the other sections or provisions of this ordinance except insofar as the section or provision declared invalid shall be inseparable from the remainder or any portion thereof..

4. This amendment to the Ridge Road Redevelopment Ordinance shall take effect upon publication as provided by law.

1. On the first day of service, an employee shall be entitled to four (4) hours per month of sick leave.

2. Upon reaching one (1) year of service an employee shall become entitled to forty (40) hours per year of sick leave time.

3. Sick leave may be carried over year to year but employees may only accumulate a maximum of 240 hours of sick leave time.

E. Miscellaneous 1. Employees shall not be entitled to any other benefits than those specifically identified

herein. By way of example, and not of limitation, the employees shall not be entitled to medical benefits of any kind, including coverage for major medical expenses, prescription drugs or dental expenses.

2. All personnel decisions, including hiring, termination and promotions, shall be made at the direction of the Mayor and Council only.

3. All employees shall be considered employees “at will,” which means that either party may end the employment relationship at any time with or without cause.

4. All employees shall be subject to the terms and conditions set forth in the Borough of North Arlington employee handbook with the exception of any such terms and condition which may be inconsistent with those set forth herein.

5. All employees shall be subject to any further terms and conditions set forth by the Mayor and Council at any time in the future.

6. All employees shall be paid for any snow days, up to a maximum of three (3) days per school year, which lead to the closure of Borough schools for a full day on a day in which the Employee is scheduled to work.

7. Any employee working on a Borough Holiday shall be paid at time and one half. IT IS FURTHER ORDAINED that all Ordinances or parts of Ordinances inconsistent
