Downstream pond sized, even at a minimum, for roadway treatment will be smaller, cheaper, and remove more pollutants than the ponds at the roadway. Additionally, business property is not removed from the tax rolls. Try to buy a larger pond, if feasible.

Canals & drainage ditches currently have Class III requirements just like natural waterbodies. Class III Limited reclassification process is onerous and uncertain.
District Maintenance / Legal will have policies on J/U ponds ‐ Often require local government to be surety for maintenance responsibilities.
