During t h e next approximately f o r t y - f i v e minutes Mr. A l l e n engaged mein a conversation regarding h i s p a r t i c i p a t i o n i n t h e cont rac t k i l l i n g o fCarl Gibson. N o one e l s e was present . W e were both seated. W e sharedcigarettes I had brought w i t h me i n t o the room. L i q u i d refreshment was o f f e r e dand denied. T h e conversation took t h e form o f a n a r r a t i v e f o r t h e most p a r t ,with me asking questions when I thought i t was appropr ia te . T h e defendantspoke l u c i d l y and c l e a r l y, and d i d no t appear t o be under t h e in f luence o fany contro l led substance- o r i n t o x i c a n t .
In summary, b u t n o t verbat im, James A l l e n t o l d me t h a t on June 2 1 , 1 9 8 4 ,in t h e e a r l y morning hours, h e was d r i v i n g Henry G r i f f i n ' s c a r northboundon the Chicago Skyway. C a r l Gibson was i n the f r o n passengers s e a t . H e n r yG r i f f i n was i n t h e r e a r passengers s e a t . H e s ra ted t h a t a s he was approachingthe 73rd S t . e x i t ramp he heard t h r e e o r f o u r shots r i n g o f f i n t h e c a r andnoticed C a r l Gibson f a l l over toward t h e f r o n t passenger sea t door immeadiatelythereaf ter. A l l e n s a i d he p u l l e d onto t h e 73rd S t . e x i t ramp and stopped i nthe middle o f t h e ramp. H e then e x i t e d t h e c a r , a s d i d Henry G r i f f i n , who washolding a gun. H e n r y G r i f f i n po in ted t h e gun a t him and t o l d him t o ge tback i n t o the c a r o r he would blow A l l e n ' s head o f f . When I asked t h e defendant how he came t o be d r i v i n g t h e c a r which wasthe scene o f a murder he t o l d me t h e fo l lowing:
On Sunday, June 1 7 , 1984 , h e was approached ny Henry G r i f f i n who o f f e r e dto s p l i t f i v e thousand d o l l a r s w i t h him i f A l l e n would l u r e a man ou t o fa bui ld ing and i n t o a c a r so G r i f f i n cou ld k i l l .him. A l l e n refused.
On Wednesday, June 2 0 , 1 9 8 4 , i n t h e l a t e afternoon o r e a r l y eveninghours, A l l e n was i n Henry G r i f f i n ' s apartment on t h e 5900 block o f SouthMichigan i n Chicago when Charles Ashley a r r i v e d . A l l e n s a i d he had knownAshley e v e r s ince he ( A l l e n ) had been a boy. D u r i n g the ensuing conversat ionAshley t o l d G r i f f i n t h a t he wanted G r i f f i n t o k i l l two men: A s h l e y ' swho had r e c e n t l y t r i e d t o have Ashley run over w i t h a. car; and a "sn i tch" .Ashley t o l d G r i f f i n t h a t one o f these men had t o be k i l l e d " r i g h t Away'and t h a t t h e h i t c o u l d n ' t w a i t u n t i l tomorrow. At approx iamate ly 7 : 4 0 P.M. o n August 9 , 1984 , I was present a tthe approximate l o c a t i o n o f 5400 S . Lake Park i n Chicago when t h e a r r e s twarrant f o r t h e murder o f Car l Gibson was executed upon t h e person o fCharles Ashley. M r . Ashley was observed t o be d r i v i n g southbound o nLake Park when h i s c a r was pu l led over by members o f t h e lNarcotics U n i tof t h e Organized Crime D iv is ion o f the Chicago Po l ice Department. I waspresent a t t h a t t i m e r i d i n g i n the c a r being used b y t h e aforementionedpolice o f f i c e r s .
Upon having h i s c a r stopped, M r. Ashley was escorted from h i s c a r t othe-Chiago P o l i c e v e h i c l e and. asked t o ge t i n s i d e . M r . Ashley entered t h erear s e a t . A t t h i s t ime I was behind t h e wheel o f t h e c a r . U p o n g e t t i n g i nthe c a r , M r. Ash ley greeted me by name and asked me why he was being a r res ted .Pr ior t o answering him I t o l d Mr. Ashley t h a t I had t o advise him o f h i sconst i tut ional r i g h t s . I d i d so. M r . Ashley s ta ted he understood h i s r i g h t Fand would t a l k t o me b u t reasserted t h a t he d i d not know why.he was beingarrested. I t o l d him he was being arrested f o r murder. H e asked me whathe had k i l l e d . I t o l d him i t wasn' t what he had k i l l e d but who, and advisedhim t h a t he was be ing charged w i th t h e contract murder o f Car l Gibson.Mr. Ashley s ta ted "Car l? Why would I k i l l Car l? H e was l i k e a son t o me."Mr. Ashley went on t o exp la in t h a t a f t e r he had found out t h a t Gibson hadbeen k i l l e d , h e had, o n h i s own, t r i e d t o f i n d o u t who had done i t . H e t o l dme t h a t h e be l ieved t h a t Sherman Overstreet had t o l d him (Ashley) t h a tSherman had seen Gibson enter ing a b lack van o r t r u c k o n t h e n igh t Gibsonwas k i l l e d when t h a t van o r t r u c k had been parked i n an a l l e y betweenCottage Grove and Maryland and between 63rd S t . and 64th S t . I askedMr. Ashley i f he knew anything e lse about t h e murder o f Car l Gibson. H esaid he d i d n ' t . H e then asked me i f I could c a l l h i s a t t o r n e y, Sam Adam,for him . W h e n we reached Area One a t approximately 8 : 0 0 P. M . , I askedMr. Ashley t o have a sea t i n an i n t e r v i e w room. He d i d . T h e door t o theroom was not c losed nor was he handcuffed. I then c a l l e d the o f f i c e o f SamAdam. M r . Adam was n o t i n h i s o f f i c e b u t I d i d l e a v e a message w i t h Georgiaregarding Mr. A s h l e y ' s s ta tus . I t o l d Mr. Ashley t h a t Mr. Adam was notavai lable . I was then asked t o c a l l Mr. L a r r y Levin on h i s b e h a l f . Idid t h i s , reaching Mr. L e v i n a t h i s home a t approximatley 8 :20 P.M. M r .Levin ins t ructed me t o have no f u r t h e r conversations w i t h h i s c l i e n t r e t a r d i n gthe charged of fense and asked me t o so i n s t r u c t t h e p o l i c e . I d i d as herequested and i n f r omed M r. A s h l e y o f h i s a t to rney 's advice as w e l l .
Mr. Lev in a r r i v e d l a t e r t h a t n i g h t a t approximatley 9 . 3 0 P.M. I informedhim o f the f a c t s forming the basis f o r h i s c l i e n t ' s a r r e s t . M r . L e v i nwas then given an opportunity t o speak w i t h h i s c l i e n t . A f t e r w a r d , M r.Ashley was transported t o the SLcond D i s t r i c t lockup f o r processing on t h echarpe o f murder.
