TO: KENNETH WADAS Supervisor '7,rc, t.rs Alt FROM: N E I L COHEN Trial Assistant Narcotics Unit RE: Statements of James Allen, Henry Griffin and Charles Ashley Regarding the Murder By Contract of Carl Gibson. On August 9, 1984, I was present at Area One Violent Crimes Headquarters at approximately 2:30 P.M. in relation to the shooting death of Carl Gibson. Upon arriving at Area One I was brought into an interview room by Det. Cathy Reardon and Det. Michael Pochordo. As I entered this room I observed James Allen . Allen was sitting on a chair and was handcuffed to a wall I asked Det. Pochordo to uncuff him. T h i s was done. I then introduced myself to James Allen by name and explained that I was an assiStant state's attorney. I explained that as an assistant state's attorney my job was to work with the police to determine what, i f any, charges should be placed against him. I explained also that, although I was an attorney, I was not his attorney. The defendant stated Co me that he understood this. I then advised Mr. Allen of his constitutional rights per Miranda. This was done from memory. Specifically, I told this defendant that he had a right to remain silent. I explained that this meant he did not have to talk to me if he did not wish to. He stated that he understood. I told the defendant that he could give uP his right to remain silent if he wanted to, but warned him that anything he said to me or any police officer could and would be used against him in court. The defendant stated that he understood this. I then told the defendant that he had a right to.have an attorney present with him while I spoke with him and that he had a right to consult with his own attorney before he spoke to me. He stated that he understood this as well. I again reminded Mr. Allen that although I was an attorney, I was not his attorney but instead was a member of the Cook County State's Attorney's Office that would be prosecuting him if he decided to go to trial. He stated that he understood this. I advised Mr. Allen that if he could not afford an attorney to represent him that he would be given a court-appointed attorney or a public defender to represent him. I explained that he could consult with his court-appointed attorney or public defender before speaking with me. H e stated that he understood this. I went on to tell the defendant that i f he wished he could speak to me without first consulting with his attorney or without having his attorney present. He stated he understood. I told Mr. Allen that if he decided to speak to me outside the presence of his own attorney or without consulting with his own attorney first he could, at any tire during our conversation, tell me he no longer wanted to speak with me and we would leave the room,
