    PLEASE TAKE NOTICE that a publichearing will be held before the Town Boardof the Town of Riverhead, at RiverheadTown Hall, 200 Howell Avenue, Riverhead,New York, on the 2nd day of June, 2015 at2:05 o’clock p.m. to consider a local law toupdate and adopt Procurement Policy pur-suant to General Municipal Law as follows:

    TOWN OF RIVERHEADProcurement Policy

    PURPOSE:The purpose of this Procurement Policy

    is to ensure that sound business judgmentis utilized in all procurement transactionsand that supplies, equipment, contracts,and services are obtained efficiently and incompliance with applicable laws and to en-sure that all procurement transactions willbe conducted in a manner that providesfull and open competition and prudent andeconomical use of public money. In addition,this Procurement Policy seeks to ensure thatthe same sound business judgment used forthe purchase of personal property (i.e. sup-

    plies and equipment) is used for the evalua-tion of personal property and/or assets withrespect to its usefulness to the Town now orin the foreseeable future and cost effective

    and efficient procedures for disposition ofthe personal property and/or assets deemedno longer of public use to the Town.

    Guideline 1: Every prospective purchaseof goods or services shall be evaluated to de-termine the applicability of General Munici-pal Law §103 inclusive of a ll future statutoryamendments, deemed to be incorporated byreference, as if recited in its entirety herein.Every town officer, board, department heador other personnel with the requisite pur-chasing authority (hereinafter “purchaser”)shall estimate the cumulative amount of theitems of supply or equipment needed in agiven fiscal year. The information gatheredand conclusions reached shall be document-ed and kept with the file or other documen-tation supporting the purchase activity.

    Guideline 2: All purchases of suppliesor equipment which will exceed $20,000 inthe fiscal year or public works contracts over$35,000 shall be formally bid pursuant toGeneral Municipal Law §103 inclusive of allfuture statutory amendments, deemed to beincorporated by reference, as if recited in itsentirety herein.

    Guideline 3:(1) All estimated purchases of less than

    $20,000 but greater than $3,000 shall requirea written request for a proposal (“RFP”)and written/fax quotes from at least threecomparative vendors; less than $3,000 butgreater than $1,000 require an oral requestfor proposal for the goods, equipment orsupplies and oral/fax quotes from at leasttwo vendors and purchaser shall maintaina record of responses whether they arereceived by phone or in writing; less than$1,000 are left to the discretion of the pur-chaser.

    (2) All estimated public works contractsof less than $35,000 but greater than $10,000require a written request for proposal andfax/proposals from at least three comparablecontractors; less than $10,000 but greater than$1,000 require a written request for proposaland fax/proposals from at least two contrac-tors and purchaser shall maintain a recordof responses whether they are received byphone or in writing; less than $1,000 are left

    to the discretion of the purchaser.(3) All written RFP shall describe thedesired goods, quantity and details regard-ing delivery, including mode of delivery and

    time parameters for delivery. The purchasershall compile a list of all vendors from whomwritten/fax/oral quotes have been requested

    and the written/fax/oral quotes offered.(4) All information gathered in comply-

    ing with the procedures of this guidelineshall be preserved and filed with the docu-mentation supporting the subsequent pur-chase or public works contract. All respons-es to the RFP shall be kept confidential untilsuch time as the contract for work or goodsis awarded and thereafter all documentsresponsive to the RFP shall be subject todisclosure pursuant to the applicable provi-sions of the Public Officers Law.

    Guideline 4: All purchasers shall makea good-faith effort to obtain the requirednumber of proposals or quotations. If thepurchaser is unable to obtain the requirednumber of proposals or quotations, the pur-chaser shall document the attempt made atobtaining the proposals. In no event shall theinability to obtain the proposals or quotes bea bar to the procurement.

    Guideline 5: The lowest responsible pro-posal or quote shall be awarded the purchaseor public works contract unless the purchaserprepares written justification providing rea-sons why it is in the best interest of the townand its taxpayers to make an award to otherthan the low bidder. If a bidder is not deemedresponsible, facts supporting that judgmentshall also be documented and filed with therecord supporting the procurement.

    Guideline 6: A request for proposal and/or quotation shall not be required under thefollowing circumstances:

    (1) Contract for professional servicessubject to resolution of the Town Board.

    (2)(a) Purchase of goods, equipment orsupplies or contract for services throughqualifying contracts let by other New YorkState political subdivisions provided that (i)the contract must have been let by the Unit-ed States or any agency thereof, any stateor any other political subdivision or districttherein; (ii) the contract must have beenmade available for use by other governmen-tal entities, i.e. inclusion in the contract letby the other entity of a clause extending the

    terms and conditions of the contract to other

    governmental entities; and (iii) the contractmust have been let to the lowest responsiblebidder or on the basis of best value in a man-

    ner consistent with General Municipal Law§ 103 and related case law. (*Note, GML103 (16) is scheduled to expire on August 1,2017).

    (2)(b) Purchase of goods, equipment orsupplies or contract for services throughqualifying contracts let by the County of Suf-folk or through any county within the Stateof New York subject to County Law 408(a).

    (3) Public emergency arising out ofan accident or unforeseen occurrence orcondition affecting public buildings, publicproperty or life, health, safety or property ofthe inhabitants of the Town. Unless exigentcircumstances exist such that time is of theessence, Purchaser shall seek to obtain ap-proval of the Town Board prior to purchaseor contract.

    (4) Sole-source situations (purchaser mustobtain written verification from vendor)

    (5) Surplus and second-hand supplies,material or equipment from federal govern-ment, State of New York, or other politicalsubdivisions, districts, or public benefit cor-poration.

    (6) Purchase of goods, equipment andsupplies under State contracts through theOffice of General Services and subject torules promulgated by the Office of GeneralServices.

    Guideline 7: The purchases of goodsor services must be accompanied by a dulysigned and completed purchase order orcontract except a purchase order shall notbe required prior to purchase/procurementunder those circumstances identified inGuideline 6 and purchases or public worksproject less than $1000.00.
