1 GENERAL ASPECTS

1.1. For details regarding the description, performance, quality and endurance of thematerials as well as the professional abilities, conditions, general obligations andresponsibilities to be fulfilled within the execution of the Contract, please refer to theConditions of the Contract, General and Particular Technical Specifications, Drawingsand any other information included in the present awarding documentation.

1.2. For the elaboration of Work Programme as well as for the calculation of the prices theContractor is obliged to get thorough information regarding the transport and storageconditions in both Tulcea and Sulina.

The transport from Tulcea to Sulina is possible only on Danube river. The loading andunloading in Tulcea and Sulina berths as well as the transport by boat for all thematerials and equipmentto be used in this contract must be adequately quoted.

Also the weather conditions must be taken into consideration as well as the fact that dueto bad weather conditions the transport on Danube may become difficult.

Consequently the Contractor must consider all the implications of these specialconditions upon the the execution duration and costs.

1.3. Unless expressly specified otherwise, all the prices in the BoQ-s (Lists of Quantities ofWorks) shall include the following items:

Guarantees and insurances requested by the present documentation and accordingto the national legislation in force,

Indirect expenses and profit

All the taxes, Romanian and foreign, including all the taxes levied by the localauthorities or the special taxes for the used buildings, import taxes, licences,authorisations related to the execution and maintenance of the works.

The necessary measures for the compliance with the Health & Safety laws in force,fire protection etc.

Labour and all the expenses related to the works execution as well as for theremediation of the defects until the expiry of their Warranty period.

Materials supply, insurance and all the costs related to them including the contracting,transport, insurance and delivery to site as well as the embedding into the works.

The transport price will include the cost for the necessary labour and equipment forunpacking, loading, transport, storage and handling of the items which are about to

be transported. Any taxes and transport insurances will also be included.

The construction machinery, the equipment and all the related expenses.

The sampling and testing of the materials and goods, the procurement, storage,packing and transport of the samples to and from the testing place in compliance withthe Special Technical Conditions. (????)

The fixing, lifting, installation and positioning the materials and goods.

The storage of the surplus, unsuitable materials, goods and materials resulted fromdigging, including the piling, stocking (including any tax levied by the Town Hall),loading, transport and unloading.

All the temporary Works including the ones for extracting the infiltration water andwaste water from trenches, clay insulation along the trenches between the new

collector and the old one, site signalisation and fencing, inhabitants access by use ofbridges with railing, etc.

All the obligations of the Contractor under the contract for a good execution of theremediation works for the damages before the expiry of the warranty period of thecontract.

Cooperation with other Contractors and operators of the public or private services,

including the local authorities, as detailed in the Specifications.

Construction and maintenance of the temporary access roads in site and of anynecessary roads for access to any part of the site for the execution of the works,taking into consideration the fact that the access roads which are in the Contractorscare and maintenance will be also used by the Contracting Authority and by thevehicles of its staff, these roads will be ensured also for the residents of the area.

The Contractor will identify the existent services: cold water, hot water, gas,electricity, sewerage and telephone and will allow manual digging where the worksare being done in the close neighbourhood of other services and where is necessary.The Contractor will acknowledge and will assume the rules, regulations and relevant

legislation for the interruption, disturbance, relocation of other services or occupationof public spaces.

Additional topographical surveys, additional geotechnical surveys and any otheractivities considered as necessary for the completion of the works plan and for theexecution of the construction and of the execution drawings.

The elaboration and multiplication of the as built drawings, the correction of thesedrawings according to the requirements of the Supervision Consultant until they areapproved by them.

1.4. The payment modality for the water and sewerage network is as following:

The Interim Works Statements for water and sewerage networks will be accepted forpayment only when all the conditions listed below are fulfilled:

1. It includes sections of water and sewerage network stated in meters of piperelated to the respective street, completely executed in compliance with thespecifications and with all the activities included in the lists of executedquantities.

2. It includes the valve chambers, hydrants, branch connections, connections,inspection chambers provided in the awarding documentation for the respectiveexecuted sector.

3. The reinstatement works for the roads are included for the respective sectors.

4. The as built drawings for the respective sector are submitted and approved bythe Supervision Consultant.

5. All the Reception Minutes for the respective sector are included, according to theQuality Control Plan for the determinant phases for the respective sector.

6. The Technical Report of the CCTV investigation is included for the sewerageworks.

1. The temporary works for the maintenance of the services during the executionwill be paid in full after the dismantling of the respective works and reinstatementof the land to the initial status.

2. In case that on a particular street both water and sewerage networks areprovided, the payment will be done only if both networks have been completelyexecuted.

1.5. The payment modality for the Pumping Stations is as following:

The Works Statements for the interim payments will reflect the percentage of the value of theactually executed works on site. The Supervision Consultant and the Contractor will agreeupon the commencement of the works the percentage split of the works per completed andreceived components, such as earthworks, concrete works and other works included in thecivil works value, as well as the percentage of the equipment, pipes and installation for themechanical works, the percentage of the equipment, cables and installation for the electricalworks or for the automation and control ones.

The interim Works Statements for the pumping stations will be accepted for payment asfollowing:

Constructions:

Up to 90% of the provided price will be paid upon the completion of the works.

10% of the provided price will be paid after the completion of the PS andissuance of the Taking Over Certificate at Completion.

Hydraulic and mechanical installations

Up to 90% of the provided price will be paid upon the completion of the works


Electrical installations



Ventilation installations



Landscaping



1.6. In case that the price lists include components for which the Contractor did not include avalue, that price will be considered of zero value.

1.7. The unit prices indicated in the respective List of prices will apply only in the cases whenthe Contracting Authority respectively the Supervision Consultant request or approveadditional works which have not been described in the present documentation.

1.8. The Contractor will take into consideration in his Works Programme the following issues:

3 DESIGN AND ENGINEERING

Will include all the costs for:

The elaboration of the execution details and adaptation to the ground for the PS-sand manholes according to the provisions of the Technical Specifications. The lawsin force regarding the design and execution for the respective structures and works

will be complied with. All the necessary revisions and corrections will be elaborateduntil the final acceptance by the Supervision Consultant,

The editing and the multiplication according to the provisions of the TechnicalSpecifications.

All the topographical, geological and any other kind of survey considered asnecessary by the Contractor for the elaboration of the above mentioned executiondetails.

The cost will also cover any related activity such as data collection, prospecting, testdrills or any other kind of such activities.

The design activities will be paid as flat rate tariff according to the following scheme:

85% of the amount will be paid after the approval by the Supervision Consultant ofthe necessary execution design for the pumping stations according to theSpecifications.

15% of the amount will be paid after the completion of all construction works andissuance of Taking Over Certificate upon Completion.

4 WATER SUPPLY NETWORKS

Will include all the costs for: Street opening (dismantling), including the setting out of the works, eventual

arrangement of traffic road way for equipment, installing and conservation of thebenchmarks and other topographical marks, the necessary measures for thepedestrian access for residents, transport of materials, signalization, railing, walkingboards, etc according to the requirements of the norms in force;

Removal of the top soil layer in the green spaces and reinstatement of top soil layerin the green spaces.

Dismantling of pavement and related curb stone, dismantling of stone pavementcovered or uncovered with asphalt, monolith concrete block pavement covered oruncovered with asphalt;

Mechanical digging;

Manual digging, including shovel levelling;

Digging props including materials, transport, installation, dismantling where isnecessary or imposed by standards, specifications, H&S rules, etc.;

Protection works, supporting works, temporary or permanent rerouting of any utilitiesnetworks;

Works for ensuring the drinking water for the residents during the execution of theworks;

Sand bed of minimum 10 cm thickness according to the specification, includingtransport, loading and unloading;

Pipes and fittings Procurement, transport and installation; the price includes theprocurement at site, positioning irrespective of the depth, joining or welding of thestraight pipes. It also includes the special joining pieces, elbows, flange connectionpieces (including the joining pieces of the existent pipes), reductions, connectionpieces, other fittings.

The procurement on site and the installation of the necessary devices for the

installation of the provided measuring devices (pipes penetration, pressure collarhold, gate valve, etc.) according to different diameters and material types.

Pressure tests according to the norms in force

The necessary dewatering activities for the execution of the works;

The disinfection of the pipe and the obtaining of the agreement from the competentinstitutions;

The execution and the compaction of the filling according to the specificationsincluding transport, loading, unloading. The following items are included: manual ormechanical return of the local filling material on site and completion where necessarywith borrowed material, layers watering for compaction purposes, manual or

mechanical compaction.

All the necessary works for the crossing of the gas pipes, sewerage pipes, watersupply pipes, electric cables, optical cables, telephone lines and heating pipes.

The necessary dewatering activities for the execution of the works;

Reinstatement of the road structure to the initial status including curb stones andpavements of all kinds;

Transport and disposal of the excess material resulted from pipes de-allocation at thelandfill indicated by the Contracting Authority, including landfill levelling;

Other works which are not specified above but are considered necessary by the

tenderer for the execution of the works;

The works will be paid per meter of water supply pipe procured, installed and tested,including the completion of the earth works and reinstatement of the roads and only afterapproval by the Supervision Consultant.

No payments will be accepted for interim stages.

5 WATER SUPPLY BRANCH CONNECTIONS


Displacement of the top road layer; including the setting out of the works, eventuallythe arrangements for one way traffic for equipment, installation and preservation ofthe benchmarks and other topographic devices, necessary measures for thepedestrian traffic for the residents, transport of the material, signalisation, railings,culverts, etc. according to the requirements of the Norms in force;

Displacement of the top layer of the green areas and covering in the green area;

Displacement of the sidewalks and related curb stones, displacement of the stonepavements covered or uncovered with asphalt, monolith concrete tiles pavementscovered or uncovered with asphalt.

Mechanical digging;

Manual digging including shovel levelling;

Trench propping (timbering) including materials, transport, installation, dismantling,where necessary or requested by standards, specifications, H&S rules, etc.;

Protection, supporting or temporary/permanent diversion for any utility networks;

Works for ensuring the drinking water for the residents during the execution of the

works; Sand bed of minimum 10 cm thickness according to the specification, including

transport, loading and unloading;

Pipes and fittings Procurement, Transport and installation; the price includes theprocurement on site, pipe positioning irrespective of the depth, straight pipe joints orwelding. Also special joining parts are included, elbows, flanged connection pieces(including the joints of the existing pipes), reductions, connection parts, other fittings.The welders must be authorised by ISCIR.

The procurement on site and the installation of the necessary devices for theinstallation of the necessary measuring gauges (pipe penetration, pressure collar

hold, gate valve, etc.) according to different diameters and material types. Pressure tests according to the norms in force.

The pipe disinfection and the obtaining of the agreement from the competentinstitutions.

The execution and the compaction of the filling according to the specifications,including transport, loading, unloading. The following are included: manual ormechanical return of the local filling material on site and completion where necessarywith borrowed material, layers watering for compaction purposes, manual ormechanical compaction.

The necessary dewatering for the execution of the works;




Metering devices for the drinking water consumption for the new branch connections(procurement, installation, tests).

The works will be paid for each branch connection installed and tested, including the

execution of the earth works and reinstatement of the roads and only after approval by theSupervision Consultant.

No payment will be accepted for interim stages.

6 REINFORCED CONCRETE VALVE CHAMBER


Displacement of the top road layer; including the setting out of the works, eventuallythe arrangements for one way traffic for equipment, installation and preservation of

the benchmarks and other topographic devices, necessary measures for thepedestrian traffic for the residents, transport of the material, signalisation, railings,culverts, etc. according to the requirements of the Norms in force;

Displacement of the sidewalks and related curb stones, displacement of the stonepavements covered or uncovered with asphalt, monolith concrete tiles pavementscovered or uncovered with asphalt;

Mechanical digging;





Concrete, reinforcement and framework for reinforced concrete valve chamber withthe dimensions according to the drawings;

Cast iron cover and frame, according to the specifications;

Valves, flanges and all the necessary accessories;

Pressure tests according to the norms in force;




Other works which are not specified above but are considered necessary by thetenderer for the execution of the works;

The payment of the works will be done for each executed valve chamber, including theinstallations, as well as after the reinstatement of the roads and only after the approval of theworks by the Supervision Consultant.

No payments will be made for interim stages.

7 UNDERGROUND HYDRANTS 80 MM





Mechanical digging;

Purchase of hydrant, including elbow, box, according to the specification, transportand installation;


The execution and the compaction of the filling according to the specifications,including transport, loading, unloading. The following are included: manual ormechanical return of the local filling material on site and completion where necessarywith borrowed material, layers watering for compaction purposes, manual ormechanical compaction.





The hydrants will be installed according to the attached drawings as well as inaccordance with the agreement of the competent institutions obtained by the

Contracting Authority. The hydrants will be paid for together with the water pipe sector on which they are

installed.

No separate payments will be accepted for hydrants.

Works for ensuring the existing utilities services for the residents during the executionof the works;


Pipes Acquisition, Transport and installation. the price includes the procurement onsite, pipe positioning irrespective of the depth, straight pipe joints. Also special joiningparts are included, elbows, flanged connection pieces (including the joints of theexisting pipes), reductions, connection parts, other fittings.


The execution and the compaction of the filling according to the specifications,including transport, loading, unloading. The following are included: manual ormechanical return of the local filling material on site and completion where necessary

with borrowed material, layers watering for compaction purposes, manual ormechanical compaction.





Inspection of the sewerage network with the CCTV after the completion of the works,including all the activities and elaboration of the related documentation.


The works will be paid per meter of sewerage pipe procured, installed, tested and inspected,including the completion of the earthworks and reinstatement of the roads and only afterbeing approved by the Supervision Consultant.

No payments will be accepted for interim stages

8 MECHANICAL WORKS

Mechanical Works, cover all the necessary mechanical works for the execution of theworks from the list in compliance with the Particular and General TechnicalSpecifications, of the execution details and the Contractors approved site adaptingdetails and also according to the Supervision Consultants requirements.

The price includes but is not limited to:

- Purchase and installation of all the fixing devices and the necessary fittings.

- Procurement, assembling and installation of the necessary mechanicalequipment;

- Design of the equipment installation;

- Factory testing delivery;

- Transport to the installation location, including all the insurance;

- Installation;

- Testing at any stage;

- Commissioning;

- Any remediation during the DNP;

- All the labour, skilled and unskilled;

- Any other activities necessary for the execution of the works.

The Mechanical Works will be paid as following:

Up to 90% of the scheduled price will be paid upon the completion of the

works,

10% of the scheduled price will be paid after the completion of the plant andthe issuing of the Taking Over Certificate at Completion.

The Works Statements for the interim payments will reflect the percentage of theworks actually done on site. The procedure described at point 1.4 will be observed.


9 ELECTRICAL WORKS

Electrical works, covers all the necessary mechanical (???????????)/ electrical worksfor the execution of the works in the List in compliance with the Particular and GeneralTechnical Specifications, of the execution details and the Contractors approved siteadapting details and also according to the Supervision Consultants requirements..


- Purchase and installation of all the fixing devices and the necessary fittings.

- Procurement, assembling and installation of the necessary equipment;

- Obtaining the agreement of the electrical power supplier;

- Connection to the electricity suppliers network;

- Transformer;

- All the taxes and amounts due to the authorities;

- The design of the equipment and all the approvals requested by the authorities;

- Factory testing- Delivery;

- Transport to the installation location including all the insurances;

- Installation;


- Commissioning of the entire operational system of earthing;


- All the labour, skilled and unskilled;

- Any other activities necessary for the execution of the works, for the constructionof the system and commissioning in accordance with the standards, codes andlaws in force in Romania.

The Electrical Woks will be paid as following:

Up to 90% of the scheduled price will be paid upon the completion of theworks,

10 AUTOMATION AND SCADA WORKS

The Automation and SCADA works, covers all the necessary works for the respectiveobject in the List in compliance with the Particular and General TechnicalSpecifications, of the execution details and the Contractors approved site adaptingdetails and also according to the Supervision Consultants requirements.


- The complete design of the SCADA system in order to reach the necessarycontrol level, including the data transmission to the local dispatch office in the

WWTP.- The purchase of the necessary hardware and software components;

- Installation and connection of the entire system, including the purchase of cables,fixing devices, auxiliaries and other materials.

- Design of the equipment;

- Factory testing- delivery;

- Transport to the installation site including all the insurances,

- Software design;

- Installation;


- Commissioning;


- All the labour, skilled and unskilled

- Any other activities necessary for the execution of the works.

The Automation and SCADA works will be paid as following:

Up to 90% of the scheduled price will be paid upon the completion of theworks,




EARTHWORKS

The Earthworks referred to in this preambleor in this List of Quantities will cover but will

not be limited to:

Supply and positioning of the concrete pavement and of the framework, finishing ofthe surfaces;

Prefab pavement platforms;

Curb stones;

All types of joints necessary for concrete works; extension joints between the existing

roads and the new ones will also include the removal of the existing curb stones; thewaste disposal and the preparation of the surface articulations of the existing loads,including the visible cuts etc.

Mesh type reinforcement.

All these works will be executed in compliance with the approved Execution Designand/or with the Supervision Consultant requirements.

The roads works will be included in the price for pipe positioning for water supply andsewerage networks and/or the works for valve chambers or inspection chambers, dependingon the case.
