Paragraph (5) of section 4108 of the Elementary and 9

Secondary Education Act of 1965 (20 U.S.C. 7118) is 10

amended—11

(1) in subparagraph (H), by striking ‘‘or’’ at 12

the end; 13

(2) in subparagraph (I), by striking the period 14

at the end and inserting ‘‘; or’’; and 15

(3) by adding at the end the following new sub-16

paragraph: 17

‘‘(J) educating children on the signs and 18

dangers of severe forms of trafficking in per-19

sons (as such term is defined in section 103(9) 20

of the Trafficking Victims Protection Act of 21

2000 (22 U.S.C. 7102(9))).’’. 22

SEC. 102. PREVENTING FUTURE TRAFFICKING IN THE 1

UNITED STATES THROUGH RECEIPT OF COM-2

PLAINTS ABROAD. 3

(a) IN GENERAL.—The Secretary of State shall en-4

sure that each diplomatic or consular post or other mission 5

designates an employee to be responsible for receiving in-6

formation from any person who was a victim of a severe 7

form of trafficking in persons (as such term is defined 8

in section 103(14) of the Trafficking Victims Protection 9

Act of 2000 (22 U.S.C. 7102(14))) while present in the 10

United States, or any person who has information regard-11

ing such a victim. 12

(b) PROVISION OF INFORMATION.—Any information 13

received pursuant to subsection (a) shall be transmitted 14

to the Department of Justice, the Department of Labor, 15

the Department of Homeland Security, and to any other 16

relevant Federal agency for appropriate response. The At-17

torney General, the Secretary of Labor, and the head of 18

any other such relevant Federal agency shall establish a 19

process to address any actions to be taken in response to 20

such information. 21

(c) ASSISTANCE FROM FOREIGN GOVERNMENTS.—22

The employee designated for receiving information pursu-23

ant to subsection (a) should coordinate with foreign gov-24

ernments or civil society organizations in the countries of 25

origin of victims of severe forms of trafficking in persons, 26

with the permission of and without compromising the safe-1

ty of such victims, to ensure that such victims receive any 2

additional support available. 3

SEC. 103. HUMAN TRAFFICKING VICTIMS REINTEGRATION 4

THROUGH EMPLOYMENT PROGRAM. 5

(a) ESTABLISHMENT.—For the purpose described in 6

subsection (b), the Secretary of Health and Human Serv-7

ices may carry out a Human Trafficking Victims Re-8

integration Through Employment Program. 9

(b) PURPOSE.—The purpose of the Program shall be 10

to prevent the re-exploitation of eligible individuals who 11

have been removed from trafficking situations, by assist-12

ing such individuals to integrate or reintegrate into society 13

through the attainment of employment skills necessary to 14

achieve self-sufficiency. 15

(c) SERVICES PROVIDED.—16

(1) IN GENERAL.—Services provided and fund-17

ed by the Program shall include—18

(A) enrollment and participation in—19

(i) basic education, including literacy 20

education and English as a second lan-21

guage education; 22

(ii) job-related skills training; 23

(iii) vocational and certificate pro-24

grams; and 25

(iv) programs for attaining a regular 1

high school diploma or its recognized 2

equivalent; 3

(B) life-skill training programs, including 4

management of personal finances, self-care, and 5

parenting classes; 6

(C) resume creation and review; 7

(D) interview coaching and counseling; 8

(E) assistance with expungement of crimi-9

nal records when such records are for non-10

violent crimes that were committed as a con-11

sequence of the eligible individual’s victimiza-12

tion; 13

(F) assistance with enrollment in college or 14

technical school; and 15

(G) other programs and services that help 16

eligible individuals to achieve self-sufficiency. 17

(2) SERVICE PERIOD.—Eligible individuals may 18

receive services through the Program for a period of 19

not more than three years. 20

(d) COOPERATIVE AGREEMENTS.—Subject to the 21

availability of appropriations, the Secretary of Health and 22

Human Services shall enter into cooperative agreements 23

with one or more eligible organizations to carry out this 24

section. 25

(e) DEFINITIONS.—In this section: 1

(1) The term ‘‘eligible individual’’ means a do-2

mestic or foreign victim of human trafficking who is 3

eligible to receive services under section 107 of the 4

Trafficking Victims Protection Act of 2000 (22 5

U.S.C. 7105), as amended by section 115 of this 6

Act. 7

(2) The ‘‘eligible organization’’ means a service 8

provider meeting the following: 9

(A) With respect to a service provider for 10

trafficking victims served by the Program who 11

are not United States citizens, the provider 12

has—13

(i) expertise in serving foreign-born 14

victims of human trafficking; 15

(ii) a national presence with local 16

reach and strong local connections; and 17

(iii) experience in utilizing national 18

networks to serve victims and collecting 19

data from local programs. 20

(B) With respect to a service provider for 21

trafficking victims served by the Program who 22

are United States citizens, the provider has ex-23

perience working with trafficking victims who 24

are United States citizens, including those who 25

have been identified as the victims of commer-1

cial sexual exploitation as children. 2

(3) The term ‘‘Program’’ means the Human 3

Trafficking Victims Stabilization and Reintegration 4

Through Employment Program under this section. 5

(4) The term ‘‘Secretary’’ means the Secretary 6

of Health and Human Services. 7

(f) ALLOCATION OF FUNDS.—In allocating amounts 8

made available for cooperative agreements under this sec-9

tion between victims of human trafficking who are United 10

States citizens and those who are not, the Secretary shall 11

take into account the eligibility of victims for other Fed-12

eral, State, and local services and funding. 13

(g) AUTHORIZATION OF APPROPRIATIONS.—Section 14

113(b) of the Trafficking Victims Protection Act of 2000 15

(22 U.S.C. 7110(b)) is amended by striking ‘‘To carry out 16

the purposes of section 107(b)’’ and inserting ‘‘To carry 17

out the purposes of section 107(b) of this Act and section 18

114 of the Frederick Douglass Trafficking Victims Pre-19

vention and Protection Reauthorization Act of 2017’’. 20

SEC. 104. MODIFICATION TO GRANTS FOR VICTIMS SERV-21

ICES. 22

Section 107(b)(2)(A) of the Trafficking Victims Pro-23

tection Act of 2000 (22 U.S.C. 7105(b)(2)(A)) is amended 24

by striking ‘‘programs for’’ and all that follows and insert-25

ing the following: ‘‘programs for victims of human traf-1

ficking, including programs that provide trauma-informed 2

care or long-term housing options to such victims who 3

are—4

‘‘(i) between the ages of 12 and 24 5

and who are homeless, in foster care, or in-6

volved in the criminal justice system; 7

‘‘(ii) transitioning out of the foster 8

care system; or 9

‘‘(iii) women or girls in underserved 10

populations.’’. 11

Subtitle B—Governmental Efforts 12

to Prevent Human Trafficking 13

SEC. 111. REQUIRED TRAINING TO PREVENT HUMAN TRAF-14

FICKING FOR CERTAIN CONTRACTING AIR 15

CARRIERS. 16

(a) IN GENERAL.—Section 40118 of title 49, United 17

States Code, is amended by adding at the end the fol-18

lowing: 19

‘‘(g) TRAINING REQUIREMENTS.—The Administrator 20

of General Services shall ensure that any contract entered 21

into for provision of air transportation under this section 22

requires that the contracting air carrier provides to the 23

Administrator of General Services, the Secretary of Trans-24

portation, the Administrator of the Transportation Secu-25

rity Administration, and the Commissioner of U.S. Cus-1

toms and Border Protection an annual report regarding—2

‘‘(1) the number of personnel trained in the de-3

tection and reporting of potential human trafficking 4

(as described in paragraphs (9) and (10) of section 5

103 of the Trafficking Victims Protection Act of 6

2000 (22 U.S.C. 7102)), including the training re-7

quired under section 44734(a)(4); 8

‘‘(2) the number of notifications of potential 9

human trafficking victims received from staff or 10

other passengers; and 11

‘‘(3) whether the air carrier notified the Na-12

tional Human Trafficking Hotline operated by the 13

National Human Trafficking Resource Center or law 14

enforcement at the relevant airport of the potential 15

human trafficking victim for each such notification 16

of potential human trafficking, and if so, when the 17

notification was made.’’. 18

(b) TRAINING OF FLIGHT ATTENDANTS AND PI-19

LOTS.—Section 44734 of title 49, United States Code, is 20

amended—21

(1) in the heading by inserting ‘‘and pilots’’ 22

after ‘‘flight attendants’’; 23

(2) in subsection (a)—24

(c) CONFORMING AMENDMENT.—The table of sec-7

tions for chapter 447 of title 49, United States Code, is 8

amended by striking the item related to section 44734 and 9

inserting the following:10

‘‘44734. Training of flight attendants and pilots.’’.

(d) APPLICABILITY.—The amendment made by sub-11

section (a) shall apply to any contract entered into after 12

the date of enactment of this Act. 13

SEC. 112. PRIORITY FOR USE OF FUNDS FOR LODGING EX-14

PENSES AT ACCOMMODATIONS LACKING 15

CERTAIN POLICIES RELATING TO CHILD SEX-16

UAL EXPLOITATION. 17

(a) IN GENERAL.—Subchapter I of chapter 57 of title 18

5, United States Code, is further amended by adding at 19

the end the following: 20

‘‘§ 5713. Priority for use of funds for lodging expenses 21

at accommodations lacking certain poli-22

cies relating to child sexual exploitation. 23

‘‘(a) IN GENERAL.—For the purpose of making pay-24

ments under this chapter for lodging expenses each agency 25

shall ensure that, to the extent practicable, any commer-1

cial-lodging room nights for employees of that agency are 2

booked in a preferred place of accommodation. 3

‘‘(b) PREFERRED PLACE OF ACCOMMODATION DE-4

FINED.—In this section, ‘preferred place of accommoda-5

tion’ means a commercial place of accommodation that—6

‘‘(1) has a zero-tolerance policy in place regard-7

ing the sexual exploitation of children (as described 8

port any such exploitation to the appropriate au-13

‘‘(3) makes training materials available to all 15

employees to prevent such exploitation; 16

‘‘(4) has trained all employees annually on the 17

identification of possible cases of such exploitation 18

and procedures to report suspected abuse to the ap-19

propriate authorities; 20

‘‘(5) protects employees who report suspected 21

cases of such exploitation according to the protocol 22

identified in training; and 23

‘‘(6) keeps records of the number of suspected 24

cases of such exploitation, including the reasons for 25

‘‘(c) REGULATIONS REQUIRED.—The Administrator 3

‘‘(2) issue such regulations as are necessary to 7

carry out this section.’’. 8

(b) CONFORMING AMENDMENT.—The table of sec-9

tions for subchapter I of chapter 57 of title 5, United 10

States Code, is further amended by adding at the end the 11

following new item:12

‘‘5713. Priority for use of funds for lodging expenses at accommodations lacking

certain policies relating to child sexual exploitation.’’.

SEC. 113. ENSURING UNITED STATES PROCUREMENT DOES 13

NOT FUND HUMAN TRAFFICKING. 14

Section 106 of the Trafficking Victims Protection Act 15

of 2000 (22 U.S.C. 7104) is amended by adding at the 16

end the following new subsection: 17

‘‘(k) AGENCY ACTION TO PREVENT FUNDING OF 18

HUMAN TRAFFICKING.—19

‘‘(1) IN GENERAL.—The Secretary of State, 20

Secretary of Defense, Secretary of Labor, Adminis-21

erating Group established under section 105(g) of the 16

Trafficking Victims Protection Act of 2000 (22 U.S.C. 17

7103(g)) should create a working group to examine the 18

role of demand reduction, both domestically and inter-19

nationally, in achieving the purposes of the Justice for 20

Victims of Trafficking Act (Public Law 114–22; 129 Stat. 21

227) and Trafficking Victims Protection Act of 2000 (22 22

U.S.C. 7101 et seq.). 23

tory damages and restitution imposed in a criminal mat-17

ter) awarded in an action under section 1595 of title 18, 18

the United States to modern-day slavery; 2

(2) the Deputy Undersecretary of the Bureau 3

of International Labor Affairs of the Department of 4

Labor and the grant programs administered by the 5

Deputy Undersecretary play a critical role in pre-6

venting and protecting children from the worst 7

forms of child labor, including situations of traf-8

ficking, and in reducing the vulnerabilities of men 9

and women to situations of forced labor and traf-10

ficking; and 11

(3) the Secretary of Labor also plays a critical 12

role in helping other Federal departments and agen-13

cies to prevent goods made with forced and child 14

labor from entering the United States by consulting 15

with such departments and agencies to reduce forced 16

and child labor internationally and ensuring that 17

products made by forced labor and child labor in vio-18

lation of international standards are not imported 19

into the United States. 20

(a) IN GENERAL.—Not later than two years after the 23

date of the enactment of this Act, the Comptroller General 24

of the United States shall submit to the committees listed 25

lenges to enforcing section 307 of the Tariff Act of 1930 2

(b) COMMITTEES.—The committees listed in this sub-4

section are—5

(1) the Committee on Foreign Affairs, the 6

Committee on Financial Services, the Committee on 7

Energy and Commerce, the Committee on the Judi-8

ciary, and the Committee on Ways and Means of the 9

House of Representatives; and 10

(2) the Committee on Foreign Relations, the 11

Committee on Health, Education, Labor, and Pen-12

sions, the Committee on Commerce, Science, and 13

Transportation, the Committee on the Judiciary, 14

and the Committee on Finance of the Senate. 15

(c) REQUIREMENTS.—The report required under sub-16

section (a) shall—17

(1) describe the role and best practices of pri-18

vate-sector employers in the United States in com-19

plying with the provisions of section 307 of the Tar-20

iff Act of 1930; 21

(2) describe any efforts or programs under-22

taken by relevant Federal, State, or local govern-23

ment agencies to encourage employers, directly or 24

indirectly, to comply with such provisions; 25

(3) describe the roles of the relevant Federal 1

departments and agencies in overseeing and regu-2

lating such provisions, and the oversight and en-3

forcement mechanisms used by such departments or 4

agencies; 5

(4) provide concrete, actual case studies or ex-6

amples of how such provisions are enforced; 7

(5) identify the number of petitions received 8

and cases initiated (whether by petition or other-9

wise) or investigated by each relevant Federal de-10

partment or agency charged with implementing and 11

enforcing such provisions, as well as the dates peti-12

tions were received or investigations were initiated, 13

and their current statuses; 14

(6) identify any enforcement actions, including, 15

but not limited to, the issuance of Withhold Release 16

Orders, the detention of shipments, the issuance of 17

civil penalties, and the formal charging with criminal 18

charges relating to the forced labor scheme, taken as 19

a result of these petitions and investigations by type 20

of action, date of action, commodity, and country of 21

origin in the past 10 years; 22

(7) with respect to any relevant petition filed 23

during the 10-year period prior to the date of the 24

enactment of this Act with the relevant Federal de-25

partments and agencies tasked with implementing 1

such provisions, list the specific products, country of 2

origin, manufacturer, importer, end-user or retailer, 3

and outcomes of any investigation; 4

(8) identify any gaps that may exist in enforce-5

ment of such provisions; 6

(9) describe the engagement of the relevant 7

Federal departments and agencies with stakeholders, 8

including the engagement of importers, forced labor 9

experts, and nongovernmental organizations; and 10

(10) based on the information required by para-11

graphs (1) through (9), identify any regulatory ob-12

stacles or challenges to enforcement of such provi-13

sions and provide recommendations for actions that 14

could be taken by the relevant Federal departments 15

and agencies to overcome these obstacles. 16

SEC. 133. MODIFICATION TO LIST OF CHILD-MADE AND 17

SLAVERY-MADE GOODS. 18

(a) IN GENERAL.—Section 105(b)(2)(C) of the Traf-19

ficking Victims Protection Reauthorization Act of 2005 20

(22 U.S.C. 7112(b)(2)(C)) is amended by inserting ‘‘, in-21

cluding, to the extent practicable, goods that are produced 22

with inputs that are produced with forced labor or child 23

labor’’ after ‘‘international standards’’. 24

(a) REPORT ON NEW PRACTICES TO COMBAT TRAF-17

after the date of the enactment of this Act, and an-20

nually thereafter for seven years, the Secretary of 21

State, in consultation with the Administrator of the 22

United States Agency for International Develop-23

ment, shall submit to the Committee on Foreign Af-24

fairs of the House of Representatives and the Com-25

(B) if no such practices have been adopted, 10

including a strategy to reduce the risk of traf-11

(2) PUBLIC AVAILABILITY.—Each report sub-13

mitted under paragraph (1) shall be posted on a 14

publicly available Internet website of the Depart-15

ment of State. 16

(b) CHILD PROTECTION STRATEGIES IN WATCH 17

LIST COUNTRIES.—The Administrator of the United 18

States Agency for International Development shall incor-19

porate into the relevant country development cooperation 20

strategy for each country on the special watch list de-21

scribed in section 110(b)(2)(A) or the list described in sec-22

tion 110(b)(1)(C) of the Trafficking Victims Protection 23

Act of 2000 (22 U.S.C. 7107(b)(2)(A) and (b)(1)(C)), as 24

amended by section 213 of this Act, strategies for the pro-25

SEC. 206. BRIEFING ON COUNTRIES WITH PRIMARILY MI-1

GRANT WORKFORCES. 2

Not later than 30 days after the date of the enact-3

ment of this Act, the Secretary of State shall provide to 4

the Committee on Foreign Affairs and the Committee on 5

the Judiciary of the House and the Committee on Foreign 6

Relations and the Committee on the Judiciary of the Sen-7

ate a briefing that includes, with respect to each country 8

that has a domestic workforce of which more than 80 per-9

cent are third-country nationals, each of the following: 10

(1) An assessment of the progress made by the 11

government of such country toward implementing 12

the recommendations with respect to such country 13

contained in the most recent ‘‘Trafficking in Persons 14

Report’’ submitted by the Secretary under section 15

110(b) of the Trafficking Victims Protection Act of 16

2000 (22 U.S.C. 7107(b)), as amended by section 17

203 of this Act. 18

(2) A description of the efforts made by the 19

United States to ensure that any domestic worker 20

brought into the United States by an official of such 21

country is not a victim of trafficking. 22

SEC. 207. REPORT ON RECIPIENTS OF FUNDING FROM THE 1

UNITED STATES AGENCY FOR INTER-2

NATIONAL DEVELOPMENT. 3

Not later than 90 days after the date of the enact-4

ment of this Act, and by October 1 of each of the following 5

four years, the Administrator of the United States Agency 6

for International Development shall submit to the Com-7

mittee on Foreign Affairs and the Committee on Appro-8

priations of the House and the Committee on Foreign Re-9

lations and the Committee on Appropriations of the Sen-10

ate a report describing, with respect to the prior fiscal 11

year—12

(1) each obligation or expenditure of Federal 13

funds by the Agency for the purpose of combating 14

human trafficking and forced labor; and 15

(2) with respect to each such obligation or ex-16

penditure, the program, project, activity, primary re-17

cipient, and any sub-grantees or sub-contractors. 18

Subtitle B—Child Soldier 19

Prevention Act of 201720

SEC. 211. FINDINGS. 21

Congress finds the following: 22

(1) The recruitment or use of children in armed 23

conflict is unacceptable for any government or gov-24

ernment supported entity receiving United States as-25

sistance. 26

(2) The recruitment or use of children in armed 1

conflict, including direct combat, support roles, and 2

sexual slavery, occurred during 2015–2016 in Af-3

ghanistan, South Sudan, Sudan, Burma, the Demo-4

cratic Republic of Congo, Iraq, Nigeria, Rwanda, So-5

malia, Syria, and Yemen. 6

(3) Entities of the Government of Afghanistan, 7

particularly the Afghan Local Police and Afghan 8

National Police, continue to recruit children to serve 9

as combatants or as servants, including as sex 10

slaves. 11

(4) Police forces of the Government of Afghani-12

stan participate in counter-terrorism operations, di-13

rect and indirect combat, security operations, fight 14

alongside regular armies, and are targeted for vio-15

lence by the Taliban as well as by other opposition 16

groups. 17

(5) In February 2016, a 10-year-old boy was 18

assassinated by the Taliban after he had been pub-19

lically honored by Afghan local police forces for his 20

assistance in combat operations against the Taliban. 21

(6) Recruitment and use of children in armed 22

conflict by government forces has continued in 2016 23

in South Sudan with the return to hostilities. 24

(7) At least 650 children have been recruited 1

and used in armed conflict in South Sudan in 2016, 2

and at least 16,000 have been recruited since that 3

country’s civil war began in 2013. 4

SEC. 212. AMENDMENTS TO THE CHILD SOLDIERS PREVEN-5

TION ACT OF 2008. 6

(a) DEFINITIONS.—Section 402(2)(A) of the Child 7

Soldiers Prevention Act of 2008 (22 U.S.C. 2370c(2)(A)) 8

is amended by inserting ‘‘, police, or other security forces’’ 9

after ‘‘governmental armed forces’’ each place it appears. 10

(b) PROHIBITION.—Section 404 of the Child Soldiers 11

Prevention Act of 2008 (22 U.S.C. 2370c–1) is amend-12

ed—13

(1) in subsection (a)—14

(A) by inserting ‘‘, police, or other security 15

forces’’ after ‘‘governmental armed forces’’; and 16

(B) by striking ‘‘recruit and use child sol-17

diers’’ and inserting ‘‘recruit or use child sol-18

diers’’; 19

(2) in subsection (b)(2), to read as follows: 20

‘‘(2) NOTIFICATION.—21

‘‘(A) IN GENERAL.—Not later than 45 22

days after the date of submission of each report 23

required under section 110(b) of the Traf-24

ficking Victims Protection Act of 2000, the Sec-25

retary of State shall formally notify each gov-1

ernment included in the list required under 2

paragraph (1) that such government is so in-3

cluded. 4

‘‘(B) CONGRESSIONAL NOTIFICATION.—As 5

soon as practicable after making all of the noti-6

fications required under subparagraph (A) with 7

respect to a report, the Secretary of State shall 8

notify the appropriate congressional committees 9

that the requirements of subparagraph (A) have 10

been met.’’; 11

(3) in subsection (c)(1), by adding at the end 12

before the period the following: ‘‘and certifies to the 13

appropriate congressional committees that the gov-14

ernment of such country is taking effective and con-15

tinuing steps to address the problem of child sol-16

diers’’; and 17

(4) in subsection (e)(1), by striking ‘‘to a coun-18

try’’ and all that follows through ‘‘subsection (a)’’ 19

(c) REPORTS.—Section 405 of the Child Soldiers Pre-3

vention Act of 2008 (22 U.S.C. 2370c–2) is amended—4

(1) in subsection (c)—5

(A) in the matter preceding paragraph (1), 6

by striking ‘‘, during any of the 5 years fol-7

lowing the date of the enactment of this Act,’’; 8

(B) by redesignating paragraphs (2) 9

through (4) as paragraphs (3) through (5), re-10

spectively; 11

(C) by inserting after paragraph (1) the 12

following: 13

‘‘(2) a description and the amount of any as-14

sistance withheld under this title pursuant to the ap-15

plication to those countries of the prohibition in sec-16

tion 404(a);’’; and 17

(D) in paragraph (5) (as so redesignated), 18

by inserting ‘‘and the amount’’ after ‘‘a descrip-19

Advanced Notification of Traveling Sex Offenders (42 15

U.S.C. 16935h) is amended by striking ‘‘and 2018’’ and 16

SEC. 305. AUTHORIZATION OF APPROPRIATIONS FOR AIR-18

PORT PERSONNEL TRAINING TO IDENTIFY 19

AND REPORT HUMAN TRAFFICKING VICTIMS. 20

There is authorized to be appropriated to the Com-21

missioner of U.S. Customs and Border Protection 22

$250,000 for each of fiscal years 2017 through 2021 to 23

expand outreach and live on-site anti-trafficking training 24

for airport and airline personnel. 25
