    In 2004, BJDgot 11 while BJP won inseven constituenciesleaving only two seats tothe opposition Congress.JMM had won one seat.

    The al l iancealso proved fruitful forboth the parties in 1999Lok Sabha polls whenCongress could win onlyone of the 21 seats.The analysts say thatgiven this track record,the BJD's decision to gofor a divorce is muchmore deep rooted than itis willing to admit.

Where chaffcan be separated fromgrain, it would be open tothe court to convict ana c c u s e dnotwithstanding, the factthat evidence has beenfound to be deficient, or tobe not wholly credible," abench of Justices ArijitP a s a y a t a n dMukundakam Sharmaobserved. The apex courtpassed the ruling whiledismissing the appeal ofMani alias Udattu Manand six others convictedand sentenced to lifeimpr i sonment by asessions court in Tamil

    Nadu for the murder ofo n e P r a b h a . T h edeceased was hacked todeath by the accused dueto previous enmity. Eventhough seven of theprosecution witnessestu rned hos t i l e , thesessions court convictedthe accused on the basis

    o f t h e e y e w i t n e s saccount of Murugammal,mother of the deceased.However, one of theaccused was acquitted ofthe charge.The MadrasHigh Court confirmed thesentence following whichthe accused appealed int h e a p e x c o u r t .

    be disregarded, and nott h a t i t m u s t b ed i s r e g a r d e d . T h edoctrince merely involvesthe question of weight ofevidence which a courtmay apply in a given set ofcircumstances, but is notwhat may be called am a n d a t o r y r u l e o fevidence," the benchobserved. Evidence ineach case has to beappraised as to whatextent it is worthy ofaccpetance, the apexcourt said.

    "Merely becausein some respects the courtconsiders the same to be

    insufficient for placingreliance on the testimonyof a witness, it does notnecessarily follow as amatter of law that it must bed i s r e g a r d e d i n a l laspects," the benchobserved, while upholdingt h e c o n v i c t i o n a n dsentence.
